FOREWORD

The United Nations Economic and Social Council expressed in July1959 the desire "that the International Atomic Energy Agency (IAEA) beentrusted with the drafting of recommendations on the transport ofradioactive substances". As a consequence the IAEA Regulations for theSafe Transport of Radioactive Materials were first published in 1961.

The basic principles underlying the IAEA Regulations were expectedto remain acceptable for a long period, but it was also realized that a"feedbacfc" of experience in application would be facilitated by revisionsof the detailed provisions. In the event three comprehensive revisionswere carried out which culminated in 1964, 1967 and 1973. Followingminor amendments, a further revision of the 1973 Edition of theRegulations was published in 1979 as the "1973 Revised Edition (AsAmended)". Finally, the latest comprehensive revision was published in1985.

The procedures used by the Agency for the preparation of theRegulations are largely responsible for their extensive national andinternational application. These procedures have involved the conveningof panels, whose members represent Member States and internationalorganizations, and also experience of various regulatory and technicalareas.

The IAEA Regulations are recommended as "model regulations" toMember States and appropriate international organizations. Internationalorganizations have in fact for many years used the IAEA Regulations as abasis for their requirements for the transport of radioactive materials.National regulations are usually based directly on the IAEA Regulations,although the IAEA Regulations are also applied through otherinternational (modal) regulations and recommendations.

The Agency has examined ways in which Member States implementinternational agreements, regulations and recommendations for regulatorycontrol of the transport of radioactive material. The results of the

;U_ INTRODUCTION

Member States of the IAEA (i.e., individual countries) implementinternational agreements, regulations and recommendations for regulatorycontrol of the transport of radioactive material in a variety of ways. Eachcountry must act within its own statutory requirements. The IAEA, workingwith the individual Member States, undertook to examine the manner in whichdomestic, import, export and through-country shipments of radioactivematerials are controlled and regulated worldwide.

The information to be examined was collected by a questionnaire, whichwas sent to Member States in July 1984. Copies of the letter and thequestionnaire are in Appendix I of this document. The follow-up letters,repeating the request to provide the IAEA with data and asking authorizationto publish the data obtained through the questionnaire, were sent in February1985 (see Appendix II and III). By the end of June 1986 completedquestionnaires had been received from 53 Member States. These Member Statesare listed in Appendix IV.

The results of the examination are summarized in this report. Theresults indicate the important role the international organizations play inthe transport of radioactive material. All the Member States involved in thisexamination regulate the transport of radioactive material within theircountry on the basis of international agreements, regulations andrecommendations. The IAEA Regulations for the Safe Transport of RadioactiveMaterial, Safety Series No. 6, is the ultimately controlling document since itserves as the basis for the radioactive material portions of otherinternational transport documents (see Appendix V) and since it is madedirectly binding in the regulations of many countries. In addition to thequestions concerning the adoption of the regulations, some questions on theimplementation of the transport regulations, e.g. on competent authorities andother regulatory bodies as well as quality assurance, were presented in thequestionnaire. This report concerns only the adoption of the regulations.The IAEA plans to clarify in the future more thoroughly these other subjects.

2i. INTERNATIONAL AGREEMENTS. REGULATIONS AND RECOMMENDATIONS AS THE BASESFOR REGULATING TRANSPORT

2.1. Domestic transport

Information on regulating domestic transport of radioactive material wasreceived from 53 Member States. In every case the domestic regulations arebased on international agreements, regulations and recommendations. Thefollowing conclusions were made:

11.3% of the Member States involved regulate based only on the IAEARegulations;

20.8% of the Member States involved regulate based only on theinternational documents other than the IAEA Regulations;

67.9% of the Member States involved regulate based on both the IAEARegulations and other international documents.

The relevant international transport documents and the areas of theirapplication are listed in Table I, which indicates the percentages of theMember States involved which use the document or documents in question as thebasis for their domestic regulation of transport.

2.2. International transport

Information on regulating international transport of radioactive materialwas also received from 53 Member States. The following conclusions were made:

11.3% of the Member States involved regulate based only on the IAEARegulations;

22.6% of the Member States involved regulate based only on theinternational documents other than the IAEA Regulations;

64.2% of the Member States involved regulate based on both the IAEARegulations and other international documents.

- 1.9% of the Member States (one country) indicated it does not useeither the IAEA Regulations or other international documents.

3_._ ADOPTION OF THE IAEA REGULATIONS AS THE BASIS FOR REGULATING TRANSPORT

3.1. Domestic transport

Detailed data on the adoption of the Regulations were received from 44Member States. These States are indicated in Appendix IV. Three of these

States, however, have adopted the Regulations only via other internationaldocuments.

Table III indicates in a summary form which edition of the Regulations isused as a basis for the domestic regulations of the 42 Member States whichhave directly adopted the Regulations.

