At the dawn of a new millennium, between the 2000 Louis Vuitton and America’s Cup regattas, the New Zealand superyacht industry created a regatta which celebrated the best of our country.

Designed specifically for visiting superyachts, the first NZ Millennium Cup fleet raced between Kawau Island and Auckland in two hard-fought races.

“The industry saw an opportunity to run an event that showcased our cruising grounds further–an event that encapsulated why the journey was worth the effort,” says Ian Cook of gold sponsor, Yachting Developments.

Now staged by the NZ Marine Export Group and supported by industry sponsors, the Cup has evolved through several iterations, travelling to Palma de Mallorca in 2007, and back to Auckland in 2009, 2012, and 2013. It’s now found a home in the Bay of Islands, which has set a stunning, and quintessentially New Zealand backdrop, for each edition of the race since 2015.

The event’s hallmarks, however of outstanding off-water events, relaxed hospitality, and spectacular competition, remain. Testimony to the lure the NZ Millennium Cup still holds, the inaugural line honours winners, Antaeus, return to take up the challenge in the Pacific Cup division in 2017.

Welcome to our regatta in one of the world’s great natural playgrounds; we’re very pleased to have you join us here for the 2017 NZ Millennium Cup.

2016 was a good year for the New Zealand industry, with steady forward-momentum, new launches, and innovation across the board.

We were pleased to watch as our central city marinas filled with superyachts and crew ready to enjoy all New Zealand has to offer, and our yards and support industries were again given the chance to prove why New Zealand workmanship is amongst the best in the world.

January though, is when our industry unwinds. As an ocean-loving nation, spending the summer on the water is in our DNA and we’re looking forward to sharing this time with you in the unbeatable setting of the Bay of Islands. Also in our blood is a love of fierce, fun racing and we, along with all the spectators, are looking forward to our fleet hitting the Bay’s courses. We can’t wait to see you perform on the water.

We look forward to welcoming crew and owners to the Bay of Islands again for the 2017 NZ Millennium Cup. SAILING INSTRUCTIONS FOR NZ MILLENNIUM CUP AND PACIFIC CUP

The Organising Authority is the New Zealand Millennium Cup

Committee and the New Zealand Marine Export Group Incorporated.

The on-water race authority is Bay of Islands Sailing Week Inc.

1.0 Rules

1.1 This regatta will be governed by the rules as defined in

the Racing Rules of Sailing 2017-2020 including Yachting

New Zealand prescriptions and including Appendix SY to

the Racing Rules of Sailing (“Racing Rules”), and including any

amendments to the Racing Rules that are issued and come into

effect prior to 24 January 2017. Appendix SY is reproduced as

an appendix to these Sailing Instructions.

1.2 The YNZ Safety Regulations of Sailing 2017-2020, Part 2,

Category 4, including any amendments to the Safety

Regulations that are issued and come into effect prior to

24 January 2017, shall apply to all boats racing in the

NZ Millennium Cup or Pacific Cup divisions.

1.3 Racing Rule 42.3 is amended so that the use of an engine

is allowed up to one minute prior to a yacht’s respective

start time.

1.4 Racing Rule 55 is amended by adding the following sentence:

“For the avoidance of doubt the discarding of elastic or wool

bands when setting a sail is not permitted”

1.5 Racing Rule 64.1 is amended by replacing the word

“disqualified” with the words “penalised at the discretion

of the protest committee.”

1.6 Appendix SY will apply to all boats racing in the

NZ Millennium Cup. This amends Racing Rule SY1.

1.7 Competitors shall comply with any reasonable request

from a regatta official.

2.0 Notices to Competitors

Notices to competitors will be posted on the official notice board

located in the North Sails/Southern Spars Marquee at the Opua

Marina. Copies of notices to competitors in the NZ Millennium Cup

and/or Pacific Cup will be posted on the notice board at the NZ

Millennium Cup race headquarters at the Opua Cruising Club.

3.0 Changes to Sailing Instructions

3.1 Any change to the Sailing Instructions will be posted before

0830 hours on the day it will take effect.

3.2 Any change to the schedule of races will be posted by

1900 hours on the day before it will take effect.

4.0 Signals Made Ashore

Signals made ashore will be displayed on the flagpole on the Carters

Race Office at the Opua Marina. Competitors are reminded that

Racing Rules provides that the flying of code flag “L” ashore means a

notice to competitors has been posted.

5.0 Schedule of Races

5.1 No practice race is scheduled.

5.2 Races are scheduled as shown on Table 1.

5.3 On NZ Millenium Cup Race Day Friday 27 January no warning

signal will be made after 1330 hours.

