The referenced property is located within the Edwards Aquifer Recharge Zone. This property is exempt from a WP AP because it is not a regulated activity according to §213.5(h)(2) "exempt ... does not exceed 20% impervious cover on the site. To my knowledge no WP AP exists for this property.
Temporary erosion and sedimentation controls should be utilized as necessary prior to construction. If any sensitive feature (caves, solution cavities, sink holes, etc.) is discovered during construction, activities must be suspended immediately and the applicant or his agent must immediately notify the TCEQ Regional Office. I The Texas Health and Safety Code, Chapter 366 authorizes the Texas Commission on Environmental Quality (TCEQ) to regulate on-site sewage facilities (OSSFs). Additionally, the Texas Water Code (TWC), § 5.012 and§ 5.013, gives the commission primary responsibility for implementing the laws of the State of Texas relating to water and adopting rules necessary to carry out its powers and duties under the TWC. The commission, under the authority of the TWC and the Texas Health and Safety code, requires owner's to provide notice to the public that certain types ofOSSFs are located on specific pieces ofproperty. To achieve this notice, the commission requires a recorded affidavit. Additionally, the owner must provide proof of the ~~C~/ recording to the OSSF permitting authority.
