ARIEL AXELROD STATEMENT Raymond. E. Helm, III Fraudulent/Fictitious Drone Training on April 10, 2018

On February 7, 2020, I discovered training fraud perpetrated by :

Raymond E. Helm III, Constable, Precinct Three, Hays County, Texas ("Ray Helm")

On or about April 10, 2018, Constable Raymond E. Helm III purportedly conducted Drone Training for five (5) hours. Those who attended and were submitted as having completed the purported training are:

The training is reflected on each of the above Personal Status Reports as indicated below and attached at Exhibit "A":

4033 Drone Training 4/10/2018 5 HAYS CO. CONST. PCT. 3 (Training Rosters)

Upon information and belief, Course Reporting Number 4033, Drone Training, was not conducted on April 10, 2018 . The peace officers identified above were actors/extras for an advertisement/infomercial. Ray Helm used Hays County law enforcement vehicles for the filming of the drone informercial/advertisement on April 10, 2018. In other words, Ray Helm used taxpayer funded resources to benefit a private party/entity.

The drone search and rescue informercial/advertisement was done by Eugene "Gene" Robinson, Vice President of Drone Pilot, Inc. Eugene Robinson can be reached at [email protected]. A February 7, 2020 phone conversation with TCOLE training staff revealed Eugene Robinson was not an approved/ certified TCOLE instructor and Drone Pilot, Inc. was not a TCOLE approved contract training provider.

Eugene Robinson did not actually conduct drone training on April 10, 2018 and, because he and Drone Pilot, Inc . were not on the list of training providers, he could not have conducted the training for TCOLE credit. Ray Helm, as Precinct 3 Hays County Constable Office agency head, submitted a fictitious training roster with himself simultaneously student and instructor.

One of the Deputy Constables Ray Helm submitted on the training roster was surprised when I informed him that Ray Helm had submitted him for the five (5) hour drone training credit purported to have been completed on April 10, 2018. Former Deputy Constable Gary Griffin wrote unequivocally that Eugene Robinson and/or Drone Pilot, Inc. did not conduct the five (5) hour

drone training class on April 10, 2018. Gary Griffin further confirmed that Ray Helm used taxpayer funded resources for a private purpose by providing Hays County law enforcement vehicles and personnel for the drone infomercial/advertisement. Gary Griffin further informed me that he would be self-reporting to TCOLE to remove the April 10, 2018 (5) hour Drone Training reflected on his Personal Status Report. See email exchange with Gary Griffin attached at Exhibit "B".

Upon information and belief, there are voluminous emails between Ray Helm and Eugene Robinson that will show the scope of the Ray Helm ' s engagement of Eugene Robinson and Drone Pilot, Inc. available from Debra Anderson, Public Information Officer with the Hays County General Counsel Office. Ms. Anderson may be reached at (512) 393-229 and by email to [email protected]. Upon information and belief Ray Helm personally emailed the video or a link to it from his government email address, [email protected], to each of those who fraudulently received 5 hours of drone training credit on April I 0, 2018.

Ray Helm is not a new instructor. He received TCOLE Instructor Certification after completing a 40-hour approved course on October 5, 2007 (he submitted an Instructor Application to TCOLE on October 10, 2007). See Certificate and Application at Exhibit "C".

Therefore, please consider this a request to prefer a formal criminal complaint in which to open a criminal investigation relating to the possibility of Constable Raymond E. Helm III intentionally and knowingly committed the above acts, specifically

Tampering with Government Record/ Texas Penal Code 37.10 - Creating False Government Documents - Submitted False Government Documents to TCOLE

Creation and Submission of a False Report in violation of TCOLE Rule §223.19(t))

This statement is true and correct to the best of my knowledge, incorporated for any and all purposes relating to criminal conduct committed against the State of Texas.

On Tuesday February 11, 2020, Sergeant Investigator Hillary Lyon and I traveled to Wimberley, Texas to conduct an interview with Hays County Constable Precinct 3, Constable Ray Helm. Sergeant Investigator Shane Norie is currently conducting an investigation concerning training hours being reported by Constable Helm that may have been falsely reported. The interview with Constable Helm was conducted at the Constables Office in Wimberley. I explained to Constable Helm that we received a complaint concerning a drone training conducted back in 2018. I asked Constable Helm if he remembered the training and he indicated he did. I would note that Constable Helm had a folder on his desk when arrived and he immediately pulled out some papers that were paper clipped together. I asked Constable Helm what he could tell me about that training. Constable Helm handed me the papers he had pulled from the folder and as I thumbed through the papers, I realized this was a lesson plan for drone training. As I thumbed through the lesson plan, Constable Helm’s stated he had Gene Robinson, who has a company that does drone training come down and they spent about ten hours learning about drones. Constable Helm’s stated that did about five hours of hard practical training and then about five hours of live video. Constable Helm’s stated when he got ready to submitted the training, he talked with Gary (Gary Griffin), who was his second in command at the time and he asked him how they were going to submit it as in-house training. Constable Helm’s stated that Gary told him that since they didn’t do (Instruct) the training, and were only student’s they needed to submit it up with Gene (Gene Robinson) as the instructor for that class and that’s what they did. Constable Helm stated that they did a nighttime exercise and a daytime exercise. Constable Helm’s stated that they didn’t learn how to fly the drones, but learned what to do when the drone is in the air. He stated they did a search and rescue, apprehension and it was a pretty intense class. Constable Helm stated after the floods down in Hays County it was good for them to know how the drones work. Constable Helm stated months after that class they did an eviction involving a Republic of Texas person and it was a hostile environment. He stated they had the drones out there and there was no way they could have executed that correctly without having some practical knowledge and a class on that. I asked Constable Helm if they had any classroom setting for this training. Constable Helm stated it was all out in the field. He stated they did everything in the field that day. I asked Constable Helm if it was both instructors, John Buell and Gene Robinson doing the instructing. Constable Helm acknowledged it was. I asked Constable Helm if John Buell was a peace officer with the Austin Police Department. Constable Helm indicated he was. I asked Constable Helm if he had a roster showing who all attended the class. Constable Helm directed me to the last page of the papers he had provided me. This page was a computer printout of a roster that is generated by TCLEDDS when it is sent to TCOLE. This roster listed the following students as: Cheatham, Cody L. Griffin, Gary L. Helm III, Raymond E. Torres, Donny R. I asked Constable if he had a roster with handwritten names and signatures. Constable Helm stated no, and that what we (TCOLE) went over that on the last class (Body Worn Camera), and he has corrected his self. He stated that he now makes them fill out a handwritten one now. He stated from what he

