Meeting With Secretary, Posts.A delegation consisting Com. C.C. Pillai,
Secretary General, Com. Desraj Sharma, DeputySecretary General, Com K.V. Sridharan, GeneralSecretary, Com. Ishwar Singh Dabas G/S P4, & Com.P. Rajanayagam, G/S Postal Accounts met SecretaryPosts on 28.09.07 and had discussion for one houron various issues. Shri Kamlesh Chandra D.D.G. (P)also present during the discussions. The following arethe important decisions arrived in the discussion.(i) All Circle Heads will be addressed to fill up allthe pending residual vacancies by fixing target dateirrespective of the years of unfilled vacancies orobtaining revival sanction to fill up the Posts. Theclarifications sought for by some of the circles will bedisposed accordingly.(ii) Another meeting at Directorate with the APMG/AD (staff) of all Circles will be convened to dispose allthe pending problems prevailing in LSG, HSG II & HSGI promotion issues at their circles.(iii) One officer will immediately be deputed toOrissa circle as assured earlier to sort out thediscrepancies in the notional LSG promotion.(iv) The revised syllabus for LGO exam is in progressand will be finalised very shortly.(v) The Secretary assured to issue instructions toall heads of circles that whenever any business activityis introduced, compensation should be fixed at theintroduction itself. Incentive in respect of IMT work willbe finalised shortly.(vi) The Secretary south the details about the circleswhich are OTA for Postal operative staff. We mentionedthat except four or five circles, the OTA is not grantedfor the absentism. The Secretary assured to causeappropriate instructions.(vii) A new scheme of engaging retired Postalemployees remunerating as a fixed rate is underconsideration and will be decided soon.(viii) While demanding to withdraw the order dt 21.5.07on declining regular LSG promotion affecting BCR, theSecretary instructed the DDG (P) to cause necessaryorders since BCR & regular promotions are two distinctcategories. We requested to release earlier orders.(ix) The Secretary reiterated once again that therewill he no curtailment of delivery and assured to pursuethe incidents we discussed about Rajasthan Circle.
We discussed further about the arbitary Rule
37 transfer orders issued to the circle president ofPostal Accounts Union from Patna to Ahmedabad.The Secretary assured to intervene.
So for the filing of SLP against High courtChennai judgment pronounced in favour of the approvedunit listed RRR candidates of Tamilnadu directing fortheir immediate absorption, we registered our strongprotest before the secretary and requested him towithdraw the move and save the life of 622 Postalfamilies as assured with the member (P) on 3.10.07and decide further.Hold Demonstration on 5.10.07 & Send Savingrams/ Post card campaign.
The Postal JCA has decided to holddemonstration at all work pots on 5.10.07 demandingto drop the move of filing SLP in the supreme courtagainst the High Court judgment on RRR approvedcandidates and implement the assurances madeduring the discussions on 19.4.07 to absorb all theapproved candidates of Tamilnadu circle as one timemeasure. Similarly Saving rams campaign may alsobe organised to exert pressure to implement thecommitment. All Branch/ Divisional/ Circle Secretariesare requested to send report after observing theprogramme effectively.Federal Council from 7.10.07 To 9.10.07
The Seventh Federal Council Session of theNational Federation of Postal Employees is scheduledto be held at Monlali Yuva Kendra, Kalkata 1y form7.10.07 to 9.10.07. Out of 64 Federal Councillors, ourunion is entitled only 18 Councillors due to improperremittance of quota by the divisional/ Branch Unions.Nationwide Strike on 30.10.07

Sub: Arbitary action in filing SLP againstabsorption of approved wait listed candidatesof Tamilnadu circle- Request to honour theassurance.
A kind reference is invited to the assurance
you have made personally on 19.4.07 during the talks
to settle the issue on absorption of approved
candidates of Tamilnadu circle.
Thereafter, the DDG (P) had a meeting with
the staff side on 21.5.07 and it was assured that since
the Chennai High Court reserved its judgement and
expected to pronounce the same in the first week of
June 2007. The absorption of the approved candidates
will be carried out after the receipt of the judgment
whether it is positive or negative.
Again another meeting was held on 25.5.07
and on behal f of th is Federat ion, Sr i .
K.V.Sridhararn, General Secretary P3 attended.
Sri. D.Theagarajan, Secretary General FNPO also
attended. The DDG (P) has furnished the details
and discussed about absorption of 622 approved
candidates of Tamilnadu circle (PA 216; PM 158;
Group 'D' 248). He informed that he has suggested
to calculate the vacancies from 2000 onwards in
direct recruitment vacancies by applying revised
norms (5% of vacancies before subjected to
screening committee) and thereby all approved
candidates could be absorbed. So far the postmen
& Group D approved candidates, efforts will be
taken to accommodate them in APS and other
Postal administrative areas.
After the pronouncement of the judgement, by
the Hon'ble Chennai High court on 20.6.07 while
N.F.P.E. CONDEMNED THE DEPT. MOVE FOR FILING SLP AGAINST
ABSORPTION OF THE APPROVED RRR CANDIDATES
dismissing the writ petition and confirming the orders
passed by the CAT Chennai to absorb all approved
candidates with in three months, the Principle Chief
PMG Tamilnadu circle has sent a proposal to
Directorate on 24.07.07 to absorb all the approved
wait listed candidates as one time measure.
All the service unions had also appealed the
Secretary to honour his commitment and absorb all
the approved wait listed candidates.
It is rather shocking and dismayed to note that
the Dept of Posts instead of honouring its commitment
extended to service unions has decided to file a SLP
before the Hon'ble Supreme court of India. It is a naked
attack on the Postal families and nothing but kicking
below the belt. We record our strong protest and
resentment.
If the Dept file SLP, the life of the most of the
approved candidates who are regularly working for
more than 10 years will be under question. They have
decided to sit on indefinite hunger fast culminating to
death. We cannot shut our eyes over these
developments and remain as silent spectators even
after violating your own assurances and taking cruel
decision to crush the life of 622 Postal families.
It is therefore requested to withdraw such
action and implement the assurance in order to keep
peace and amity in the Postal Service.
Soliciting your immediate response by causing
orders to absorb all the wait listed candidates.

MEETING AT PLI DIRECTORATE ON 1.10.07
A Special Meeting with Ms. Suneeta Trivedi,
Chief General Manager (PLI) was held at PLI
Directorate on 1.10.07 to sort out the issues pertaining
to Decentralisation of PLI and other connected issues.
Sri Gautam Bhattacharya, Addl General Manager
(PLI), Sri Rajagopalan, Chief Accounts officer & others
present. On behalf of our Union Com. K. V. Sridharan,
General Secretary and Com. Balwinder Singh, Asstt.
Treasurer attended the meeting. The following are the
outcome.
Decentralisation of PLI/RPLI work at Divisional
level
The Directorate has issued orders to grant
honorarium to divisional office staff for processing of
PLI/RPLI proposals vide its letter No. 29-12/2001-LI
dt. 3.7.07. We suggested that the rate of honorarium
should be uniform at all circles and the cap of Rs.
4000/- should be removed. The copy of the Directorate
orders is enclosed.
Posting of PLI Data through HPO TPS.
We pointed out the contents of our letter dt.
15.5.07 about the disadvantage of HPO TPS software
and also the advantage of Meghdoot Millennium
Software in posting of PLI. The CGM informed that a
bridge software is being ready for use to sort out the
Problems in TPS software. It was assured to send a
detailed reply after sorting out this issue.
Grant of honorarium/ incentive to Accounts
Branch staff for preparation of RPLI schedules
We discussed in details about the need &
importance of the schedule works, we are performing
at Accounts branch. The CGM agreed to consider and
grant incentive for the schedule work performing at
Accounts branches in Head Post offices.
Grant on incentive for accounting & processing
RPLI Proposals at Accounts office
After elaborated discussions, it is agreed to
consider to fix incentive for the work performed by the
SPMs of the Accounts office.
Spot Payment of incentive amount due to BPM/
SPMS for Securing RPLI business
We discussed about the proposal of delinking
the payment of incentive from allotment of funds to
BPMs/SPMs for procuring RPLI business.
The present method of verifying the bills at HOS
with schedules which is laborious has been explained
and the need for incentive for such extraordinary work
has been detailed.
After discussion, it was agreed to consider our
suggestion to effect payment of incentive directly from
C.O/R.O based on the ledger entries every month so
that it will reduce the unwarrented paper work being
executed for this work.
Utilising the services of PRI (P)s & SPMs for
procurement of PLI business.
We discussed that all Group C official should
be authorised for procurement of PLI/RPLI business
and the restriction of only two officials per division
should be removed forthwith.
Based on earlier representation & letters, the
Directorate has already caused order vide its No. 28-
05/201-LI dt. 18.5.07 intimating that the total strength
of PAs selected for procurement of PLI/RPLI business
will be decided by the Heads of Circle depending on
the local compulsions.
Cash award for procuring PLI/RPLI Policies
We mentioned that the Postman staff who
procured more business while comparing other D.Os
has not been brought under the Cash Award at Chennai
which will demotivate the staff who work hard for the
business. We stressed that this provision should be
reviewed and modified.
Calculation of Service Tax and Education cess in
respect of PLI/RPLI business.
We made a reference that the Service Tax &
Education cess should be inbuilt in the premium and
explained the practical problems being faced at
BOs/AOs.
The CGM stated that from 1.11.07, it will be in
built and there is no need to collect Service Tax &
Education cess while collecting premium. We record
our thanks for this good decision.
Fixing Time Factor for RPLI work.

