It’s that time again when we have to ask ourselves “where do our tax dollars go, by what method are these taxes levied, what is the procedure if I disagree with my appraised value, and what are my rights of representation should I so choose?” Well, let’s try to clarify some of these questions for you.

Property taxes are the largest funding source for local services such as public schools, city streets, county roads, police and fire protection and many other services. Local taxing entities are MUD #18, county of Montgomery, hospital district, emergency district #2, and Montgomery I.S.D. These taxing entities decide how much money they must spend to provide the public ser-vices and then set tax rates according to these budgets.

1) On January 1st of every new year, the Montgomery Central Appraisal District (MCAD) establishes the value of your property. A property’s valuation, or appraisal, depends upon the use of that property and the current market conditions at that point in time. The Texas Constitution sets out five basic rules for property taxation:

a. Taxation must be equal and uniform meaning that no single property or type of properties should pay more than their fair share of taxes;

b. Generally, all tangible property must be taxed on the basis of its current market value. A property’s market value is the price it would sell for when both buyer and seller seek the best price and neither is under pressure to buy or sell;

c. All property is taxable unless a federal or state law exempts it from the tax. The Texas Legislature may provide for constitutionally approved exemption;

d. Property owners have a right to reasonable notice of increases in appraised property value;

e. Every property in a county must have a single appraised value.

2) Between January 1st and April 30th of every year, MCAD makes value determinations for all taxable property within the county. After May 1st the Appraisal Review Board (ARB) begins hearing protests from property owners. If you think that your property value appraisal is too high, you can submit a Notice of Protest to the ARB. The role of the ARB is to settle disagreements between the property owner and MCAD regarding the property’s taxability and value. ARB members are private citizens appointed by MCAD’s Board of Directors. Prior to the ARB hearing an MCAD appraiser will review your protest with you. If resolution is not reached at this one on one discussion, a hearing with the ARB is scheduled where both the property owner and the chief appraiser’s representative present evidence to cor-roborate their opinion of value. The ARB then presents their decision of value. If this determination is still not to the satisfaction of the property owner, one of two options remain: binding arbitration or lawsuit in district court.

You may choose to represent yourself in any property tax matter, or you also have the right to appoint by written authorization an agent to represent your interests. Blair Smith and Terry Bowie have joined forces to provide Bentwater property owners with extensive experience throughout the entire dispute representa-tion process at MCAD.

(1) Blair has represented hundreds of Montgomery County residents, especially those within Bentwater, and has been successful in reducing more than $25 million in appraised values in just the last 8 years.

(2) Terry joins Blair this year bringing six years of service on the Montgomery County ARB with the last two serving as Board Chairman. This experience gives him a working knowledge of MCAD and the local appraisal protest pro-cess second to none.

BLO – Bentwater Ladies Organization

Looking ahead, the Businesswomen of Bentwater luncheon will be Monday, May 14th. This is one of the favorite luncheons of the year where business women who live in Bentwater adorn the luncheon tables with information about their business and items they sell.

Mark your calendars today for the BLO annual gambling and golf bus trip to the Coushatta Casino. The trip is scheduled for Wednesday and Thursday, October 24-25th. It sounds like a long way off, but we will be taking reservations at the May luncheon. It is a fun event with two busloads of ladies laughing, talking, and playing Bingo from Bentwater to Louisiana and back. Some of the ladies enjoy a game of golf when we arrive and the rest just hit the casino. We had a couple of big winners last year and this year may be your lucky year. Don’t forget to sign up for this fun trip at the May BLO meeting.

The Bentwater Ladies Organization activities are in full swing again. The antiques group recently held a luncheon at Shade, a culinary delight, and went antiquing in the Heights in Houston. The Art to Lunch group took a bus to Houston to see the King Tut exhibition and visited the Holo-caust Museum. They lunched at Sorrel Urban Bistro afterwards. The dining groups are getting together to have dinner out or at someone’s home and that’s just a sampling of what is happening in Bentwater this spring.

