Baltimore, Md., Friday January 15th, 1937.

THE STATE BOARD OF UNDERTAKERS OF MARYLAND, 508 Old Town Bank Building.

The regular meeting of the Board was called to order by President Levinson at 8:00 P.M., with the following members present:

Mr. Sol Levinson, President, Mr. J. Jerome Framptom, Treasurer,

Mr. George A. Farley, Mr. Andrew K. Coffman, Mr. William Cook, Mr. John Ullrich, Mr. John M. Weber.

There being no corrections the President ordered the minutes of the meeting held on Friday, November 13th, 1936, be approved as read.

Eastern Funeral Association, Incorporated, represented by Richard F. Curley and Attorney R. A. Kanode , appeared and filed letter from the Telephone Company stating that the present listing of Eastern Funeral Association, Incorporated, under "Funeral Directors and Embalmers" in the telephone directory will be dis­continued.

Joseph Machovec appeared accompanied by Roland Herr, and agreed to take listing of Joseph Machovec out of the classified and white section of the telephone directory as "Funeral Director", and to file letter from the telephone company confirming same. Also to file letter from the Bohemian newspaper stating that in the future no habituary notice would carry the name of Joseph Machovec.

Mrs. Edith V. Leaf of Williamsport, Maryland, appeared, accompanied by Attorney Alexander Armstrong, and inquired of the Board if it was possible to obtain embalmer's license by registra­tion. The Board informed Mrs. Leaf that it was impossible for them to comply with her request.

William A. Jackson appeared and agreed to discontinue using the name of "Easton Funeral Home" of "Daniel Easton", unless same have his name appear as successor to Daniel Easton. Mr. Jackson also agreed to send letter from the telephone company showing that he had arranged to discontinue this listing.

W. A. Williams, proprietor of the Harlem Funeral Home, accompanied by Attorney Henry L. D. Stanford, Jr., Charles H. Alexander, and Franklin W. Seitz, and after a hearing on charges preferred by the Colored Funeral Directors Association,- they were instructed to appear for future hearing on Tuesday, February 2nd, at which time all parties concerned would be summonsed to appear.

Mr. Coffman moved, seconded by Mr. Weber, that the next meeting be held on Tuesday, February 2nd, 1937, at 1:30. P.M.

Mr. Ullrich moved, seconded by Mr. Framptom, that if Harvey Williamson can show that he has 840 embalming school hours to his credit, that he be permitted to take the embalmer's examination without completing the two year apprenticeship. SO ORDERED.

Mr. Ullrich moved, seconded by Mr. Framptom, that Warren A. Shuping be considered eligible to take embalmer's examination, having served the two year apprenticeship under Theodore Jenkins, providing he has the necessary high school credits. SO ORDERED.

Mr. Farley moved, seconded by Mr. Weber, that Harle, In­corporated, be granted undertaker's license upon payment of the necessary fees. SO ORDERED.

R. C. Richardson and Albert Ashe failed to appear in answer to notice sent them.

Mr. Farley moved, seconded by Mr. Weber, that the meeting now adjourn. SO ORDERED.

THE STATE BOARD OF UNDERTAKERS OF MARYLAND, 508 Old Town Bank Building.

The regular meeting of the Board was called to order by President Levinson at 1:30 P.M., with the following members present:

Mr. Sol Levinson, President, Mr. J. Jerome Framptom, Treasurer,

Mr. George A. Farley, Mr. Andrew K. Coffman, Mr. William Cook, Mr. John Ullrich, Mr. John Weber.

There being no corrections the President ordered the minutes of the meeting held on Friday, January 15th, 1937, be approved as read.

Mr. Levinson, due to the condition of his throat, requested that some one else act as President.

Mr. Framptom moved, seconded by Mr. Coffman, that Mr. Farley act as President. SO ORDERED

The Board immediately started hearing on charges preferred by the Colored Funeral Director's Association against William A. Williams, proprietor and operator of the Harlem Funeral Home.