The PLI Directorate has sent proposal to fix Time
factor for the RPLI work at BOS which can be equated
with S.B. transactions. The grant of incentive to BPMS
is nothing but similar to the incentive granted to D.O.
(PLI). The need for fixing Time Factors for work
calculation (point) and for taking into account for 'value
return' has been focussed by the PLI Directorate to
the Establishment branch of the Directorate. This is
certainly a good news for the GDS Comrades.
We recorded our thanks to the CGM & AGM,
& other officers for having invited us and offered a
chance to discuss the problems we are facing at grass
root level. We have been assured to include our name
in the mailing list. Some important orders we collected
from the PLI Directorate are appended herewith.
1) Order No.: 29-12/2001-LI dated : 03-07-2007
l Payment of Honorarium to Supervisors and
Staff of Divisional Office for processing of PLI and
RPLI proposals for acceptance.
This is regarding payment of honorarium to the
supervisors (IPOs/ASPOs) and staff of Divisional office
for processing and checking of PLI/RPLI proposals
and related work.
2. The decentralization of work relating to
acceptance of proposal of PLI/RPLI has increased the
work load at Postal Divisional office which may justify
extra manpower. However, due to ban on creation of
new posts, it is not possible at present to provide
additional manpower. In this background Circle Heads
during meeting at Dte of PLI had suggested for
payment of honorarium to the Divisional office staff
and supervisors for the work relating to processing of
PLI/RPLI proposals to cope up with the situation.
3. After examining the issue in detail, it has now
been decided to allow the system of payment of
honorarium to staff (including supervisors) of Divisional
office for processing of PLI/RPLI proposals and for issue
of acceptance letters/PR books.
4. The usual conditions prescribed including the
ceiling of Rs. 4,000/- per annum per official should be
adhered to while sanctioning the payment of
honorarium.
5. It should also be ensured that under no
circumstances the process relating to acceptance of
proposal shall be delayed at Divisional level. In the
bigger Divisions, where the proposals are processed
in large number, Divisional Heads may form exclusive
cells to process PLI/RPLI cases and honorarium may
be paid for work in excess of the minimum threshold.
6. Rates of honorarium may be finalized by the
Circles in consultation with their Circle internal financial
advisors. Honorarium paid may be booked under 3201-
03-101-08-01 salary' for PLI and '3201-30-101-09-01
salary' for RPLI for which Circles will provide the funds
to their Divisions after getting the same allotted at RE
stage.
7. This has been issued with the concurrence of
Internal Financial Advisor of this Directorate.
2) Order No.:28-05/2000-LI dated : 13-09-2006
l Authorization of Ex D.O.(PLI), PRI (P) and
selected Postal Assistants (who are well versed
with PLI & RPLI schemes/jobs) for procurement
of PLI/RPLI business
As per road map fixed for PLI and RPLI, we
have to increase the premium income both in PLI and
RPLI by 23.5% and 50% respectively each year. The
circles are facing difficulties in achieving the targets
due to less deployment of our field staff. In view of
this, there have been continuous demands from the
circles to increase the Field staff by authorizing the
Ex D.O.(PLI), PRI (P) and selected Postal Assistants
for procurement of PLI/RPLI business. This proposal
has been under consideration of this Directorate and
it has now been decided to authorize Ex D.O (PLI),
PRI (P) and selected Postal Assistants for
procurement of PLI/RPLI business on the following
conditions:
(i) They will procure business during off duty hours
and on Sundays/Holidays.
(ii) Incentive at the rate applicable to D.Os (PLI) will
be paid for whole business without deducting
incentive free business.
(iii) No TA/DA shall be paid for canvassing PLI/RPLI
business.
(iv) No excuse shall be acceptable for neglecting their
normal official work. If any official is found
neglecting his/her regular duties, he/she will be
debarred from procuring PLI/RPLI business.
(v) They will require to equip themselves with

necessary forms for use of clientele and policy
holders.
(vi) They should understand underwriting techniques
and they will be held responsible for procuring
bad lives and loss to the Department will be
recovered from them if they procure bad, risky or
uninsurable lives.
(vii) The Ex D.Os (PLI), PRIs(P) and Postal
Assistants so deployed will be required to
contact the proponents personally to verify date
of birth, family history, health of the proponent
and source of income and will held responsible
for dereliction of this duty.
(viii) The Postal Assistants so deployed shall be
selected by the Head of Circle and the total
strength shall not be more than the number of
Postal Divisions in the circle i.e. only one Postal
Assistant per Division shall be deployed.
2. These orders shall take immediate effect.
3) Order No.: 25-4/2003-LI dated : 06-03-2007
l Conditions for Extension of Tenure of DO
(PLI)
I am directed to refer this Directorate letter of
even No dated 22-07-2004 on the subject and further
to convey the decision of Competent Authority that a
DO(PLI) procuring effective business to the tune of
Rs. 25 crores or more shall now be eligible for
automatic extension of tenure for the next one year.
Such extension will be granted by Head of the Circles
subject to good work, conduct and satisfactory record
of service in the year.
2. Where the Head of the Circle does not approve
such extension on any ground whatsoever, the case
will be referred to this Directorate for concurrence of
CGM(PLI) before such rejection.
3. The limit of business procurement upto 12 years
of tenure shall remain unchanged.
4) D.O. No.: 28-05/2000-LI dated : 08-05-2007
l Traditionally promotion of PLI has been carried
out mostly by the Development Officers of the
Department who are engaged normally for a tenure of
5 years from amongst the Postal Assistants(PAs) and
PACOs. This way, the number of DOs for PLI in the
country as a whole comes to 195 which is almost
insignificant as compared to 20,000 DOs and some
15 lakhs Agents of LIC.
2. We have about 450 Field Officers for promotion
of PLI who are mostly retired Postal Employees. This
number is also found to be absolutely inadequate. As
a result, even after 120 years, PLI has not been able
to bring in its fold more than 10% of its potential
customer base.
3. When Rural PLI Scheme was launched,
GDSBPMs were authorised to procure business on
incentive basis and a part of incentive went to the
concerned Sub-Divisional Inspectors/ASPs.
Subsequently in the year 2003, Circles were asked to
engage Direct Agents for procurement of PLI&RPLI
business but because of inadequate incentive
structure, restrictions in the number of Agents to be
appointed and because of lack of training, this scheme
did not succeed. We are now working hard to revive
the Scheme.
4. Certain steps were taken by this Directorate in
recent years to develop the sales force of PLI/RPLI
which are summarized below:
(a) Inspectors & ASPOs working in the Postal
Divisional Offices and in Sub-Divisions were
authorised to procure PLI/RPLI business outside
their duty hours and on Sundays/Holidays via this
Office letter of even number dated 06-08-2003.
Incentive at the rate applicable to DOs was to be
paid to them for whole amount of the business
that they procured (without deducting incentive
free business).
(b) Subsequently Inspectors/ASPOs working in RMS
Divisions and those working in Class-I GPO were
also authorised to procure PLI/RPLI business vide
this Directorate Memo of even number dated 30-
01-2004, on the same conditions as prescribed
for the Inspectors/ASPOs of Postal Divisions.
(c) Departmental Postman were authorised to procure
PLI business under certain conditions vide this
Office Memo No. 5-1/94-LI(Pt) dated 20-10-2004.
Incentive structure as applicable for Inspectors/
ASPs were also applicable for them.
(d) Retired GDSBPM were authorised to work as Field
Officers for procurement of PLI/RPLIbusiness
under certain conditions vide this Directorate

Memo of even number dated 27-02-2006. They
were made eligible to get incentive at the rate as
admissible to other Field Officers appointed from
amongsts the retired employees.
(e) Mail Overseers were authorised to procure RPLI
business vide this Office Memo of even number
dated 29-06-2006 under certain conditions.
(f) Ex-DOs, Public Relation Inspectors and one
Postal Assistants on an average of one (1) from
each Postal Division was authorised to procure
PLI/RPLI business outside their duty hours and
on Sundays/Holidays vide this Office Memo of
even number dated 13-09-2006. Incentive structure
for the Inspectors/ASPs was applicable for them
also.
5. It has been observed that many Circles had
implemented above orders in a half-hearted fashion. A
time has come when we are required to reorient the
role of the Development Officers. Besides procuring
their own business, Development Officers are required
to act as facilitator for the sales force in their
jurisdiction. Service of the Development Officers may
be used to train and coordinate the Sales force to be
developed from amongst the Departmental employees
as discussed in Para 4. Development Officers can also
monitor their performances and bring it to the notice
of concerned Divisional Head and the Regional
Director. They can also work as facilitator in providing
better after-sales service through the network of
departmental officials authorised to procure business.
It should be remembered that intake in Government
Departments and Public Sector Undertakings has
declined very substantially in recent years. This is
having its restrictive effect on the new customer base
of PLI. Unless we intensify our sales efforts through
authorised Departmental employees, PLI will be loosing
its market share further and for that we need to involve
Divisions and Regions also.
6. In order to assess the exact impact of the
orders issued by this Directorate, I shall request you
to let us know the amount of business that was
procured by various categories of departmental staff
in the Financial Year 2006-07. I shall request you to
fill up the Table given in the Annexure and send it of
us by May 18, 2007 along with your views on the
issue.
5) Order No.: 28-05/2000-LI dated : 18-05-2007
l Authorization of Ex D.Os (PLI), PRI (P) and
selected Postal Assistants (who are well versed
with PLI and RPLI schemes/jobs) for procurement

order of even number dated 13-09-2006, I am directed
to convey that the total strength of the Postal
Assistants Selected by the Head of Circles for
procurement of PLI/RPLI business will be decided by
the Head of Circles only, depending on the local
compulsion.
6) Order No.: 28-05/2000-LI dated : 30-05-2007
l Undertaking of Agency work for LICI to be
a disqualification for seeking appointment as ED
Agent in the Department of Posts - Regarding.
It has been brought to the notice of this
Directorate that in certain Circles the ED Agents (now
Gramin Dak Sewaks) are working as LICI Agents and
they are neglecting RPLI propagation which affects
the business procurement adversely.
2. In this context, I have been directed to draw
your attention to the Postal Directorate order No. 17-
96/95-ED & TRG dated 20-11-1995 (copy enclosed
for ready reference) on the Department of Posts. The
Directorate has also clarified that unless otherwise
specifically provided, persons appointed as ED
Agents on or after the date of issue of these
instructions will not to be permitted to act as agents
for the LICI.

Sub: Long pending and burning problems -
Request to arrange an interview for discussion
and expeditious settlement.
It is constrained to bring to your kind notice
that despite our persistent requests to mitigate the
enclosed issues confronting the Postal Group 'C'
for months together, there is no improvement and
things are moving in snai ls pace only. The
assurances given during the talks we had on 19.4.07
have not been implemented but protracted under one
pretext or the other. We are very much fed up with
the delay which is causing serious resentment
amidst the employees.
We shall be obliged if you will arrange a meeting
for discussions on the issues enclosed herewith and
arrange immediate and expeditious settlement of the
problems mentioned therein at the earliest.