Lastly, the Bentwater Ladies are looking for a few more beautiful homes to put on the Christmas Home Tour in December. If you have toured the homes in the past, you know what a wonderful adventure it is. All of the proceeds of the ticket sales go to the homeowner’s charity. Last year each homeowner’s charity received more than $1,400. So, if you have a favorite charity that you would like to help this year and a home you would like to put on the tour, please contact Pat Wagner, Laurie Burtch or Kimi Poole for more information.

If the events mentioned above sound like fun, why not join in? All you have to do to become involved is to become a member of Bentwater Ladies Orga-nization. Don’t say that you still work as many of our activities take place on weekends and include spouses; we have a number of members that work. What better way can you think of to meet new

friends? We always have a good time at meetings, dining together, or attend-ing events away from Bentwater. If you are interested in becoming a member of BLO, contact Karen Walker, our mem-bership chairwoman. Also, if you have never attended a BLO meeting, they are held the second Monday of the month, January-May and September-December. A Lesson in Beautiful Viewinggarden club

At the meeting of the Bentwater Garden Club in the Harbor-view Room, Bentwater resident Bob Bierman showed photo-graphs of flowers and discussed how to take beautiful photo-graphs. He showed pictures of tulips, daffodils, and hyacinths from Holland and sunken logs, sunken anchors, and sand from Lake Conroe as well as Texas wild flowers. The most beautiful photograph of wildflowers was a snapshot of bluebonnets and a railroad track near Marble Falls. Bob stated that the best time to use your camera was in early morning or late afternoon.

At that same meeting, a second presentation was given by Miriam Hemmeline, the Garden Club’s vice-president. The topic was Plant Families to Love. Miriam gave us advice about shrubs. Her suggestions were to select a mature sized plant, noting the color, shape and foliage of shrubs. She reminded us to read the shrub’s tag and to do our homework by looking on the internet to find information about a chosen shrub or plant.

Over seventy people have become members of Bentwater Garden Club.

Here is another photo of Marsha and Alex Krezel’s dog, Alex, a Yorkshire Terrier, commonly called a Yorkie. They were his babysitters for several years before he was given to them. He loves people and gets around the neighborhood often. Of course he is always accompanied by at least one of his best friends, Marsha or Alex. The photo with the red and white bow was taken while he was watching the 4th of July parade. This little six pound fellow loves to be outdoors in his yard, taking time to smell the flowers.

This beautiful girl is named Zena. We took her into our home when she showed up as a stray on the Weiskopf golf course hole #7 five years ago. We have cared for her. Once spayed, she turned into

the most amazing cat. Perhaps you have seen her out walking with us. Zena loves to take long evening walks just like dogs.

Our new president, Lynn Guilbault, held the first Antique Friends meeting for the year in her lovely and spacious home. Lynn served a won-derful Cajun meal of red beans and rice, gourmet salad, cornbreads and desserts to 55 returning and new members.

Before the luncheon, Laurie Van Fleet and Dr. Debra Andrist, both docents with Bayou Bend in Houston, gave a talk and slide show about portrait artist Charles Wilson Peale. Mr. Peale

was famous for paintings of Thomas Jefferson, Ben Franklin and many other notables of the 1700's. He

had a fascinating history both here and in London, England.

A business session was then held deciding announcements and plans for our trips for the months to come. We have some really good trips planned, so if you are interested in joining us, please contact Dee Soderman. ([email protected]). We meet the fourth Thursday of each month and you don't have to collect or own antiques. We cover a lot of different interests and always have a good time.

Prior to our trip to the Heights in Houston, the Antique Friends had the opportunity to check out a couple of small towns just this side of Austin and found out the grass isn't always greener on the other side of the fence. Smithville, where Hope Floats and several other films have been made, had many shops that were closed or for lease, with generally no activity. It made our little town of Montgomery look like an antique heaven. Bastrop had more to offer in the way of antiques and home decor stores as well as a nice historical downtown; it was hard and saddening to see all of the burned acreage from the fires they suffered this past year. This trip made us appreciate all of the things we have so close to home.

