Intellectual Property activities in 2010 were guided by the policy of the Party and the State on encourag-ing and promoting creation and innovation, and protection of IPRs in order to serve the national devel-opment. Especially, the Documents approved by the 11th National Congress of the Communist Partyof Vietnam in January 2011 clearly indicate the development direction of the socialist-oriented market

economy; accordingly, Vietnam aims at developing an advanced economy with a modern production force andan advanced production relation - a knowledge-based market economy of the 21st century. The DevelopmentStrategy also identified demands for strong development of scientific and technological market associatedwith protection of intellectual property rights. Under the Socio-economic Development Plan in 2011-2015, with

high investment in developing economic tools, more investment would be made in intellectual property activi-ties, particularly in protection and commercialization of intellectual property assets.

The National Office of Intellectual Property of Vietnam (NOIP), as an agency under the Ministry of Science and Tech-nology responsible for overall state management of intellectual property and specialized in industrial property, hasbeen operating more effectively and significantly contributing to the national socio-economic development.

The visit of the Director General of the World Intellectual Property Organization (WIPO) to Vietnam where he

met leaders of the country and related agencies, including NOIP in early 2010, has showed that WIPO highly

valued the progress of Vietnam in the field of intellectual property, as well as the interest shown by the Party

and the State to intellectual property.

In 2010, the worlds financial crisis continued to create negative impact on the Vietnams economy, including IPactivities. NOIP continued playing a key role in developing IP activities in Vietnam. The national intellectual prop-erty system continued to be improved in all aspects, including IP legislation system, especially with regards toimplementing regulations for the revised IP Law; the receiving and processing industrial applications remained athigh rate; international cooperation activities were widely expanded; IP information, application of informationtechnology and training activities positively supported to the development of IP system; enterprises, researchinstitutions and universities paid more attention and received effective supports on creation and protection of IPassets; enforcement of IPRs was promoted etc. Achievements made by NOIP have considerably contributed to thetechnical creation, production and business and boosted foreign investment and technology transfer in order to

serve the socio-economic development and international economic integration of the country.In the year of 2011 and coming years, there are both opportunities and challenges for IP activities. NOIP will keepplaying its core role in the countrys IP system, and, under the guidance of the leaders of the Ministry of Scienceand Technology, it will endeavor to take advantage of the opportunities as well as to overcome challenges with aview to promoting IP activities nationwide.

On January 19 and 20, 2010, at the invitation of the Minis-ter of Science and Technology H.E. Hoang Van Phong, the

Director General of WIPO, Dr. Francis Gurry paid an officialvisit to Vietnam. This was the second visit of WIPOs headto Vietnam since 1986.

Director General Francis Gurry was well received by the lead-ers of the State and the Government of Vietnam. In the meet-ing with the Director General, President Nguyen Minh Trietconfirmed Vietnams commitment to protect intellectualproperty and informed the progress in the development ofthe national legislative and administrative frameworks. ThePresident called on WIPOs continued assistance to supportthe countrys full integration of into the national develop-

ment strategy to become a knowledge-based economy andproducer of high-end, value-added goods and services. TheDirector General briefed the President about importance ofintellectual property (IP) in promoting innovation and boost-ing national economic development. Mr. Gurry pledged theWIPOs continuing support in further enhancing Vietnamsnational IP capacity to innovate and achieve sustainableeconomic growth.

In a meeting with Director General Francis Gurry, Perma-nent Deputy Prime Minister Nguyen Sinh Hung stressed thatsustainable development of the national IP system in line

with international obligations is a priority of Vietnams gov-ernment. He reiterated that continued support from WIPOin further strengthening the national IP system would helpfacilitate the countrys on-going economic transformation.Director General Francis Gurry noted Vietnams impressiverates of economic growth in recent years and its resilience tothe global financial crisis. He called Vietnam anexemplaryrole model in exercising IP rights and said its commitmentto encouraging innovation helps to promote its image andproducts abroad and attract investment. The Director Gen-eral promised support for Vietnams ongoing modernization

of its national IP system and the training of IP specialists.The aim, he said, is to help enable state-of-the-art servicesto businesses, inventors and creators through the IP system.

During his visit, Director General Francis Gurry also held talkswith the Minister of Science and Technology Hoang VanPhong and Deputy Minister of Foreign Affairs Doan Xuan

Hung. He met with senior officials from the National Office ofIntellectual Property of Vietnam (NOIP), the Copyright Officeof Vietnam (COV) and the Plant Varieties Office of Vietnam.

The Director General also had a talk with students of VietnamNational University, Ha Noi; attended the WIPO Award Cer-emony and the Launching Ceremony of Distance LearningProgram on Intellectual Property in Vietnamese language.