knew when he submitted this course (Drone training), he only submitted through TCLEDDS, but they have fixed that. As I thumbed through the papers, I pointed to the evaluations and asked if these were the evaluations for the drone class. Constable Helm indicated they were. I asked Constable Helm if this class was put on 04/10/2018. Constable Helm indicated it was. As I thumbed through the papers, I noted on the lesson plan cover sheet, and just above the bottom paragraph on that page I noted the following: DATE PREPARED: DATE REVISED: 4/10/2018 PREPARED BY: REVISED BY: Ray Helm I asked Constable Helm if revised the document. Constable Helm replied “um hmm”. I asked Constable Helm what he meant by revised, and what did he revise. Constable Helm replied “Oh, I mean revised, I didn’t know… see on those things I just put the day that we did it and then it’s a revised date, I guess it’s the same I haven’t touched it since then, that we did it”. I pointed to the date and asked if this is when it was done and Constable Helm replied “Right”. I asked Constable Helm if there was any reason why people would say that they didn’t actually take training and that they actually went out and cut a commercial for the drone company. Constable Helm replied “we did, we did part of that, but I couldn’t give a whole ten hours, I mean we were out there for over ten hours. There’s no way I could give… honestly give ten hours training, when we’re doing a video shoot on that”. I asked Constable Helm if they did the training before the commercial cut. Constable Helm replied “Um hmm. Right, yeah, yeah”. I asked Constable Helm this was a two day or one deal. Constable Helm stated it was a whole day. He stated they went out that morning and then came back in the evening to do the evening training. Constable Helm stated what they would do, is go over the search and rescue on how to apply the technology, and we learned everything about grid searches. He stated they would run a video after that. I asked Constable Helm if the students learned how to operate the drone. Constable Helm stated no, what they learned was how to deal with the drones and deal with the pilots as they told us what to do from overhead. Constable Helm stated they don’t fly them. He stated when we need a drone we call these guys, but now we know how to act when these guys come out, like how to set up a landing strip and all that stuff. I asked again if this was done prior to the commercial being done. Constable Helm replied “right, yeah, yeah, we couldn’t have done the commercial without doing the training”. I asked Constable Helm if he had any documentation of the show-up times, like a handwritten roster the times they arrived. Constable Helm replied “no… I mean, no… I mean I, like I said submitted that, that thing on the TCLEDDS, I used that as a roster. Now I know you don’t do that after the body cam thing”. I then pointed to the very front page of the papers Constable Helm provided to me and I asked Constable Helm if this letter was written up on 2018. Constable Helm replied “Yes”. I again asked Constable Helm if both instructors were there. Constable Helm replied “right, uh huh”. I asked if both gave instructions. Constable Helm replied “Yep”. I asked if this was their lesson plan. Constable Helm replied “Yep”. I asked Constable Helm if the instructors provided any type of certificates. Constable Helm stated no. I asked Constable Helm, based on the lesson plan and the training the instructors gave was this the reason for reporting the five hours training. Constable Helm replied “Right”. I again asked Constable Helm if he could think of any reason why someone would say that they didn’t take the training or hours. Constable Helm stated that this guy Axelrod (Ari Axelrod) and Gary Griffin

they won’t quit. I asked Constable Helm if Donny Torres is going to tell us that he took the training. Constable Helm replied “correct”. And it was put on by instructors everything was taught the way it was supposed to be. Constable Helm replied “yes sir”. I told Constable Helm that Griffin was probably not going to say that. Constable Helm replied “no he’s not”. I asked Constable Helm what was Cody (Cody Cheatham), going to tell us. Constable Helm replied “right”. I asked if he was going to say he took training and not just a commercial. Constable Helm replied “training, not just a commercial, I mean”. I again asked Constable Helm if that is what they are going to tell us. Constable Helm replied “yeah”. I explained to constable Helm that Sergeant Investigator Norie would be making contact with the Deputies listed on the roster for the drone class. I explained we would also be contacting both instructors as well. I told Constable Helm that I would hope he would not influence his people (Witnesses) one way or the other and just let TCOLE get an answer from them. I explained to Constable Helm that if he started influencing them as what to say, it would certainly create a problem. Constable Helm replied “right, yeah witness tampering and everything else”. DETAILS OF INVESTIGATION

This case began with a complaint from Ari Axelrod, advising Constable Raymond Helm, Hays County PCT 3, had reported fraudulent Drone Training to The Texas Commission on Law Enforcement on or around April 10, 2018. Axelrod emailed the complaint to my email address on February 7, 2020 and when I checked my email on February 10, 2020, I forwarded it to Enforcement Specialist Donna Sudennan to open the case.

I had also received a telephone call from Gary Griffin, PID referencing the Drone Training class. Griffin had received communication from Axelrod inquiring whether or not he had Drone Training on or around April 10, 2018. Griffin emphatically denied having Drone Training; he stated to me the training in question was a commercial shoot, not training. Griffin advised me he had spoken to Donny Torres, PID

( - - as well Griffin gave me Torres' contact infonnation and J in tum then ca.lied Torres and set up an interview with him on February 10, 2020 at the Texas Commission on Law Enforcement.

Februarv 10, 2020

I met with Donny Torres, PIO and received a recorded statement at approximately 1245 PM, which will be included with the case file. The following is a summary of the statement and is not intended to be a transcript.

Torres said Helm told them (Cody Cheatham, Donny Torres and Gary Griffin) to go to an area in Hays County {Wimberley), that they were going to help a guy named Gene Robinson get some Drone footage. Torres advised they arrived mid-morning.

Torres advised they had movie equipment set up at the location and to get in their cars and have the lights on.

Torres then identified a screen capture from Drone, Inc. (The Company Gene Robinson owns) of Constable Vehicles and of Gene Robinson.

Torres stated they were told they would be filming a commercial for a drone company. Torres said throughout the day they were given direction on where to stand and where to park their vehicles.

Torres said they were out there alt day and came back in the afternoon. He said they came back did a night time shoot. He said Gene showed them what he did as a pilot, but they never flew the drone.

Torres stated it was not a typical TCOLE class he was used to. Torres said a typical TCOLE class he was used to, is when you are given handouts, take a·n exam, fill out an evaluation and sign a roster. He also said you were aware of any TCOLE credit you would be given. Torres stated he didn't even know he had received credit.

Torres stated Helm had called him on Saturday February 8, 2020, asking him if he remembered the "drone class". Torres responded "vaguely, why"?

Helm told him Axelrod put something on a website saying it didn't happen. Torres said "wasn't that a commercial".

Torres advised Helm became upset and told Torres "I can't have you not remember, Do you remember or don't you."

Torres told Helm "I don't know, you're talking about a year and a half ago". Advised I am sorry I don't remember.

