SUBPART A - GENERAL 143.001 Applicability

1. This part prescribes the requirements governing the certification and operation of ATS training provider.

2. The course for which application is made under paragraph 1 of this

section may be for ATS personnel approved by the Director. 143.002 Definitions

As used in this part; Core Curriculum A set of courses approved by the Director, for use by an ATS training provider and its satellite ATS training providers. The core curriculum consists of training which is required for certification. It does not include training for tasks and circumstances unique to a particular user. Course 1. A program: of instruction to obtain ATS certification, qualification,

authorization, or currency;

2. A program of instruction to meet a specified number of requirements of a program for ATS training, certification, qualification, authorization, or currency; or

3. A curriculum, curriculum segment or component, required. Courseware Instructional material developed for each course or curriculum, including lesson plans, flight event descriptions, computer software programs, audiovisuals programs, workbooks, and handouts or training displays.

Evaluator A person who is authorized by the Director to performs tests for certification, added ratings, proficiency checks and to administer such checks and tests.

Simulator/training device A simulator, as defined in 143.030.1 of this part, or training device, as defined in 143.030.2 of this part. Instructor A person employed by a training center and designated to provide instruction in accordance with subpart 143 C of this part. Specialty Curriculum A set of courses that is designed to satisfy a requirement of the CASR and that is approved by the Director for use by a particular training center or satellite ATS training provider. The specialty curriculum includes training requirements unique to one or more training center clients. Training center An organization governed by the applicable requirements of this part that provides training, testing, and checking under contract or other arrangement to ATS subject to the requirements of this CASR.

Training program Courses, courseware, facilities, flight training equipment, and personnel necessary to accomplish a specific training objective. It may include a core curriculum and a specialty curriculum.

Training and checking credit The hours or specific operational areas of an approved course, which may be credited toward the operational work practices requirements of that course.

Training Device Simulator or advanced training device that has been given training and checking credit by the Director. Training specifications A document issued to a training center certificate holder by the Director that prescribes that center’s training, checking, and testing authorizations and limitations, and specifies training program requirements.

143.003 Issue of approval

1. The issuance of an approval for a training organization and the continued validity of the approval shall depend upon the training organization being in compliance with the requirements of this Part.

2. The approval document shall contain at least the following:

a. Organization’s name and location; b. Date of issue and period of validity (where appropriate); c. Terms of approval.

143.004 Certificate and Training Specifications Required

No person may operate an ATS training provider without, or in violation of, a training center certificate and training specifications issued under this part.

143.005 Requirements for an ATS Training Provider Certificate

1. An applicant will be issued an ATS training provider certificate and training specifications with appropriate limitations if the applicant shows that it has adequate facilities, equipment and personnel to conduct the training proposed by the ATS training provider;

2. Completes the application for an ATS training provider certificate

on a form and in a manner prescribed by the Director containing the information outlined in section 143.007 of this part;

3. Each applicant for the original issue of an ATS training provider

certificate who intends to conduct training under this part must submit the following financial information:

a. A balance sheet that shows assets, liabilities, and net worth, as

of a date not more than 60 days before the date of application. b. An itemization of liabilities more than 60 days past due on the

balance sheet date, if any, showing each creditor’s name and address, a description of the liability, and the amount and due date of the liability.

c. An itemization of claims in litigation, if any, against the applicant

as of the date of application showing each claimant's name and address and a description and the amount of the claim.

d. A detailed projection of the proposed operation covering 6 complete months after the month in which the certificate is expected to be issued including

1) Estimated amount and source of both operating and non

operating revenue, including identification of its existing and anticipated income producing contracts;

2) Estimated amount of operating and non operating

expenses by expense objective classification; and

3) Estimated net profit or loss for the period.

e. An estimate of the cash that will be needed for the proposed operations during the first 6 months after the month in which the certificate is expected to be issued, including a full explanation on the following;

1) Acquisition of property and equipment; 2) Retirement of debt; 3) Additional working capital; 4) Operating losses other than depreciation and amortization;

and 5) Other subjects as considered significant by the Director.

f. An estimate of the cash that will be available during the first 6

months after the month in which the certificate is expected to be issued, giving full explanation of;

1) Sale of property or flight equipment; 2) New debt; 3) New equity; 4) Working capital reduction; 5) Operations (profits); 6) Depreciation and amortization; and other

g. A schedule of insurance coverage in effect on the balance sheet date showing insurance companies; policy numbers; types, amounts, and period of coverage; and special conditions, exclusions, and limitations.

h. Any other financial information that the DGCA requires to

enable him or her to determine that the applicant has sufficient financial resources to conduct his or her operations with the degree of safety required in the public interest.

