The NYS Office of Children and Family Services issued 21-OCFS-LCM-24 advising funds are available to Social Services districts to provide enhanced or expanded core and/or optional non-residential domestic violence services provided by OCFS-approved non-residential DV programs. Locally, we will contract with Salvation Army for this service. This request is for the five-year term of October 1, 2021 to September 30, 2026. Per 21-OCFS-LCM-30, grant funds are available due to the federal Child Abuse or Neglect Prevention and Treatment Act (CAPTA) Comprehensive Addiction and Recovery Act of 2016 (CARA). CAPTA/CARA funding is intended to help states improve their response to families and infants affected by substance use disorders. Locally, funding for districts will be used to hire a behavioral health consultant or public health nurse to assist in the identification of families experiencing substance abuse disorders, and in the development, implementation, and monitoring of plans of safe care with infants and families affected by substance abuse. OCFS will also accept the sharing of a behavioral health consultant or public health nurse among smaller counties within upstate New York State. Various Foster Care expenditures are requested not to exceed $4,100,500 per year, as follows;
• A total of $3,850,500 per year is requested for various Foster Care services. Claiming of Foster Care payments are driven by the eligibility category of the child, and include Title IV-E, Title XX, TANF EAF Foster Care funding, as well as, State Foster Care Block Grants. Various Foster Care Provider agreements are projected to be reimbursement as 33% Federal, 34% State, and 33% Local.
• A total of $250,000 per year is dedicated for expenses related to the Raise the Age initiative. Raise the Age is 100% state funded, with no local share associated. The LDSS will be responsible to provide placement for both 16 and 17-year-old youth, as these youth will no longer be reprimanded to County jail.
Chemung County Foster Care is provided to children according to the State Plan and includes all activities and functions relative to the care of a child away from his or her home 24 hours per day. The child must be in a family foster home, a daily certified or approved foster family boarding home, a duly certified group home, agency boarding home, child care institution, health care facility, or a combination thereof. Please note the term is requested to cover the two-year period of January 1, 2022 to December 31, 2023. The LDSS must ensure any active Foster Care agency or institution has a contract in place and is entered in the Connections software placement module by January 1, 2022. If the contract information is not entered, the foster home or congregate care setting will be excluded from the list of appropriate placements for these youth. Theseagreements make the Pharmacy a participating provider in the various plans that cover most of theresidents in the Nursing Facility. Due to the high volume of these plans, and similarity of rates andprovisions, it is requested that the County Executive be given authorization, subject to County Attorneyreview, to sign plans without need for a new Legislative resolution for each plan or each plan's revisions.The period of authorization would be 1/1/22-12/31/22. Explain action needed or Position requested (justification):Under NYS Municipal Law, a public hospital or nursing home is permitted to participate in GPOs as analternative means of purchasing to formal competitive bidding or state contracts. For over 25 years, theNursing Facility has participated in several regional and national GPOs that specialize in providing goods,equipment, and services to healthcare facilities. Under the terms of membership in such GPOs, facilitiesget the benefit of discounted pricing from vendors who sell to similar facilities. In many cases, the pricingfrom GPOs is lower than state contracts. A further advantage of membership is the fact that an facilitiescan obtain higher discounts based on the total dollar volume of purchases made by all vendors in theGPO and the combined cost of pharmaceuticals, medical supplies, oxygen, and equipment results inincreased discounts for the facility. The Health Center has a large number of third party reimbursement agreements with insurancecompanies, managed care organizations, and other entities for the purpose of establishing rates andterms for the provision of services to recipients by the Health Department and Nursing Facility. Theseplans are subject to rate changes and contract amendments on a periodic and frequent basis, and inorder to expedite execution of agreement amendments, a standard authorizing resolution has beenadopted by the Legislature to authorize the County Executive, subject to County Attorney review, tosign contract changes without the need for the separate Legislative resolution each time. SUBJECT: THIRD PARTY REIMBURSEMENT AGREEMENTS
The purpose of this correspondence is to request Legislature authorization to continue or amend existing third party reimbursement agreements for the Chemung County Nursing Facility and the Chemung County Health Department for calendar year 2022. The Nursing Facility and Health Department have many agreements with third party payers that reimburse for services provided to individuals covered by a particular plan. Due to the nature and longevity of these agreements, it is not practical to enter into a new agreement every five years, but it is necessary to revise the agreements from time to time for changes in reimbursement rates, to modify covered services or add certain amendments or addenda. Most of these agreements do not have a specific term or duration and have been in place for many years. Therefore, we are requesting adoption of a Resolution to continue or amend, as needed, the current third party reimbursement agreements listed below. The Resolution requested would give authorization to the County Executive to sign agreement amendments for changes in rates, scope of services or addenda that may be required for legal or regulatory purposes. The Resolution should be specific to the agreements listed below, and any new agreements in the future will be submitted individually to the Legislature for approval.