1. Filling up the Posts of LSG, HSG II & HSG I Posts
Despite the orders of the Directorate dt.
20.11.06 prescribing the checklist for LSG, HSG II &
HSG I Promotions and subsequent orders, the issue
has not been totally implemented in many circles.
I. In many circles, the LSG Promotion on notional
basis was not accorded and has given with prospective
effect only resulting in denial of HSG II & HSG I
Promotions. In M.P. circle & A.P. Circle, the LSG
Promotions are not accorded so far.
II. In respect of Orissa circle, the notional
promotion was granted only from 1993 instead of from
1984. The Dept. assured to depute the Director SPN
Sri V.C. kajla to verify the process in May'07 itself
but yet the problem remains as it was. The Orissa
circle administration mentioned that there were 258
number of surplus LSG official as on 1.1.84 and
adjusted them up to the vacancies of 1991 which is
not at all possible and prior to 1984, the LSG was
accorded based on the vacancies. Then there was
no chance of surplus LSG.
Despite the assurances to sort out the mistake and
grant notional promotion to the seniors, this is not
being exercised so far resulting deprival of their dues
to the senior officials.
III. The orders of the Directorate dated 22.5.07 to
verify the exercise of notional promotions and correct
the same in case of any mistakes in order to ensure
due promotions to the senior officials has not been
carried out in any circle. There was no check
prescribed for this purpose. The seniority list of LSG
officials after correcting the date of notional promotion
to LSG official has not been circulated in many circles
for making reprasentation by the affected officials.
IV. The 1/3 rd LSG vacancies earmarked for general
category from 4-1-02 to 18-05-06 and unfilled vacancies
of 2/3rd earmarked for FTP examination should also
be filled up on notional basis.As the date of notional
promotion has not been corrected in many circles,
there is a dearth of eligible LSG officials for HSG II
promotion as per the recruitment rules resulting non-
filling up of such HSG II Posts.
V. Similarly, the assurances to relax the minimum
qualifying service for HSG II promotion in order to fill
up the HSG II posts in the absence of eligible LSG
official has not been implemented. There are several
HSG II Posts existing vacant.
VI. The DO P&T had agreed as a special case to
fill up the HSG I vacancies among HSG II officials as
one time measure for a period of one year on adhoc
basis with out prescription of any minimum service in
HSG II. According to the DO P&T instructions, the
revised recruitment rules for HSG I should be notified
before the end of Oct'07. Otherwise, there will be
problem once again in filling up the posts of HSG I.
This may please be expedited.
VII. According to the DO P&T guidelines & also
the Directorate orders the Bench mark for LSG
Promotion was introduced only in 2002 vide
notification No GSR 88 (E) communicated in letter
No. 137-10-96-SPB II dt. 19.2.02. Where as in many
circles, the benchmark of the current period had been
applied for notional promotions for the vacancies from
1984 onwards resulting denial of due LSG Promotion
for the vacancies of earlier periods. Moreover the
Directorate instructions contained in letter No 137.04/
2006 SPB II (pt) dt 16.5.07, (i.e.) "the DPC should
be realistic and objective in their assessment in order
to avoid unnecessary staff grievances and depriving
dues of the staff for Promotion"- has not been
practiced in any circle.
VIII. In many circles like Tamilnadu, ordered LSG

promotion on regular basis against the vacancies and
intimated that the promotions of the officials will take
effect from the date on which the officials actually join
the post of LSG. Some officials have been posted in
the same office or nearby who could immediately
assume charge on receipt of orders. Whereas others
are awaiting for relief to hand over charge before joining
the new Posts. This will result in postponement of
HSG II promotion for the later and also loose his
seniority in LSG. Hence, the condition that promotion
will take effect form the date on which they actually
join the post of LSG should be removed. The date of
promotion should take effect form the date of order of
promotion issued by the circle office.
IX. The following anomaly has been arisen due to
notional promotion now accorded since 2006.
i) Since the LSG notional promotion was granted
on notional basis, in some divisions due to more
number of LSG Posts in existence, the juniors got
their LSG promotion. In other divisions due to dearth
of LSG Posts, the seniors are deprived notional LSG
promotion.
ii) Similarly, the Rule 38 transferees could not get
their LSG notional promotion due to application of
Divisional gradation List.
In order to mitigate the genuine grievances of
the above said officials in promotional aspects,
Modification of LSG' by granting notional promotion
may be explored since the anomaly is prevailing due
to various changes and the procedures of the LSG/
HSG II recruitment rules.
X. The pay scale of HSG II & BCR is one and the
same. After the modification of FR 22 on 30.8.99, any
official holding/drawing the pay of HSG II on regular
basis even for a single day can very well officiate in
HSG I, as these promotions are in the same general
line. The officiating pay for the officiation in HSG I Posts
by the BCR officials have been denied in many circles.
This may please be clarified.
XI. In some circles like Tamilnadu, west Bengal,
some BCR officials were allowed to officiate in HSG I
Posts for more than one year during 2002-2005 in the
absence of clarity orders and the circle heads referred
the matter to regularise the arrangement beyond one
year as one time measure which is pending at the
Directorate over one year. The due officiating pay had
neither drawn nor taken for pensionary benefited.
XII. The unfilled 2/3rd vacancies in LSG earmarked
from 2002 to 2006 may also be filled up alongwith 1/
3rd vacancies among senior officials on notional basis
which will facilitate to have more number of eligible
LSG officials to avail HSG II promotion without resorting
for exemption and seniors will be benefits.
2. Clarificatory orders on TBOP equating with
LSG- declining promotion- contained in
Directorate letter No. 22-5/95-PEI dt 21.5.07-
request to withdraw the instructions.
In Para 2 of the above said letter, it is clarified
that if an official declines regular promotion after getting
higher pay scale under TBOP/BCR promotion
schemes, his/her placement in higher pay scale under
BCR scheme/regular promotion be delayed for the
period he/she declined regular promotion.
This is arbitrary, unjust and against to the spirit
of TBOP/BCR schemes, which were introduced after
surrendering posts on matching savings as per the
agreement reached between the Dept & staff side.
'The placement of and official in higher pay scale
under BCR promotion scheme' can be delayed only
when a TBOP official due for BCR promotion declined
BCR promotion and the period of such declination is
valid for one year normally.
Declining promotion is the right of an official
and it is not an offence for which no punishment such
as reduction in the pay or pay scale could be ordered
as there are no such provisions in the FR commonly
applicable for all central Govt Servants. Similarly there
is also no provision or procedure in the FRs for such
delaying of a scale of pay to and official who has not
committed any punishable offence.
The Dept vide its letter no. 137-18/2001-SPB II
dt 23.4.01 clarified that upgradation under TBOP/BCR
schemes and promotions to LSG/HSG II as per the
provisions of recruitment rules are two distinct matters.
As such the present linkage with BCR with regular
LSG is in contradiction of such orders. This will
tantamount to the wrong application of powers and
freezing the benefits of financial upgradation like ACP
misconstruing the normal channel of regular promotion.
This is nothing but a farce as BCR officials in
the pay scale of RS. 5000-8000 are being given
promotion to a cadre with a lower pay scale of Rs
4500-7000. without any monetary benefits but involving
change of work spot, maintenance of double
establishment etc.
It is requested to withdraw the orders forthwith
3. Filling up the post of APM Accounts LSG &

HSG.II posts
In almost all the circles, the notional promotion
to APM (LSG) Accounts cadre since 1986 has not
been granted to the PO and RMS Accounts qualified
officials based on the gradation list prepared with the
date of qualifying in the PO & RMS Accountants
Examination.
In some circles, the FTP qualified officials
possessing accounts qualifications were considered
for the APM Accounts post. They are of the considered
opinion that there is no discrimination between General
and Accounts line and Accounts line lost its identity.
The CAT Chennai in its OA No. 201/2006 in the
case of Shri P. Ramadoss vs. The Principal Chief
PMG, Tamil Nadu Circle held the separate identity of
APM Accounts cadre and directed to conduct the DPC
for Accounts line without any procastination based on
the Recruitment Rules dated 13-09-76 and issue
necessary promotion orders to the eligible PO and
RMS Accounts line officials within a period of four
weeks.
Since there is no amendment has given to the
LSG Accountants Rule 1976 and it will be most
appropriate to maintain a separate entity of the cadre,
it is requested to issue necessary clarificatory orders
to all the circles to issue notional and regular promotion
to LSG & HSG.II from 1986 onwards to the Accounts
line cadre.
4. Filling up of Residual Vacancies.
While thanking the kind gesture of the Dept in
causing orders to fill up the Residual vacancies vide
its letter No. 60-5/2007- SPB I dt 15.5.07 in very clear
terms, it is constrained to note that this has not been
implemented in true spirit in any circle.
(i) In respect of Tamilnadu circle, decision has not
been taken to fill up 858 PA vacancies and seeking
clarifications on flimsy reasons. The regularisation
of adhoc candidates was held in direct recruit
vacancies during 2001,2002 &2003. The marks
obtained them may be taken as the cut off mark
for the recruitment year and the posts may be
filled up.
(ii) So far the case of Andhra Circle, the chief PMG,AP
Circle has sought permission by extending one
time relaxation from the recruitment rule vide Col
II of schedule to recruitment rules 2002 to fill up
the 1045 PA Posts kept unfilled under this
catogary.
(iii) Similarly, the Chief PMG, Chattisgarh has sent
proposal for approval to fill up the PA Posts.
(iv) In respect of Rajasthan, there are 292 PA Posts
kept unfilled up and the Chief PMG has not initiated
any action.
(v) The Chief PMG, Jharkhand Circle informed that
there are 134 PA vacancies kept unfilled up under
this category
(vi) The Chief PMG, Orissa submitted proposal to
approve for filling up of 190 PA Posts vide his letter
dt. 11.06.07.
(vii) In Uttarakhand Circle, no action has been initiated
to fill up the 112 PA vacancies which are kept
unfilled up under this category.
(viii) The chief PMG West Bengal has also sought
clarification to fill up the vacant posts which is
more than 1000 under this category.
In short, the guidelines issued by the Directorate
have not been strictly implemented. All circle heads
are seeking clarifications or approvals from the
Directorate resulting in unwarranted delay in filling up
of such vacant posts. Suitable action may please be
taken to fill up all the vacant posts under this category
at the earliest.
5. Recovery of alleged over Payment of Pay
& Allowances to Postman on account of fixation
from the officials of Accounts branches of Head
Post offices.
Please refer this union letter No P/4-2/Pay dated
5.4.07 on this subject.
The drawing and disbursing officers have been
made as scapegoats in this case. According to Rule
87 of P&T FHB. Vol I, any excess payment can be
recovered at any time. The Apex court also confirmed
that any excess paid due to administrative mistake,
there is no rule which prohibits such recovery
(udayasankaran Vs. Union of India JT 1996 (4) (SC).
The most pertinent point that the inspection
parties like ICIR and Audit have approved and certified
such drawals in many places. The clarification
regarding fixation of pay of postmen in scale of Rs.
2750-4400 (with two advance interments) was issued
only on 10.6.99 vide letter no. 23-66/97-PEI (PCC) dt.
10.6.99. The defective order dt 9.10.97 resulted in over
payments. For this over payments and consequently
for obtaining undertakings, accounts branch alone
cannot be held responsible.
It is inhuman to recover the amount in lakhs

