EditorialCEEP is on the eve of celebrating its 50 year anniversary in Brussels. As an organisation which initially came into existence shortly after the signing of the Treaty of Rome establishing the European Economic Community, it has participated in the development and establishment of the European Union. CEEP has evolved in tandem with Europe, reflecting the needs of a changing society, gaining increasing recognition for Public Services who make up and contribute to the fabric of our society as we know it.We will all remember 2009 for different reasons – Obama’s inauguration in the US, world recession, financial crisis, a botched Copenhagen Climate Summit etc.For CEEP, 2009 was significant as it became increasingly clear that the importance of Public Services and their contribution to the European economy on a number of levels, from employment to GDP, particularly in times of economic instability, was still not fully recognised.Public Services, also known as Services of General Interest (SGIs), are services whose provider is entrusted by a public authority (national, regional or local) with specific missions by virtue of general interest. These services can either be of economic or non-economic nature and their missions can include Public Service obligations or universal service obligations. Public Services include energy, water, public transport, postal services, telecommunications as well as healthcare and social work, public administration, defence, education, etc.In response to a question from Nicolaos Vakalis (former MEP) to Commissioner Špidla on the significance of Public Services in Europe, CEEP, with the financial support of the European Commission, embarked on a comprehensive, Europe-wide measurement and analysis of Public Services. The full results of the study will be made available during the course of 2010 and we look forward to using these hard facts to continue our representation of Public Services and Services of General Interest at policy level in Europe.2010 will bring new policy priorities to the fore. Europe’s 2020 vision and strategy, the single market, and the need for crisis counter measures will require huge input if we are to emerge from this crisis without using our Public Services to bear the costs. Our aging population and the creation of so-called Green Jobs are other key areas to focus on. CEEP and its members are ready to rise to the challenge. We have set ourselves ambitious objectives which we feel are strongly needed in light of the year just gone.

CEEP, the European Centre of Employers and Enterprises providing Public Services, established in Brussels since 1961, represents employers and enterprises providing Services of General Interest in such vital sectors as Transport, Energy, Water, Environment, Housing, Hospitals, Education and Training, Postal Services, Communications, Local Administrations etcWe believe that modern Public Services, or Services of General Interest (SGIs), serve the fundamental goals of the EU, its Member States and its regions supporting business, delivering social and territorial cohesion, economic and social solidarity and a better quality of life for all citizens.We strive to ensure that SGIs play a key role in helping move forward the integration of the EU Member States into a common economic area in a manner supportive of the internal market concept, while at the same time delivering the maximum possible choice to local and regional democratic institutions over how Public Services are delivered.As one of the three recognised European general cross-industry Social Partners, we believe that employer consultations as well as social dialogue are essential to promote the Lisbon Treaty’s targets for innovation and growth. In order to help our members achieve these goals, we focus on the European Employment Strategy (EES), promoting adaptability to change, addressing regional disparities and helping build partnerships at regional and local levels.We support sustainable development and call for environmental criteria to be included in all decisions implementing EU policies such as transport, energy, water supply, waste disposal and telecommunications.

Services of General Interest (SGIs) are services that are entrusted by a public authority to a service provider by virtue of general interest criteria. These services can either be of economic or non-economic nature. Their missions can include Public Service obligations or universal service obligations.At European level, Public Services are known as Services of General Invest (SGIs).

CEEP Driving PolicyThe contribution of Services of General Interest is underestimated in Europe, yet it is clear that Public Services are key drivers of the European economy. Directly, they contribute to more than 26% of the EU27 GDP (2006). Indirectly they create employment in other sectors, for instance through investment in local businesses and infrastructures.

The employment dimension of SGIs in the EU is even more impressive with 30% of the workforce being employed by providers of SGIs. This corresponds to more than 64 million employees (2006).

The main infrastructure networks (Electricity, Gas, Post, Telecommunications, Public Transport, Railway, Water management, etc.) invest important sums of money into the economy. Their share in the total investment in Europe is about 6.4%, representing more than 153 billion € for 2006.

All in all, more than 500 000 providers (public, private, with mixed capital, operating at local regional, national or sometimes at European level) deliver essential services for about 500 million Europeans.

