    Subject: To promote Bal Sewikas of HP as supervisor in ICDS scheme

    Honorable sir,

    With regards, I want to state that the Bal Sewikas are serving in various

    Shishu Kendras(cratches) of H.P. for last 28 years without any respectful honorarium. The Governor of

    HP had notified as below:-

    The Governor, Himachal Pradesh, is pleased to order that "One year Balsevika Traning Course" introduced by

    the Indian Council of Child Welfare, al Kamla Nagar (Bhatt-Kuffar) of Shimla district Himachal Pradesh be recognized for

    employment a:. Nursery Teacher in the Department of Education in Himachal Pradesh.

    The Governor, Himachal Pradesh, is further pleased to order that J.B.T. certificate awarded by the Punjab &

    Haryana education department to candidates, who had earlier qualified one year nursery teacher training course & underwent

    second year J.B.T. integrated course, be considered equivalent to two year J.B.T. course of Himachal Pradesh Government for

    the purpose of employment in the state of Himachal Pradesh.These orders shall come into force with immediate effect.

    But this benefit has been

    limited to only 100 Bal Sewikas and approximately 145 Bal sewikas are still on the same post without any

    promotion benefit for last 28 years. Many bal sewikas have done the one year NTT course too but still they

    have not been promoted. It is injustice and not in accordance with the earlier notification mentioned

    above.

    Now, as they are working on the

    honorarium of mere Rs. 1400 per month, their honorarium after 28 years is almost equal to the freshly

    appointed Part Time Water Carriers in Govt. Primary Schools of H.P. After such a long duration of

    service, this inadequate honorarium is injustice towards these Bal Sewikas.

    MY OBJECTIONS ABOUT THE POLICY WITH BAL SEWIKAS ARE AS BELOW:-(1) Why they have not been promoted Supervisor directly in ICDS department as the nature of work is

    same in Anganwari and Balwari Kendras. If Govt. has not given them any extra duty itself, how it can

    claim that they are inferior to the post scheme appointee Anganwari workers.The Bal Sewika Scheme

    under HP Child Welfare Council was initiated in decade of 1970 and the ICDS based Anganwari Scheme

    was launched in 2000. So Bal Sewikas are the most senior employees in Pre-Primary/ECCE education in

    H.P. having working experience more than Anganwri workers. Still the honorarium of ICDS based

    Anganwari workers is approx.3000+other honorariums in respect of various surveys. The working time of

    ICDS based Anganwari workers in 10:00 am to 3:00 pm but the same working schedule for Bal Sewikas is

    9:00 am to 5:00 pm. Even then, the honorarium of Bal Sewikas is very little instead of seniority and more

    working hours. Isnt it an injustice towards these Bal Sewikas ? Why they have not been given a respected

    salary ? In our state, 8 years to 12 years of service holder all type of dailywagers, contract employees andtemporary/adhoc employees have also got regularization but Bal Sewikas have been the only exception in

    last 28 years. In the light of above facts, why they are not promoted as Supervisor in ICDS department

    which had issued the advertisement of the recruitment of 808 post of supervisors in HP. But the

    age,written test and interview may not be applied in case of Bal Sewikas and as the only one time

    relaxation to Bal Sewikas, they should be promoted in a single batch this time for the said posts as they

    have been deprived from the posts of JBT teachers too.By virtue of seniority and lack of other benefits,

    they must be given this promotion without having any age bar for promotion as many Bal Sewikas will

    retire within three years. At the end time of service, if they get the benefit of promotion, they will get only

    satisfaction for the injustice done to them in last 28 years.

    (2) The quota of Bal Sewikas in the promotion for Supervisor may be managed and re-arranged in such a

    manner for one time that they get promotion in a single batch now. All Bal Sewikas having more than

    10-15 years of service may be promoted as Supervisor and rest of the posts may be filled in according to

    the R&P rules amended by HP Govt. whose copy is attached herewith the petition.

