Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the Pennsylvania General Assembly. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).

Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.

The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”

It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES

ACU researched and selected a range of bills before the Pennsylvania General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Pennsylvania’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 10 Prohibiting Municipal “Sanctuary City” Laws. This bill bars local governments from adopting so-called “Sanctuary City” laws that prevent local authorities from cooperating with federal immigration authorities to enforce immigration laws. ACU believes states should not preempt the federal government’s constitutional role in setting immigration laws and supported this bill. The Senate passed the bill on February 7, 2017 by a vote of 37-12.

2. SB 3 Banning Late-Term and Dismemberment Abortions. This bill bans abortions after 20 weeks (five months) of pregnancy and makes it a felony to perform a dismemberment abortion. ACU believes abortion is a human tragedy, supports restrictions on the practice and believes the human remains from this tragedy should be treated with the utmost respect and supported this bill. The Senate passed the bill on February 8, 2017 by a vote of 32-18 but it was vetoed by the governor.

3. SB 166 Prohibiting the Deduction of Union Dues for Political Activity. This bill bars public-sector unions from deducting union dues and using them for political activities. Under the bill, however, deductions are still permitted for the so-called “fair share” amount that is used to pay for union contract negotiations and representation. ACU does not believe the government should be a collection agency for the unions and supported this bill as a step in the right direction. The Senate passed the bill on February 28, 2017 by a vote of 28-22.

4. SB 5 Prohibiting Firearm Restrictions by Local Governments. This bill prevents local governments from imposing restrictions on the sale or use of firearms that are more restrictive than state law. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on April 25, 2017 by a vote of 34-16.

5. SB 1 Reforming the State’s Pension System. This bill reforms the state’s employee retirement system in order to increase its long-term financial solvency. Under the bill, a hybrid plan is created that places half of the state’s contribution into a “defined” 401(k)-style plan, with an option for workers to convert all their benefits to the 401(k) plan. ACU supports this fiscally sound approach that will help prevent the massive liabilities that have bankrupted state pension systems in other states and supported this bill. The Senate passed the bill on June 5, 2017 by a vote of 40-9.

6. SB 561 Increasing Legislative Oversight over Government Spending. This bill requires any new regulation that has an economic impact of $1 million or more on either the government or private sector to be approved by the General Assembly. ACU supports increased legislative oversight of costly regulations and efforts that ensure the proper use of taxpayer dollars and supported this bill. The Senate passed the bill on June 13, 2017 by a vote of 29-20.

7. HB 1071 Banning Local Bag Taxes. This bill prohibits local government from banning or taxing single-use plastic shopping bags. ACU believes individuals should be free to carry their groceries in any way they wish and supported this bill. The Senate passed the bill on June 14, 2017 by a vote of 28-21.

8. SB 529 Reforming Criminal Record Laws. This bill reforms the way in which criminal records are recorded by ensuring the records of individuals who have committed non-violent misdemeanors are sealed, and that charges that do not lead to convictions are removed from the state’s records. The ACU Foundation Center for Criminal Justice Reform is a leading voice on this issue and works to reduce over-criminalization. ACU supports efforts to protect the rights of those who are not convicted of a crime and supported this bill. The Senate passed the bill on June 28, 2017 by a vote of 50-0.

9. HB 218 Raising Government Spending. This bill raises government spending by $500 million in Fiscal Year 2018 with no funding mechanism to obtain a balanced budget as required by the state constitution. ACU opposes this fiscally irresponsible proposal, especially after the state recently increased its spending by more than $2.8 billion—more than the previous eight years combined—and opposed this bill. The Senate passed the bill on June 30, 2017 by a vote of 43-7. This bill is double rated due to the serious implications to the state’s long-term fiscal health.

10. HB 97 Strengthening Charter Schools. This bill expands school choice by implementing a series of reforms to expand the operations of charter schools in the state. Under the bill, the charters of well-performing schools are extended from five to 10 years, community colleges and universities are required to provide access to charters for student testing, and charters are provided the right of first refusal to use vacant school buildings. Educational attainment provides substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports strengthening school choice and supported this bill. The Senate passed the bill on July 9, 2017 by a vote of 26-23.

11. HB 59 Establishing Medicaid Work Requirements for Able-Bodied Adults. This bill requires able-bodied adults who are on Medicaid to follow work or job-search requirements in order to continue to receive certain benefits. Families and the economy do better when people are employed and benefit from the dignity of work, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports reasonable restrictions on welfare benefits and supported this bill. The Senate passed the bill on July 27, 2017 by a vote of 35-15 but it was vetoed by the governor.

12. HB 45 Allowing Terminally Ill Patients the Right to Try Experimental Drugs. This bill gives terminally ill patients the right to try drugs that have not fully completed the federal Food and Drug Administration’s drug approval process. ACU believes it is absurd to deny terminally ill patients the right to try new drugs and supported this bill. The Senate passed the bill on October 2, 2017 by a vote of 49-0.