from the poor officials of Account branch for minor
negligence of not obtaining undertakings.
It is therefore requested to stop such recovery
and drop action if any initiated anywhere to recover
the amount from the officials working in Accounts
branch.
6. Counting of Special Allowance for pay
fixation - case of PO and RMS Accountants
A kind attention is invited to the letter No. 9 (1)/
2004-PA Admn. I/501 to 504 dated 29-10-2006 from
Shri T.K. Mitra, ADG (PA and Admn) of the Directorate
wherein it is informed that the Special Pay, which is
now called as Special Allowance drawn in lieu of higher
pay scale, may be taken into account for fixing pay
under ACP to the JAO examination qualified
candidates on ACP promotion.
The above said instructions were issued in
consultation with DOP&T and the same and similar
analogy should be applied in the case of PO and RMS
Accountants also and their Special Allowance should
be taken for fixation of pay in the higher cadre on
promotion.
Further, vide letter No. 8 (1)/2004-PA-Admn/1/
54 to 76 dated 23-04-07, it was mentioned that this
issue relates to operative offices, the matter may be
taken up with Directorate through CPMG, which
exhibits lack of coordination among the branches in
the Directorate.
It is, therefore, requested to cause immediate
orders on the issue, which is hanging over ten years.
Further the orders applicable to JAO qualified official
be applied to the similarly situated official working
in the post offices on acquiring TBOP / BCR
promotion.
7. Tenure posting of officials in Single &
Double Handed post offices - request to withdraw
the conditions.
Please refer this union letter No. P/38-RT dated
24-01-2006. The condition that the SPM / PA working
in Single / Double handed offices should not be posted
back to the same office during their entire service is
against the statutory rules of P&T Manual Volume
IV. The doubts about the integrity of all Postal
Assistants / Sub Postmasters will mar the interest
of the officials and it is requested to withdraw the
conditions forthwith.
8. Restriction in posting of SPM due to minor
penalties / CR entries
The Directorate has given instructions to all the
Circle Heads from investigation section dated 06-11-
2006 that if an official is awarded with anyone of the
minor or major punishments or adverse entries in the
CR, he should not be posted as SPM throughout his
career.
The suggestion given by the Investigation wing
as a preventive measure to minimise and eradicate
the losses and frauds has been circulated for
implementation not only in the RT 2007 but also in the
existing cases.
The suggestion is practicable only if the
department is having full staff strength and it is not
feasible to implement when the shortage exceeds
30% in the Postal Assistant cadre. This will create
hardship to the officials. That too reverting the
existing SPMs from their SPM posts as Postal
Assistant before completing their tenure is unjust and
bad in law and against to the natural justice. This
will spoil their reputations earned from the public by
shifting them from SPMs post before completing their
tenure.
The other suggestion given by the same section
earlier that not to keep vacant in B & A class offices
and fill up the Postal Assistant posts has not been
implemented. As such this will create many hardships
to all the officials who are unwilling to take position as
Postmasters.
This is most pertinent to mention that after lapse
of certain periods, the officials inflicted with punishment
become eligible to write the promotional exams like
IPO, JAO, Group B etc. As such, mere imposition of
even a minor penalty which will be the disqualification
to be a SPM throughout his career is nothing but a
farce and not maintainable.
If the suggestions are implemented
retrospectively, at one stage none will be available for
the post of SPM due to prevailing shortage, a well
senior official has to work as Postal Assistant under
the supervision of his most junior which will also be a
punishment not improvised in the CCS CCA Rules.
9. Counting the training period for benefits of
promotion under TBOP / BCR scheme
Despite the clear instructions contained in
Directorate letter No. 44-47/98-SPB.II dated 31-07-2000
& 27-07-2001, that the period of induction training may
also be counted as qualifying service for the benefit of
TBOP / BCR promotions, this has not been

implemented in many circles.
To cite an instance, the circle IFA, Tamil Nadu
Circle has denied such kind of benefits to those
recruited and deputed for training before 01-01-86.
Based on the opinion, the Chief Postmaster General,
Tamil Nadu Circle has issued instructions vide his
letter No. STA/80-1/00/Rlgs dated 21-02-2003 in
which it was stated that the period of Induction training
can be taken for the benefit of promotion under TBOP
/ BCR only if the person selected was under training
on 01-01-86 or deputed for training on or after 01-01-
86, apart the fulfilment of other conditions such as
obligatory nature of such training, immediate
promotion on completion of such training.
Resultantly, the officials granted with BCR
promotions based on the Directorate orders dated 31-
07-2000 taking into account of their training period for
promotion have faced recovery and re-fixation. The
opinion of the circle IFA to cut short the benefits from
01-01-86 is wrong and arbitrary one.
It is, therefore, requested to cause necessary
instructions to all the circle heads to count the training
period without any restriction and stop recovery
immediately.
Similarly, the induction training period of the
promotes to LGOs may also be taken as service
rendered in Postal Assistant cadre if opted for fixation
and other benefits.
10. Non conducting of Group B examination
since 2003
On the pretext of CAT case, no Group B
examination has been conducted since 2003, depriving
the chances of many bright officials aspiring for Group
B promotion.
The department has neither gone for appeal nor
brought out updated version of postal manuals
prescribed for the examination. It is a gross neglect
of the interest of the so many bright officials.
Under the present context of modernisation with
a sea change in the printing industry, the printing of
volumes within a short span of three months does not
pose any problem or otherwise as in the case of
Volume VII & V, we can authorise the publishers like
Swamy's Publishers, Nabhi Publishers etc. to
accomplish this task.
A pertinent point to be noted in this regard is
that after the 5th Pay Commission, the department,
unmindful of the amendment of the recruitment rules
by due notification with the approval of nodal
ministries, has plunged to controversial issue of orders
permitting only those officials who are holding
standard LSG post on regular basis, blocking out all
TBOP / BCR officials. As everybody knows, the
bunch of Group B officers passed Group B
examination when they were holding TBOP / BCR
status and many of them retired. To deny such
benefits available to the TBOP / BCR officials, a
sudden switch over to standard LSG criteria has
neither been consulted with service union nor has
amended the recruitment rules with the due approval
of nodal ministry.
Hence, it is requested to conduct the Group B
exam immediately permitting the officials having 20
years of clerical service irrespective of the fact whether
they are LSG or TBOP.
11. Allowing to appear in the Departmental
Exam like IPOs - case of physically handicapped
officials
The Directorate has clarified vide its letter No.
7-8/04-SPB dated 28-07-2005 that physically
handicapped officials should not be allowed to appear
in the IPO Examination as they are unable to perform
the physically demanding nature of work.
This is unfortunate and total injustice to the
physically handicapped officials who fulfil all the
required qualifications, skills etc. and could perform
the duties efficiently and effectively. There are many
jobs in IPO cadre, which did not require any outdoor
duties. Even in the case of physically handicapped
officials, they could also do the outdoor duties with
the vehicle, advance equipments or with the
assistance.
Their disability should not be construed or taken
as a ruse to deny their justified right to appear in the
examination which is against to the canon of natural
justice.
It is, therefore, requested to reconsider the
decision and allow all physically handicapped officials
to appear in the exam under relaxed terms or at least
fix some reservation of the posts of IPOs which do not
require any outdoor duties like circle, regional offices.
12. Revision of FSC
The Fixed Stationery Charges fixed to office /
officials does not commensurate with the expenses
being incurred for the purpose due to spiral increase
of commodities & inflation.