    (3) There is no pension provision for Bal Sewikas and after such along service duration, why they are not

    entitled for such benefit , however, Supreme Court has given many verdicts which are enough to indicate

    that there must be minimum pension to the person who has devoted more than 20 years in service of any

    Department/Board/Council under State/Centre Govt. Why it is not done ? Please issue the necessary

    directions as the Social Justice and Welfare Department is giving pension to senior citizens,widows,

    handicappeds etc.as only for sake of living and no productive work towards the Department but these BalSewikas have done the productive job for the same department , yet they are deprived of the pension

    policy.Some Bal Sewikas have died during service but they have not been given any benefit. This is really a

    tragic.

    (4) All employees are given insurance benefits by the state/centre govt. MNREGA workers are also insured

    but Bal Sewikas are not insured.Anganwari workers and many other workers have been given at least one

    single insurance but Bal Sewikas have got none. Health/Life insurance may be given to them please.

    (5)Many pay scale came and gone in last 28 years but the honorarium of these Bal Sewikas have reached

    from Rs. 200 to 1400 and Balwari(Shishu Kendra) Helpers are working on Rs. 700 per month which is an

    injustice towards them. The dignity of work is must for every govt. I do not blame any particular govt. for

    the ignorance of these Bal Sewikas as they have been ignored by all.

    (6) The nutrition money sanctioned for the children in Shishu Kendras is less than that of ICDS scheme.They must be made equal as the pre-primary children have same level of needs.The nutrition must reach

    to them per month instead of after many months as the existing pattern says. They are also not given salary

    in Bank Accounts via online process. It must be applied on them too.

    (7) The Bal Sewikas have not been given any infrastructures to keep the records, make children sitting in

    classroom etc. They basic infrastructure is must. There are no chairs, no almirahs, no desks/tat patti etc.

    for students in many Shishu Kendras. It is shameful and must be given high attention immediately.

    (8) The Bal Sewikas are asked to collect fees from parents for Pre-Primary Education. It is a real shame.

    When Primary and Pre-Primary Education are free universally as per UNESCO and UNICEF guidelines,

    why such injustice is done? If it is done, I shall move the matter to UNESCO and UNICEF alongwith

    concerned Department of Govt. of India because it is not in accordance with RTE 2009 and many

    international laws made for Pre-Primary education. Clear written guidelines must be issued in this regardimmediately.

    In brief, 15th

    August, 2012 is near

    and Bal Sewikas are waiting for justice from the state govt. If they are paid special attention, it will not

    make any huge burden on the state govt. as there are approx. 100 Helpers to Bal Sewikas and 144 Bal

    Sewikas in H.P. as per my information but the number of Bal Sewikas may be less. Albeit, it is clear that if

    the state govt. plans good for them, it will not insert huge financial burdens and more over, if they are

    given immediate promotion benefits, they will get the justice which is justified by virtue of seniority. All

    NTT trained Bal Sewikas may be given such benefit without any question and rest of Bal Sewikas may be

    given such benefit by virtue of seniority in service.

    Lord Rama had faced exile for 14 years

    but the exile for Bal Sewikas is double to that . Some Bal Sewikas promoted as Clerk, JBT etc. are gettingRs. 32000 per month and the same batch recruited Bal Sewikas deprived of promotion are getting only Rs.

    1400 per month. I have not seen such a partiality in my life. I hope that the Govt. will act wisely in the

    matter.All required letters and notifications are attached below.

    RECRUITMENT AND PROMOTION RULES FOR THE POST OF SUPERVISOR

    CLASS-III(NON-GAZETTED) IN THE DEPARTMENT OF SOCIAL JUSTICE &

    EMPOWERMENT. HIMACHAL PRADESH.

    I. Name of the Post: Supervisor

    Number of posts 808 (Eight hundred & eight

    Classification Class-III (Non-Gazetted)

    Scale of pay i)Pay Scale for regular incumbents:-

    Rs. 10300-34800+ 3200GP

    ii)Emoluments for contract employees:-The contract appointee will be paid fixed contractual amount Rs. 13500 per month (which shall

    be equal to minimum of the pay band +grade pay). The contract appointee will be entitled for increase in contractual amount @ % 410 /-

    ( 3% minimum of the pay band in grade pay of the post.)