4. Each holder of an ATS training provider certificate shall submit a

financial report for the first 6 months of each fiscal year and another financial report for each complete fiscal year.

5. Each financial report containing financial information required by

paragraph 4 of this section must be based on accounts prepared and maintained on an accrual basis in accordance with generally accepted accounting principles applied on a consistent basis, and must contain the name and address of the applicant's public accounting firm, if any. Information submitted must be signed by an officer, owner, or partner of the applicant or certificate holder.

143.006 Training Procedures Manual

1. An applicant for an ATS training provider approval shall prepare a Training Procedures Manual. Each manual shall be specifically identified and shall include at least the following:

a. a system for amendments; b. manual holder name and copy number; c. a general description of the scope of training authorized under

the organization’s terms of approval; d. the content of the training programmes offered including the

courseware and equipment to be used; e. a description of the procedures used to establish and maintain

the competence of instructional personnel;

f. a description of the method used for the completion and retention of the training records

g. a description of the organization’s quality control system;

h. an organizational chart, showing the responsibility and reporting levels of each member of the organization;

i. a description of the duties and responsibilities of the reporting

levels listed on the organizational chart; j. a simple floor plan of the facility, showing the location of the,

classrooms and offices, and a general description of facilities; k. instructor qualifications; l. a description of the quality control system that ensures the

policies and procedures are effectively in place; m. a copy of the course curriculum; n. sample copies of examination questions, which shall reflect all

subjects taught; o. an explanation of the means by which a student’s attendance

and grades can be verified; p. a description of any exceptions to attendance requirements; q. procedures for development of examinations; r. a copy of the graduation certificate; s. a list of the names and signatures of all individuals authorized to

sign certificates, forms and letters; t. a description of the course prerequisites for basic training; u. a list of reference material; v. a description of training aids available for basic training.

2. The training organization shall ensure that the training and

procedures manual is amended as necessary to keep the information contained therein up to date.

3. Copies of all amendments to the training and procedures manual

shall be furnished promptly to all organizations or persons to whom the manual has been issued.

143.007 Application for Issuance or Amendment

1. An application for an ATS training provider certificate and training specifications shall

a. Be made on a form and in a manner prescribed by the Director; b. Be made at least 120 calendar days before the beginning of any

proposed training or 60 calendar days before effecting an amendment to any approved training, unless a shorter filing period is approved by the Director.

2. Each application for an ATS training provider certificate and training

specification shall provide

a. A statement showing that the minimum qualification requirements for each management position are met or exceeded;

b. A statement acknowledging that the applicant shall notify the

Director within 10 working days of any change made in the assignment of persons in the required management positions;

c. The proposed training authorizations and training specifications

requested by the applicant;

d. The proposed evaluation authorization;

e. A description of the ATS training equipment that the applicant proposes to use;

f. A description of the applicant’s training facilities, equipment,

qualifications of personnel to be used, and proposed evaluation plans;

g. A training program curriculum, including syllabi, outlines,

courseware, procedures, and documentation to support the items required in subpart B of this part, upon request by the Director,

h. A description of a record keeping system that will identify and

document the details of training, qualification, and certification of students, instructors, and evaluators;

i. A description of quality control measures proposed; and

j. A method of demonstrating the applicant's qualification and ability to provide training for a certificate or rating in fewer than the minimum hours, if the applicant proposes to do so.

3. The facilities and equipment described in paragraph 2.f. of this

section shall

a. Be available for inspection and evaluation prior to approval; and b. Be in place and operational at the location of the proposed ATS

training provider prior to issuance of a certificate under this part.

4. An applicant who meets the requirements of this part and is approved by the Director is entitled to

a. An ATS training provider certificate containing all business

names included on the application under which the certificate holder may conduct operations and the address of each business office used by the certificate holder; and

b. Training specifications, issued by the Director to the certificate

holder, containing :

1) The type of training authorized, including approved courses;

2) For each simulator and training device subject to

qualification evaluation by the Director;

3) The name and address of all satellite ATS training providers, and the approved courses offered at each satellite ATS training provider;

4) Authorized deviations or waivers from this part; and

5) Any other items the Director may require or allow.

