In the event of M/s Urbainia Spaces Pvt. Ltd. (hereinafter called the Company) agreeing to provisionally allot a Residential

Unit/Commercial Unit/IT/ITES Office. I/we agree to pay further instalment of unit cost and all other dues as stipulated in

this application and the Allotment Letter and the Payment Plan as explained to me/us by the Company and understood by

me/us.

I/we have clearly understood that this application does not constitute an Agreement to Sell/Allotment and I/we do not

become entitled to the provisional and/or final allotment of an unit notwithstanding the fact that the Company may have

issued a receipt in acknowledgment of the money tendered with this application. It is only after I/we sign and execute the

Allotment letter on the Company’s standard format agreeing to abide by the terms and conditions laid down therein that the

allotment shall become final and binding upon the Company.

I/we agree to abide by the terms and conditions of this application including those relating to payment of sale price and

other charges, forfeiture of money as laid down herein and the execution of the Allotment Letter.

I/We agree that the allotment of Units is at the sole discretion of M/s Urbainia Spaces Pvt. Ltd. and the Units is not allotted

to me/us for any reason whatsoever, I/we shall not raise any objection or claim damages or challenge the same in any

court of law and the amount deposited herein shall be refundable to me/us without any interest within 30 (thirty) days from

the date of notice by any mode regarding rejection of this application.

I/We agree that the allotment shall become final and binding upon M/s Urbainia Spaces Pvt. Ltd. only after acceptance by

it of the signed Buyer’s Agreement. If I/We fail to execute the flat buyer’s agreement and deliver to, M/s Urbainia Spaces

Pvt. Ltd. then my/our application shall be treated as cancelled and all the sums/amount/paid/deposited/Adjustments by

me/us with M/s Urbainia Spaces Pvt. Ltd. shall stand forfeited without any notice/reminders.

I/We have gone through the all terms and conditions and have understood them and I/we hereby record my/our

acceptance thereof.

TERMS & CONDITIONS FORMING PART OF THIS APPLICATION FOR THE ALLOTMENT OF UNIT IN THE PROJECT, URBAINIA TRINITY- NX FLOATED BY M/S

URBAINIA SPACES PVT. LTD. CORPORATE OFFICE : 4TH FLOOR, C-56/5, SECTOR-62, NOIDA-201301.

Whereas the right of the intending Allottee/(s) will be restricted up to the allotment of a unit in the IT/ITES Project mentioned herein above on the following terms and

conditions relating only to the above said IT/ITES Project and complex to be constructed there on: whereas all terms & conditions of the lease deed of the above plot

executed in favor of the company shall also be applicable to the intending Allottee/(s).

1. The Building plans of the purposed IT/ITES Project will be submitted/sanctioned to/by the Greater Noida Authority. The Project Complex will have units of different sizes

and dimensions in the various blocks therein.

2. That saving and accepting the particular unit allotted, the intending Allottee/(s) shall have no claim or right of any nature or kind whatsoever in respect of unsold unit’s,

open spaces, parking places, lobbies, staircases, lifts, terraces, roofs, parks, basements, parking spaces, club or any such facility.

3. That as per the layout plan it is envisaged that the unit’s on all floors shall be sold as an independent Unit with impartable and undivided share in the land area underneath

the plot. The intending Allottee/(s) shall not be permitted to construct anything on the terrace. However, the company shall have the right to explore the terrace in case of

any change in the F.A.R. carry out construction of further unit in the eventuality of such change in the F.A.R. However, if as a result thereof, there is any change in the

boundaries or areas of the said Unit, the same shall be valid and binding on the intending Allottee/(s).

4. That the covered area shown in the brochure, map or any other document has been calculated on brick wall to brick wall basis.

5. That the intending Allottee/(s) is/are aware of and has/have knowledge that the building plans are tentative and agree that the Company may make such changes,

modifications, alterations and additions therein as may be deemed necessary or may be required to be done by the company, the Government/Greater Noida Authority,

any other Local Authority or Body having jurisdiction.

6. Herein above property known as “Lease able Area” Comprise the covered areas, areas under walls, full area of galleries and other projection whatsoever together with

proportionate interest in the common areas and facilities such as area under staircases, lifts, entrances, and the exits of the building, water supply arrangements and

installation such as power, light sewage etc. and including all rights attached to the said Unit. However, it is admitted acknowledged and recorded between the parties that

another rights excepting what have been mentioned above including easement spaces, lobbies , staircases, lifts, terraces, roofs, spaces for parks, parking spaces

(excepting what has been allotted by an agreement to intending Allottee/(s) or tot-lots, space for public amenities, shopping centers of or any other space will be the sole

ownership of the Company, who will have the authority to charge membership for such facility and dispose off the assets, whatsoever stated above.