Through its General Secretariat in Brussels, CEEP represents the interests of its members to the European institutions.

CEEP Priorities SERVICES OF GENERAL INTEREST (SGIs)

To advocate their special position with regard to competition rules and to emphasise their crucial contributions to the European social and economic model

EUROPEAN SOCIAL DIALOGUETo use social dialogue as a means to modernise Public Services and to help build a European labour market based on more and better jobs; to focus on some crucial aspects of the European Employment Strategy (EES) such as promoting the adaptability to change and address regional disparities; and to promote a stronger development of regional and local level partnerships

SOCIAL, ECONOMIC AND TERRITORIAL COHESIONTo assist the European integration process by offering higher quality Public Services; to emphasise the importance of Services of General Interest (SGIs) in future cohesion policies, as well as priorities for the development of an enlarged Europe; to advocate that those services are supported by adequate social and physical infrastructures

SUSTAINABLE AND ECO-EFFICIENT DEVELOPMENTTo reinforce sustainable development in all decisions implementing EU policies and to support a just transition towards a low carbon economy

2009 – A yearin ReviewNew Faces in the European ParliamentAlong with the Czech and Swedish Presidencies, and the likely ratification of the Lisbon Treaty, at top of mind were the Parliamentary elections, signalling both the re-election of old MEPs, and the arrival of new faces, not yet familiar with CEEP and its resources. CEEP developed a handbook targeted at all MEPs, outlining areas within which it could support policy discussions, particularly in the field of Social Dialogue and Services of General Interest. The concerted communications effort in sending the handbook to all MEPs and subsequently following up with more targeted, sector specific fact sheets, opened numerous doors for CEEP, and kick-started a more proactive approach for the organisation.

Article 14 – Finally, a sound legal basis for the treatment of SGEIs1 in EuropeThe adoption of the Lisbon Treaty on 1 December 2009, and in particular Article 14 has brought significant changes to the treatment of Services of General Interest from a political, legal and institutional point of view. CEEP has been at the forefront of discussions and negotiations relating to Article 14 since the beginning of this lengthy process. We have been passionate about representing our member interests throughout, and this issue has contributed to our raison d’etre, hence our particular sense of achievement at the end of the year.Article 14, together with other provisions in the Treaty concerning SGEIs (Protocol No 26, Charter of Fundamental Rights), form a stronghold basis to provide legal certainty for Services of General Interest, their objectives and their varied forms of organisation.Before the Lisbon Treaty, the Parliament and the Council had no competence to act on SGEI. It was solely in the competence of the European Commission to issue guidance and explanation of the Treaty provisions concerning the functioning and development of the

internal market and competition rules in all areas. It was left to the European Court of Justice to develop a response to every question concerning SGEI based on quite vague legal provisions on a case by case basis creating uncertainty in the process.In practical terms, the adoption of the Treaty and Article 14 means that a specific policy approach to SGEIs needs to be developed, particularly in relation to competition and the internal market; the European Parliament and the Council have an obligation to act in order to establish principles and set conditions which would enable SGEI to fulfil their missions, and effectively meet the needs of European citizens.

Social Dialogue: CEEP is the representative of Public Services Employers

Throughout 2009 CEEP has continued to strive for an effective and result oriented European Social Dialogue. Negotiations have brought two major achievements for public employers:

1. FRAMEWORK AGREEMENT ON PARENTAL LEAVE.In June 2009, in the presence of Vladimir Špidla, European Commissioner for Employment, Social Affairs and Equal Opportunities, the European Social Partners, formally adopted an agreement revising their 1995 Framework Agreement on Parental Leave.The revised agreement improves several provisions of the pre-existing agreement, such as: an increase in the length of parental leave from three to four months and strengthening it as an individual right, by making a part of it fully non-transferrable; it offers workers a right to request flexible working arrangements when returning from leave; it calls on Member States and/or Social Partners to establish notice periods to be given by workers when exercising their right to parental leave. It also strives to recognise increasingly diverse family structures and to promote an equal sharing of family responsibilities between men and women. Furthermore, it respects the diversity of measures taken by the Member States in areas such as leave facilities, childcare and flexible working arrangements.From the public employer’s perspective, it makes it easier for employers to manage the effects of parental leave on their workforce and operations with compulsory

