MEETING OF THE BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA August 11-14, 1977 The Radisson Plaza Hotel Charlotte, North Carolina The Board of Medical Examiners of the State of North Carolina met at The Radisson Plaza Hotel, Charlotte, N. G. , August 11-14, 1777 for the purpose of interviewing applicants for license by endorsement of credentials and conducting other business. Drs. Charles B. Milkerson, Jr. , President, J. Jerome Pence, Jr. , Secretary- Treasurer, David S. Citron, Bryant L. Galusha, Joyce H. Reynolds, and E. Milson Staub were present. Dr. Bruce B. Blackmon was absent from the meeting. Also present were Bryant D. Paris, Jr. , Executive Secretary, Mrs. Betty Joe Barick, Assistant Executive Secretary, Mrs. Diane Freeman, and Mr. Lee Denney, Investigator. RE: Visa ali in Examination Dr. Galusha moved that the Board support the Board of Directors of the Federation of State Medical Boards in their resolution declaring the Visa Qualifying Examination as equivalent to the ECFMG examination for the purposes of EGHCG certification. Seconded by Dr. Pence and duly passed. REs Dr Hadrahan Baner ee, Cleveland, Ohio Request to be allowed to take FLEX, and be covered by a resident's training license at a state institution while waiting to take the examination, and during the interim of certification of the gradesg and if he does not pass the examnnation the first time, but makes a FLEX Meighted Average of at least 70. 0 on the first attempt, he be allowed to remain in the state institution, covered by the resident's training license until the next KZX examination. Dr. Galusha moved that Dr. Banerjee be advised that based on his past performance on the FLEX examination, the Board feels this is tantamount to fulfilling the Board's policy on this matter, and the Board deny his request. Seconded by Dr. Pence and duly passed. RE: Visa ali in Examination —Dr. Galusha moved that the Board support theBoard of Directors of the Federation of State Medical Boards in their resolutiondeclaring the Visa Qualifying Examination as equivalent to the ECFMG examinationfor the purposes of EGHCG certification. Seconded by Dr. Pence and duly passed.

RE: Recertification examination for Mobile Intensive Care Technicians—Following general discussion, Dr. Galusha moved that the procedure for the recer-tification examination be accepted as presented by the Office of Emergency MedicalServices, and the Board would appreciate it if that office would present to theBoard with each list of re-certified Mobile Intensive Care Technicians the following:

1) a liat of all persons taking the recertification examination, passes andfailures;

2) a copy of the examination for the Board's review;3) a brief explanation of the examination procedure, including such things as

whether it was closed or open-book examination, supervision, etc. ;and that the Executive Secretary so notify the Office of Emergency Medical Services.Motion seconded by Dr. Pence and duly passed.

RE: Dr Alton R Anderson Raleigh, N. C. —Dr. Anderson missed taking thefirst part of the June, 1977 examination, stating that someone told him the firstday of the examination was Mednesday instead of Tuesday. The Board advisedthe Executive Secretary that the Board's policy is that the examination must betaken and passed in one sitting.

RE! Catawba Valle Technical Institute —Assistant to P sician Pro am:The Board discussed the training program for assi. stants to physicians at theCatavba Valley Technical Institute, which program presently will train assistantsfor work only in hospital emergency departments. The President of the Board vasauthorized to discuss the Board's concerns about the program with Colonel CharlesSpeed, Director of the Office of Emergency Medical Services, and the Board's con-cern for the students already enrolled inde program. The President was alsoauthorized to tell Colonel Speed that the Board vas considering making it a require-ment for all assistants to physicians to pass the examination given by the NationalCommission on Certification of Physician's Assistants in order to be approved bythe Board to function as an assistant to a physician.

Dr. Citron moved that the Board request their attorney to draft a proposedregulation vhich would require that an assistant to a physician pass the NationalCertifying Examination within a certain period of time after his graduation froman approved program as a requisite for his continued approval by the Board, aftera certain date, and that this be considered at the October, 1977 Board meeting.Seconded by Dr. Pence and duly passed.