The first witness to be heard was John M. Johnson, President of the Colored Funeral Director's Association of Baltimore, Mary­land. The following is Mr. Johnson's statement:

On December 26th, 1936, Joseph A. Lively, undertaker and embalmer of the Colored Funeral Director's Association, called Mr. Johnson and told him that Mr. Williams, who is connected with the Harlem Funeral Home, had called at the home of Milbert Hurley, Sr., 1704 Mosher Street, and notified them of the death of their baby, Milbert Hurley, Jr.., at the City Hospital, and asked them if they would let him take charge of the funeral. Johnson, accompanied by Mr. Lively, then called at the Mosher Street address and inter­viewed Milbert Hurley, Benjamin Roane, Lottie Roand, and they made the following statement- to Johnson.

About 12:30 on Christmas day, December 25, 1936, Williams called at their.home and told them that their baby had died at the City Hospital; that he was an undertaker and , if they so desired, he could bury the child cheaper than any other funeral director because he bought ."his supplies in carload lots, and therefore was in a position to sell caskets to them cheaper than any other under­taker. They told him that they had an undertaker who had had funerals before for them, and that they did not desire his services. Mr. Williams gave them a card of the Harlem Funeral Home and left.

After" hearing these statements, Mr. Johnson asked them if they would make affidavit to these statements and they agreed. Their affidavit was filed with the complaint.

The next witness to be heard was Joseph A. Lively, under­taker, 661 W. Barre Street.

He stated that he received a call from Milbert Hurley to take charge of the, funeral of Milbert Hurley, Jr., and upon oalling at the home the family told him that Mr. Williams had called and notified them of the death of their child, and told them that he could conduct a funeral oheaper than any other funeral director.

Milbert Hurley, Sr., of 170& Mosher Street, was then oalled. After being.sworn Mr. Farley, acting President, explained the charges against M.r. Williams, and then Mr. Hurley made the following statement:

Mr. Williams called at his home Christmas day, December 25, 1936, and upon rapping on the door, the door was answered by Dottie Roane, his.mother-in-law. Mr. Williams told her that the Hurley baby was dead, and she called me down from up stairs. Williams told me my child had died and that he owned the Harlem Funeral Home, and oould.make, funeral arrangements. I immediately left to get ipy wife who had gone to a neighbors to call the hospital to inquire about the child.

Benjamin Roane, 1704 Mosher Street, after being sworn, was asked the following question by Mr. Farley:

(Q) You understand why you are down here this afternoon.

(A) Yes.

Roane made the following statement:

"My grandchild was in the City Hospital and my daughter, the child1s mother, had gone to a neighbors to call the hospital be­tween 12:30 and 1 o'clock, to inquire about the child when Mr. Williams called at our home and notified us that the child was dead and asked us if we wanted him to take charge of the funeral. He stated that, he .was an undertaker and that he bought his caskets in carload lots, and could do the funeral for us cheaper than any one else. I asked him how he found out that the child was dead, and he said he was at the hospital getting a body when the child died, and he stopped by to notify us. I told him that Mr. Lively was our undertaker and so he left a card with us and when Mr. Lively came to our home we gave .him the card." Mrr-Bevin

Mr. Levinson then asked him if the card that had been filed with the charges was the card that was left by Mr. Williams. Mr. Roane said.that it was.

Mr. Roane said that after he had told Mr. Williams that Mr. Lively was"their family undertaker, Mr. Williams started talk­ing to him about.secret orders.

Ques..by.Mr. Stanford: Did Mr. Williams tell you that he was an undertaker?

Ans. Yes he told me he was an undertaker.

Ques. by Mr. Cook: Did your daughter oome baok while Williams was still there?

Ans. Yes, but she was histerical and they took her immediately upstairs.

Ques. by Mr. Coffman: Did Williams insist upon conducting the funeral?

Ans. No. Only stated that he was an under­taker and connected with the Harlem Funeral Home, and could bury the child cheaper than any one else.

Lottie Roane, 1704 Mosher Street, after being sworn, was asked the following by Mr. Farley.