Torres said I just remember sitting in the cars and them telling us what they were going to do and to run certain ways. He said when Helm said class and when he didn't go along with it, it aggravated Helm.

Torres advised it was around 10pm on February 81 2020 when Helm called. Torres then said Helm called Corporal Cody Cheatham on Sunday night February 9, 2020. Torres knew this because he was with Cheatham when Helm called.

Torres said he overheard the first part of the conversation between Cody and Helm. Helm said he couldn't have {Donny Torres) not remembering certain parts of the class. Torres said he overheard Ray tell Cody he was going to fire Torres on Tuesday, February 11, 2020. Torres said he could hear Helm talking through Cody's phone, that's how aggravated and loud he was. Torres said Cody was just listening and trying to calm Helm down.

When Cody hung up the phone he told Torres that Helm thinks Torres was not backing him up on the training. Torres reiterated he couldn't remember, but said they never took a test or signed a roster. Torres said his understanding of the class was it was a commercial.

Torres then stated he contacted Gary Griffin to ask about a referral for an attorney. Torres said he talked to Ray after Cody and Helm told him he was fine and he is not getting fired.

This was the end of the interview.

I then asked Torres ifwe could make a telephone call to Helm about the conversations the past weekend and record it, he agreed. The following is a summary of the phone call and is not intended to be a transcript.

Helm apologized to Torres for venting on him last night. Ray said Torres was "good", referring to his employment on Tuesday.

Helm told Torres he just wanted to get through this election and he was tired of getting beat up.

Helm said Griffin (referring to Gary Griffin), has put out a "bold ass lie" and Helm advised he would "go to the mat on that one." Helm then apologized again for going off on Torres and the phone call was ended.

Captain Doug Skolaut along with Sergeant Hillary Lyon traveled to Hays County Constable's Office, PCT 3 to meet with Constable Helm to retrieve the Drone class training file. Captain Skolaut provided a supplement and a copy of the statement by Helm. It will be included with this case file.

I received an email notification that Attorney Chevo Pastrano would represent Deputy Cody Cheatham. A copy of the letter will be placed in the case file.

February 18. 2020

I met with Gene Robinson, owner of Drone Pilot, Inc., and received a recorded statement at approximately 0948 AM, which will be included with the case file. Robinson along with John Buell, owner of Drone Pilot, Inc., were the points of contact for Helm regarding the commercial. The following is a summary of the statement and is not intended to be a transcript.

Robinson started the interview by saying he met Helm when he was a Deputy Constable and that most of their interaction was work related or in passing. Robinson said he has never had any formal agreements with Helm for training.

Robinson stated he never had a formal agreement for training and Drone, Inc. is the company Robinson/Buell (John Buell is the other owner in Drone Pilot, Jnc.) operate under.

Robinson advised he was approached by a company named Yuneec, a drone company, to show the use of the aircraft (drone) in a public safety scenario. Robinson agreed and reached out to the Hays County Sheriff's Office first. Hays County initially agreed and then at the last minute pulled the plug. When that happened Robinson reached out to Helm. Robinson said the agreement with the Sheriff's Office was to shoot a commercial.

Robinson said it was never purported to be a training class and there was no impression it was ever given it would be a TCOLE class. When Helm was contacted by Robinson it was to say we need people for a commercial.

Robinson said his intention was never to offer training it was to shoot a commercial.

When everyone arrived on scene Robinson/Buell went over safety procedures and other protocols with the deputies. Robinson is a subject matter expert and his resume will be included with the case file.

Drone Pilot, Inc. has two training classes according to Robinson.

1. 30,000 foot view, which is an administration class and takes 8 hrs. Robinson describes it as a high intensity class with a lot of information.

2. The next class is 100 hours and consists offlying the drone.

Robinson advised there was a production crew on site and they instruct them on what they want to shoot. Once the production crew advised what they wanted, Robinson/Buell would convey to the Constables where to go, what direction to go and how to react to it. Robinson said the instruction is what they needed for the commercial.

Robinson stated Helm had called him around February 11th or 12th, 2020. Ray said he needed scenarios for the drone class. Ray further said he was under investigation for 5 hours of training.

Robinson emailed Helm three scenarios, which covered Active Shooter, Bomb threat and Haz Mat. Robinson said he has never sent any other material to Helm and furthermore, stated he has never taught any class for Helm.

Robinson did say there was a scenario in Hays County Republic ofTexas individual) were Helm utilized some of the skillset they used on 04/10/2018.

I asked Robinson why he didn't supply Helm with material to properly train for the class and he

simply replied because the intention was to shoot a commercial.

February 19. 2020

I along with Sergeant David New met with Corporal Cody Cheatham at bis attorney's office in San Marcos. A recorded statement was received from Cheatham and his attorney, Chavo Pastrano, was present. A copy of the inteiview will be included with the case file. The following is a summary of the statement and is not intended to be a transcript.

Cheatham was told by Helm to go to a location in Wimberley for training. Cheatham met with Gene Robinson and another male.

Cheatham advised they were given scenarios and when the scenarios were run they would film

with remote controlled cars and drones.

They did part of the day, roughly 5 hours, and then they were told to come back later because they had to do some night shooting. Cheatham said they showed up later in the day and they did more filming with the drones.

Cheatham said later in the day he asked "what is going on, are we filming". The response was yes for an ad or commercial for the drone.

Helm had announced at the beginning of the day "Hey I have some cool training for y'all and their gonna do some filming to".

Cheatham stated there was no skills test, they didn't have to show proficiency in anything and they did not sign a roster. Cheatham said they did show them the trucks and how to interact with the drones.

Cheatham explained they did feel at one point they were actors. So much so Griffin said "this isn't t raining guys, were filming".

Cheatham said he was unaware they were getting 5 hours of TCOLE credit and he never thought anything about it after they completed the day.

Cheatham stated it came up again on Sunday February 9, 2020. Helm had called Cheatham and said he was pissed off at Donny. Helm told Cheatham he had talked to Donny the day before and said Donny could not remember much about the drone training. Helm furthermore stated, if he doesn't remember much about that day then he's going to receive an F5 on Tuesday, February 11, 2020. (For clarification an FS Is a TCOLE document showing the officer has been separated from the agency, ie: terminated, retired or quit} Thus, by Helm saying Torres is going to receive an FS on Tuesday, he is saying he would be fired from the agency.

Cheatham then asked Helm why he would do that. Helm then asked Cheatham what he remembered about that day. Cheatham told Helm they did some filming. Helm responded well we did some training tho.

Helm again said he (Torres) didn't remember that much and if he can't remember that much then he's gonna receive an F5. Cheatham then told Helm "let me find out what's going on with Donny".