1. HB 975 Deregulating the Sale of Wine. This bill deregulates the sale of wine in the state by implementing a series of reforms. For example, the amount of wine individuals can purchase is increased and retailers are now able to negotiate prices and have wine delivered directly to them. In addition, grocery stores are now able to sell wine. ACU opposes the state’s draconian regulations on the sale of legal products and supported this bill. The House passed the bill on April 25, 2017 by a vote of 107-84.

2. HB 1075 Abolishing the Government-Run Monopoly on Liquor Sales. This bill abolishes the government bureaucracy that controls all liquor and wine sales in Pennsylvania and allows private wholesales of liquor and wine. ACU believes government should not be in the liquor business and supported this bill. The House passed the bill on April 25, 2017 by a vote of 105-84.

ACU supports the founders’ belief in the Second Amendment and supported this bill. The House passed the bill on April 26, 2017 by a vote of 134-53.

7. HB 442 Creating a New Occupational License. This bill creates a new bureaucracy within the Department of Labor, called the State Board of Plumbing Contractors, to establish and administer an occupational license for plumbers. ACU opposes the proliferation of occupational licenses that are primarily designed to restrict competition and opposed this bill. The House passed the bill on June 20, 2017 by a vote of 105-91.

8. HB 218 Raising Government Spending. This bill raises government spending by $500 million for Fiscal Year 2018 with no funding mechanism to obtain a balanced budget as required by the state constitution. ACU opposes this fiscally irresponsible proposal, especially after the state recently increased its spending by more than $2.8 billion—more than the previous 8 years combined—and opposed this bill. The House passed the bill on June 30, 2017 by a vote of 173-27. This bill is double rated due to the serious implications to the state’s long-term fiscal health.

9. HB 171 Allowing Poll Watchers From Different Areas. This bill allows registered voters from anywhere in the state to be a poll watcher in a local precinct. Currently, poll watchers must be registered to vote in the county where the precinct is located. ACU supports strengthening efforts to prevent vote fraud and supported this bill. The House passed the bill on September 26, 2017 by a vote of 106-91.

10. HB 59 Establishing Medicaid Work Requirements for Able-Bodied Adults. This bill requires able-bodied adults who are on Medicaid to follow work or job-search requirements in order to continue to receive certain benefits. Families and the economy do better when people are employed and benefit from the dignity of work, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports reasonable restrictions on welfare benefits and supported this bill. The House passed the bill on October 4, 2017 by a vote of 166-78 but it was vetoed by the governor.

11. HB 45 Allowing Terminally Ill Patients the Right to Try Experimental Drugs. This bill gives terminally ill patients the right to try drugs that have not fully completed the federal Food and Drug Administration’s drug approval process. ACU believes it is absurd to deny terminally ill patients the right to try new drugs and supported this bill. The House passed the bill on October 4, 2017 by a vote of 198-0.

12. HB 110 Capping Government Spending. This bill amends Pennsylvania’s constitution to limit annual increases in spending to the combined rate of inflation and population growth over a three-year period. Overriding this spending cap will require a three-fourths majority of the legislature. ACU supports this fiscally sound approach to government spending and supported this bill. The House passed the bill on December 11, 2017 by a vote of 103-83.

13. SB 3 Banning Late-Term and Dismemberment Abortions. This bill bans abortions after 20 weeks (five months) of pregnancy and makes it a felony to perform a dismemberment abortion. ACU believes abortion is a human tragedy, supports restrictions on the practice and believes the human remains from this tragedy should be treated with the utmost respect and supported this bill. The House passed the bill on December 12, 2017 by a vote of 121-70 but it was vetoed by the governor.

14. SB 166 Prohibiting the Deduction of Union Dues for Political Activity. This bill bars public-sector unions from deducting union dues and using them for political activities. Under the bill however, deductions are still permitted for the so-called “fair share” amount that is used to pay for union contract negotiations and representation. ACU does not believe the government should be a collection agency for the unions and supported this bill as a step in the right direction. The House defeated the bill on December 12, 2017 by a vote of 90-102.

15. HB 1940 Closing the Loophole on a Balanced Budget. This bill requires the Secretary of the Budget to disapprove or reduce appropriations that exceed the official revenue estimate. Currently, out-of-balance budgets can become law if the governor fails to sign an official revenue estimate. ACU supports efforts to assure a balanced budget, thus preventing the need for further tax increases to balance the budget and supported this bill. The House passed the bill on December 12, 2017 by a vote of 116-76.

16. HB 1941 Preventing the Accumulation of Unspent Funds in Government Accounts. This bill requires all unspent funds to be returned to the Treasury after one year. Currently, there is no time limit on how long these funds can remain in government accounts. ACU supports this effort to protect the use of taxpayer funds and prevent “slush funds” from accumulating in government agency accounts and supported this bill. The House passed the bill on December 12, 2017 by a vote of 116-76.