Tell us what you know about Mr. Williams calling at your home.

Lottie Roane: When Mr. Williams came he asked if Milbert Hurley lived here and then asked to see him. I called Mr. Hurley and Mr. Williams then said he was an undertaker, and that your child has just died at the City Hospital. Mr. Hurley then left to get my daughter, who had gone to telephone the hospital. Mr. Williams then said he was an undertaker and could bury the ohild cheaper because he bought his caskets in carload lots.

Ques. by Mr. Levinson: Did Mr. Williams tell you he was an undertaker?

Ans. Yes.

Ques. by Mr. Stanford: Did Williams tell you that he repre­sented the Harlem Funeral Home?

Ans. No. Mr. Williams after stating th4t he could bury the child cheaper, and we had told him that Lively was our undertaker, gave us a card of the Harlem Funeral Home and left.

Ques. by Mr. Stanford: Did Williams tell you he was an undertaker?

Ans. Yes.

Mr. Williams after being sworn made the following statement.

Ques. by Mr. Farley: How did you come to call at the Hurley home, 1704 Mosher Street?

Ans. Around 12 o*clock on Christmas day, December 25th, a light brown colored

man called at my home and asked me if there was any thing in it for him if he got a funeral for me. He said the Hurley child had just died at the City Hospital. I took him accross the street from my home and bought him a drink, and then we went to the Hurley home at 1704 Mosher Street and notified them that their child was dead. I told them that I represented the Harlem Funeral Home, and that Mr. Alexander was our funeral director and could give them as cheap a service as they could get any where else.

Ques. by Mr. Cook: Did Mr. Nusbaum call you and tell you the child was dead?

Ans. No sir.

Ques. by Mr. Cook: What was the name of the man who told you about the child being dead?

Ans. I do not know the man?

Ques. by Mr. Farley: At the last hearing you stated that you had not called at the Hurley home but now say that you looked back through your records and found that you had.

Ques. by Mr. Cook: Was it possible for you to forget so soon that you had called at this home?

Ans. I had forgotten until I looked through the records and found notation of this call.

Ques. by Mr. Farley: What kind of records do you keep?

Ans. I just looked through some papers that were in my desk and they recalled it to my memory.

Mr. Stanford then called Arthur Redding, 605 Lafayette

Ques. by Mr. Stanford: Do you remember around Christmas day any thing unusual happening around Lafayette and Pennsylvania Avenues?

Ans. I was standing on the corner of Lafayette and Pennsylvania Avenues with Ed Robinson when two men drove up and parked a car on the corner, got out of the automobile and walked down the street to the Harlem Funeral Home, looked in and came baok up the street. As they passed they said

they were going to trick this fellow Williams. I then walked down and told Williams he had better watch out because of what I had just heard.

Stanford. Do you see any of the men who were in that car in this room now?

Redding then pointed to Lively and said he was the man who had gotten out of the car.

Mr. Johnson then interrupted to say that he requested that this hearing be postponed, as he did not know such things would be brought up here, and they would like to be represented by their attorney.

Mr. Cook: We cannot postpone this case any longer.

Q. by Mr. Stanford: Redding do you know this man? (pointing to Lively)

Ans. No. The only other time that I have ever seen him was on that day just be­fore Christmas when he got out of the car at Lafayette and Pennsylvania Avenues.

Q. by Mr. Farley: Are you related to Williams?

Ans. No.

Q,. by Mr. Coffman: How long have you known Williams?

Ans. Ten years.

Q,. by Mr. Coffman: Is Mr. Williams your undertaker?

Ans. Have had no deaths.

Charles. E. Robinson, 1326 Pennsylvania Avenue, after being

Do you remember any ocoasion when you and Redding were standing on the corner of Lafayette and Pennsylvania Avenues?

I was standing on Pennsylvania Avenue near Lafayette, around Christmas, when this man,-pointing to Lively- and another man parked their oar on the southwest corner and walked down the street. As they passed I heard this statement made "we are going to frame that sun of a bitch. Redding said I believe they are talking about Williams. I then left and Redding walked down the street.