Appendix IV indicates which edition of the Regulations has been adoptedby different States. It also indicates the method which is used in adoptionof the Regulations. In summary, the Regulations have been adopted as follows:

35.7% of Member States involved have adopted the Regulations bydirect reference,

- 47.6% have adopted the Regulations in principle - but notincorporated word by word, where a different format or differentwords were used,

16.7% by other means, e.g. decisions of a competent authority andcombination of the means above, and

- none by direct adoption verbatim, i.e. incorporated word by word innational regulations.

3.2. International transport

Detailed data on the adoption of the Regulations were received from 42Member States. These States are indicated in Appendix IV. Three of theseStates, however, have adopted the Regulations only via other internationaldocuments.

Table IV indicates in a summary form which edition of the Regulations isused as a basis for the international regulations of the 40 Member Stateswhich have directly adopted the Regulations.

42.5% of Member States involved have adopted the Regulations bydirect reference,42.5% in principle,15.0% by other means, and

- none by direct adoption verbatim.

3.3. Adoption of the 1985 Edition of the Regulations

Information on current plans to adopt the 1985 Edition of the Regulationswas received from 43 Member States. These states are indicated in AppendixIV. 88.4% of the states involved plan to adopt the Regulations in the sameway as they do now. In addition, the regulations of one state are alreadybased on the 1985 Edition.

Table V summarizes the adoption plans indicating the projected years ofadoption.

4_._ ADOPTION OF INTERNATIONAL TRANSPORT DOCUMENTS OTHER THAN THE IAEAREGULATIONS

As discussed in section 2, most of the Member States involved regulatetheir domestic and international transport of radioactive material based alsoon international documents other than the IAEA Regulations. Appendix VIindicates which other international documents the individual states involvedhave adopted. It should be noted that the questionnaire did not includequestions on how the adoption of other documents has been carried out. Thusthere might be differences in the way the States have provided data, i.e.,some States may have indicated only those documents which have been formallyadopted as a basis of national regulations, whereas some States may haveindicated in addition those documents which are otherwise recognized, e.g. bythe carriers.

I have the honour to Inform you that the International Atomic EnergyAgency will convene a Technical Committee Meeting on Assuring Implementationof the Transport Regulations in November 1984. This will be the secondmeeting on the subject; the first meeting (TC-458) was convened by the Agency22-26 November 1982.

The TC-458 committee recommended that the IAEA should gather informationon the current status of implementation of the Transport Regulations by MemberStates and the international transport organizations; specifically, on whichedition of Safety Series No. 6 is in effect and whether additional ordifferent requirements have been prescribed, if so what these are; andinformation on the practices and procedures utilized by CompetentAuthorities. The principle task of the forthcoming Technical CommitteeMeeting on Assuring Implementation of the Transport Regulations (TC-458.2)will be the development of a draft "Implementation Assurance" document, andthe above information will be required for this meeting.

The Secretariat has prepared a questionnaire which will provide thedesired implementation information, a copy of which is enclosed. Because theworking language of the TC-458.2 meeting will be English only, and the timeperiod is so short, the questionnaire has been prepared only in English. Thisquestionnaire is an initial step in a comprehensive effort being undertaken bythe Secretariat to gather information on radiation protection issues. Ishould be grateful if the questionnaire was completed by the nationalCompetent Authority (or Authorities) responsible for approvals andauthorizations in respect of the transport of radioactive material for yourgovernment. To be useful for TC-458.2, the completed questionnaire should bereceived by the Secretariat no later than 15 October 1984.

Assuring the Implementation of the Transport Regulations (TC-458.2) whichwas convened in Vienna 12-16 November 1984, recommended that data on themethods used by Member States for regulating the transport of radioactivematerials be assembled and published. This would assist in harmonizing theapplication of the Agency's Regulations for the Safe Transport ofRadioactive Materials (Safety Series No. 6). It was recommended that thisactivity be completed during 1985 so that the results could be reviewed bythe Standing Advisory Group on the Safe Transport of Radioactive Materials(SAGSTRAM) which should next be convened in early 1986.

In a letter to your Government, Jl-TC-458.2 Circ., 31 July 1984,information was solicited through a questionnaire which, in part, addressedthis issue. The data therefrom were intended, at that time, only for theuse of TC-458.2. The Secretariat has not, as yet, received the completedquestionnaire from your Government. I therefore take this opportunity torequest that your Government provide the completed questionnaire sent on31 July 1984 and simultaneously provide permission to use the answers toquestions 2 through 15 therefrom in developing the document proposed by thecommittee. In responding to this request could you please direct allcommunications and questions to Mr. R. Pope, Division of Nuclear Safety. Iwould appreciate it if your response could be received by the Secretariat nolater than 15 May 1985.