On this occasion, Minister of Science and Technology HoangVan Phong awarded a Commemorative Medal to Dr. FrancisGurry to acknowledge his contribution to the development

of science and technology of Vietnam.

LEGISLATION AND POLICYON IN TELLECTUAL PROPERTY

Further improvement of NationalIP Legislation and Policy

With respect to the protection and enforcement ofIPRs, a number of legal papers were drafted and en-acted in 2010, namely:

Decree No. 119/2010/ND-CP dated 31 December 2010amending and supplementing some articles of DecreeNo. 105/2006/ND-CP on guiding the implementation

of a number of articles of the Intellectual Property Lawon the Protection of Intellectual Property Rights andon the State management of IP. This Decree amendsand supplements some provisions on determining ofinfringing elements of rights to plant varieties, valuesof infringed goods, procedures for dealing with re-quests for infringements settlement, assessment ofIPRs, mandates of the Ministry of Science and Technol-ogy for the State management of IP;

Decree No. 122/2010/ND-CP dated 31 December 2011amends and supplements some articles of Decree No.

103/2006/ND-CP on guiding the implementation ofsome articles of Intellectual Property Law on industrialProperty. The Decree amends and supplements someprovisions on secret invention, the state managementof geographical indications, professional require-ments for practicing IP representative services;

Decree No. 97/2010/ND-CP dated 21 September 2010replaces the Decree No. 106/2006/ND-CP on sanctionof administrative violations in the field of industrialproperty;

Decree No. 43/2010/ND-CP dated 15 April 2010 on

business registration replacing Decree No. 88/2006/ND-CP dated 29 August 2006 of business registration(including provisions on companies names to avoid

infringing IPRs towards protected trademarks, tradenames and geographical indications);

Circular No. 13/2010/TT-BKHCN dated 30 July 2010amends and supplements Circular No. 01/2007/TT-BKHCN dated 14 February 2007 of the Minister ofScience and Technology on recordals, modification

and elimination of IP representative organizations;procedures for cancellation/termination of validity ofprotection titles; vouchers of payment of IP fees andcharges.

Besides, several draft legal documents in the fieldof industrial property were prepared for approval,namely:

The draft Decree on Innovation: The Decree pro-vides details about requirements, procedures for rec-ognition of innovation, rights of innovators and own-ers in registration, recognition, recordal, applicationand transfer of innovation, measures for promotinginnovative activities and the state management of in-novation. The Draft was submitted to the Governmentfor comments and approval;

The draft Directive of the Prime Minister onstrengthening the management and enforcementof industrial property rights;

The Draft Circular to amend and supplement to Cir-cular No. 01/2008/TT-BKHCN, which was revised bythe Circular No. 04/2009/TT-BKHCN, on industrialproperty assessment:The Draft will be circulated toseek comments of relevant agencies and to be enact-ed in 2011.

Being considered as one of the key tasks in the State management of intellectual property, in 2010, theNational Office of Intellectual Property of Vietnam (NOIP) continuously implemented ranges of activitiesfocusing on completing and improving the intellectual property (IP) legislation and policy in order to sup-port an effective establishment and protection of IP rights (IPR) in the country. The NOIP took a leading rolein preparing drafts and providing comments on various legal documents in the field of IP that guide andimplement the amended Intellectual Property Law 2009, as well as overcome shortcomings and meet realand practical demands.

of the Minister of Science and Technology guidingthe implementation of Decree No. 103/2006/ND-CP: The draft is now in the final stage and will be cir-culated for comments by concerned agencies to enactin 2011.

Also in 2010, under the framework of Project 30 on Admin-istrative Reform, there were 31 procedures in the field ofindustrial property, containing 29 central-level ones and 2provincial-level ones, were reviewed, and27 procedures and9 forms being proposed to be revised accordingly. Thesechanges were adopted by the Government by the ResolutionNo. 25/NQ-CP dated 02 June 2010 and the Resolution No.

67/NQ-CP dated 23 December 2010. Amendments of 4 pilotprocedures in the field of intellectual property, as approvedby the Resolution No. 25/NQ-CP dated 06 February 2010 ofthe Government, has been made in Circular No. 13/2010/TT-BKHCN; Amendments of 23 remaining procedures on in-tellectual property as referred to in Resolution No. 67/NQ-CP

dated 23 December 2010 will be fulfilled in 2011.

Activities to guide implementation of IP laws and regulations

were carried out regularly through providing interpretationsand responses to problems in the process of execution of IPprovisions by provincial Departments of Science and Tech-nology, organizations and individuals, especially enterprisessuch as: representation and power of attorney; identifica-tion of net price in IP license agreements; priority transfer;infringements of trademarks; transfer of right to patents forpublic works. These contributed to relieve difficulties in theimplementation of IP legal provisions in practical produc-tion, trading, and management activities.