Cheatham advised Torres was at his house and heard the conversation along with Cheatham's wife. Helm was so bothered Torres could hear Helm through Cheatham's phone {his phone was not on speaker).

Cheatham then spoke with Torres, who was upset because he was going to be fired on Tuesday. When Cheatham spoke with Torres he replied "so he's gonna fire me cause J don't remember much about that day".

Torres told Cheatham he believes since he kept telling Helm they were filming, he got upset. Cheatham then told Torres he needed to contact Helm and work it out.

Cheatham then said Torres called Helm and recorded the call so none of his words would be twisted by Helm.

Cheatham said he retained Attorney Chevo Pastrano Monday night, February 10, 2020. Pastrano then sent a representation letter to Helm.

Cheatham said when Helm received the letter Helm sent Cheatham a text Monday night stating "what is this", referring to the letter. Cheatham told Helm he couldn't answer a lot of questions but did tell Helm they retained counsel due to TCOLE contacting them.

Cheatham told Helm due to those factors he can't speak of the case any longer. Cheatham said at that point Helm stated "ok, J guess I'm screwed". Cheatham also provided screenshots of text messages between Cheatham and Helm, and they will be included in the case file.

Cheatham said Helm called him early Tuesday morning, which Cheatham found odd and tried talking to him about the case. Cheatham again told Helm he couldn't talk about it.

Cheatham said Helm came into the office and handed him a packet and asked him to check it. Cheatham began to look at it and first observed the evaluations. When Cheatham finally observed the word Drone he gave it back to Helm and walked off.

Helm then told Cheatham TCOLE was coming so you might want to get out of here so they don't ask you questions. (This was on the same day Captain Skolaut and Sgt. Lyon went there}.

Cheatham said Helm called him when TCOLE Investigators departed the agency and began talking about the case again. Cheatham then reminded Helm, he can't talk about the case. Helm then told Cheatham he just wanted to tell him everything was good.

Helm called after that and told Cheatham for everyone to come back to the office that he needed to speak with everyone. Everyone mean Kaley Gassman, Cody Cheatham, Donny Torres, John Shellhorn and Darryl Ayres.

Cheatham stated once they arrived at the office Helm began talking about TCOLE and started to talk about the incident. Torres stopped Helm and Helm responded "it will only take a second". Cheatham and Torres started to leave the meeting, but before they could helm said "everything with TCOLE is good but their still gonna meet with Cheatham and Torres".

It was at this point I handed Cheatham some documents from the training file retrieved from Helm by Captain Skolaut. I handed Cheatham the evaluation forms from the file provided by Helm. I asked Cheatham if he filled out any of the four (4) evaluation forms, and he replied "no".

Cheatham further stated, he has never seen those before. Cheatham stated again he has never filled out an evaluation form for Drone Training dated 04/10/2018. Cheatham confirmed the evaluation forms were the same forms he saw when Helm gave him the training packet.

Sergeant New then reviewed the learning objectives from the lesson plan with Cheatham. Cheatham did not know any of the lesson plan objectives.

Cheatham said Helm then sent an email stating no one could take off from now until the election unless you were sick or it was an emergency. Cheatham felt like that was due to him and Torres getting attorneys and Helm knee jerking because he is a knee jerk type person. Cheatham also felt like it was retaliation. Cheatham said he was in fear of his job due to his being truthful with TCOLE about the class. Cheatham also felt like Helm fabricated the training file and he confirmed he never filled out any documents for the class and received nothing.

This was a follow up interview to the first interview conducted with Torres. Torres reiterated it was a commercial.

I produced the same four (4) evaluation forms shown to Cheatham. Torres said that normally you fill out evaluations at the end of a class.

Torres looked at all four (4) forms and said he has never seen those forms and did not complete one. Torres said he felt like Helms filled the forms out.

Torres explained he felt like Helms was the one because he credited them with the drone training. Torres said he knew nothing about being credited with the hours.

Torres went on to explain Helm called him on February 8, 2020 about the training and Torres called it a commercial and it "pissed off" Helm.

Torres stated he was at Cody Cheatham's house when he overheard a conversation between Helm and Cheatham. Torres heard Helm talking about submitting an FS (separation form) on Torres he decided to call Helm. The phone call was recorded and the recording will be included with the case file.

Torres said Helm asked him about the letter from his attorney and Torres told Helm he couldn't talk about anything. Torres said after he said that Helm became upset and started ignoring the employees, gave everyone the cold shoulder and look of disgust.

I then showed Torres the lesson plan and objectives. Torres stated he has never seen or went over any oft he material listed.

I along with Sergeant Hillary Lyon met with John Buell, P1D at TCOLE at approximately 0924. Buell is part owner along with Gene Robinson of Drone Pilot, Inc. Buell stated they were contacted by a producer from a company identified as Yuneec Drones, The company wanted to do a documentary type commercial for public safety. The went to Wimberley to shoot the commercia I in a rural setting.

Gene Robinson coordinated the commercial with Constable Ray Helm, Buell said they arrived mid-morning to the scene.

Buell said they had a search and rescue mission planned, so they had the actors show up mid­morning. The film crew staged the actors to do a real world type scenario. Buell identified the "actors" as the Constable's Office.

Buell said they explained to the Constables it was a commercial shoot. The producers told them were to go and how to walk. Buell explained later in the day they moved to a storage facility to shoot an active shooter scenario at night.

Buell explained their training requires a PowerPoint presentation, Agenda, Outline and Test (Pre & Post). Buell said the day was strictly for a commercial not training. Buell said they do training but that day was a "straight up" shoot and everyone was aware of that.

Februarv 20, 2020

I, along with Sergeant Hillary Lyon and Sergeant Dave New met with Gary Griffin, PIO at TCOLE at approximately 1345. Griffin was a Sergeant for Constable Helm and was one of the reported students. A copy of the interview will be included with the case file. The following is a summary of the statement and is not intended to be a transcript.

Griffin advised Cheatham and Torres were told to go to a pasture off of FM 1492. Griffin said he was performing Justice of the Peace court duties. He was then told to go to the location as soon as he could, presumably after his court duties.

Helm introduced them to Gene Robinson, a couple of actors and a video producer. Griffin said they were briefed they were going to make a PSA (Public Service Announcement) by Gene Robinson for this new drone. They were told to act like they were looking for a missing person.

I knew when Robinson was introducing us to video production people, John Buell and the movie producer was telling us were to park our trucks. Griffin stated everything they did was orchestrated by the production crew. They were working at the video producer's direction.