5.4 On NZ Millenium Cup Race Day Friday 27 January the race

officer will endeavour to set a course that can be completed by

all boats by 1600 hrs.

5.5 There will be daily race briefing from 0830 hrs to 0900 hrs

each Race Day. This meeting will be held at NZ Millennium Cup

race headquarters at the Opua Cruising Club at the Opua

Marina. There must be at least one representative from each

yacht at this meeting. It is recommended attended by the

Captain, designated Safety Officer and Racing Tactician or

Navigator. Note that there is a 5 knot speed limit between the

Okiato Point beacon and the Opua Cruising Club jetty.

6.0 Division Flags

6.1 The division flag for the NZ Millennium Cup and the Pacific Cup

will be the NZ Millenium Cup flag.

6.2 Each boat will be issued with an individual coloured flag

(“boat’s individual flag”). Boats while racing will fly their boat’s

individual flag either on the backstay or the aft starboard shroud.

7.0 Racing Area

7.1 The racing area will be the Bay of Islands (chart NZ 5125).

7.2 The start area is shown on page 19 of this Sailing Instructions

Booklet. The committee boat will display a red and white staff

with an orange flag on it.

8.0 The Courses

8.1 Page 21 of this Sailing Instructions Booklet states the courses,

including the order in which marks are to be rounded, and the

side on which each mark is to be left.

8.2 The specific course to be sailed for the day will be advised at

the daily race briefing.

8.3 Boats will be advised of their individual start times by no later

than 1115 hrs each day. Each boat’s start time will be calculated

based on its handicap, the course to be sailed and the forecast

wind for the day. A boat’s start time is likely to vary each day,

depending on the course and the wind. The handicap for boats

in the NZ Millennium Cup will be the International Superyacht

Rule handicap. The handicap for boats in the Pacific Cup will be

the PHRF handicap.

9.0 Marks 9.1 The course marks are described at page 19 and 20 of this

Sailing Instructions Booklet.

9.2 The starting and finishing marks will be the committee boat

and the outer distance mark at the other end.

10.0 The Start 10.1 The starting line for all races will be between a red and

white staff displaying an orange flag on the committee boat

at the starboard end and the outer distance mark at the port

end. When starting the committee boat is to be left to

starboard and the outer distance mark to port.

10.2 Each race will be a pursuit race where each yacht will have a

different start time as advised by the race committee no later

than 1115 hrs.

10.3 The start sequence for the first boat scheduled to start will be

as described in table 2. Times will be taken from the visual

signals; the absence of a sound signal shall be disregarded.

10.4 The start sequence for all other boats shall be: (a) one minute

before a boat’s start time that boat’s individual flag will be

displayed and a sound signal made; (b) at a boat’s start time

that boat’s individual flag will be lowered and a sound signal

made. When the last boat starts the division flag will be

lowered at the same time as that boat’s individual flag.

Times will be taken from the visual signals; the absence of a

sound signal shall be disregarded.

10.5 Boats whose warning signal has not been made should avoid

the starting area.

10.6 Racing Rules 29 and 30 shall not apply. Any boat crossing the

start line early shall not restart and will be given a time penalty

equal to five minutes plus the time she was over early.

10.7 NZ Millennium Cup and Pacific Cup boats will be started as

part of the same start sequence.

11.0 Change of the Next Leg of the Course Change of Course – Racing Rule 33 is replaced by the following:

If the race committee signals a change of course (displays Flag

C with repetitive sounds) as the boats approach a mark, after

rounding/passing that mark boats shall sail directly to the finish.

12.0 The Finish The finishing line will be between a red and white staff displaying

an orange flag on the committee boat and the outer distance mark.

When finishing the committee boat is to be left to port and the outer

distance mark to starboard. The committee boat on station at the

finish may not be the same as that at the start of the race.

13.0 Penalty System 13.1 Where a boat has broken a rule in Part 2 of the Racing Rules

or Racing Rule 31, only one turn, including one gybe and one

tack, is required. This changes Racing Rules 44.1 and 44.2.

13.2 A boat that has taken a penalty or retired under Racing Rule 31

or Racing Rule 44.1 shall complete an acknowledgement form

at the Carters Race Office within the protest time limit.

13.3 Racing Rule 44.1 is changed to permit a boat that has broken a

rule in Part 2 of the Racing Rules or Racing Rule 31 to take a

penalty after racing but prior to any protest hearing. Her

penalty shall be a scoring penalty as calculated in Racing Rule

44.3(c) equal to 40% of the number of entries in her fleet or

50% of the difference between her finishing and the number of

entries in her fleet, whichever is less.