    Whether Selection or Non- Non Selection Selection post:

    Age for direct recruitment; Between 18 and 45 years.

    Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including

    these who have been appointed on adhoc or on contract basis;

    Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will

    not, however, be admissible to such staff of the public sector Corporations/ Autonomous Bodies who were/ are subsequently appointed

    by such Corporations/ Autonomous Bodies and who arcIwere finally absorbed in the service of such Corporation/ Autonomous Bodies

    after initial constitutions of the Public sector Corporations/ Autonomous Bodies.

    11.In case of recruitment by promotions, deputation,transfer grade from which promotion

    /deputation/transfer is to be made:(a) 20% from Angawari wokers who have passed Matriculation Examination from a recognized

    Board of School Examination/Institution more than 20 years experience as Anganwari Workers

    on the basis of the seniority without conducting any competition/written examination and

    interview.(b) 10% from Angnawari workers who have passed Graduation form a recognized University

    with more than 15 years experience as Anganwari worker on the basis of the seniority without

    conducting any competition/written examination and interview.

    which may be extendable for two more years on yean to year basis.

    Provided that for extension/renewal of contract period on year to year basis the concerned HOD shall issue a

    Certificate that the service and conduct of the contract appointee is satisfactory during the year and only then

    his/her period of contract is to be renewed/extended.

    (b) POST FALLS WITHIN THE PURVIEW OF HPSSSB:- The Director, Social Justice & Empowerment after

    obtaining the approval of the Government to fill up the vacant posts on contract basis will place the requisition

    with the concerned recruiting agency i.e. H.P.SS3B Hamirpur.

    C) The selection will be made in accordance with the eligibility conditions as prescribed in these Rules.

    (ii) Contractual Emoluments

    the Supervisor appointed on contract basis will be paid fixed contractual amount @ Rs. 13500/- P.M. (which

    shall be equal to minimum*of pay band-*-grade pay). The contract appointee will be entitled for increase in

    contractual amount @Rs. 410/- (3% of the minimum of pay band igrade pay) of the post as annual increase in

    emoluments for the subsequent contract is extend beyond one year.

    (iii)APPOlNTING/DlSCIPLlNARY AUTHORITY.

    Director of Social Justice & Empowerment H.P. will be appointing

    and disciplinary authority.

    (iv) SELECTION PROCESS.

    Selection for appointment to the post in the case of Contract

    Appointment will be made on the basis of viva-voce test or if

    considered necessary or expedient by a written test or practical lest

    the standard/syllabus etc. of which will be determined by the

    concerned recruiiing agency i.e. HPSSSB.

    COMMITTEE FOR SELECTION OF CONTRACTUAL

    APPOIM MENTS:-

    As may be constituted by the concerned recruiting agency i.e. the

    H.P.S.S.S.B.

    vi) AGREEMENT

    After selection of a candidate, he/she shall sign an agreement as

    per Anncxure-B appended to these Rules.

    vii)TERMS AND CONDITIONS:

    (a) The contract appointee will be paid fixed contractual amount @

    Rs13500 per month (which shall be equal to minimum of the pay

    band +grade pay). The contract appointee will be entitled for

    increase in contractual amount @ 7410 /- (3% of minimum of the

    pay band+ grade pay of the post) for further extended years and no

    other benefits such as senior/selection scales etc. will be given.

    (b) The service of the Contractual appointee will be purely on

    temporary basis. The appointment is liable to be terminated in case

    the performance/ conduct of the contract appointee is not found

    satisfactory.

    16. Reservation

    17 DepartmentalExamination

    18. . Powers to Relax:

    (c) Cotractual appointee will be entitled

    for one

    day casual leave after putting one month service.

    This leave can be accumulated uplo one year. No

    leave of any other kind is admissible to the contract

    appointee. He/she shall not be entitled for Medical

    Reimbursement and LTC etc. Only maternity leave

    will be given as per Rules.