Griffin advised they wanted to do a night shoot and I didn't feel good about it. Griffin said the then told Cheatham, Torres and Helm he wasn't going to do it. Griffin told Cheatham and Torres he didn't feel good about it and he was leaving.

I asked Griffin why he didn't feel good about it and he stated he couldn't put his finger on it. Griffin said there have been times since 2011 (his start date at the Constables Office) Helm has asked him to alter documents. Griffin explained Helm asked him to back date a radar certification. Griffin said he just didn't feel like it was legitimate.

Sergeant New asked Griffin if Helm had asked him to alter or back date any other documents and Griffin stated not that he could recall.

Griffin said at no time during the event no one said they were getting TCOLE Credit or filled out a roster or said they were training. Griffin said he never saw a roster or filled out an evaluation form.

I then provided Griffin the evaluation forms from the training packet Helm provided to Captain Skolaut.

Griffin said none of the evaluation forms were of his doing. Griffin said he knew no of them were his because he always writes in the comments section. The only evaluation with written comments was identified as NOT being Griffins. Griffin said the writing was not his handwriting and furthermore, he would never give all S's as depicted on the form.

Gary was then shown documents from the file and Griffin said he had never seen them before.

Griffin at this point was show the memo dated 4/10/18 drafted by Helm. Griffin said that was the first time he had seen that document.

I asked Griffin if the document was true and his response was "it wouldn't be worth toilet paper and none of it was true". Griffin advised he and Helm never had a conversation after the training about anything in reference to the event.

Griffin said the first he has heard about the class was when Ari Axelrod reached out to Griffin in early February 2020 and asked him if he took Drone Training. Griffin responded to Axelrod he has never been to Drone Training and Axelrod said "it's on your PSR". Axelrod then sent Griffin his PSR (Personal Status Report).

Griffin said he looked at it and then remembered shooting that commercial. Griffin ended the interview by stating it was a commercial. He and Helm never had a discussion about the commercial and he never filled out an evaluation.

I received an email from Gene Robinson revealing the communication between Ray Helm and Gene regarding information for the "Drone Training". The time/date stamp of the email shows Saturday February 8, 2020 at 7:14 pm. It appears Helm was gathering information on the same weekend he was calling Cheatham and Torres. ·

February 24, 2020

Gassman heard from Corporal Cody Cheatham TCOLE was going to be at the HCCO on 02/11/2020 investigating a training violation.

Gassman stated some of the officers went to have lunch and Helm asked them to come back to the office.

Gassman said Helm told them at the meeting TCOLE had been there and everything looked good. Gassman said that Cheatham then said they couldn't talk about anything and Torres said the same thing. Cheatham and Torres then left the meeting.

Helm then said I'm not discussing anything, I'm just telling y'all everything looks good on my part. Gassman said that was pretty much all that was said.

The rest of the interview she explained and described her Field Training process with HCCO, PCT3.

February 24, 2020

I along with Sergeant David New met with Constable Ray Helm, Hays County Constables Office, PCT 3. A recorded statement was received from Helm at HCCO PCT 3 at approximately 1255 hrs. Also present in the interview was Constable Helm's attorney, Kent "Bud" Wymore. A copy of the interview will be included with the case file. The following is a summary of the statement and is not intended to be a transcript.

The interview started with Helm describing how the drone training came about.

Helm explained it was a last minute thing, that Gene Robinson had called him and told him they were gonna be doing some training with the drone asked Helm if he could participate in search and rescue and grid training. Robinson also told Helm they were going to do some filming and Helm asked how long they were going to be there. Robinson responded about 10 hours or more.

Helm then got a hold of Cheatham, Torres and Griffin to participate. Helm said they initially got on scene around 1230-100 pm. Helm stated they went over everything they wanted us to do. They took them over to a van and showed them how to communicate with them. They also went over some practicals and then practiced those.

Helm stated the only people out there were Gene Robinson, John Buell, Gary Griffin, Cody Cheatham, Donny Torres and Ray Helm (6 total). I then confirmed with Helm there were 4 Constables and Gene/John out there and he said yes.

Helm said they had a lot of stuff they don't use but it was more how to communicate with them if they show up. Helm said once they finished that they took about an hour break and returned for a night exercise.

Helm said they showed them how to do night time stuff and what to do or not to do. He said they then did a "film" on that when they captured the guy.

Helm advised they did not receive any certificates and that is why he got with Gary Griffin on how to submit the training,

Helm said Griffin instructed him on how to do it. Helm said he got with Griffin the same day they were performing the training. Helm said he told Griffin would find out at the end of the day how many hours they were going to get. Helm felt he couldn't claim 10 hours. Helm said they could only claim 5 hours because the other 5 or 6 hours was filming. Helm said he didn't feel comfortable claiming any more than 5 hours. Helm stated Robinson and Buell were the ones filming. Helm said he was watching his watch so he felt good about S hours.

Sgt. New asked Helm what purpose they were filming and Helm said applying what they learned, such as grid searches. When confronted that to would have been part of the training, Helm said he wasn't comfortable claiming any more than S hours.

Helm said he felt uncomfortable because he knew that they {Robinson/Buell) were going to use that film for their website (Drone Pilot, Inc.), like a marketing video. Helm said Robinson never said it was for marketing, it was training.

Helm said there were occasions the Constables were told to slow down your movlng to fast.

Helm was then shown the training file which he gave Captain Skolaut on 02/11/2020. Helm confirmed he filled out the document titled Phase HI -Training Scenarios. Helm stated he also received some of the documents from their website and he built the lesson plan from their website (Drone Pilot, Inc. site) and onsite training. Helm said he built the lesson plan off of their stuff in April 2018.

I then produced the evaluation forms and Helm identified the one with writing on it as his. The other three forms were identified as Cody Cheatham, Gary Griffin and Donny Torres'. Helm said he collected the evaluation forms from the deputies the next day. Helm said they completed them on 04/11/2018.

I then read the memorandum dated 04/10/2018 out loud. Helm said he created the document on 04/10/2018.Helm then reiterated he did not know how to write up the training so he asked Griffin.

Helm said he wrote the memo in case anyone ever questioned the class. Helm could not produce a memo from any other class that was taught. Helm did produce two (2) additional memos he placed into the training file after Captain Skolaut left on 02/11/2020. Those memos were written by Ray Helm and Matt Farris (Telecommunicator). The memos spoke to current

allegations against Helm from Axelrod. The document drafted by Helm was dated in 2019 but Helm said it should have been 2020.

I then asked Helm if there was a production crew out at the site. Helm replied yes there was a guy filming for the commercial. Helm said the only time they told the officers what to do and were to go was during the filming part of the day. Helm said the film crew directed them in the morning and evening.