RE: Dr Lewis B Bolin Gastonia, N. G. —A hearing was held before theBoard of Medical Examiners of the State of North Carolina upon and concerningcharges and accusations preferred by the Board in the above matter at The RadissonPlaza Hotel, Charlotte, North Carolina, on Friday, August 12, 1977, at vhich hearingDr, Lewis B. Bolin did appear and vas represented by counsel, Frank P. Cooke, Esq.Following this hearing and the presentation of evidence, and upon motion duly madepseconded and passed, Dr. Bolin's license to practice medicine in the State of NorthCarolina was suspended; suspension stayed upon the terms and conditions as setforth in the Findings of Fact, Conclusions of Law and Order of the Board.

RE: N w le 'slation —John Anderson, attorney for the Board, discussed thenew legislation that was considered and passed by the North Carolina General Assemblyduring their most recent session, concluded in June, 1977. This included an addi-tional requirement for licensure in the state of the successful completion of oneyear of post-graduate training in a Board-approved training program. Also includedas part of the new legislation are new Board procedures relating to public hearings,and the collection and compilation of records and information regarding physicianslicensed by the Board. Also in this same session of the General Assembly, a billwas passed entitled "An Act to Enable Registered and Licensed Practical Nurses toCarry Out the Orders of Physicians' Assistants Under Certain Conditions. " Thisbill concerns the use of written standing orders which must be employed when aphysician intends for his assistant to physician to give orders to registered orlicensed practical nurses. Following general discussion on this particular newlegislation, Dr. Citron moved that for any new applications for approval of assis-tants to physicians, or at the next registration period for all assistants tophysicians, should the supervising physician intend for his assistant he is applyingfor approval of, to give orders to registered nurses or licensed practical nurses,the Board will require, as part of that approval or registration process, the sub-mission of standing orders for the Board's review. Seconded by Dr. Pence and dulypassed.

RE: Dr Jo e h E Swanton Mississippi —Dr. Citron moved that the chargespreferred against Dr. Swanton be held in abeyance unless he advises the Board he isreturning to North Carolina to practice. Seconded by Dr. Pence and duly passed.

with the Board his request for special consideration for license by endorsement ofcredentials, although he does not meet the requirements of the Board regardingcitizenship. Dr. Shirkhoda said he wanted a full license because with his trainingand credentials he does not feel he should have a resident's training license,especially since he is here toteach as well as receive additional training himself;and he possibly may want to do some locum tenens. He said he did not think thecitizenship regulations were fair to him, and was asking the Board for their helpin working out this situation. The Board advised him they could not make an excep-tion to the rule, and since he does not yet have a resident's training license as ofthis date, he should apply for that immediately so he would be covered in his work.

REs Joint subcommittee —N. G ~ Board of Medical Examiners and N. CD Boardof Nursing —subcommittee reports Dr. Pence reported on the meeting of the jointsubcommittee held on Thursday afternoon, August 11. Topics discussed by thesubcommittee included House Bill 1216 which would allow registered nurses andlicensed practice nurses to take orders from assistants to physicians and registerednurses performing medical acts. This Bill is valid only until July 1, 1978, andduring this time will be reviewed by the Legislative Research Commission. Alsodiscussedwere the guidelines developed by the Joint Practice Committee for reviewby the subcommittee regarding nurses with graduate education who feel they havemet the same requirements as nurses having completed the FNP programs, and wantingcertification as registered nurses performing medical acts based on that graduateeducation. Dr. Citron informed the Board that the subcommittee members from theBoard would keep all the other members informed on all aspects of House Bill 1216and nurses with graduate education and action taken by the subcommittee in thisrespect. Other topics discussed included the time limit for countersigning orders, sitevisits to clinics utilizing nurse practitioners, and a workshop being planned bythe Maternal and Child Health Branch of the N. C. Department of Human Resources.

Ms. Johnson is working at the Madison County Health Department,but is also helping out at the Hot Springs Clinic due to their recent heavy patientload, where she had previously been approved to work. Subcommittee advised herthat it is not the policy of the subcommittee to approve two practice sites, but herfirst approval to the Hot Springs Clinic will not be withdrawn at the present timebecause the committee understands her committment to her work.

RE: Dr Howard S Husse Jr. Tarboro, N.C. —new applications submitted forFlossie S. Dunston and Annie P. Vick following request of supervision clarificationat the June, 1977 meeting. Provisional approval granted to Ms. Dunston and Ms. Uickpending a site visit to the clinic in the near future, with a report due at theOctober, 1977 meeting.
