BETTER APPLYING EUROPEAN CROSS-BORDER PROCEDURES Series of interactive legal and language training events for court staff in Europe

The Project

Under the Justice Programme 2014-2020, ERA is implementing in partnership with the European Judicial Training Network (EJTN) and the support of 23 national judicial training institutions from 19 Member States, a pilot project tackling the deficiencies of court staff training on European law.

The project will tackle gaps in training on EU law for court staff by developing standardised training materials in the area of EU civil law and by organising a series of training activities addressed exclusively to court staff from all over Europe.

In order to familiarise court staff with the relevant EU acquis and to increase their confidence in their future using of the available legal instruments and procedures, it is essential:

• To identify the court staff’s specific training needs;• To provide interactive and well-structured training;• To improve the court staff’s English communication

skills.

• Creating a standardised training package, consisting of practical case studies and a manual on legal terminology in English, for setting up interactive seminars in the specific area of cross-border civil litigation for court staff;

• Implementing a series of 20 legal seminars and 13 language training events around Europe, aimed at approximately 930 court staff;

• Developing both legal and linguistic skills of court staff members and strengthening their competences in order to facilitate cross-border communication and cooperation;

• Bringing together court staff training providers from 19 different EU Member States and providing them with a platform for exchange of best practices, sharing information and know-how;

• Ensuring a widespread future use of the training package by making it available in various official languages of the EU and by distributing it to all interested stakeholders.

Objectives

MethodologyAlthough there is a wide variety of training needs on EU law for court staff, this project will focus on an area with particular practical relevance for their work, namely the European cross-border civil procedures. The following instruments will be covered:

• Brussels Ia Regulation• European Enforcement Order• European Payment Order • European Small Claims Procedure• Service of documents• Taking of evidence

The training materials for the provision of legal training will mainly consist of case studies covering the abovementioned EU instruments. The materials will focus on tasks relevant to the work of court staff and be as basic and practical as possible. The case studies will be drafted in English and translated into French and German right upon their finalisation. For the provision of language training a manual on legal terminology in English including language exercises will be developed. The exercises will focus on developing four skills: reading, writing, speaking and listening.

Legal seminarsThe 20 legal seminars will have a duration of 1.5 days and will be addressed to max. 30 participants each. The training will be based on introductory face-to-face presentations and the solving of the developed case studies. Each seminar will deal with one of the following topics:

• Cross-border enforcement of civil law claims: simplified European procedures

Participation fee: € 250

Accommodation: The participation fee includes maximum 2 nights at the hotel booked by ERA.

Travel: Selected court staff will receive a significant contribution to their travel costs upon receipt of the original invoices, tickets and receipts. Participants are asked to arrange their own travel.

Legal English training events on European cross-border procedures

In parallel to the organisation of the purely legal seminars, a series of 13 English language training events will be implemented. Each event will have a duration of three days in total and will be addressed to maximum 26 court staff from various EU Member States.

The legal training will be conducted by three legal experts and the linguistic training by two professional linguists: all experts will have at their disposal the training materials (case studies & linguistic manual) specially developed for the implementation of these training events.

By the end of the project’s lifetime, the following results will be achieved:

• 33 training events for court staff organised throughout Europe;

• 927 court staff trained on EU civil law instruments;

• 6 sets of case studies and 1 linguistic manual developed;

• translation of the case studies in (partly) 16 EU languages;

• 1 webpage including all project’s deliverables.