5. At any time, the Director may amend an ATS training provider

certificate

a. On the Director’s own initiative, or b. Upon timely application by the certificate holder.

6. The certificate holder must file an application to amend an ATS training provider certificate at least 60 calendar days prior to the applicant's proposed effective amendment date unless a different filing period is approved by the Director.

143.008 Location of Facilities.

The holder of a ATS training provider certificate may have a base or other facilities located outside the Republic of Indonesia, provided the Director determines the location of the base and facilities at that place are needed for the training of students who are citizens of Indonesia.

143.009 Business Office and Operations Base.

1. Each holder of an ATS training provider certificate must maintain a principal business office with a mailing address in the name shown on its certificate.

2. The facilities and equipment at the principal business office must be

adequate to maintain the files and records required to operate the business of the organization.

3. The principal business office may not be shared with, or used by,

another ATS training provider.

4. Before changing the location of the principal business office or the operations base, each certificate holder must notify the Director, and the notice must be:

a. Submitted in writing at least 30 days before the change of

location; and b. Accompanied by any amendments needed for the certificate

holder's approved training course outline.

5. A certificate holder may conduct training at an operations base other than the one specified in its certificate, if:

a. The Director has inspected and approved the base for use by

the certificate holder; and b. The course of training and any needed amendments have been

approved for use at that base.

143.010 Management and Personnel Requirements

An applicant for an ATS training provider certificate must show that 1. For each proposed curriculum, the ATS training provider has, and

shall maintain, a sufficient number of instructors who are qualified in accordance with subpart C of this part to perform the duties to which they are assigned;

2. The ATS training provider has designated, and shall maintain, a

sufficient number of approved evaluators to provide required checks and tests to graduation candidates within 7 calendar days of training completion for any curriculum leading to licenses;

3. The ATS training provider has, and shall maintain, a sufficient

number of management personnel who are qualified and competent to perform required duties; and

4. A management representative, and all personnel who are designated

by the training center to conduct direct student training, are able to understand, read, write, and fluently speak the English language.

143.011 Facilities

1. An applicant for, or holder of, an ATS training provider certificate shall ensure that

a. Each room, training booth, or other space used for instructional

purposes is climatically controlled, ventilated and lighted to conform to local building, sanitation, and health codes, and

b. The facilities used for instruction are not routinely subject to

significant distractions caused by flight operations and maintenance operations at the airport.

2. An applicant for, or holder of, an ATS training provider certificate

shall establish and maintain a principal business office that is physically located at the address shown on its ATS training provider certificate.

3. The records required to be maintained by this part must be located in

facilities adequate for that purpose.

4. An applicant for, or holder of, an ATS training provider certificate must have available exclusively, for adequate periods of time and at a location approved by the Director, adequate ATS training equipment and courseware, including at least one simulator or advanced ATS training device.

5. An ATS training provider certificate may be issued to an applicant

having a business office or ATS training provider located outside Indonesia.

143.012 Quality Control System

1. A quality control system shall be established to ensure that the policies and procedures described in the Training Procedures Manual are effectively in place.

2. The ATS training provider shall appoint a person who will be

responsible to ensure the integrity of the quality control program.

3. The person appointed in accordance with paragraph 2 of this section shall have:

a. Experience as a trainer and / or administrator at a recognized

training center; b. Demonstrated ability to administer a quality control program.

4. Each ATS training provider must meet the following requirements:

a. Comply with its approved training course; and b. Provide training of such quality that meets the requirements of

this part.

5. The failure of an ATS training provider to maintain the quality of training specified in paragraph 4 of this section may be the basis for suspending or revoking that organization's certificate.

6. When requested by the Director, an ATS training provider must allow

the DGCA to administer any knowledge test, practical test, stage check, or end-of-course test to its students.

7. When a stage check or end-of-course test is administered by the

DGCA under the provisions of paragraph 6 of this section, and the student has not completed the training course, then that test will be

based on the standards prescribed in the organization's approved training course.

8. When a practical test or knowledge test is administered by the DGCA under the provisions of paragraph 6 of this section, to a student who has completed the organization's training course, that test will be based upon the areas of operation approved by the Director General.