Lynn Guilbault did the scouting for the Antique Friends out-ing to the Houston Heights. Nancy Caillouet took care of all the planning and arrangements for the thirty-plus group and the day went oh so smoothly. Lunch was held at the famed Shade restaurant, which everyone agreed was delicious. Then all went their separate ways and visited the shops, nurseries and thrift shops. It is always interesting to return and visit one of the first "in" places in Houston’s rich history and to see the original bungalows and remodeled gingerbread houses along with the new buildings and townhomes.

Here's to all of the treasures we have in our own back yard and the wherewithal to explore them all!

Celebration of a $12,000 donation to Lone Star Family Health Center for Breast Cancer Prevention

FAITH in Montgomery County is a 501c3 cancer based orga-nization that raises funds for the express purpose of benefiting the people of Montgomery County. It is comprised of a team of past chairman and committee members, both men and women, of the American Cancer Society/Cattle Barons Ball, with over 100 years of experience in fund raising efforts for cancer research and treatment.

FAITH in Montgomery County recently presented a check for $12,000 to the Lone Star Family Health Center in Conroe. These funds from a family trust were given specifically for breast cancer prevention or treatment, wellbeing, diagnosis and care, for patients in Montgomery County.

Lone Star Family Health Center (LSFHC) was represented at the Bentwater Employee Fair held in late 2011. As LSFHC staff was attending to the Bentwater maintenance employees,

FAITH in Montgomery County has sponsored fund raising events including the “still talked about” wildly successful Sex and the City 2 movie premiere with a multi-course dinner and fashion show at Jasper’s Restaurant and The Cinemark at Market Street in The Woodlands. The funds raised from this event were used to send M. D. Anderson teen patients and their siblings to the renowned M.D. Anderson Camp A.O.K. for a week during the summer.

The next event sponsored by FAITH in Montgomery County will be “A DAY OUT WITH THE HOUSEWIVES” on April 28th, at The Woodlands Waterway Mar-riott. It will include a New York style fashion show and luncheon with a cancer survivor parade, Boutique Shopping Promenade, Health and Wellness Fair, raffle, and book signing with Theresa Giudice from The Real Housewives of New Jersey currently appearing on the Celebrity Apprentice. Dawn Cleboski, Bentwater POA General Manager, heard their story and submitted LSFHC to the directors of FAITH in Montgomery County as a candidate for donations. After extensive research and tours, they were selected to receive the above referenced donation for cancer diagnosis and care for the benefit of patients in Montgomery County. Marilyn Kasmier-sky, Lone Star Family Health Center Business Development Director, stated: “We are a compassionate and comprehensive health care center for the entire family. The insured, Medicaid/Medicare, Sliding Care, and No Pay Patients are seen. Mam-mograms, with services provided by the Rose Mammography Group, are given to those who can or cannot pay.” Lone Star Family Health Center is building a new center, which will triple their square footage, on Loop 336 South scheduled to open in late summer. All Bentwater residents will be invited to their grand opening.

LITTLE LEAGUE ELBOW INJURIES:Is Your Child At Risk?

Definition “Little League Elbow” is a throwing injury to the elbow commonly found among pre-teen and early-teenagers that play baseball or softball competitively. Injury occurs when the repetitive throwing creates an excessively strong pull on elbow tendons and ligaments. This can tear ligament and tendon away from the bone. Sometimes small fragments of bone are pulled away as well. The elbow can also become compressed causing bones to rub together. Young athletes are particularly prone to this type of injury because their bones are immature. A child should stop throwing at the first sign of elbow pain, restricted range of elbow motion or locking of the elbow joint. Young pitchers are also advised against trying to throw a curve ball. The additional twisting motion used to make a pitch "break" is very hard on the immature elbow.

Bentwater resident, Loretta Evelyn Jacoby, passed away on Feb-ruary 1, 2012. She was born on July 14, 1936 in Taylor, North Dakota and spent her childhood in North Dakota and Wiscon-sin. She and her husband Ken moved to Dallas, Texas in 1959 and relocated to Conroe in 1970. A memorial service was to be held in Conroe, TX 77303 to celebrate her life.