The present amount does not meet the 1/3rd
requirements and the incharges are incurring expenses
at their own cost.
It is requested to consider the same and revise
the FSC with retrospective effect.
13. Enhancement of honorarium to RD
premature closures
The rates fixed for RD PMC work a decade back
needs revision. The norms were also revised. During
1996, the PMC was permitted without interest after
one year. Now PMC is allowed only after three years
with SB interest. Resultantly IBB has to be worked
out for more than three years consuming more time.
After RD decentralisation, it becomes very difficult and
risky too.
It is requested to revise the honorarium upward
at the following rates.
Sub Postmaster - Rs. 5.00 per account
Postal Assistant - Rs. 10 per account
Clarification may also be issued about the
quantum of honorarium entitled to single handed
SPMs.
14. Assurances made on 19.4.07 for settlement
of genuine, Serious Problems confronting the
staff
(I) During discussions on 19.4.07 with the Secretary,
it was assured to cause orders to employ retired
pensioners to manage the shortage of staff in post
offices.
Orders have not been issued so far
(II) It was stated that an internal committee will be
appointed to process and decide the quantum of
honorarium/incentive for the new business activities
like RPLI/Western Union Money Transfer,
processing of pass port Applications, verification
of addresses for cell phones, NRGEIS. etc. and
uniform application of honorarium in all circles for
common work. This is yet to be finalised.
(III) It was assured that the syllabus for LGO exam
will be liberalised in order to fill up the posts and
the draft copy was also handed over later to
unions. There after there is no information. The
assured special exam for LGOS in the month of
November '07 may be implemented with the
revised syllabus duly increasing the number of
chances as agreed.
(IV) It was assured to grant OTA to Postal operative
staff to manage the excess work due to
absenteeism and shortage. The Secretary
personally agreed this. Whereas no orders have
been communicated to the circles so far despite
our repeated requests and reminders.
(V) It was assured to dispense the confirmation
examination and stated that it will be included in
the revised recruitment rules for Postal Asst. it is
requested to expedite the same.
15. Non-allotment of adequate funds to clear
Personal Claims of the officials.
The adequate funds under OTA, TE, HON,
have not been allotted to circles. The circles have
been advised to spent1/12th every month of total
al lotment for the year and whenever we are
demanding to clear pending bills, we have been
replied that adequate funds are available. But the
reality is different.
In many divisions, the TA Bills are pending since
2004/2005. OTA Bills are pending years together;
Medical Bills are also pending similarly. For instance,
in Ongole division in A. P. Circle, T.A Bills are pending
since 2002 amounting to Rs. 1200000 approximately
where as the allotment of 3 lakhs only was made for
the current year. Similar is the position of most of the
divisions.
It is therefore requested to correctly assess the
total requirement of funds under all heads from all
divisions and seek extra allotment of funds from the
MOF as one time measure as it was done earlier and
wiped out the pending bills then.
16. Inspector post Examination - Request to
increase the number of chances
In accordance with the Directorate letter No. A-
3402/01/2007-DE. Dt 13.4.07, the surplus qualified
candidates who are available over & above the selected
candidates in a circle can be allotted to the different
circles. This has given effect from 2007.
In many circles, the officials who secured higher
marks in the I.P.O. Exam but could not be declared
successful due to dearth of Vacancies in their circles
have exhausted the maximum number of chances
earlier. As such, the benefits of this order do not reach
the merited candidates.
It is requested that due to introduction of new
system, one more chance be given to the officials who
exhausted their chances to appear in the ensuing I.P.O.
examination.

Recoveries on alleged grounds of so-calledcontributory negligence are increasing day by day.Subordinate Officers follow only one Rule-the inhumanRule of recovering the entire losses sustained byGovernment from innocent employees foisting on theunfortunates some charge or other. The charge isusually that the employee did not adhere to this orthat rule in the discharge of duties. The rules arequoted only when a loss occurs. The dishonest elementmore often, goes scot-free. Many of the subordinateOfficers did not care about whether the workingconditions provided by them permitted the employeeconcerned to observe the rules. The shortage of staffand overburden of work are not taken in to account.The extenuating factors are not at all considered whileordering the recovery. There are also some officerswho conspire to shield the real culprit and punish theinnocents. In short 'Pardoning the guilty andprosecuting the innocents' is the order of the day indeciding such cases.
We reproduce below some orders ofGovernment, which sympathise with the innocents.They may be carefully studied.1) Extracts from D.GP&T Memo No. 6/8/59-DISCdated 9.7.1959"The nature and magnitude of the offence on the partof each official determine the penalty prima-faciejustified. Therefore, the Disciplinary Authority should,before initiating departmental proceedings, determinewhether action should be taken under rule 15 or rule16 of the Central Civil Services (Classification, Controland Appeal) Rules, 1957. If only one of the minorpenalties is called for, action should normally be takenunder rule 16 ibid so that the proceedings are notdelayed unnecessarily."
While it is important that every officialresponsible for mis-conduct or negligence should besuitably dealt with it is of equal importance that theconcept of contributory negligence' should be correctlyunderstood by the Disciplinary' Authorities and thereshould not be any attempt to somehow or other effectrecovery of the entire loss sustained by the Departmentby imposing punishments on official who are guilty ofonly minor omissions. In the interest of expeditiousaction it is important that 'contributory negligence'should be correctly assessed in a realistic mannerand while determining any omissions or lapses on thepart of an official, the bearing of such lapses on theloss considered and the extenuating circumstancesin which the duties were performed shall be given dueweight. For instance in the case of burglary in a post

office, if normal precautions are taken in the locking ofthe office or safe, holding an official responsible forcontributory negligence for the simple reason that oncertain previous occasions he had allowed the officesafe to be opened in his presence by a Class IV officialwould be a far-fetched hypothesis in regard tocontributory negligence and would cause unduehardship to officials and delay in the finalisation ofdisciplinary proceedings.2) Copy of D G P&T Memo No. 25/49/60-DISCdated 30.11.60In this office Memo No, 6/20/58-Disc. Cases still occur where neitherthe prescribed form is used nor there is any indicationin the charge sheet that action was contemplated formor indicate in the charge sheet that action wasproposed under Rule 16 of the C. C. S (C.C.A) Rules,1957, or that it was proposed to impose a particularpenalty, the proceedings become liable to be halted.
One of the penalties prescribed in rule 13 of theCentral Civil Services (classification, Control and Appeal)Rules, 1957 is recovery from pay of the whole or part ofany pecuniary loss caused to the Govt. This penaltycan be imposed, only when it has been establishedthat the Govt, Servant concerned was negligent in theperformance of his duties or was responsible for breachof rules or orders and that the loss was caused bysuch negligence or breach. It has come to notice, thatin quite a few cases punishment orders do not containa finding on these two important issues in clear andprecise terms. In some, the relation between thenegligence or breach of orders or rules and the loss isleft out while in some this relation is so looselydescribed as would be capable of a construction otherthan that intended. As such punishment order are liableto be successfully challenged. In is necessary that thedisciplinary authorities word these orders carefully andin conformity with the language of the rule. In other words,they must contain a clear finding on the following points:-I. That the Govt. servant was responsible for a particularact or acts of negligence or breach of orders or rules andII. That such negligence and/or breach of ordersor rules caused the loss.
It is of course necessary that the punishmentorder should discuss the case fully so as to clearlybring out that the finding/findings have been arrived atafter the punishing authority has applied his mindthereto.

l Drawal of HRA in respect of Chinsurah R.S,
Magra & Adconagar PO in West Bengal Circle.
It is constrained to note that due to protracted
delay in obtaining Dependency certificate from the
District Collector for renewal sanction, the due HRA
at par with Hoogly city has not been drawn and paid
to the staff working at Magra & Adconagar from 1.8.01
and Chinsurah R.S from 1.1.02. The delay is
deplorable.
It is requested to cause necessary actions to
clear the sanction up to the current period.
Further, it is requested to consider whether such
lengthy procedure of obtaining dependency certificate
from other department consuming a lot of time can be
dispensed with for the renewal sanction of HRA once
in three years.

Letter No. P/2-13/Nanded dated :21.09.2007
addressed to the Secretary, Department of Posts
l Fraud committed in R.D. Accounts at
Nanded HO-request immediate action.
It is constrained to note that one Sri A.A. Dayna,
PA, Nanded HO has committed fraud in the single RD
accounts only to the tune of one lakh which come to
light two years back.
There are many more items which could be
detected if the enquiry is properly made from MPKY
and PRSS accounts. Since the delinquent is the brother
LETTERS TO DEPARTMENTof then SPOs, Nanded division, the enquiry has been
halted at the initial stage itself even after two years.
We feel that at later date, the innocent officials
may be brought under the net of contributory factors
by acquitting the culprit in this episode. This causes
a serious concern.
It is therefore requested to cause necessary
instructions to the circle administration to expedite
the enquiry and punish the guilty without hearing the
pressure exerted by the then SSPOs who is said to
be protecting culprit in this case.

Bi monthly meeting with Director has not been settled
and protracted on one pretext or the other.
(i) Issuance of M.D.W in respect of Divisional
office.
(ii) Distribution of L.R.P.A in operative units.
(iii) Redeployment of two PAs to F.P. import
section.
(iv) Supply of C- 1 bags to F.P. import section.
(v) Publishing the revised Gradation list.
(vi) Arranging supply of Postal manuals/ volumes
in Operative Sections.
The divisional union is taking up the issues
regularly to honour the assured items of the Bimonthly
meeting and nothing has been settled so far resulting
resentment amidst officials.

PRI (P) should get AMFI qualification with in a period
of three months and if they fail to get AMFI

to the circle administration, Tamilnadu circle to
withdraw such condition enforced on PRI (P) s by the
regional administration immediately.

riverbank. Most of the Postal workers are visiting this
place frequently where no proper guest house/hotels
are available.
The demand over two decades by the Circle
Union to provide a Holiday Home at this place has not
been considered favourably so far.
It is therefore requested to consider the same
and provide Holiday home at the earliest.

l Provision of construction of 228 numbers
of Cycle/Scooter shed at P&T colony, unit IV,

Orissa Circle vide his letter No. Bldg/16-261/2006 dt.
17.8.07 has requested for provision of funds allotment
to the tune of Rs 32,55,417 for the proportionate share
to Telecom towards the proposed construction of
Cycle/Scooter shed at P&T colony, unit IV.
Bhubaneswar.
It is requested to expedite the approval and allot
funds at the earliest so that the above work can be
completed in the current financial year.

l Harassing staff in the name of Business
activities case of Hoshangabad Division in M.P.
Circle.
It is rather shocking to note that the SSPOs,
Hoshangabad has issued a letter on 7.9.07 directing
all the Postal employees to purchase one KVP at once
compulsorily and five KVP certificates by all SPMs
before 25.11.07. The copy of the letter is enclosed
herewith for your information.
This kind of threatening is causing a serious
concern. I hope you will not agree to this kind of
developing business by harassing the staff to buy
certificates. I trust you will intervene and set right
matters and halt this kind of harassment on staff if
unleashed elsewhere.