143.013 Satellite ATS Training Providers

1. The holder of an ATS training provider certificate may conduct training in accordance with an approved training program at a satellite ATS training provider if

a. The facilities, equipment, personnel, and course content of the

satellite ATS training provider meet the applicable requirements of this part;

b. The Instructors and evaluators at the satellite ATS training

provider are under the direct supervision of management personnel of the principal training center;

c. The Director is notified in writing that a particular satellite is to

begin operations at least 60 days prior to proposed commencement of operations at the satellite ATS training provider; and

d. The certificate holder's training specifications reflect the name

and address of the satellite ATS training provider and the approved courses offered at the satellite ATS training provider.

2 The certificate holder's training specifications shall prescribe the

operations required and authorized at each satellite ATS training providers.

143.014 Display of Certificate

1. Each holder of an ATS training provider certificate must prominently display that certificate in a place accessible to the public in the principal business office of the ATS training provider.

2. An ATS training provider certificate and training specifications must

be made available for inspection upon request by

a. An authorized representative of the Director;

b. An authorized representative of the National Transportation Safety Committee, or

c. A law enforcement officer.

143.015 Oversight

1. DGCA will maintain an effective oversight programme of the approved ATS training provider’s to ensure continuing compliance with the approval requirements.

2. The Director inspects each certificate holder every 5 years, in order

to determine compliance with or to determine initial or continuing eligibility and the ATS training provider's certificate and training specifications.

3. Except as provided in paragraph 2, each certificate holder must allow

the Director to inspect ATS training provider facilities, equipment, and records at any reasonable time and in any reasonable place.

143.016 Evaluation and Checking

When DGCA has authorized an approved ATS training provider’s to conduct the testing required for the issuance of a licence or rating, the testing shall be conducted by personnel authorized by the Licensing Authority or Sub Directorate Air Traffic Management DGCA or designated by the ATS training provider’s in accordance with criteria approved by DGCA.

143.017 Advertising Limitations

1 The holder of an ATS training provider certificate may not make any statement relating to its certification that is false or designed to mislead any person contemplating enrollment in that organization.

2. The holder of an ATS training provider certificate may not advertise

that the organization is certified unless it clearly differentiates between courses that have been approved under part 143 and those that have not been approved under part 143.

3. The holder of an ATS training provider certificate must promptly

remove:

a. From vacated premises, all signs indicating that the organization was certified by the Director; or

b. All indications (including signs), wherever located, that the organization is certified by the Director when its certificate has been surrendered, suspended, or revoked.

143.018 Deviations or Waivers

1. The Director may issue deviations or waivers from any of the requirements of this part.

2. An ATS training provider applicant requesting a deviation or waiver

under this section must provide the Director with information acceptable to the Director that shows

a. Justification for the deviation or waiver; and b. That the deviation or waiver will not adversely affect the quality

of training or checking. 143.019 Validity, Suspension, Revocation and Surrender of an ATS Training

Provider Certificate

1 Every ATS training provider certificate shall be considered valid and in force unless;

The holder voluntarily surrenders it to the Director; The Director decides to suspend or revoke the certificate either in whole or in part; The ATS training provider knowingly violates a provision of its ATS training provider certificate.

2 Where an ATS training provider certificate has been suspended or

revoked, it shall be returned to the Director within seven days of receiving notice of suspension or revocation.

3. Where an ATS training provider is returned to the Director pursuant

to 1 and 2 of this section, the holder must also include a statement confirming compliance with the limitations of 143.007 in this Part.

SUBPART B - ATS CURRICULUM AND SYLLABUS REQUIREMENTS 143.020 Applicability

This subpart prescribes the curriculum and syllabus requirements for the issuance of an ATS training provider certificate and training specifications for training, testing and checking conducted.

143.021 Approval of ATS training program

1. Except as provided in paragraph 2 of this section, each applicant for, or holder of, an ATS training provider certificate must apply to the Director for training program approval.

2. Application for ATS training program approval shall be made in a form and in a manner acceptable to the Director.

3. Each application for ATS training program approval must indicate

which courses are part of the core curriculum and which courses are parts of the specialty curriculum;

4. If, after a certificate holder begins operations under an approved ATS

training program, the Director finds that the certificate holder is not meeting the provisions of its approved ATS training program, the Director may require the certificate holder to make revisions to that ATS training program.