notice periods. It also discourages long-terms absences from the labour market through maintaining contacts between workers and employers during parental leave.From CEEP’s perspective the decision was significant in that it inscribed parental leave in broader flexicurity policies and acknowledged that parental leave is only one element of diversified reconciliation measures in the Member States. It also highlighted the positive role of the European Social Dialogue in finding solutions to important challenges facing Europe, whilst addressing and recognising the concept of work-life balance in parallel.In the absence of an agreement, the Commission would have proposed EU legislation going far beyond the compromise found by the Social Partners including a suggested payment provision of 66% of last salary during parental leave.

2. INCLUSIVE LABOUR MARKET AGREEMENTThroughout the year, unemployment rates in Europe continued to increase. By mid-2009 employment in the EU had contracted by 4.3 million jobs (1.9%)2 compared with a year earlier, resulting from a broad deterioration across almost all sectors. Urgent and determined action was needed to halt this cycle and to ensure that Europe was in a position to pounce on the upturn.Public Employers have always recognised the business case for better labour market participation rates amongst all groups of working age - hence CEEP’s initiation of negotiations on inclusive labour markets.The agreement is fully in line with the CEEP negotiating mandate which included, amongst other things, the request not to define disadvantaged groups at EU level (this being the prerogative of national, regional and local social partners) and not to create compulsory quotas or entitlements to training.The agreement recognises that the creation of inclusive labour markets does not only depend on employers’ initiatives but also on workers collective and individual efforts. Concerning the latter, there is the acknowledgment that lack of motivation and attitudes of individual workers can be an obstacle to integration into the labour market.The agreement recognises that the maximisation of the

full potential of Europe’s labour force is not an exclusive competence of the social partners. There are some fields in which public authorities should take specific action involving, wherever possible, the appropriate social partners. Therefore the framework agreement contains an annex which lists a series of recommendations to public authorities and other actors. Amongst those, public authorities are asked to provide support and incentives for employers to hire people furtherest from the labour market and emplower social partners to remove obstacles to employing such people.

CEEP’s negotiation team was enriched by FEDES (European Federation of Social Employers) with whom we have a cooperation agreement. Their unique expertise, experience and know-how from the perspective of the integraton of disadvataged workers in the workplace on a daily basis proved invaluable.

Key for CEEP is the maximisation of the labour market’s potential and the importance of reaching out to all categories of actual and potential workers.

CEEP Supporting Healthcare and EducationThrough its vast membership touching on all dimensions of the Public Services, CEEP has a privileged insight into sector representation at European policy level. It became evident that employers in the education sector did not have a vehicle through which to make its voice heard. In 2009, CEEP helped to establish the European Federation of Education Employers (EFEE). EFEE represents the interests of education providers of all levels (from pre-school to university and vocational education) as employers at European level, and thereby contribute to the improvement of education in the Member States of the EU.

HOSPEEM is the European hospital and healthcare employers’ association. The association aims to regroup at European level national employers’ associations operating in the hospital and healthcare sector, in order to co-ordinate their views and actions with regard to a sector and a market in constant evolution. CEEP is proud to have supported HOSPEEM in discussions on legislation relating to the agreement on prevention from sharp injuries in the hospital and healthcare sector, the

results of which will be transformed into a directive in 2010.

Communicating the European Public Services LandscapeFollowing a question from Nicolaos Vakalis (former MEP) to Commissioner Špidla on Public Services in Europe, CEEP committed to collecting comprehensive and up to date data on Public Services in Europe and to improving the knowledge of industrial relations in the field of Public Services3.

Fundamentally, Europe’s understanding of Public Services – who they are, what they represent etc – is very varied. Different terminology in different countries contributes to the confusion. The study will clarify the definition of Public Services and Services of General Interest, and on this basis, we can correctly establish the value of Public Services in Europe economically, financially, environmentally and sociallyThe eagerly awaited report will be finalised and published in the first half of 2010, with copies to be made available to all stakeholders.

Based on the results, the intention is to create a more structured discussion group – Public Services’ Employers Forum – bringing together CEEP and sectoral employers’ organisations representing providers of Services of General Interest. The official launch is due to take place in June 2010.