Helm said Gene Robinson purported it to be training, but said there would be some filming to. Helm told Robinson that was fine as long as they could get some drone stuff out of it as well. Helm went on to say there was no misunderstanding that it was training between he and Robinson. Helm said they didn't receive a certificate from Robinson because his company was just geUing off the ground.

Sergeant New then went over the lesson plan objectives with Helm. Helm said they met all of the learning objectives.

J then confirmed with Helm that Cheatham filled out an evaluation, Torres filled out an evaluation and Griffin filled out an evaluation, Helm agreed. I then made the comment they didn't and helm said "umm hmm". I then stated to Helm he needs to be honest. I then asked Helm, who filled out the evaluations and he replied he remembered he filled out one and I gave those other guys theirs to fill out.

I again asked Helm who filled them out and he admitted I guess they didn't fill out the evaluations, he then said "I know I filled one out". I then said "no you filled all four out" and Helm responded "ok" and I said I just want to clarify "you filled all four out" and he responded "ok". Helm then stated he may had filled them out he couldn't remember.

I then asked Helm why he wou Id fill out four evaluations and he said so they would be covered on the class. Helm then said he looked at the file a week or two after they did the training and realized they didn't have the documents.

I then made the comment to Helm that there was no way he looked at that file then and said we need evaluations and then put them in there. l then asked him how about the last 6 months, referring to placing the documents in the training file. Helm replied "it coulda been".

I then asked Helm if it would be a true statement that he ·1ooked in the training file within the past 6 months and said "uh oh I'm missing some documents; let me get this folder up to compliance", Helm responded "probably so". I then asked him "probably so" or "yes" and Helm responded "yes". Helm said the only documents missing were the evaluations. Helm said he did the lesson plan in 2018.

I then told Helm there was no way he wrote the memorandum dated 04/10/2018 in 2018 and he responded "oh I sure as heck did". He said he didn't want to get dinged on something from the class. I then asked Helm if that was what he was going to stick with and he replied "that's exactly what I'm gonna stick with".

Helms attorney then asked if Helms could step out for a second and I said not at all. Helm then departed the interview leaving myself, Sgt. New and Attorney Wymore. The recorder was then left recording from 37:12 thru 45:37.

I then advised the attorney what the true story was with the training, as far as it being a commercial, not training. So much so John Buell and Gene Robinson both said it was a commercial.

Wymore then wanted to go off the record and go speak with Helm and the recorder was stopped.

The recorder was then reactivated at approximately 1413 hours on 2/24/2020.

Wymore then handed Helm four (4) documents titled Instructor Evaluation Forms. Helm acknowledged he recognized the documents. Wymore asked Helm if those documents were to memorialize training Helm, Griffin, Cheatham and Torres and Helm responded "correct".

Wymore then handed Helm another document dated "04/10/18" and asked him if he recognized it and Helm responded "yes". Wymore further asked Helm "were all those documents were created by you on or about February 8, 2020", Helm responded "yes".

I then confirmed all of the documents (Evaluations and Memo) and Wymore stated all of the documents we just identified and Helm said "yes".

We then said Helm was being cooperative and the recording was stopped at approximately 1414 hours on 02/24/20.

Once the interview was complete we departed the Hays county Constable's Office, PCT 3. I will also place the two (2) memorandum/statements Helm generated after Captain Skolaut departed the agency and placed in the training file.

February 26, 2020

1 received the telephone recording of a conversation between Torres and Helm which was recorded by Donny Torres on February 9, 2020. The following is a summary of the recording and not intended to be used as a transcript. The recording will be supplied with the case file.

Torres began the phone call with asking Helm if he was in trouble and Helm said ''no". Helm said Cheatham knew everything about that course that day.

Torres then brought up apparently he would be terminated if he didn't remember anything. Helm responded that was not it. Helm told Torres he needed him to remember because TCOLE

Torres became upset and tells Helm that was in 2018 and he was sorry he couldn't remember every single detail. Helm let Torres vent and then makes the comment we did a class for over 10 hours that day and I gave y'aU5 hours of classroom credit and when you tell me I don't remember shit (Torres interrupts Helm again).

Torres then responds I don't remember, all I know is we filmed a commercial sitting in our trucks the whole time and you called us back and we had to go back at night time. That's all I remember and then they showed us something on the monitor when it was dark. Torres then said I'm sorry if I don't remember anything with it and I'm not doing anything intentionally to harm you.

Helm then speaks and says that's the story I need you to stick to. Torres then says ok and confirms he's not going to get fired on Tuesday.

Helm responds "no" and then starts to say I need you to know, then changes it to "we went out and did a training exercise for over 10 hours, daytime and night time on how to work with Drones and what to do". "We did grid searches, we_did night time shots with that before t hey did any filming". We did search and rescue that day and Gary Griffin is saying we didn't do any of that.

Helm says "Gary is saying w e did nothing but a movie shoot and that's bullshit".

Helm says we a hell of a lot more than a movie shoot cause I pulled y'all off your regular duties to come out there and do patrol, do search and rescue, do grid pattern searches and do night

time. We didn' t do any filming unt il we had t hat down.

Torres then confirms with Helm he has all the lesson plans and rosters and asked him were all good. Helm responds "oh yea" I've got all of it backed up, I wrote everything including John Buell from Austin PD and Gene Robinson from Wimberley FD on all of that, all of their credentials.

Torres says if Helm has it all backed then he's not going to worry about it then. Helm says we did all of that and I don't need someone coming in and saying "Well I don't remember anything". Torres then becomes upset with Helm and says that it was in 2018. I'm sorry I dori't remember every single detail.

Torres says It hurts when he heard that Helm was talking about terminating him. Helm says " no shit" it hurts when he hears "I don't remember anything other than filming a movie". Torres tells Helm he is still blaming him. Helm tells Torres "I'm not blaming you but I don't need people saying they don' t remember shit".

Torres references the prior night's conversation between Torres and Helm and how Torres said it was a commercial. Helm says we just didn't do a commercial we did a lot more than that.

Helm then asks Torres did he not learn on that lesson plan how to deal with night vision, how to

deal with instructions in the air, did you learn how to deal with people in the air in the daytime,

grid pattern searches and everything I put in that lesson plan? You didn't learn any of that?

Torres replied "I don't remember a lesson plan". I'm being honest with you, I don't remember that. I don't have the handouts. Helm said it was his responsibility to have the lesson plan.

Torres again says "I don't remember a handout or anything; I'm just being real with you. But if

that's gonna get me fired because I don't remember then fine, fire me. Torres said I wou Id never try to burn you like that.

Helm then responds "I hope no one is trying to burn me in this office". Torres tells Helm the only one burning Helm is Helm. Torres references Helm putting things on Facebook. Torres also

references Helm coming into the office calling people ''Rats", implying their talking about him.