5. If the Director requires a certificate holder to make revisions to an

approved ATS training program and the certificate holder does not make those required revisions, within 30 calendar days, the Director may suspend, revoke, or terminate the training center certificate under the provisions of 143.021 in this part.

143.022 ATS Training Program Curriculum Requirements

Each ATS training program curriculum submitted to the Director for approval must meet the applicable requirements of this part and must contain

1. A syllabus for each proposed curriculum; 2. Minimum training equipment requirements for each proposed

curriculum; 3. Minimum instructor and evaluator qualifications for each proposed

curriculum;

4. A curriculum for initial training and continuing training of each instructor or evaluator employed to instruct in a proposed curriculum;

5. For each curriculum that provides for the issuance of a license

a. A means of demonstrating the ability to accomplish such training in the number of hours; and

b. A means of tracking student performance.

143.023 Enrollment.

1. The holder of an ATS training provider certificate must, at the time a student is enrolled in an approved training course, furnish that student with a copy of the following:

a. A certificate of enrollment containing

1). The name of the course in which the student is enrolled;

2). The date of that enrollment.

b. .A copy of the student's training syllabus. 2. The holder of an ATS training provider certificate must maintain a

monthly listing of persons enrolled in each training course offered by the organization.

143.024 Graduation certificate.

1. The holder of an ATS training provider certificate must issue a graduation certificate to each student who completes its approved course of training.

2. The graduation certificate must be issued to the student upon

completion of the course of training and contain at least the following information:

a. The name of the organization and the certificate number of the

organization; b. The name of the graduate to whom it was issued; c. The course of training for which it was issued; d. The date of graduation; and

e. A statement that the student has satisfactorily completed each required stage of the approved course of training including the tests for those stages.

SUBPART C – ATS TRAINING COURSE OUTLINE AND CURRICULUM 143.025 Applicability

This subpart prescribes the personnel and ATS training equipment requirements for a certificate holder.

143.026 Training for Instructional Personnel

The training organization shall ensure that all instructional personnel receive initial and continuation training appropriate to their assigned tasks and responsibilities. The training program established by the training organization shall include training in knowledge and skills related to human performance.

143.027 ATS Training Provider Instructor Eligibility Requirements

1. A certificate holder may not employ a person as an instructor in an ATS training course that is subject to approval by the Director unless that person

a. Is at least 24 years of age; b. Is able to read, write, and speak and understand in the English

language; c. Is approved by the Director; and d. Satisfies the requirements of paragraph 3 of this section;

e. Minimum 3 years has field experience in ATS.

2. An ATS training provider must designate each instructor in writing to

instruct in each approved course, prior to that person functioning as an instructor in that course.

3. Prior to initial designation, each instructor shall:

a. Complete training on the following subject matter:

1). Instruction methods and techniques 2). Training policies and procedures

3). The fundamental principles of the learning process

4). Instructor duties, privileges, responsibilities, and limitations 5). Proper operation of simulation controls and systems

6). Proper operation of environmental control and warning or

caution panels

7). Limitations of simulation

8). Minimum equipment requirements for each curriculum 9). Revisions to the training courses

b. Satisfactorily complete a written test

1). On the subjects specified in paragraph 3.a of this section; and

2). That is accepted by the Director as being of equivalent difficulty, complexity, and scope as the tests provided by the Director for the ATS instructor knowledge tests.

143.028 ATS Training Provider Instructor and Evaluator Privileges and

Limitations

1. A certificate holder may allow an instructor to provide:

a. Instruction for each curriculum for which that instructor is qualified.

b. Testing and checking for which that instructor is qualified.

c. Instruction testing and checking intended to satisfy the

requirements of any part of CASR. 2 An ATS training provider, whose instructor or evaluator is designated

in accordance with the requirements of this subpart to conduct training, testing, or checking in qualified and approved ATS training equipment, may allow its instructor or evaluator to recommend for issue, endorsements required.