Loretta was a devoted wife to Ken as well as a loving mother, grandmother, and true friend to many. She was a very able and hard working person holding executive secretary positions and most recently as tax consultant for LB Walker and Associates in Houston where she retired in January 2011. Loretta was pre-ceded in death by her parents Eva and Phillip Hubert, broth-ers Ronnie and Mike and sister Margaret. Loretta is survived

Bentwater Resident Edra Lee Leonard went to be with her Lord and Savior, Jesus Christ, Friday February 10, 2012. She was born in Mobile, Alabama to Charles and Edra Shake. At the age of 15, she left Alabama to live in Houston. She mar-ried Charlie Koenig, Jr. They were married for 25 years and had four daughters.

She married John T. Leonard in 1975 and was married until his death in 1988. She remained in Houston until moving to Willis in 1999 to be closer to her children. In Houston, she was a member of the Memorial Drive First United Methodist Church. After moving to Bentwater, she became a member of First United Methodist Church of Willis. Lee lived life to the fullest and always saw the silver lining in a dark cloud. She was a wonderful mother, grandmother, and great grandmother. Her greatest gift and pleasure was her family.

J.C. Burton, Jr. passed away on February 6, 2012 after a long battle with cancer. He was born on August 6, 1938, in Waco, Texas to Mr. J.C. and Ara (Teer) Burton. J. C. Jr. grew up in Tyler, TX and graduated from Tyler High School in 1956.

He graduated in 1960 from Texas A&M University with a degree in petroleum engineering and a commission as a second lieutenant in the U.S. Air Force.

In June 1960, he went to work for Pan American Petroleum Corp., (which later became Amoco and is now BP) in Odessa, Texas. Two months later, he was called to active duty in the Air Force and reported to Minot AFB in Minot, North Dakota. He spent two years in Minot where he met and married the love of his life, Laurelei Nadine (Wald) Burton. J.C. and Laurelei spent the last year of his assignment at Stewart AFB in New-burg, N.Y. Their first son, Jeffery, was born at the U.S. Military Academy at West Point, N.Y., (14 miles away) as Stewart field did not have a maternity ward. Finishing his military duty, J.C., Laurelei, and Jeff returned to Odessa where J.C. resumed his 38-year career with Amoco. They lived in Midland where their second son, Stuart, was born. Then came Fort Worth, Monah-ans, Oklahoma City, Tulsa, Houston, Chicago, London, Denver, Chicago again, and finally Houston. During his career J.C. held positions of area engineer, regional engineer, GM of planning

and administration, GM of supply and trading, VP of interna-tional production, President of Amoco Europe, VP and GM of the western US and finally President of International Opera-tions. In his International career J.C. visited over 40 foreign countries. J.C. retired from Amoco in April 1998 and in 2000 they moved to Bentwater.

After retirement, J.C. served on the board of directors of Marine Drilling, Pride International Drilling, and Newport Steel Cor-poration. He also held board positions with the Brookfield Zoo in Chicago and the Cairo American University in Egypt. J.C. was an avid hunter, fisherman, and rancher.

He is survived by his wife of 50 years, Laurelei; his son Jef-fery and his wife, Kathy, and their sons, John and Colin, of The Woodlands; his son Stuart of Austin; his sister Jane Ford of Chandler, TX; his sister LaJuana Huhn of Covington, LA; and numerous nieces, nephews and cousins. Bentwater Property Owners Association (POA) is delighted to announce the establishment of the Bentwater scholarship fund on behalf of all Bentwater property owners. An anonymous donor designated Bentwater resident and POA trustee Terry Bowie as his/her representative for the express purpose of estab-lishing a scholarship fund for Bentwater employees and their families with a generous contribution of one hundred thousand dollars ($100,000.00). Whoever you are, we thank you from the bottom of our hearts.

A large number of Bentwater employees, single and married, attend local higher learning institutions and struggle to afford tuition, books, and other required materials. There are many Bentwater property owners who will want to assist them by contributing to this extremely worthwhile scholarship program.

Bentwater Property Owners Association elected Trustee and Advisory board members will act as the criteria committee of this scholarship fund. Sam Houston State University (SHSU) in partnership with Lone Star Community College has been selected to manage the fund.