    (d) Unauthorized absence from the duty

    without the

    approval of the controlling officer shall automaticallylead to the termination of the contract. Contract

    appointee shall not be entitled for contractual amount

    for the period of absence from duty.

    (e) An official appointed on contract basis

    who

    have completed 5 year tenure at one place of posting

    will be eligible for transfer on need based basis

    wherever required on administrative grounds.

    N.A.

    Selected candiadate will have to submit a certificate of his/her

    fitness from a Government/ Registered Medical Practitioner.

    Women candidates pregnant beyond twelve weeks will stand

    temporarily unfit till the confinement is over. The women

    candidate will be re-examined for fitness from an authorized

    Medical Officer/ Practitioner.

    (g) Contract appointee will be entitled to TA/ DA

    if required to go on tour in connection with his/her

    official duties at the same rate as applicable to regular

    officials at the minimum of the pay scale.

    (h) Provision of service rule like FR, SR. Leave

    Rules, GPF Rules, Pension Rules and Conduct Rules

    etc as arc applicable in case of regular employee will

    not be applicable in case contractual appointees.

    They will be entitled for emoluments etc as details in

    this Column.The appointment to the service shall be subject to orders regarding

    reservation in the service for Scheduled Castes/Sch. Tribes/Other

    Backward Classes/ Other categories of persons issued by the

    Himachal Pradesh Government from time to time. N.A.

    Where the State Government, is of the opinion that it is necessary

    or expedient to do so, it may, by order for reasons to be recorded in

    writing and in consultation with the Himachal Pradesh Public

    VI) AGREEMENT:-

    Alter selection of a candidate, he'ahe shall sisn an

    agreement cs per Armexure-B appended tc these Rules.

    (VII) TERMS AND CONDITIONS:

    (a) The contract appointee will be paid fixed

    contractual amount @ Rs. 7500/- per month( which

    shall be equal lo initial of the pay scale Dearness pay). The ContractAppointee will be entitled for increase in contractual amount @Rs. 160/-per annum for second and their years respectively and no other allied

    benefits such as senior selection scales etc. shall be given.

    (b) The service of the contractual appointee will be purely on temporary

    basis. The appointment is liable to be terminated in case the performance

    conduct of the contract appointee is not found satisfactory.

    (c) Contractual appointment shall not confer any right io incumbent for

    the regularization in service at any stage.

    (d) Contractual appointee will be entitled for one day casual leave after

    putting one month service. This leave can be accumulated upto tweleve

    days in a calendar year and casual leave not avoided in calendar year

    shall lapse close of calendar year. No leave of any other kind is

    admissible to the contract Appointee. He/she shall not be entitled lor

    Medical Reimbursement and LTC etc. Only maternity leave will be given

    as per Rules.

    (e) Unauthorized absence from the duty without the approval of the

    controlling officer shall -automatically lead to the termination of the

    contract. Contract appointee shall not -be entitled for contractual amount

    for his period of absence from duty.

    (f) Transfer of a contract appointee will not be permitted from one pi:ueto anotherin any .case.

    (g ) Selected candidate will have to submit acertificate of his/her fitness fom a Government' Registered Medical

    Practitioner. Women candidates pregnant beyond twelve weeks will

    stand temporarily unfit till her confinement is over. The women

    candidate will be re-examined for fitness from an authorized Medical

    Officer Practitioner.

    (h) Contract appointee will be entitled to TA/DA if required to go on tour

    in connection with his/her official duties at the same rate as applicable io

    regular officials at the minimum of the pay scale.

    RIGHT TO CLAIM REGULARAPPOINTMENT:

    The candidate engaged on contract basis under these rule shall have noright to claim regularization/ permanent absorption asSupervisor in the Department at any stage.

    Where the State Government is of the opinion that it isnecessary or expedient to do so. it may, by order for

    reasons to be recorded m writing and in consultationwith the Himachal Pradesh Public Service Commission-relax any of the provisions of these Rules with respect :oany class or category of persons or posts.