Q. by Mr.. Framptom: How long have you known Williams?

Ans. Five or six years.

Q. by Mr. Framptom: Are you any relation?

Ans. I just live several doors below where Williams has the Harlem Funeral Home.

Q,. by Mr. Framptom: Did Williams ever give you any money?

Ans... No.

Mr. Williams was then recalled and made the following state­ment: that he and Nusbaum had been in partners operating the Harlem Funeral Home, and that he had bought Nusbaum's share out on the 29th day of December.

Q,. by Mr. Cook: Was Martin interested in the Harlem Funeral Home?

Ans. No.

Q. by Mr. Cook: When did Alexander start to work for you?

Ans. On December 27, 1936.

Q,. by Mr. Farley to Mr. Lively: Do you remember being on this corner?

Ans. I have never been on the corner and never remember seeing this man before.

John M. Johnson then made the following statement: that con­fidentially Edward A. Arundel, proprietor of the Arundel Garage, had given him the. .following information: that Nusbaum and Martin had arranged for him to furnish cars for a number of funerals.

Mr. Seitz was then called and stated that he had never eean conducted a funeral for the Harlem Funeral Home, but that his son had conducted one funeral for them.

Mr. Ashe was then called and stated that he had conducted a funeral for the Harlem Funeral Home, that Mr. Nusbaum had called him and requested him to take charge.

George A. Nusbaum, Baltimore City Hospital, after being sworn made the following statement:

"I am no.longer connected with the Harlem Funeral Home. I was in partners with Williams and conducted the Harlem Funeral Home on Edmondson Avenue from around January 1, 1936 to July. We then moved to 1336 Pennsylvania Avenue and conducted business there until December 29, 1936, when I sold my interest to Williams

Q. by Mr. Farley: How long have you been employed at the Baltimore City Hospital?

Ans. Since September 1936.

Q,. by Mr. Farley: Did you operate the Harlem Funeral Home while you were employed at Mr. Cooks?

Ans. Yes.

Q,. by Mr. Farley: How long were you connected with the Har­lem Funeral Home while in the employ of Mr. Cook?

Ans. Six or seven months.

Q. by Mr. Cook: How many funerals did you have while con­nected with the Harlem Funeral Home?

Ans. I have no record of the number of certificates I signed.

David R. Martin, 1003 W. Baltimore Street, after being sworn.

Mr. Farley: The Board wants you to explain your connections with the Harlem Funeral Home.

Mr. Martin: I have never been connected with the Harlem Funeral Home. Never did any work for the Harlem Funeral Home and never had any money to invest in the Harlem Funeral Home.

Q. by Mr. Cook: Can you explain the telephone calls which you received from the Harlem Funeral Home before Christmas while employed at my place?

Ans. Yes. Mr. Williams called and asked me to get him five turkeys from up the country.

Mr. Coffman moved, seconded by Mr. Levinson, that the dis­cussion on the above case be held over until the next meeting.

SO ORDERED.

Mr. Coffman moved, seconded by Mr. Ullrich, that the ex­aminations start on Tuesday, March 2, 1937 at 10 A.M. SO ORDERED

Mr. Coffman moved, seconded by Mr. Weber, that the meeting now adjourn. SO ORDERED.

The special meeting of the education committee was called to order by President Levinson at 1:30 P.M., with the following members present:

Mr. Sol Levinson, President, Mr. George A. Farley, Mr. William Cook, Mr. John M. Weber.

The following applicants appeared for the scholastic examination:

James J. Bruzdzinski - Baltimore, Md. Kenneth R. Thomas - Cambridge, Md. John C. Hopkins, Jr. - Millington, Md. Warren A. Shuping - Hancock, Md.

James J. Bruzdzinski and Warren A. Shuping, having received a passing mark were declared eligible for the coming embalmer's ex­amination.

Kenneth R. Thomas and John C. Hopkins, Jr., having failed to receive a passing mark, were declared ineligible for the coming embalmers' examination.