Letter No.P/2-4/ Raipur dated- 27.09.2007 addressed
to the Secretary, Department of Post
l Unhelpful and anti worker attitude of Chief
PMG Chhattisgarh Circle.
Ref: your letter No. 16-68/2007-SR dt. 22.8.07.
Apropos references, it is dismayed to note that
the Circle administration has not given full facts of the
case and furnished fabricated report to the Directorate.
1. Sri B.L. Gangber, SPM Sankar Nagar and also
the Divisional Secretary of the union has been shifted
from the SPM post merely for non writing of one day
entries in the copy of the S.O. Account. Repeat not a
longer period and that too due to heavy work carried
out in the office. For the reason, he has been proceeded
Rule under 16 in order to justify his shifting from the
SPM Post. This is nothing but blatant misuse of power
against the staff representative of the division.
2. Sri M.K. Sharma, Divisional Treasurer of Raipur
division is a LSG FTP official and the Chief PMG has
issued orders on 7.7.07 to accommodate him at Raipur
HO by downgrading the post of Raigarh since the
official would face transfer to the distance of more than
400 kms. The order was cancelled on 9.7.07 due to
intervention of the rival union Circle Secretary. The Chief
PMG is favouring the rival union members to the
maximum extent. One Sri C.G. Goswami, ACS of
National union is permitted to occupy the staff quarters
even after his transfer from Durg.
3. Sri V. K. Agarwal, Divisional Secretary, Durg
division and a qualified S.B. official has not been
considered for transfer to Durg HPO, despite unqualified
officials are working at HO. On the other hand, the

Chief PMG has favoured the then Circle Secretary
and transferred him three times within two years and
posted at Durg eventhough one HSG I Post was lying
vacant at Raipur. This shows his undue favouritism
extended to rival union.
4. One of the Asst Circle Secretary of this union
working at Raigargh division has been transferred to
Ambikapur on his promotion to LSG even though there
was a vacancy at Raigarh.
The Chief PMG is totally unhelpful and resorting
vendictive action against the office bearers of this union
due to pointing out of certain issues by the Circle Union
in person like,
a. Improper utilisation of Gardener
b. Utilisation of Power Supply from office to
quarters portion.
c. Wrong policy in computerisation programme
which ends a stand still and a total misled report
sent to Directorate.
d. Threatening the staff on the pretext of
computerisation even after receiving fullest
support from staff.
e. Undue favouritism extended to rival union and
acting as per their wishes.
In nutshell, there is a total resentment among the
staff and apprehension prevailed due to the threatening
postures of the Chief PMG. It is told that a number of
Group 'B' officers sought voluntary retirement in the recent
past due to his abuses and high handed action.
It is therefore requested to intervene effectively
and set right the situation at the earliest to ensure
peace and amity in the circle.

l Acquisition of Miraj S.R. PO-C/o Sangli
Division, in Maharastra Circle.
The building of Miraj HO which is functioning
now at Miraj S.R. PO is under the possession of Postal
department over 110 years and it is centrally located
in the corporation of Miraj city.
The building is owned to state and if we process
for acquisition of the land, it will be a better one for the
future construction of departmental building for the HO
& its development activities.
It is requested to consider the same and reply
at the earliest.
Sub: Applicability of CCS (Pension) Rules 1972in respect those appointed prior to 1.4.04 andput on induction training- clarification sought far.
Kindly refer to the Dept of pen & PW OM No.
38158/06-P & PW (A) dt 11.10.06 in which it was
clarified that due to the request made by the Staff
Side of the National council (JCM), the Govt.
considered and clarified that the employees who were
put on induction training after their appointment prior
to 1.1.04 and are paid salary from that date would be
covered under CCS (Pension) Rules 1972.
So for the Postal employees who were
appointed and put on training are paid not salary but
stipend only. According to the orders stated in para
supra, the officials who are paid salary during training
period before 1.1.04 will be covered by CCS (Pension)
Rules 1972. This has beneficial only to the IAS, IPS
officers who are alone drawing salary for their training
period and it is definite that the staff side shall not
take up such issues for officers in the JCM.
In fact, this order is not beneficial to any Group
C or Group D staff.
It is requested to take up this case at
appropriate level and see the clarification should be
applied for those employees who were on training on
1.1.07 and drawn stipend for their training period.

promotion is granted to him due to non holding DPCs
by the Circles for years together.(e.g.M.P.Circle).
5. The promotional avnues of Accountant is much
limited as lesser posts of APM(A/Cs) of HSG-II/I cadre
are created/available.

Growth has made pay parity possible

A wage is considered the product of collective
bargaining reckoned with reference to the productivity
and profits of an enterprise. Trade unions play a vital
role in making the bargain effective from the workers'
standpoint. In the case of government employees,
though the right to form associations is afforded, the
right to strike is denied.
Having thus shut out collective bargaining, the
periodical wage revision for government employees had
been-and continues to be-through the Pay
Commission. Even before the Royal Commission
(presided over by Raymond Priestly) on UK's civil
services propounded the theory of "fair comparison"
as the primary principle of wage determination, the
First Pay Commission set up by the colonial rulers in
the wake of the phenomenal price rise in the post-war
economy of our country, had advocated that a fair
relativity should be maintained between the rates of
pay of civil servants and outside rates, with a caveat
that in no case should pay be less than a living wage.
The Second Pay Commission, which came into
existence in 1957-59, asserted further that comparison
should be with the rates of remuneration in enterprises
in which personnel problems, viz, recruitment, condition
of service etc, are dealt with in a systematic manner.
The commission went on to suggest that while at the
lowest level, the socio-economic necessity of providing
a fair wage or a living wage is to be adhered to, with
regard to the highest salaries, retaining persons with
requisite talent and qualifications must be an important
criterion. The commission approvingly quoted the
dictum incorporated in the First Five-Year Plan report
that the "wages in public undertakings should not be
less favourable than those prevailing in the
neighbouring private enterprise".
It is also pertinent to note that the Royal
Commission was of the view that "fair comparison" as
the primary principle of wage determination is not only
fair to employees but also to the community at large.
For, if the government, which represents the interest
of taxpayers, pay what responsible employers pay for
comparable work, citizens cannot reasonably complain
that they are being exploited.
Having stated this laudable principle of wage
determination, none of the pay commissions translated
it into reality. The 15th Indian Labour Conference (ILC)
resolution on "need-based minimum wage", basing
upon the Dr Aykroyd formula of a net intake of food
which provides 2,700 calories for an average Indian
adult of moderate activity, was deliberated at length
by the Third Pay Commission and discarded.
It is the bounden duty of the government to
provide the "need-based minimum wage" computed
on the basis of the 15th ILC norms at the lowest level
of the government hierarchy, given the fact that the
country's economy has registered a growth rate of 8-
9% in recent years and its revenue has gone up
considerably, whereby the wage bill as a percentage
of tax revenue has come down to 9% today from 21%
in 1997-98.
In the matter of salaries at the highest level,
the government has to be guided by the requirement
of retaining persons with talent, ability and
qualifications needed for a highly complex job. Some
of the large corporate houses in the country pay
exorbitant salaries to their executives. This has led to
personnel at various levels in government service
migrating in search of the fabulous monetary benefits
offered by private entrepreneurs. While it would be
inadvisable to disregard this fact, the government's
decision in the matter will have to be tempered with
the equally important requirement of maintaining a
reasonable ratio between the minimum and maximum
salary. The principle of wage determination for
government employees has undoubtedly to be
the basis of a fair comparison of wages obtaining in
private and public sector undertakings.

Consider the perks & job security, too

Globalisation and the consequent stiff
competition in the labour and product market has led
to a demand from several quarters for the need to have
parity in pay and allowances between government/
public sector jobs and those in the private sector. It is
argued that in the absence of such parity, there will
be a flight of talented and competent manpower from
government to private sector, seriously eroding the
efficiency of the former. Such a trend is already visible
to some extent.
Although it should be admitted in general that

such a challenge might exist in a few sectors, such
an argument has serious limitations, and is in fact
dangerous at this stage of our development. First, the
nature of a government job is overwhelmingly that of
public utility and non-commercial. That is why such
jobs are mostly treated as services and hence the
nomenclature 'Indian Administrative Service', 'Indian
Foreign Service', etc. Most public utilities are heavily
subsidized by the government (and, hence, taxpayers'
money).
In such a situation, it would be erroneous to
treat these jobs in the same category in those in the
profit-making private sector. This also suggests that
while selecting people for government and public sector
jobs, the spirit of service should be kept in mind.
However, a distinction may be made between public
sector commercial undertakings and public utilities.
While some parity in crucial jobs (not CEO) between
public sector commercial undertakings and private
sector may be considered, the social responsibility of
the former (eg, lending by commercial banks to the
priority sector, etc) should also be kept in mind.
Second, most government jobs have many other
hidden benefits such as housing, shorter working hours
and a higher welfare component (pension, etc). Around
90% of employees in the private sector do not get
pension, whereas it is almost universal in the case of
government jobs, notwithstanding recent reforms in
the pension system. A secretary to the government of
India living in a posh Delhi colony with several other
perks cannot be compared only in terms of so-called
monthly salary with private sector professionals. That
is why the real difference between the two groups may
not be as high as is generally thought to be. Further,
it should be kept in mind that an overwhelming large
percentage are disadvantaged as their counterparts
in government.
Thirdly, there is almost universal security of job
in the government sector, against high risks in private
sector. The psychological and mental stress through
which professionals in the private sector go through is
enormous. Even lower middle and lower level
employees in a vast majority of the private sector face
extreme uncertainty.
Lastly, the very high salary and perks for a small
percentage of people is also unethical as well as has
the potential of leading to social unrest in a country
like India with widespread poverty and where more than
half of rural labourers do not get a minimum wage
(which is just a subsistence wage).
And, ironically, there has been a significant
growth in consumption by middle and higher income
groups. Such a widening social divide is very unhealthy
for Indian society and its polity. The incidence of
Naxalism and violence in a vast tract of rural India is a
manifestation of such acute social and economic
deprivation.
Therefore, one should not loose sight of these aspects
while considering an income and pay policy. There is
need for a delicate balance between equity and social
stability on one hand, and meeting the challenge of
globalisation on the other. Hopefully, the Sixth Pay
Commission will not be blindly dictated by market
considerations.