This permanent endowment will be used to benefit the current employees of Bentwater Yacht & Country Club, Bentwater Property Owners Association and Bentwater Sales Corporation and their spouses, legal dependents, children and grandchildren, who will be eligible to apply for scholarships to any higher learning institution although the proximity of Lone Star Col-lege and Sam Houston University make them attractive loca-tions. DEADLINE INFORMATION at SHSU: Priority Date: February 1st - It is recommended that students have a completed application submitted by February 1st.The College of Education and the College of Criminal Justice have a firm deadline of February 1st. Applications for scholarships for the College of Education and the College of Criminal Jus-tice will not be considered if received after February 1st.

The college of business administration has a deadline of February 20th.

The sociology department has a firm deadline of November 1st for spring awards and March 15th for fall awards.

Awarding will start in mid-February.

Students are notified via mail from the department offering the scholarship and via e-mail from the financial aid & scholarships department if they are awarded. Students can also view their award packages on their Self-Service Banner.

How is my Scholarship Disbursed? Once a recipient is selected, an award letter is mailed to the student’s permanent address. Students are also notified via email from Financial Aid. Awarded Scholarships can be viewed by logging into Banner using their SAM ID and PIN. Applications received after deadline dates will be awarded pending availability of funds. We have all heard the saying, “If you are given lemons make lemonade.” Well three of Bentwater’s littlest residents turned their lemonade into a $124.10 donation to the Bentwater Montgomery County United Way.

If you played on the Miller course in January, you might have bought some homemade lemonade from Sabrina Macauley, her neighbors, Katia and Samia Hijazi, and the Macauley’s pet bird Rocky, who with his loud trill, directed golfers to the lemonade stand.

When Sabrina’s uncle, Sean Macauley, was diagnosed with advance stage colon cancer last summer, the three girls wanted to help in the fight against cancer. On three occasions the girls sold lemonade and candy in the Macauley’s backyard to golfers. They raised over $60 and their father, Simon Macauley, held up his end of the bargain and matched their earnings.

According to the American Cancer Society, cancer of the colon and rectum is the third most common cancer in both men and

women today. It is estimated that approximately 102,900 new cases of colon and 39,670 cases of rectal cancer will occur this year.

Simon believes that if his twin brother Sean Macauley, who is only 54, had undergone a colonoscopy the cancer could have been caught in time.

“I want to encourage everyone over 50 to have a colonoscopy,” Simon said. “There is no reason for anyone to have colon cancer. A simple colonoscopy can detect each individuals risk, and if detected early, has a 100 percent treatment success rate.”

Sabrina, Katia and Samia want to thank all the people who bought and/or donated money, especially the cart girl who donated more cups for their lemonade.

Other News: North Shore Republican Women hosted a candidate forum in late January, drawing a huge crowd of over 200 residents and candidates at the North Montgomery County Convention Cen-ter in Willis to learn about those appearing on the Republican primary ballot. With tables set up for the candidates and their literature and supporters, those attending could visit one-on-one with candidates as well as hearing them speak during the forum. Three U.S. Senate candidates looking to replace Senator Kay Bailey Hutchison were in attendance, as well as those run-ning for county attorney, judges, precinct offices, state senate and House of Representatives, and several other offices.

Creating this beautiful quilt named Garden of Hope was an amazing effort by Bentwater resident Debra Spincic and others with the purpose of being raffled at a fundraiser for the Ameri-can Cancer Society. Many quilters who share the cancer experi-ence participated in the design and sewing of the quilt.

Debra Spincic decided to create a quilt for the annual American Cancer Society fundraiser. As a member of an active on-line quilting community, her first thought was to ask her quilting friends to send her "9 patch blocks." She knew that two of her Bentwater neighbors, Freda Jackson and Marilyn Fortezzo, were also quilters. She asked them to provide blocks as well.

Within weeks she had more than enough colorful blocks to start arranging a composition. Marilyn came to Debra’s studio and they worked for a week planning the quilt with the goal of repre-senting a spring garden growing from a generous Mother Earth. Soft organic quilting lines were sewn to represent leaves.

Once the quilt top was done, Debra asked her friends for name ideas. One cancer survivor suggested the name of Garden of

Hope. She felt the most important part of the healing process was to have hope. It was the perfect name. The quilt, designed with the help of a number of friends, is special because many of the quilters who made the 9 patch blocks have been directly affected by cancer. Some wrote that they contributed blocks with a loved one in mind. It is Debra's hope that those buying raffle tickets will buy them with their loved ones in mind.