7. That after the execution of the Builder-Buyer agreement, the intending Allottee/(s) shall be treated/referred/as Allottee/(s).

8. That the installments in respect of payment will be due at the intervals as per prescribed payment plans laid down by the company. In case payment is not received within

stipulated period in the payment plan or if there is a breach of any terms and conditions of the allotment by the Allottee/(s) the allotment will be cancelled and 25% of the

basic price of the unit will be forfeited and balance amount, if any, will be refunded without any interest.

9. That, if for any reason, the booking of the unit is cancelled by the intending Allottee/(s) or by the company, (with proper reasons), then 25% of the Basic Price of unit will be

forfeited and the balance amount, if any, will be refunded without any interest.

10. That the schedule of installments under payment plan shall be final and binding on the intending Allottee/(s). It is made clear that timely payment is the essence of the

allotment. That in case, the intending Allottee/(s) fails to pay two consecutive installments as per payment plan agreed, the company has the right to cancel the allotment of

the unit and retain 25% of the deposited amount and balance amount shall be refunded to the intending Allottee/(s). The Allottee/(s) will have no claim to the Allotment of

Unit in such cases.

11. That the drawing display in the Site Office/Registration office/Corporate office of M/s Urbainia Spaces Pvt. Ltd. showing the Building/Units Are provisional and tentative

and are subject to change at the instance of the sanctioning authorities or the Company and change can be made during the course of construction without any objection or

claim from the Allottee/(s).

12. That the intending Allottee/(s) consents that the Company can make any type of changes in layout/elevation/design besides alteration in open spaces, green area or

parking spaces etc, as and when required or deemed fit by the company.

13. That any request for any change in construction of any type in the unit from the intending Allottee/(s) will not be entertained.

14. That the intending Allottee/(s) will pay interest Free Maintenance Security Deposit (IFMS)@..... per sq.ft. to the Company. Individual Electric Meter Connection Charge

shall be extra.

15. That if for any reason, whether within or outside the control of the company the whole or part of the Scheme is abandoned, no claim will be preferred, except the money

received from the intending Allottee/(s), will be refunded in full, without interest.

16. The other expenses i.e. cost of Stamp Duty for registration of the Sub lease deed/Registry, Registration charges/Fee, miscellaneous expenses and Advocate legal

fee/charges etc. shall be borne and paid by the intending Allottee/(s). The Intending Allottee/(s) will be responsible and liable for paying any stamp duty deficiency in stamps

and valuation of the Unit for the stamp duty.

17. That the intending Allottee/(s) shall abide by all laws, rules and regulations of the Greater Noida Authority, proposed Body Corporate, Association of the Buyers (as and

when formed till then as prescribed by the Company and shall be responsible for all deviation violations or breach of any of the conditions of law/bye laws of rules and

regulations after the completion of the complex. The unit shall be used for the purpose for which it is allotted.

18. Further, if there is any Statutory dues Including Service Tax, Trade Tax and Additional levies, Rates, Taxes, Charges, Compensation to the farmers, Cess and Fees etc.

or any other levy as assessed and attributable to the Company as an consequence of order from the Government/Greater Noida Authority or other local Authority(s), Court

the intending Allottee/(s) will be liable to pay his/her/their proportionate share.

19. That the intending Allottee/(s) shall get his/her/their complete address registered with the Company at the time of booking and it shall be his responsibility to inform the

Company by registered Address letter/courier about subsequent change, if any, in his/her/their address, failing which all demand letters/notices and letters posted at the

first registered address will deemed to have been received by him/her/them at the time when those should primarily reach and the intending Allotttee/(s) shall be

responsible for any default in payment and other consequence that might occur there from.

20. Transfer by the intending Allottee/(s) will need the prior approval of the Company.

21. The company has not authorized any broker/property agent/sales organizer to issue credit notes or any cash back schemes. The broker/property agent/sales

organizer is not authorized to collect cash from the intending Allottee/(s), if the intending Allottee/(s) accepts any credit notes or any cash back schemes from the

broker/property agent/sales/organizer or gives cash to any broker/property agent/sales organizer, The Company is not liable for the same and the intending Allottee/(s)

shall do so at his/her own risk and cost.