Torres tells Helm he's treating the deputies like dirt and Helm responds "how". Helm then wants

Torres to explain to him how he is treating people like dirt. Torres tells Helm he is walking around trying to figure out who is talking to Gary Griffin.

Torres tells Helm is telling his ex-wife the inter office stuff. Torres says half the citizens he runs into are telling us stuff that is going on in our office and its coming from Helm.

Helm keeps asking Torres what stuff and Torres responds everything going on in the media, all

of the stuff going on with KXAN and every time we go somewhere your constable is in trouble. Helm then asks Torres how all that comes back to you.

Torres tells Helm he doesn't get it. If something happens to Helm then it happens to everybody.

When you go down, we go down. What benefit is it to us if you go down. What happens if you go down and Jessica (Helms opponent in the election) takes over, were all out of a job.

Torres reminds Helm of how much he and Cheatham have worked their "ass off' for Helm.

Helm stops Torres and says "I love you brother", you know that. Torres says I don't know cause you just threatened to fire me Ray. Helm then says "no I didn't, did you hear that from my mouth". Torres says "so Cody is lying"? Helm responds "yep". Helm says all I need to know is whether you have my back or not. Torres then responds "wow, dude really".

Helm then begins laughing and Torres tells him he is at his wits end with a lot of stuff. Torres then asked Helm if he had his back and Helm says "absolutely". Helm says" I would take a bullet for you boys."

Helm asked Torres when he has ever not shown them he doesn't have their back. Torres replied

"what I just heard tonight". (Referring to the phone call between Helm and Cheatham).

Helm said he was pissed because when he's hearing "I don't remember all we did was a movie shoot, we did way more than a movie shoot". Torres says fine Ray, but I don't think I should get fired for that.

Helm tell Torres to hold up, He's not firing anybody for anything. Helm then says he told Cheatham all Donny remembers is a movie shoot, what do you remember?

Helm says Cheatham says we did some training exercises and we did some night time stuff and I said yea we spent over 5 hours; we spent over 10 hours on that scene. Helm says 10 hours and I gave y'all 5 hours of training credit and Griffin is coming in here saying he don't remember shit.

Torres then tells Helm to call Griffin and get it over with. Helm responds with, it doesn't work that way. He is in a criminal investigation and he's gonna smear me anyway he can, that's the way it works. Helm says" This is politics season, I'm stressed, you're stressed, Cody is stressed, David's stressed, Darrell is stressed and the whole god damn world is fucking stressed, alright''.

Helm tells Torres, he and Cody are my lead guys; y'all got the most experience in that office. Kaley and John {Kaley Gassman and John Shellhorn) are just between you, me and the fence posts, their gophers and we were all gophers at one time until we got over 6 years, agreed7

Helm then says we (Helm, Griffin, Cheatham and Torres) spent a lot of time on that "set" that day. Doing what we could to learn and I wrote up that lesson plan, its 8 pages long.

Helm tells Torres, Axelrod is claiming Griffin was never there. You and I both know that's bullshit and I don't need memory lapses over this. I really don't.

Helm then references a scenario where they utilized the drone for a Republic of Texas suspect. Helm says without that training we would not have known what to do, agreed? Tell me I'm wrong.

Torres then responds after a pause "If I tell you you're wrong, then I'm fired". Helm tells Torres he would neverfire him.

The conversation continued and Helm asked Torres if he had heard from Griffin. Helm said Cheatham told him Gary had Cheat ham's back and he was protecting him. Torres tells Helm he doesn't see how it's a big deal.

Helm then tells Torres he is "scared to fucking death, dude". Torres then asked him of what and Helm responded "of losing this race, this is my life, this is my kid's life, this is my family's life".

Torres then tells Helm he should ask for help. Helm tells Torres he doesn't ask for help, but he is

scared to death.

Torres asks Helm what he needs help with and Helm responds "just from the assholes". Helm tells Torres he does the best job he can and in his best ability and Gary Griffin is an "evil mother fucker". Helm says I don't need y'all tied to that asshole. Torres responds "were not''.

Helm tells Torres, of all t he people in the Constable's Office, he trust Torres more than anyone, even Darrell. Torres asked Helm if he really meant that and Helm responds "yea I do". Helm tells him that's why he's hard on Cody and Torres.

Helm says he doesn't know Cheatham well enough to put my life for him, but I do know you. Helm begins sobbing and telling Torres it affects him if Cheatham wins his Constable's race he

will take Torres with him.

Helm tells Torres again of all the people he had to trust it would be him. Helm tells Torres this is why you bring people in you can't trust. You just don't bring in random people. This isn't a PD or a Sheriff's Office.

Torres asks Helm what they can do the following week and Helm said they would just play it by ear. Helm then says "that fucking Gary Griffin".

Helm then reiterates to Torres that he can claim the drone class all day long; they were out

there for it. Helm says the body cam one, we justified that one.

Helm says the lesson plan is in there and you can view it and get acclimated with it, but "god damn it" we were there.

Helm then says to Torres he has their back and he always has and says Gary Griffin, "that mother fucker needs to go." Torres tells Helm to lay low and then Helm tells Torres Darrell is loyal and Helm owes him a lot, but he owes a lot more to Torres. Helm then says Cody, we hired on and brought him in and he's running a race, big deal. Helm then says "John is just John, Katey is just Kaley. Keith is a gopher". Helm then tells Torres if anyone in there you know this job, you know the admin of it, you know what it takes and you know this shit probably more than I do. Were two of the most educated mother fuckers in there.

The call then ends abruptly.

I traveled to Hays County IT Department and met with Mr. Jeff McGill, IT Manager. Mr. McGill produced two (2) thumb drives containing the infonnation requested through TCOLE Subpoena. Those thumb drives were identified as:

March 41 2020

I traveled to the Pastrano Law Finn and met with Deputy John Shellhorn, Hays County Constable Office, PCT 3. Shellhorn provided a statement regarding TCOLE Case Number 20-02-I 285 at approximately 1254 hours. The recorded statement will be included with the case file. The following is a summary of the statement and is not intended to be a transcript.

Shellhorn advised there was an occasion he was in Helms office with Helm and Darrell Ayres. Shellhorn stated this happened on February 21, 2020. Ayres and Helm were talking about everything that is going on in the office. Ayres was pointing the finger at Cody Cheatham say he was the Nrat" .

Shellhorn made the comment he can leave, he doesn't have to be involved in all of this (referencing who is the rat), and they told him he can stay.