Anticipation of Change in Public Services – the first step towards the Public Services’ Employers ForumOn the follow-up of the CEEP project on “Restructuring and Modernisation through effective Social Dialogue and Human Resource Management”, CEEP together with ETUC and partners of the sectoral social dialogue in the field of Public Services have started the “Anticipation of Change in Public Services” Project.The overall objective of this project is to improve expertise regarding anticipation of change in public services. The specific objectives of the project are to bring together sectoral Social Partners in the field of Public Services, to allow sectors to deepen the debate and explore the scope for new social dialogue initiatives.

CEEP – Valuing Corporate Social Responsibility (CSR): From Discerno to the CEEP-CSR LabelThe CEEP-CSR Label is a recognised European label for Public Services Providers complying best with CSR. The label allows organisations to showcase their achievements enhancing their corporate image among local communities, stakeholders, customers and service users.The label itself is based on a set of criteria which have their origins in international standards (ISO 9001, ISO 14001, EMAS, Global Compact, ISO26000 etc). A second phase assessment covers:• Corporate governance• Socially responsible behaviour• Human resources• Inclusion of economic stakeholders (suppliers,

shareholders, partners, etc)• Links with municipalities and other stakeholders

(local Consumer and utility associations)• Links with other environmental initiatives• EU and International StandardsIn October 2009, CEEP hosted an awards ceremony in Brussels celebrating 15 companies who achieved the standards set and were awarded labels that are valid for 2 years. 2010 will signal the end of European Commission funding for the initiative. However, due to its success, and the benefits members are deriving from the label, CEEP will make every effort to continue to manage and fund the label. CEEP in 2010 – Establishing priorities for the next decadeCEEP’s key underlying priority for 2010 will be to communicate the significance, contribution and importance of Public Services and Services of General Interest in Europe to all stakeholders that have relevance for our members. It necessitates a proactive strategy, supported by a dynamic general secretariat.

In parallel with our institutional commitments including the Spanish, Belgian and Hungarian presidencies, 3 of our major initiatives for the year will be the conclusion of the Mapping of Public Services project, Anticipation of Change in the Public Services and of course Europe’s vision for 2020 and beyond.

Our level of activity and our achievements in 2009 have already set the tone and context for 2010. CEEP will be reaching out to new players, exploring partnership potential with private actors while continuing to effectively defend the interests of its members at European level.

Brodie)• General Rapporteur: Jeanette GRENFORS CEEP represents the interests of Public Service employers and providers in the framework of the European cross sectoral Social Dialogue, both at bipartite and tripartite levels. As such we are recognised by the European Commission as one of the two general cross-industry employer’s organisations able to negotiate with the trade unions at European level on all matters affecting employment relations within the framework of Articles 154 and 155 of the EC Treaty4. This puts us right at the heart of the debate on all issues affecting employment relations and labour market reform and makes sure we are in regular contact with the European Commission, the European Parliament and other institutions over the impact of legislative and policy developments in the field of social affairs.

and promotion of work-life balance in the context of the Parental Leave Directive

Macro-Economic Committee• Chair: Edith KITZMANTEL• Vice-chair: Stefano GORIThe Macro-Economic Committee’s main function is to represent CEEP in the Macro-Economic Dialogue, an institutionalised form of discussion between the Council, the European Commission, the European Central Bank and the European Social Partners. CEEP is one of the three general cross industry Social Partners along with ETUC and BusinessEurope. The purpose of the Dialogue is to make the voice of the Social Partners heard in European macro-policy making and to form an opinion on wage and price developments.

The focus of the committee during the course of 2009 was to support an exit strategy for Public Services from the crisis, whilst ensuring sustainability of public finances. It called for the development of new instruments to alleviate national budgets from financing large-scale crisis operations to help speed recovery.

European Commission’s consultation on the “Transforming the digital divide opportunity into social benefits and economic growth in Europe” supporting the description of an EU roadmap for the digital divide, as it will clarify the future technical usages of this spectrum band and will therefore facilitate the harmonisation across Europe.