3 An ATS training provider may not allow an instructor to

a. Conduct more than 8 hours of instruction in any 24-consecutive-hour period, excluding briefings and debriefings;

b. Provide ATS training equipment instruction unless that instructor meets the requirements of 143.029.1.c, 143.029.1.d and 143.029.1.e as applicable; or

c. Provide instruction in an ATS Simulator unless that instructor

meets the requirements of 143.029.1.c, 143.029.1.d and 143.029.1.e

143.029 ATS Training Provider Instructor Training and Testing Requirements

1. Except as provided in paragraph 3 of this section, prior to designation and every 12 calendar months beginning the first day of the month following an instructor initial designation, a certificate holder must ensure that each of its instructors meets the following requirements:

a. Each instructor must satisfactorily demonstrate to an authorized

evaluator knowledge of, and proficiency in, instructing in a representative segment of each curriculum for which that instructor is designated to instruct under this part.

b. Each instructor must satisfactorily complete an approved course

in at least

1). The fundamental principles of the learning process; 2). Elements of effective teaching, instruction, methods, and

techniques;

3). Instructor duties, privileges, responsibilities, and limitations; 4). Training policies and procedures; and

5). Evaluation.

c. Each instructor who instructs in a qualified and approved ATS

Simulator or ATS training device must satisfactorily complete an approved course of training in the operation of the ATS Simulator, and an approved course of ground instruction, applicable to the training courses the instructor is designated to instruct.

d. The ATS Simulator training course required by paragraph 1. c.

of this section which must include

1). Proper operation of ATS Simulator and ATS training device controls and systems;

2). Proper operation of environmental and fault panels;

3). Limitations of simulation; and

4). Minimum equipment requirements for each curriculum.

e. Each ATS instructor who provides training in an ATS Simulator must satisfactorily complete an approved course of ground instruction and training in an ATS Simulator, ATS Unit or ATS training device.

f. The approved course of ground instruction and training required

by paragraph 1. e of this section which must include instruction in 1). Performance and analysis of ATS training applicable to

the training courses that the instructor is designated to instruct;

2). Technical subjects covering ATS Simulator subsystems

and operating rules applicable to the training courses that the instructor is designated to instruct;

3). Emergency operations;

4). Emergency situations likely to develop during training;

and

5). Appropriate safety measures.

g. Each instructor who instructs in qualified and approved ATS training equipment must pass a written test and annual proficiency check

1). In the ATS training equipment in which the instructor will

be instructing; and 2). On the subject matter of a representative segment of

each curriculum for which the instructor will be instructing.

2. An instructor who satisfactorily completes a curriculum required by

paragraph 1of this section in the calendar month before or after the month in which it is due is considered to have taken it in the month in which it was due for the purpose of computing when the next training is due.

3. The Director may give credit for the requirements of paragraph 1 of this section to an instructor who has satisfactorily completed an instructor training course if the Director finds such a course equivalent to the requirements of paragraph 1 of this section.

143.030 ATS Training Provider Evaluator Requirements

1. An ATS training provider must ensure that each person authorized as an evaluator,

a. Is approved by the Director; b. Is in compliance with 143.028; and c. Prior to designation, and except as provided in paragraph 2 of

this section, every 12-calendar-month period following initial designation, the certificate holder must ensure that the evaluator satisfactorily completes a curriculum that includes the following:

1). Evaluator duties, functions, and responsibilities; 2). Methods, procedures, and techniques for conducting

required tests and checks;

3). Evaluation of ATS personnel performance; and

4). Management of unsatisfactory tests and subsequent corrective action; and

d. If evaluating in qualified and approved ATS training equipment

must satisfactorily pass a written test and annual proficiency check in an ATS Simulator in which the evaluator will be evaluating.

2. An evaluator who satisfactorily completes a curriculum required by

paragraph 1 of this section in the calendar month before or the calendar month after the month in which it is due is considered to have taken it in the month is which it was due for the purpose of computing when the next training is due.

3. The Director may give credit for the requirements of paragraph 1. c of

this section to an evaluator who has satisfactorily completed an evaluator training course if the Director finds such a course equivalent to the requirements of paragraph 1.c of this section.

143.031 ATS Simulators and ATS Training Devices

1. Each ATS Simulator used to obtain ATC training credit allowed for ATS Simulators in an approved ATS training course curriculum must have been evaluated, qualified, and approved by the Director.

2. Each ATS training device used to obtain ATS training credit allowed

for ATS training devices in an approved ATS training course curriculum must have been evaluated, qualified, and approved by the Director.

3. Each training aid, including any computer based audio visual aid,

mock-up, or chart listed in the approved training course outline, must be accurate and appropriate to the course for which it is used.