OFFICE MEMORANDUMThe undersigned is directed to refer to this
Ministry's Office Memorandum No. 1 (2)/2007-E-II (B)/
64 dated 22nd March, 2007 on the subject mentioned
above and to state that President is pleased to decide
that the Dearness Allowance payable to Central
Government employees shall be enhanced from the
existing rate of 35% to 41% with effect from 1st July,
2007
2. The provisions contained in paras 3,4 and 5 of
this Minstry's O.M. No. 1 (13)/97-E-II (B) dated
3.10.1997 shall continue to be applicable while
regulating Dearness Allowance under these orders
However, with effect from 01-04-2004, Dearness
Allowance is computed on the basis of Basic Pay,
Dearness pay, Stagnation Increment and NPA.
Provisions contained in para 3 of this Ministry's OM
No.1(13)/97-E-II(B) dated 03-10-1997, therefore, stand
amended to this extent.
3. The additional installment of Dearness
Allowance payable under these orders shall be paid
in cash to all Central Government employees.
4. These orders shall also apply to the civilian
employees paid from the Defence Services Estimates
and the expenditure will be chargeable to the relevant
head of the Defence Services Estimates. In regard to
Armed Forces personnel and Railway employees
separate orders will be issued by the Ministry of
Defence and Ministry of Railways, respectively.
5. In so far as the persons serving in the Indian
Audit and Accounts Department are concerned, these
orders issue after consultation with the Comptroller
and Auditor General of India.

l Setting up of an Economic Cell in the
Department of Posts - Items of work to be assigned
to the Economic Cell - reg.
Vide letter no. 23-6/2005-PE-II dated 17-07-
2007, an Economic Cell was set up in the Deaprtment
GOVERNMENT ORDERS
of Posts to improve the quality of economic analysis
of the work being undertaken in the Department, to
analyse all proposals "from the economic angle, as
distinct from the financial point of view", and to make
economic analysis an integral part of presentations/
reports, as well as the Annual Plan.
2. The Economic Cell shall perform the following
functions:
(i) Demand and usage pattern of postal services.
(ii) Postal revenue analysis and forecast.
(iii) Investment planning and financial projections
of Department of Posts based on cost-benefit
analysis of all Plan and Non-Plan schemes
using opportunity cost and shadow price where
necessary.
(iv) Appraisal of the Annual Plan, Mid-Term
appraisal etc.
(v) Economic Analysis and performance of postal
units by accessing National Data Centre.
(vi) Approach to new Pricing Policies for postal
products/services/packages business
partnerships.
(vii) Economic analysis of Global Business
environment.
(viii) Other miscellaneous types of work such as:
a) Vetting of policy papers prepared by
other divisions from economic angle.
b) Advice on policies of other Ministries.
c) Preparation of Discussion Paper for
Planning Commission/Standing
Committees.
d) Interaction with bodies such as FICCI,
CII, ASSOCHAM etc.
e) Any other work entrusted by the
Department.

l Role of Assistant Superintendent of Posts -new duties and responsibilities - regarding.
OFFICE MEMORANDUM
This is regarding new duties and responsibilities
of Assttt. Supdt. of Posts in the changed scenario of
the Department of Posts, and also keeping in mind
the need to implement the new technologies at all
levels of the Postal business.
2. Asstt. Supdt. of Posts, in post offices as well
as mail offices, are the first level managers in the
Postal service. The Department, in spite of having

conferred Gazetted status on this level of officers, has
not yet taken full advantage of the additional
responsibilities that their new role carries. In order to
bring them in tune with the needs of the Department
in the present system, it is proposed that their role
should be expanded and redefined.
3. As Head of the Sub-Division, the ASPOs will
maintain a comprehensive MIS for all Branch Offices
and Post Offices. This MIS will contain detailed
information of every aspect of each Post Office /
Branch Office including revenue earned, expenditure,
business earned, SB accounts and RPLI business,
mail statistics etc.
4. He will set targets for individual Branch Post
Office and the Sub-Post Office. This target will be
assessed in terms of its potential, with an eye on the
total population and kind of businesses carried out in
the locality i.e. whether the surrounding population are
involved in agriculture or some other business. For
this, he will make an assessment of the economic
trends in the village or town in which this Post Office
exists. This information will also be available in the
MIS he will maintain. He will assess the business
available in that Post Office, types of mail business
and the quality of the delivery of that Post Office,
whether it has manpower to carry out its duties in
mail processing for delivery or whether it has manpower
to carry out its duties in mail processing for delivery or
whether it has manpower to carry out its duties in
mail processing for delivery or whether it needs to be
augmented or reduced as the case may be.
5. In the Post Office under his control, he will
assess the status of financial services of SB accounts.
He will also set a target for the Branch Post Master in
opening of SB accounts and marketing of SB
accounts. He will continuously visit SB account
holders within his jurisdiction and satisfy himself that
there are no serious complaints. He will also take views
from SB account holders as to how to improve the
service. If there is IMTS in that Post Office, he will
meet the clients and also conduct surveys for improving
the business together with the Post Master. He will
set targets to the Branch Post Masters for generating
PLI business. He will also ensure that all applications
received for enrolment in PLI and RPLI are disposed
off within 10 days.
6. He will equip himself with all knowledge with
regard to technology, software and computers and
other programmes available in the Post Office so that
he can function as an effective trainer of the staff in
the Sub-Division. He should be able to find solutions
to simple technology problems faced in the Division
under his jurisdiction.
7. He will constantly monitor the rural operations,
talk to local Panchayat Heads so that he is a familiar
figure with the village Committees where his Post Office
functions. He should meet the Village Headman and
other important people to publicize Postal
programmes.
8. The role of ASRMs in Mail Offices and BulkMail Centres - When attached to Mail Offices or
Business Mail Centre, the ASRM will supervise the
Distribution of work, making sure that requisite
manpower is available. He will monitor the inflow and
outflow of mail with a view to rationalize distribution of
work. He will review all bags received/dispatched & to
be closed. He will continuously review mail
arrangements with a view to optimize quick and
economical flow of mails. He will liaise with rail, airline
and transport authorities wherever necessary. He will
identify areas where there is a hold-up of mail and
advise the Divisional Head on options available. He
will continuously review the quality of sorting so as to
advise and also upgrade the abilities of Sorters
attached to that Office. If necessary, he will arrange
short training session for SAs of his Unit. He will
promptly report to Divisional Head cases of accident,
break down, shortage of staff, hold-up of mail or any
other incident that affects the flow of mail. He will liaise
with big mailers and corporates and also set a target
for bringing in more mail/revenue.
9. Therefore, the additional role and responsibility
of ASP/ASRM will be as follows:

10.1 Maintain contact with corporate customers to
solicit new business and providing customer services.
10.2 Take on the job associated with key account
management in terms of maintaining contact, billing,
monitoring of business volumes.
10.3 Maintain related databases of the businesses
and ability to forecast the mailing pattern and planning
for the mailing rush periods.
10.4 Gather business intelligence about the
functioning, quality offered and pricing strategies of
the competitors.
11. OPERATIONS
11.1 Design operational procedures, build up
standard operating procedures for customized solutions
and design business packages including cost
components for business packages.
11.2 Ability to plan the operations in accordance with
the requirement of the customer.
11.3 Have comprehensive understanding of the mail
management and mail arrangements in their territory.
11.4 Develop and implement quality control systems
in the mail stream and regular monitoring of quality

targets.
11.5 Participate in the quality test and develop a feed-
back system from customers and maintain such MIS.
11.6 Monitor the delivery efficiency associated with
local Post Offices.
11.7 Monitoring of new financial services,
international monetary transfer services, electronic
fund transfer and rural Postal Life Insurance Schemes
and other e-enabled services.
11.8 Assist in promoting Philately amongst schools
and colleges.
12. TECHNOLOGY
12.1 Ability to work on the technological solutions
for the mail businesses, provide feed-back and
implementing these solutions either at postal premises
or premises of the customers.
12.2 Implementation/monitoring/supervision of the
operation of MPCMs, EFMs (Electronic Franking
Machines)
12.3 Monitoring of new financial services,
international money transfer services, electronic fund
transfer and rural PLI Schemes and other e-enabled
services.
13. HRD
13.1 Maintenance of MIS of the Mail Office/Business
Mail Centres/Post Office/Sub-Division about staff
profile, their workload, substitute arrangement,
establishment and TRCA etc. and maintaining data
about the growth of business in the Sub-Division.
13.2 Ensure discipline in the office and other
statutory job requirements.
14. LIAISON WITH STAKE HOLDERS
14.1 Maintain excellent relations with other serviceproviders like railways, airlines, transport agencies,suppliers and other contractors to ensure availabilityof services at all time.

l Amendment to the provisions of Rule 10 ofCCS (CCA) Rules, 1965 regarding review ofsuspension
The undersigned is directed to refer to theprovisions of Rule 10 of Central Civil Services(Classification, Control and Appeal) Rules, 1965 andto say that the provisions regarding deemedsuspension have since been reviewed by thisDepartment.
2. The provisions in Rule 10 of CCS (CCA) Rules
have been modified and amendment to the same have
been notified in Notification No. GSR 105, dated
06-06-2007 published in the Gazette of India, dated
16-06-2007.
3. As per the original provisions of Rule 10 of the
CCS (CCA) Rules, 1965, the provision for review within
ninety days was applicable to all types of suspensions.
However, in cases of continued detention, the review
becomes a mere formality with no consequences as
a Government servant in such a situation has to
continue to be under deemed suspension. It has,
therefore been decided that a review of suspension
shall not be necessary in such cases. Accordingly, a
provision has now been added to sub-rule (7) of the
said Rule 10 as follows:
"Provided that no such review of suspension shallbe necessary in the case of deemed suspensionunder sub-rule (2), if the Government servantcontinues to be under detention at the time ofcompletion of ninety days' of suspension and theninety days period for review in such cases willcount form the date the Government servantdetained in custody is released from detentionor the date on which the fact of his release fromdetention is intimated to his Appointing Authority,whichever is later".
4. In deemed suspension under sub-rule(2), the
date of order of suspension may be much later than
the deemed date of suspension. With a view to making
these provisions explicit, sub-rule (6) of the aforesaid
Rule 10 has now been amended to substitute the
words "ninety days from the date of order of
suspension". Consequent upon this amendment, it
would henceforth be necessary to specifically indicate
in the orders of suspension the effective date of
suspension.
5. Sub-rule (7) of the aforesaid Rule 10 stipulates
says that "Notwithstanding anything contained in sub-
rule (5) (a), an order of suspension made or deemed
to have been made under sub-rule (1) or (2) of this rule
shall not be valid after a period of ninety days unless it
is extended after review, for a further period before the
expiry of ninety days." Sub-rule (5) (a) of the aforesaid
Rule 10 has, therefore, now been amended to read as
follows:-
"Subject to the provisions contained in sub-rule(7), an order of suspension made or deemed tohave been made under this rule shall continueto remain in force until it is modified or revokedby the authority competent to do so."
Consequently, the words "Notwithstanding
anything contained in sub-rule (5) (a)" stated in sub-
rule (7) of Rule 10 have become redundant and have

therefore, been deleted.
6. In so far as persons serving in the Indian Audit
and Accounts Department are concerned, these
amendments have been made in consultation with the
Comptroller and Auditor-General of India.
7. All Ministries/Departments are requested to
please bring the aforementioned amendments of Rule
10 of the CCS (CCA) Rules, 1965 to the notice of all
Disciplinary Authorities under their control and ensure
that review of the orders of suspension is conducted
strictly in conformity with the amended provisions
thereof.