• Next Generation Access Networks; Next Generation Access Networks (NGAs) are essential for consumers and businesses to benefit from tomorrow’s broadband services, but care has to be taken in the use of efficient spectrum management. CEEP has been advocating against the inclusion of functional separation as part of the solution.

• Consumer Collective Redress; CEEP provided responses to the European Commission’s questions relating to the Green Paper on consumer collective redress highlighting issues of importance to members, including the need for the EU to ensure that the rules for cross-border redress are harmonised, and to

guarantee to consumers and enterprises the respect of all the existing Community rules, especially in national transposition measures.

• Public Service Broadcasting; CEEP supported the review of the Communication on the Application of State Aid Rules to Public Service Broadcasting, but considered that it should remain a flexible instrument which allows Member States to continue to reflect their national needs, culture and constitutional law when defining, organizing and entrusting Public Service organizations.

Environment Committee• Chairman: Francisco SOARES • Vice-Chairman: Michel DESMARS • General Rapporteur: Klaus NUTZENBERGER In the context of the Europe 2020 Strategy, the CEEP Environment Committee represents the interests of enterprises involved in waste management, soil protection, urban planning, tourism as well as energy, water and transport. Its particular focus is climate change and the implementation of adopted directives.

POLICY FOCUS 2009• Soil Protection; CEEP was responsible for raising key

questions on soil protection that require an answer before the transposition of the Waste Framework Directive into national law, and in particular because of insufficient analysis of the Commission and its reference to the definition of hazardous waste and contaminated soil

• Waste Framework - The adoption of the Waste Framework Directive was supported by CEEP, contributing to discussions in the European Parliament, focusing in particular on incineration standards (seen from both an environmental and economic perspective)

• Bio-Waste; The White Book on Bio Waste tends towards the introduction of a Europe-wide collection system. CEEP fears this would entail a large investment for public entities and public enterprises without a credible gain of Environmental Protection. CEEP submitted these points to the European Commission

• Certification in the Waste Sector; CEEP’s “Certification” Working Group kicked off the development of a voluntary agreement for the certification of public enterprises in the waste sector

• Landfill; The 16th of July 2009 was a key date for European landfill management. In accordance with the requirements of the EU waste landfill directive (CD 1999/31/EC) the operation of any landfill must have ended on that day if it did not meet the requirements of the directive. CEEP represented the interests of its members in relevant discussions on the topic.

• Climate Change; CEEP’s contribution to the

Transport Committee• Chairman: Alberto RHO• Vice-chairman: José CAPEL FERRER • Vice-chairman: Ronald JUHRS• General Rapporteur: Elena MONTAFIA The Transport Committee represents the interests of employers on all European transport and transport related issues including railways, urban, water and air transport, as well as social and environmental matters.

POLICY FOCUS 2009• Charging of heavy goods vehicles for the use of

certain infrastructures (the Eurovignette Directive); CEEP represented its members by calling on the EU to allow and encourage Member States to develop a road charging system which tallies more closely with sustainable mobility objectives, and in particular to recognise that charging should be related to distance driven (in km) rather than to time (vignette) as this is economically and environmentally more efficient

• Action Plan on Urban Mobility – CEEP supported the development and finalisation of the European Commission’s Action Plan, which effectively proposes twenty measures to encourage and help local,

regional and national authorities in achieving their goals for sustainable urban mobility.

• Passenger Rights in bus and coach transport; CEEP supports the initiatives from the European Commission designed to make public transport a natural mobility choice. Local transport is designed to serve citizens with frequent, short distance, widespread coverage and capilliary service. Often this service is organised in multi-model networks. The text of the regulation does not consider these characteristics as it is aimed at long-distance and international bus and coaching services.

• Future for Transport; “A sustainable future for transport: Towards an integrated, technology-led and user friendly system” is the aspiration of the European Commission. A public consultation was launched with a view to the publication of a new 10-year Transport White Paper scheduled for the end of 2010. CEEP’s Transport Committee will be representing its members throughout the consultation process.

Defined as an inherited commodity and as a heritage to be protected and defended rather than an ordinary commercial item, water helps cement regional cohesion through unlimited security of supply, and social cohesion. Representing all of Europe’s major water providers, CEEP, through its Water Committee, is engaged in promoting a sustainable water economy.