4. An applicant for, or holder of, an ATS training provider certificate

must show that each ATS Simulator and ATS training device used for training, testing, and checking must be approved by the Director for each curriculum or training course in which the ATS Simulator or ATS training device is used, if that curriculum or course is used to satisfy any requirement of CASR.

5. Each qualified and approved ATS Simulator or ATS training device

used by an ATS training provider must

a. Be maintained to ensure the reliability of the performances, functions, and all other characteristics that were required for qualification;

b. Be modified to conform with any modification, if the modification

results in changes to performance, function, or other characteristics required for qualification; and

c. Have a discrepancy log in which the instructor or evaluator, at

the end of each training session, enters each discrepancy. 6. Unless otherwise authorized by the Director, each component on a

qualified and approved ATS Simulator or ATS training device used by an ATS training provider must be operative if the component is essential to, or involved in, the training, testing, or checking of ATS personnel.

SUBPART D - OPERATING RULES 143.032 Applicability

This subpart prescribes the operating rules applicable to an ATS training provider certificated under this part and operating a course or ATS training program curriculum approved in accordance with subpart B of this part.

143.033 Privileges

A certificate holder may allow ATS Simulator instructors and evaluators to meet recency of experience requirements through the use of a qualified and approved ATS Simulator or qualified and approved ATS training devices if that ATS Simulator or ATS training device is 1. Used in a course approved in accordance with subpart B of this part; 2. Approved for meeting recency of experience requirements.

143.034 Limitations

1. The holder of an ATS training provider certificate may not recommend a trainee for a license, unless the trainee

a Has satisfactorily completed the appropriate training specified in

the course approved under this part; and b Has passed the appropriate final tests required by this part.

2. The holder of an ATS training provider certificate may not graduate a

student from a course unless the student has satisfactorily completed the curriculum requirements of that course.

SUBPART E - RECORD KEEPING 143.035 Applicability

This subpart prescribes the ATS training provider record keeping requirements for trainees enrolled in a course, and instructors and evaluators designated to instruct a course, approved in accordance with subpart B of this part.

143.036 Record Keeping Requirements

1. A certificate holder must maintain a record for each trainee that contains

a. The name of the trainee; b. A copy of the trainee's licenses if any, and medical certificate;

c. The name of the course and the make and model of ATS

training equipment used;

d. The trainee's prerequisite experience and course time completed;

e. The trainee's performance on each lesson and the name of the

instructor providing instruction;

f. The date and result of each end-of-course practical test and the name of the evaluator conducting the test; and

g. The number of hours of additional training that was

accomplished after any unsatisfactory practical test.

2. A certificate holder shall maintain a record for each instructor or evaluator designated to instruct a course approved in accordance with subpart B of this part that indicates that the instructor or evaluator has complied with the requirements of this part, as applicable.

3. The certificate holder shall

a. Maintain the records required by paragraphs 1 of this section for at least 3 years following the completion of training, testing or checking;

b. Maintain the qualification records required by paragraph 2 of

this section while the instructor or evaluator is in the employ of the certificate holder and for 3 years thereafter; and

c. Maintain the recurrent demonstration of proficiency records

required by paragraph 2 of this section for at least 3 years.

4. The certificate holder must provide the records required by this section to the Director, upon request and at a reasonable time, and shall keep the records required by

a. Paragraph 1 of this section at the ATS training provider, or

satellite ATS training center where the training, testing, or checking, if appropriate, occurred; and

b. Paragraph 2 of this section at the ATS training provider or

satellite ATS training center where the instructor or evaluator is primarily employed.

5. The certificate holder shall provide to a trainee, upon request and at

a reasonable time, a copy of his or her training records. SUBPART F – OTHER APPROVED COURSES 143.037 Conduct of Other Approved Courses

1. An applicant for, or holder of, an ATS training provider certificate may apply for approval to conduct a course for which a curriculum is not prescribed by this part.

2. The course for which application is made under paragraph 1 of this section may be for ATS personnel approved by the Director.

3. An applicant for course approval under this subpart must comply with

the applicable requirements of subpart A through subpart F of this part.

4. The Director approves the course for which the application is made if

the ATS training provider or ATS training provider applicant shows that the course contain a curriculum that will achieve a level of competency equal to, or greater than, that required by the CASR or parts under which such applicant is operating.