14.0 Time Limits and Target Times There is no time limit.

15.0 Protests

15.1 Immediately after finishing a boat intending to protest shall,

in addition to the requirements of Racing Rule 61.1(a), inform

the committee boat at the finishing line of her intention to

protest and the identity of the boat(s) protested against. The

protesting boat must receive an acknowledgement from the

race committee. This changes Racing Rule 61.

15.2 Protest forms are available at the Carters Race Office. Protests

shall be delivered there within the protest time limit. Parties

lodging protests must be present in the vicinity of the Carters

Race Office from the protest time limit until their protest

is heard.

15.3 The protest time limit is 90 minutes after the last boat in its division

has finished that day’s race. The same protest time limit applies

to all protests by the race committee and protest committee about

incidents they observe in the racing area. This changes Racing Rules

61.3 and 62.2. Protest time limits will be posted.

15.4 Notices will be posted on the notice board in the North Sails/

Southern Spars Marquee within 30 minutes of the protest time

limit to inform competitors of hearings in which they are

parties or named as witnesses. Hearings will be held as soon

as practicable.

15.5 Notices of protests by the race committee or protest committee

will be posted on the notice board in the North Sails/Southern

Spars Marquee to inform boats under Racing Rule 61.1(b).

15.6 Breaches of instructions 10.5, 13.2, 17 or 20 will not be grounds

for a protest by a boat. This changes Racing Rule 60.1(a).

Penalties for these breaches may be less than disqualification if

the protest committee so decides.

15.7 On the last day of the regatta a request for re-opening a

hearing shall be lodged:

(a) Within the protest time limit if the party requesting re-opening

was informed of the decision on the previous day; or

(b) No later than 30 minutes after the party requesting re-opening

was informed of the decision if informed of the decision on the

last day of the regatta.

This changes Racing Rule 66.

15.8 For protests where only a rule in Part 2 of the Racing Rules

or Racing Rule 31 is alleged to have been broken, an arbitration

hearing may be offered prior to any formal hearing. Racing

Rules Appendix on arbitration will apply. This changes

Racing Rule 44.1.

15.9 Racing protests must be lodged by the end of protest time on

Orams Marine Race Day Wednesday 25 January 2017.

16.0 Scoring 16.1 One race is to be completed to constitute a series.

16.2 A boat’s series score will be the total of her race scores with

no discard. Race scores will be based on the finishing positions

on line, but subject to any alteration of finishing position that

occurs as a result of a time penalty under instruction 10.6 or as

a result of a protest, including under instructions 17.3 and 20. If

two or more boats finish the series on equal points, their series

positions will be determined using the count back provisions set

out in rule A8 in Appendix A of the Racing Rules.

16.3 The scoring abbreviation for a discretionary penalty given

under instruction 15.6 will be DPG.

17.0 Safety Regulations 17.1 A boat that retires from a race shall notify the race committee

as soon as possible.

17.2 Any boat or equipment may be inspected at any time for

compliance with safety requirements, rating certificates

and/or Sailing Instructions.

17.3 No later than the close of the protest time limit applying to

the division the boat is sailing in, the race committee will report

any breaches of the safety standards to the protest committee

requesting action on the report. If a breach of the safety

standards is upheld the protest committee will impose a 5%

time penalty applied to the race completed that day or such

other penalty as is appropriate given the seriousness of the

breach. Any time penalty will be calculated on elapsed time.

This changes Racing Rule 60.2.

18.0 Radio Communication 18.1 Except in an emergency, a boat shall neither make radio

transmissions while racing nor receive radio communications

not available to all boats. This restriction also applies to racing

related calls on mobile telephones.

18.2 Race information will be broadcast by the committee on

VHF Channel 17.

18.3 At their discretion, the committee may answer radio queries

relating to courses, time and racing. This modifies Racing Rule 41.

18.4 Boats shall use VHF channel 17 to communicate with each

other while racing.

19.0 Escort Boats 19.1 Each vessel may be accompanied by its own motorised escort

boat whose functions may include warning spectator boats and

the like.

19.2 Escort boats should be made available to assist in the

management of the race if requested by the race committee.

20.0 Flags and Decals Sponsor’s flags and decals may be provided by the organising

committee. If these are provided they must be displayed as required

by the organising committee, including during all races participated in

during the regatta. Protests over the failure to display sponsor’s flags

or decals can only be lodged by the race committee.

21.0 Prizes Prizes will be given for first, second and third in the NZ Millennium

Cup series and first in the Pacific Cup series; or first and second in the

Pacific Cup series if there are three boats in the series; or first, second

and third in the Pacific Cup series if there are more than three boats

in the series.

