Chapter 230, the Chapter governing Vehicles and Traffic is amended as follows so as to modify the provision preventing a left turn from Bloomfield Avenue to 115 Bloomfield Avenue between certain hours to preventing a left turn at all times: Amend Section 59, Article V, Prohibited Turns at Intersections as follows: Name of Street Direction Turn Hours At Intersection of of Travel Bloomfield Avenue East Left All Elm Road 2. All Ordinances and/or Resolutions of the Borough of Caldwell, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such inconsistency. 3. WHEREAS, the Borough of Caldwell, pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-7.29(c), may by resolution and without advertising for bids, purchase any goods or services under the State of New Jersey Cooperative Purchasing Program for any State contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury; and WHEREAS, the Borough of Caldwell has the need on a timely basis to purchase goods or services utilizing the Morris County Cooperative Purchasing Council under Contract 15-C Utility Vehicles Item #22; and WHEREAS, the Borough of Caldwell has the need for a 2015 Ford F-350 XL Regular Cab Pickup Truck for the Caldwell Department of Public Works; and WHEREAS, the Borough of Caldwell intends to enter into a contract with Route 23 Ford Commercial Fleet, 1301 Route 23, Butler, New Jersey 07405 through the Morris County Cooperative Purchasing Council for an amount of $39,669.00 as appropriated in Capital Ordinance #1295-14; and WHEREAS, the governing body of the Borough of Caldwell pursuant to N.J.A.C. 5:30-5.5(b), the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Finance Officer: NOW THEREFORE BE IT RESOLVED that the Borough of Caldwell authorizes the Borough Administrator to enter into a contract for the Borough of Caldwell as described herein;

RESOLUTION OF THE GOVERNING BODY OF THE BOROUGH OF CALDWELL AUTHORIZING THE ADOPTION OF THE 2015 ESSEX COUNTY ALL HAZARD MITIGATION PLAN UPDATE

WHEREAS, all of Essex County has exposure to natural hazards that increase the risk to life, property, environment and the County’s economy; and

WHEREAS; pro-active mitigation of known hazards before a disaster event can reduce or eliminate long-term risk to life and property; and

WHEREAS, The Disaster Mitigation Act of 2000 (Public Law 106-390) established new requirements for pre and post disaster hazard mitigation programs; and

WHEREAS; a coalition of Essex County jurisdictions with like planning objectives has been formed to pool resources and create consistent mitigation strategies within Essex County; and

WHEREAS, the coalition has completed a planning process that engages the public, assesses the risk and vulnerability to the impacts of natural hazards, develops a mitigation strategy consistent with a set of uniform goals and objectives, and creates a plan for implementing, evaluating and revising this strategy;

NOW, THEREFORE, BE IT RESOLVED that the Borough of Caldwell:

1) Adopts in its entirety, the 2015 Essex County All Hazard Mitigation Plan Update (the “Plan”) as the jurisdiction’s

Natural Hazard Mitigation Plan, and resolves to execute the actions identified in the Plan that pertain to this jurisdiction.

2) Will use the adopted and approved portions of the Plan to guide pre- and post-disaster mitigation of the hazards identified.

3) Will coordinate the strategies identified in the Plan with other planning programs and mechanisms under its jurisdictional authority.

4) Will continue its support of the Mitigation Planning Committee as described within the Plan. 5) Will help to promote and support the mitigation successes of all participants in this Plan. 6) Will incorporate mitigation planning as an integral component of government and partner operations. 7) Will provide an update of the Plan in conjunction with the County no less than every five years.

WHEREAS, the Borough Administrator has advised the Borough Council that there are obsolete Borough of

Caldwell vehicles that are no longer needed for public use; and WHEREAS, N.J.S.A. 40A:11-36 authorizes the disposition of personal property not needed for public use without public sale when the fair market value of the property is less than $3,750.00; and WHEREAS, the Borough of Caldwell vehicles being disposed of below, have a value of less than $3,750.00;

and WHEREAS, it is in the best interest of the Borough of Caldwell to dispose of said equipment. WHEREAS, the homeowner at 14 Bowers Road filed a tax appeal for the tax year 2010, the property having an assessed Value of $762,500; and WHEREAS, the assessor found true value at $637,500, $125,000 less than the assessed value; and WHEREAS, to mitigate the financial impact on the city the tax assessor negotiated a settlement reducing the assessed value $100,000, in 2010 and $25,000 for the subsequent year; and WHEREAS, the assessor overlooked adjusting this record in the subsequent years; and NOW THEREFORE BE IT RESOLVED the tax assessment for the property at 14 Bowers Road, Block 75, Lot 5 be reduced by $25,000 and the new assessed value will be $637,500, for 2015 and going forward; and BE IT ALSO RESOLVED that the Tax Collector is instructed to credit fourth quarter taxes for the year 2015 in the amount of $605.76 for overpayments in years 2014.

TITLE:

RESOLUTION AWARDING A CONTRACT TO JAMES R. HAAS LANDSCAPE SPECTRUM LLC, 128 HILLSIDE AVENUE, WEST CALDWELL, NJ 07006 FOR LAWN MAINTENANCE SERVICES IN THE BOROUGH OF CALDWELL

WHEREAS, the Borough of Caldwell advertised for and received bids for Lawn Maintenance Services in the

Borough of Caldwell on February 10, 2015; and WHEREAS, the Borough of Caldwell received proposals from (1) proposer; and WHEREAS, this matter was reviewed by the Mayor and Council of the Borough of Caldwell; and WHEREAS, the lowest responsible bidder was James R. Haas Landscape Spectrum LLC, 128 Hillside

Avenue, West Caldwell, NJ 07006 with a Base Bid of $18,390.00 and Option 1 bid of $45.00 per hour per person and $20.00 per hour for additional equipment; and

WHEREAS, the governing body of the Borough of Caldwell pursuant to N.J.A.C. 5:30-5.5(b), the certification

of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Finance Officer.

NOW THEREFORE, BE IT RESOLVED, that Borough Council of the Borough of Caldwell, New Jersey does hereby authorize the award of a contract for Lawn Maintenance Services in the Borough of Caldwell to James R. Haas Landscape Spectrum LLC, 128 Hillside Avenue, West Caldwell, NJ 07006 in the amount of the Base Bid of $18,390.00 and Option 1 bid of $45.00 per hour per person and $20.00 per hour for additional equipment as specified in the bid specifications. BE IT FURTHER RESOLVED by the Borough Council of the Borough of Caldwell that the Borough Administrator is authorized to execute the necessary contracts and documents upon approval.