The quilt is being raffled as part of Bentwater's fundraiser for the American Cancer Society. Raffle ticket prices are $5/ticket; 5 tickets/$20; or 30 tickets/$100. Tickets may be purchased at the Bent-water tennis tournament on April 13th, the Bentwater/ACS live auction on April 15 or by calling Debra at (936) 597-6917. The draw-ing will be held at the live auction on April 15th.

Bentwater Yacht Club and Marina Harbormaster Rob Brown announced that the Bentwater Civic Association (BCA) has offered to co-sponsor the annual HAZARDOUS WASTE RECYCLE DAY to be held Saturday, April 21st, from 10am to 4pm at the Bentwater Yacht Club parking lot. BCA members will staff the receiving area and help unload and sort the recycle items from vehicles as well as providing pick-up service at Bent-water residents’ homes if the residents are unable to remove and transport items on their own. No paint will be accepted at this event. Montgomery County Pct. 3 charges fees of $10 for each TV or computer monitor dropped off at this site as they are the group that administers the final disposal of the items.

Montgomery United Methodist Church has started a new ministry called BIKES for KIDS. The mission is to provide bicycles to children in the Montgomery area whose families do not have the means to provide them. These children are identified through other church ministries and through the guidance counselors at Montgomery elemen-tary and middle schools.

The source of bicycles is from donations. If you have a children’s size bike that your kids or grandkids have outgrown, please consider donating it to this ministry. A donation receipt will be provided so that you can designate the donation as a charitable contribu-tion for tax purposes.

The Bentwater Wineaux Group is gearing up for another great year. Gaye Watkins, Chief Wineaux, is hoping to have at least 200 members this year. The group has been growing at a fast pace each year. Gaye has the members divided into groups that meet four to five times a year to taste wines.

Most of the groups are casual wine drinkers and enjoy getting together to try something new instead of the usual. Most of the wines sampled are in the $15-$25 range. Each couple is asked to provide two bottles of wine from a specific category; red wines from Australia or Italian whites and joins others in the group at one of the member’s homes. Food is usually a potluck. Sometimes someone is brave and tries to pair the wines with food, but most are happy with chips and dips or bread and cheese.

If you are a serious collector or drinker, there is a special Wineaux group for you. It is for those who are usually educated about the wines they are tasting. They know that the aroma of the wine is an important part of selection. They will also know that a slow drizzle of the wine down the inside of the glass indi-cates thickness, perhaps with higher levels of sugar and alcohol. The Wineaux also do a couple of away events. One of the big-gest is The Woodlands Food and Wine Week. Gaye arranges for a bus to take us there and back so we don’t have to worry about driving home. Since Bentwater Life’s inception, the magazine’s staff has been made aware of the varied interests of Bentwater property owners, from mountain climbing, to collecting unusual artifacts, to partic-ipating in extreme sports, to involvement in a border watch group. Al Dorval, Bentwater resident, is a volunteer member of the Texas Border Volunteers (TBV), a border watch group based in South Texas whose mission is to assist law enforcement, uphold the rule of law and educate the general public regarding immigra-tion issues. TBV, who is described as comparable to a neighbor-hood watch program, conducts watches on private ranches where they have been invited by the landowners to help protect their property. TBV headquarters is on a south Texas ranch and may cover in excess of 10,000 acres. Volunteers pay their own travel, living and some equipment expenses.

During a watch, volunteers may be assigned to areas that are known to be used by human traffickers and drug smugglers or in response to reports from ranchers. TBV’s policy is to stay concealed, observe, and report to law enforcement the sightings of uninvited groups and vehicles on these private ranches, not-ing unusual activity and items such as large backpacks that may contain drugs or illegal contraband and persons carrying high-powered weapons.

When a group is sighted, the watchers will communicate by radio to headquarters. They will report the location, number of trespass-ers, and direction of travel. Headquarters will relay the informa-tion to U.S. Border Patrol who will then take appropriate action.