22.0 Disclaimer of Liability 22.1 Competitors participate in the regatta entirely at their own

risk. See Racing Rule 4, Decision to Race. The Organising

Authority will not accept any liability for material damage

or personal injury or death sustained in conjunction with

or prior to, during, or after the regatta. Owners shall accept

full responsibility for the seaworthiness and safe navigation

of their boats and the competence of their crews.

22.2 As all owners are aware competitive racing inevitably

carries with it an increased risk of collision between boats

and resultant damage and expense. The Organising Authority

urges all owners to carry full racing insurance and believes

that at the very least third party insurance should be held. It is

not, however the responsibility of the Organising Authority

to police or enforce insurance; it is a matter of choice for

individual owners and skippers. The Organising Authority

will not be responsible for losses arising during the regatta

(insured or otherwise). All owners and skippers are advised that

it is the responsibility of owners and/or skippers to ensure that

they carry the relevant insurance. Boats race at their own risk.

RECOMMENDED ACTION FOR ON-WATER EMERGENCIESIf you have an accident or injury while on the race course or coming or going from the race course and outside assistance is required, the following actions should be taken:

1. If there is imminent threat to life or property and immediate assistance is required – use the Mayday procedures on VHF Channel 16.

2. Otherwise contact the Coastguard:

The Coastguard will be on duty throughout the regatta. When contacting the Coastguard or race officers, please advise the nature of the problem, giving as much information as possible, including:

• Name of vessel(s) involved • Current location • Nature of incident • Details of any person(s) injured • Details of damage to boat(s)

In the event of a serious injury needing evacuation, you will be directed by the Coastguard as to the nearest evacuation point.

If you are unable to contact the Coastguard, please inform the race officer for your course.

3. If you have to retire from a race or leave the race area, advise the race officer on the VHF Channel for your course. Please avoid calling the race officer while he/she is starting a race or setting a course.

4. Incident report forms are available at the Carters Race Office. We encourage you to fill out an incident report as that will help us make the regatta safer.

APPENDIX SY SUPERYACHT RACING RULESWhen stated in the notice of race and the sailing instructions,

Superyacht races shall be sailed under The Racing Rules of Sailing as

changed by this appendix.

Version 2.2, May 2014.

SY1 TERMINOLOGY ‘Superyacht’ means a boat with a hull length greater than

30.5 metres. ‘Superyacht class’ means a racing fleet in which a

majority of the fleet are superyachts.

SY2 Changes to the Definitions and the Rules of Part 1 and Part 2 SY2.1 The definition Keep Clear is changed to:

Keep Clear One boat keeps clear of another if the other can

sail her course with no need to take avoiding action and with

no less than 40 metres between the boats.

SY2.2 The definition Mark-Room is changed to:

Mark-Room for a boat to leave a mark on the required side

with no less than 40 metres between the boats.

Also, (a) room to sail to the mark when her proper course is to

sail to it, and (b) room to round the mark as necessary to sail

the course.

SY2.3 The definition Room is changed to:

Room The space a boat needs in the existing conditions,

including space to comply with her obligations under the

rules of Part 2 and rule 31, while maneuvering promptly in

a seamanlike way, with no less than 40 metres between

the boats.

SY2.4 The definition Zone is changed to:

Zone The area around a mark within a distance of

300 metres of it. A boat is in the zone when any part of her

hull is in the zone.

SY2.5 Add new rule 1.3:

1.3 Communication

At all times while in the racing area, a boat shall monitor

the VHF safety channel specified in the sailing instructions,

shall respond promptly to a hail from another boat, and shall

communicate with other boats on matters of safety.

SY2.6 Rule 17 is changed to:

17 ON THE SAME TACK; PROPER COURSE

17.1 A leeward boat shall not sail above her proper course while

she is within 80 metres of the windward boat.

17.2 A boat being overtaken from clear astern shall sail her proper

course from the time the overtaking boat is within 80 metres

of her until the overtaking boat is clear ahead or more than

80 metres from her. The overtaking boat shall not sail within

40 metres of the other boat.

17.3 When rules 18, 19 or 20 apply, rules 17.1 and 17.2 do not.

SY3 Changes to the Rules of Part 4 and Part 5 SY3.1 Rule 42.3(g) is changed to:

(g) Any means of propulsion may be used to help a person

or another vessel in danger, or as required to comply

with rule 14, Avoiding Contact.

SY3.2 Rule 52 is deleted.

SY3.3 Add new rule 60.4:

60.4 When the race committee or protest committee learns,

from any source, of an incident involving boats sailing

within 40 metres of each other or not responding to a

radio hail, it may protest any boat involved.