l Simultaneous action of prosecution in acourt and initiation of departmental proceedings
The undersigned is directed to refer to the
M.H.A. O.M. No. 39/30/54-Ests., dated the 7th June,
1955 and No. 39/8/64-Ests., dated the 4th Sept., 1964
on the above subject which state that prosecution
should be the general rule in all cases which are found
fit to be sent to Court and in which the offences are of
bribery, corruption or other criminal misconduct
involving loss of substantial public funds and that in
such cases departmental action should not precede
prosecution. References are being received in this
Department seeking clarification as to whether
departmental action can also be taken where the same
matter has been taken up in a court of competent
jurisdiction for prosecution of the Government servant
concerned.
2. What may be deduced from the above
instructions is that, in serious cases involving offences
such as bribery/corruption, etc., action should be
launched for prosecution as a matter of course. The
Hon'ble Supreme Court had held in their various
judgments the important ones being State of Rajasthan
v. B.K. Meera and others [1996 6 SCC 417]. Capt. M.
Paul Anthony v. Bharat Gold Mines Limited [1993 3
SCC 679], Kendriya Vidyalaya Sangathan and others
v. T. Srinivas [2004 (6) SCALE 467] and Noida
Entrepreneurs' Association v. Noida [JT 2007 (2) SC
620] that merely because a criminal trial is pending, a
departmental inquiry involving the very same charges
as is involved in the criminal proceedings is not barred.
The approach and objective in the criminal proceedings
and disciplinary proceedings are altogether distinct
and different. In the disciplinary proceedings, the
question is whether the respondent is guilty of such
conduct as would merit his removal from service or a
lesser punishment, as the case may be whereas in
the criminal proceedings, the question is whether the
offences registered against the Government servant
are established and if established, what sentence can
be imposed on him. In serious nature of cases like
acceptance of illegal gratification, the desirability of
continuing the concerned Government servant in
service in spite of the serious charges leveled against
him may have to be considered by the Competent
Authority to proceed with departmental action.
3. However if the charge in the criminal case is of
a grave nature which involves complicated questioned
of law and fact, if would be desirable to stay the
departmental proceedings till the conclusion of the
criminal case. This will depend upon the nature of
offence and the evidence and material collected
against the Government servant during investigation
or as reflected in the charge-sheet. If the criminal case
does not proceed or its disposal is being unduly
delayed, the departmental proceedings even if they
were kept pending on account of the pendency of the
criminal case can be resumed and proceeded with so
as to conclude them at an early date so that if the
employee is found not guilty, the administration may
get rid of him at the earliest if the case so warrants.
4. In the case of Hindustan Petroleum Corporation
Ltd. v. Sarvesh Berry [2004 (10) SCALE Page 340], it
has been held in Para. 9 that "it is not desirable to lay
down any guidelines as inflexible rules in which the
departmental proceedings may not be stayed pending
trial in criminal case against the delinquent officer.
Each case requires to be considered in the back-drop
of its own facts and circumstances. There would be
no bar to proceed simultaneously with departmental
inquiry and trial of a criminal case unless the charge
in the criminal trial is of grave nature involving
complicated questions of fact and law. The Apex Court
has referred to the conclusions given in Para. 22 of
Captain M. Paul Anthony's case.
5. It is therefore, clarified that stay of disciplinary
proceedings is not a must in every case where there
is a criminal trial on the very same charges and the
concerned authority may decide on proceeding with
the departmental proceedings after taking into
consideration the facts and circumstances of each
case and the guidelines given by the Hon'ble Supreme
Court as mentioned in the preceding paragraphs.
6. All Ministries/Departments are therefore
requested to keep in view the above guidelines while
dealing with cases of criminal misconduct of
Government servants.

Appeal No. 143 of 2001 filed by Shri Surinder
Singh against Union of India and others against

the judgment and order, dated 27-09-2000 of HighCourt of Punjab and Haryana at Chandigarh inCivil Writ Petition No. 13280-CAT/2000
I am directed to forward a copy of judgment,
dated the 30th March, 2007 on the above subject,
delivered by the Apex Court. In this case, the following
questions of law have been raised before the Supreme
Court :
(i) Whether the selection to post of EDDA (now
called GDS Mail Deliverer) can be quashed
by the Tribunal when minimum qualification
prescribed for a Post is middle standard and
merit list is prepared on the basis of marks
obtained in the preferential qualification, i.e.
matriculation, and
(ii) Whether the Tribunal is competent to lay down
the procedure for selection of a candidate and
further empowered to impose conditions and
restrict the exercise of the power of the
employer in making the appointment as per
prescribed rules.
2. The Hon'ble Supreme Court has taken into
consideration the following orders issued by the
Department:
(a) Letter No. 17-366/91-ED & Trg., dated 12-3-1993.
(b) Letter No. 19-17/97-ED & Trg., dated 21-11-1997.
The Apex Court at P. 10 of judgment has observed
that "guidelines/norms/instructions clearly stipulate
that if the candidates, who have passed matriculation
examination, are available for selection to the posts of
EDDA, the selection should be made by the Selection
Committee on the basis of the marks obtained by the
candidates in preferential qualification (i.e.
matriculation) and in the absence of matriculate
candidates, the selection has to be made on the basis
of essential qualification, viz,. 8th standard. It appears
that the CAT as well as the High Court, both have lost
sight of the object and import of the Guidelines/Norms/
Instructions, dated 21-07-1998 laid down by a
Competent Authority. The CAT is not competent to
lay down criteria for the selection and appointment to
the post of EDDA. It is the prerogative and authority of
the employer to lay down suitable service conditions
to the respective posts.
In our view, in service jurisprudence, the
prescription of preferential qualification not only refers
to numeric superiority but is essentially related to
better mental capacity, ability and maturity to shoulder
the responsibilities, which are entrusted to the
candidates after their selection to a particular post.
All the more, it is important for efficient and effective
administration. The basic object of prescribing a
minimum qualification is to put a cut-off level for a
particular job in accordance with the minimum
competency required for the performance of that job.
The object of prescribing preferential qualification is to
select the best amongst the better candidates who
possess more competence than the other. Sub-clause
(iv) of Clause 3 puts a limit with respect to preferential
qualification by way of a clear stipulation that no
preference should be given to the qualification above
matriculation. Hence, the preferential qualification was
considered to be more effective and efficient and also
it was a clear assumption that a candidate possessing
the same is best suited for the post in question.
………….In Government of Andhra Pradesh v.
P. Dilip Kumar and another [(1993)2 SCC 310], this
Court in Paragraph 13 held as under :-
"13…………. There is nothing arbitrary or unreasonable
in the employer preferring a candidate with higher
qualification for service. It is well settled by a catena
of decisions that classification on the basis of higher
educational qualification to achieve higher
administrative efficiency is permissible under our
constitutional scheme".
Further in Paragraph 15, it is observed as under :
"15…………..It is true that notwithstanding the
preference rule it is always open to the recruiting agency
to prescribe a minimum eligibility qualification with a
view to demarcating and narrowing down the field of
choice with the ultimate objective of permitting
candidate with higher qualifications to enter the zone
of consideration."
In view of above stated factual situation and
settled position of law, the orders of the CAT as well
as High Court cannot be sustained."
3. You are requested to bring the contents of this
important judgment to the notice of all concerned for
information, guidance and necessary action. If any
such case is presently pending before CAT/High Court,
the contents of this judgment may be brought to the
notice of the concerned CAT/High Court, through
CGSC.

Some Circles/PSDs have sought for
clarification as to whether the enhanced rate for
chappals is also applicable to eligible lady
employees. In this regard, it is clarified that the upper
revised ceiling of Rs. 200/- for chappals would be
applicable to both ladies and gents. All other terms
and conditions of the letter dated 03-05-2007, referred

cities on the basis of the population figures of 2001
census for the purpose of House Rent Allowance/
Compensatory (City) Allowance to the Central
Government Employees and to say that consequent
upon re-constitution of the area of Hyderabad Municipal
Corporation and re-naming it as Greater Hyderabad
Municipal Corporation with the addition of certain areas
within its Municipal limits vide notification dated 16-
04-2007 of the Government of Andhra Pradesh, the
population of 'Greater Hyderabad Municipal
Corporation' has increased, and therefore qualifies for
classification as 'A-1 class city for the purpose of
House Rent Allowance. Compensatory (City)
Allowance to the Central Government employees.
2. The President is, accordingly, pleased to decide
that Greater Hyderabad Municipal Corporation shall
stand classified as 'A-1' class city for the purpose of
grant of House Rent Allowance/Compensatory (City)
Allowance to the Central Government employees
posted at Greater Hyderabad Municipal Corporation.
3. These orders shall be effective from 1st
September 2007.
4. The orders will apply to all civilian employees

city for the purpose of grant of House Rent Allowance/
Compensatory (city) Allowance to the Central

3. These orders shall be effective from 1st
October 2007.
4. The orders will apply to all civilian employees
of the Central Government. The orders will also be
applicable to the civilian employees paid from the
Defence Services Estimates. In respect of Armed
Forces personnel and Railway employees, separates
orders will be issued by the Ministry of Defence and
the Ministry of Railways, respectively.
5. In so far as the persons serving in the India
Audit and Accounts Department are concerned, these
orders issue in consultation with the Comptroller &

class.
