Box 748 St. Francis, KS 67756 NOTICE O SUSPENSION Dear Mr. Callicrate: This serves as official notification by the Food Safety and Inspect ion Service (FSIS) o f the Suspension o f the Assignment of Inspection personnel at Establishment M40432, Callicrat e Cattle Company located at 95 5 Road 12 , St Francis, Kansas 67756, as per Regulati ons 500.3(b) (Rule s of Practice). The Notice o f Suspension is based on your failure to prevent inhumane handling and slaughter of livestock at your facility. Background/ Authority The Humane Method of Slaughter Act of 1978 (7 U.S.C. 1901-1906) states: he Congress finds that the use of humane methods in the slaughter o f ivestock prevents needless suffering; results in safer nd better working conditions for persons engage d in the slaughter ing ind ustry ; brings about improv ement of he products and economics in slau ghtering operations; an d produce s other benefit s for producers processors nd consumers which ten d to expedite an orderly flow of ivestock and live produ cts in interstate nd oreign commerce. It is therefore declared to be the policy o f he United States that slaughtering o ivestock nd handling o f ivestock in conne ction with slaughter shall be carried out only by humane metho ds. FSIS has developed Rules of Practice regarding enforcement (9 CFR Part 500) that describe the types of enforcement action that FSIS may take and include procedures for taking a withholding action and or suspension, with or without prior notification, and for filing a complaint to withdraw a grant of Federal inspection. As per the Code of Federal Regulations 9 CFR 500.3(b ), FSIS may impose a suspension without providing the establi shment prior notifica tion because the establis hment is handling or slaughtering animals inhumanely. The Federal Meat Inspection Act (FMIA) 21 U.S.C. 603 et seq.) states: For the purpose o f preventing the inhumane slaughtering o f ivesto ck the Secretary shall cause to be made by inspectors appointedfor that purpose an examination nd inspection of he me th od by which cattle sheep swine goats horses mules or other equines are slaughtered nd handle d in connection with slaughte r in the slaughte ring establishments inspected under this Act .