Shellhorn said after he left the meeting he made contact with and told Cheatham they were blaming him. Shellhorn said Helm wanted to come up with a scenario of how to figure out who the rat was.

The scenario was that Helm was going to quit the Constables Office and they were going to appoint Shellhorn into the Constable position and finish the unexpired term. That's how the lie was going to be and see how it came back through. In an attempt to smoke out the "rat", by putting out a false story and see who repeats it.

Shellhorn told Helm he would do it and then went home and started thinking about it and thought to himself he likes Cheatham and Torres, he doesn't have any beef with those two. Shellhorn then decided not to do it. Helm contacted Shellhorn after that and said he was going to do it. Shellhorn told Helm if you want to find out who the rat is then you do it yourself.

Shellhorn felt Helm asked him to do that because he and Helm had been friends so long. Plus, at the meeting Shellhorn said he would do it. Shellhorn said he and Helm had been friends since 1994.

Shellhorn went on to say the only thing Helm has ever mentioned about the drone class was at lunch. Helm asked him if Cheatham said anything about the drone class.

Shellhorn told Helm he thought Cheatham said the drone class was training and they went through scenarios. Helm then asked Shellhorn if he would put that in a statement for him saying Cheatham said that. Shellhorn told Helm he would but never did.

l asked Shellhorn if anyone had ever asked him to record a conversation and he said no.

Shellhorn said the only thing Helm has asked him to do was put out the false story in order to find out who the leaker was.

Shellhorn then changed his story and said the false story got brought up in a meeting between Shellhorn, Helm and Matthew Farris. Farris is office personnel (but also has a telecommunicator license and is Ayres god son). Shellhorn said when it was Helm, Shellhorn and Ayres all that was talked about was who the rat was.

The meeting with Helm, Shellhorn and Farris was a second meeting. In this meeting is when Helm wanted Shellhorn to put out the false narrative.

Helm ultimately told Shellhorn he went to a "meet and greet" for Cheatham's own Constable Campaign (Cheatham was running for Hays County Constable, PCT 1). This is when Helm told Cheatham about leaving office.

I then asked Shellhorn about the meeting that occurred after Captain Skolaut left (02/11/20). Shellhorn said Helm called everyone in and Cheatham and Torres make the statement they couldn't be there for this and left.

Helm made the ~mment "I don't know why they took off', "I was just gonna tell th.em nothing came from what they came here to investigate". Shellhorn said that was it and the meeting was over.

March 5, 2020

I reviewed the two thumb drivers received from Hays County IT Manager Jeff McGill. The thumb drives contained no evidentiary value through the content reviewed.

CONCLUSION

Based on Interviews of witnesses and Ray Helm, PIO this investigation revealed that Constable Ray Hehn. Hays County Constables Office, PCT 3, submitted fraudulent documents to the Texas Commission on Law Enforcement pertaining to Drone Training on April 10, 2018.

During the February I 0, 2020 interview with Donny Torres, PIO Hays County Constables Office, PCT 3, he stated when the Deputy Constables arrived on location "they had movie equipment set up". Torres even states they were told they would be filming a commercial for a drone company. Torres also went on to say it was not a typical TCOLE class he was used to.

Gene Robinson, Owner/Instructor Drone Pilot, Inc. went on to say it was never purported to be training to Constable Helm. Robinson said it was actually the opposite, Constable Helm was told it was a commercial for a Drone company.

Robinson advised there was a production crew on site and they would instruct Robinson and another owner of Drone Pilot Inc. John Buell where they needed to send the Constables and what they needed to do.

Robinson said Constable Hehn contacted him on/or around February l Jth or 121\ 2020 stating he needed scenarios for the drone class because he was under investigation for the 5 hours of training. Robinson then emailed Constable Helm 3 scenarios to Constable Helm's personal email address (

Corporal Cody Cheatham was interviewed and when he arrived on scene he asked "what is going on, are we filming", and the response was "yes for an ad or commercial for the drone". Cheatham advised there was no skills test; they didn't have to show proficiency in anything and they did not sign a roster. Cheatham explained there was a time they did feel like they were actors.

When Corporal Cheatham retained counsel due to TCOLE Investigators questioning officers and Helm was made aware ofit he responded "ok, I guess I'm screwed".

Furthennore, Corporal Cheatham was shown the four ( 4) evaluation forms from the training file retrieved from Helm and he responded he has never seen those docwnents before and he did not fill any of those documents out.

Deputy Donny Torres was shown the same documents during his second interview and he to responded he has never seen those fonns and he did not complete one,

Gary Griffin, who was Constable Helm's Sergeant, was interviewed and he advised when the officers got on scene they were briefed by Gene Robinson, who told them they were shooting a Public Service Announcement for a new drone.

Griffin was shown the evaluation forms from the training packet Helm provided. Griffin said none of the forms were of his doing. He stated when he fills out evaluation forms he always writes comments. The only forrn with writing in the comments section was not Griffin's handwriting. Griffin ended his interview by stating he and Helm never had a conversation about the training, as indicated in the memorandum dated 04/10/18 Constable Helm provided. He also stated it was a commercial and he never filled out an evaluation.

During Constable Ray Helm's interview, he had his attorney, Kent "Bud" Wymore present during the interview. Helm initially told Investigators the only people at the location were Helm and his deputies, along with Buell/Robinson. Although, later in the interview he admitted there was production staff on scene as well.

Helm stated they did not receive any certificates for the training and that is why he got with Gary Griffin on how to submit the training.

When I produced the evaluation forms Helm gave to Captain Skolaut, Helm advised the one with writing on it was his and the other three (3) belonged to Griffin, Cheatham and Torres. Helm further stated, the deputies filled them out and he collected them the next day. I then read the memorandum dated 04/10/18 out loud and Helm said he created the document on that date.

Helm went on to say Robinson purported it to be training, with some filming involved. We learned this not to be true by Gene Robinson's statement saying just the opposite. It was never purported to be training.

Once Helm was through giving his explanation of the event, I made the comment to Helm that the officers did not fill out the evaluations and he responded "uh hmm". I then told Helm he needed to be honest and he said he filled out one evaluation and the other three were filled out by the officers.

Helm did finally admit he fabricated the evaluation forms and the memorandum dated 4/18/18. Helm went on to say he generated the documents on or around February 10, 2020. It is worth noting the weekend prior to the 10111 of February would have been the time frame Helm found out through Axelrod the "Drone training" was brought into question.

In conclusion, Helm fabricated documents (4 evaluation forms and a memorandum) to memorialize a training class that was nothing more than a commercial for a drone company. The only person out of all the individuals interviewed saying it was training is Constable Helm; all others immediately responded it was a commercial. Helm ultimately confessed to the fabrication of those said documents.