INTERNATIONAL COOPERATION OFINTELLECTUAL PROPERTY

Multilateral Cooperation

The year of 2010 was recorded with many outstanding international cooperative activities in the field

of intellectual property. International cooperation activities were increasingly undertaken in terms ofquality, quantity and cooperation partners.

Cooperation activities under the multilateral frameworkwere mainly conducted in the cooperation with World TradeOrganization (WTO), the Asia-Pacific Economic Cooperation(APEC) Forum and the Association of Southeast Asian Na-tions (ASEAN).In cooperation with WTO, the NOIP regularly followed, up-dated and handled issues relating to intellectual property,actively and fully participated in TRIPS /WTOs sessions.

With APEC, the NOIP participated in the 30th and the 31stmeetings of the APECs Intellectual Property Experts Group(IPEG), developed its National IP Action Program, together

with other APEC member economies to develop and imple-ment collective actions of IPEG. Furthermore, the NOIP con-tributed to APECs papers such as Draft texts of APEC Submitmeeting, APEC Ministerial Conference, v.v.).

With ASEAN, the NOIP actively participated in the 33rd meet-ing of the ASEAN Working Group on Intellectual PropertyCooperation (AWGIPC) and successfully hosted the 34thAWGIPC meeting in Da Nang City; cooperated with otherIPOs of ASEAN member states in implementing the ASEANEconomic Community Blueprint; developed ASEAN IP Direc-tory, implemented the Cooperative Program on Examinationof Patent application (ASPEC Project), v.v.; participated in de-velopment of ASEAN - Australia - New Zealand CooperativeProgram on IP; participated in the implementation of ASEAN- China Memorandum of Understanding on Intellectual

Bilateral Cooperation

In cooperation with the WIPO, the NOIP successfully orga-nized the official visit of Director General Francis Gurry ofWIPO to Vietnam; participated in important meetings of theWIPO, including the 48th series meetings of General Assem-blies of WIPO and meetings of its specialized committees.With the assistance of WIPO, the NOIP has conducted manyactivities relating to human resource development, namely,

implementation of the Distance Learning Program on Intel-lectual Property in Vietnamese language (DL 101), organi-zation of the Seminar on IP for enterprises in Ha Noi and aStudy Visit on the use of IP for Vietnamese small and mediumenterprises to Korea. In addition, NOIP also cooperated withWIPO in studying the possibility of developing a NationalStrategy on IP and continued implementing the Project onpatent application search and examination and the projectof Patent Documents Digitization.

In addition, the NOIP continued to well maintain good co-operation ties with other partners through the implementa-

tion of the Memorandums of Understanding (MoU) with theState Intellectual Property Office of the Peoples Republic ofChina (SIPO) and with the Korean Intellectual Property Of-

fice (KIPO) and the Vietnamese - Swiss Project on Intellec-tual Property (SVIP Project) funded by the Swiss Government(the Project was completed in late June 2010). The NOIP alsosuccessfully implemented a range of cooperation activitiesin various fields of intellectual property rights in cooperationwith ASEANs IP Offices, the European Patent Office (EPO),the United States Patent and Trademark Office (USPTO), the

Korean Intellectual Property Office (KIPO), the Japan PatentOffice (JPO), and the Department of Intellectual Property,Standardization and Metrology of Lao PDR, etc.

Cooperation ties were also established with new partners,such as the Danish Patent and Trademark Office (DKPTO) andthe German Patent and Trademark Office (GPTO).

It could be said that international cooperation activities onintellectual property in 2010 were actively implementedby NOIP and obtained remarkable achievements that sig-nificantly supported and contributed to efforts of NOIP inimprovement and completion of the IP system, as well as

affirmed of the countrys position in the process of interna-tional economic integration.

ESTABLISHMENT OF INDUSTRIAL PROPERTY RIGHTS

The receiving and handling of industrial property applications were well done to meet the demands on

establishment of industrial property rights by the public, businesses, research institutions and univer-

sities. This task in 2010 has gained following satisfactory achievements.

The receiving of industrial propertyapplications:

In 2010, NOIP received 62,982 applications of all types ofIP rights, equivalent to the number of last year. Among the

total number of applications, the IP applications accountedfor the majority with 33,616, including 3,582 for patents, 299for utility solutions, 1,730 for industrial designs, 27,923 fornational trademarks, 4,236 for international trademark (ex-cluding 2,508 for renewal of international registrations), 7 forGIs, 2 for topography of integrated circuits and 5 for inter-national patents and 72 for international trademarks whosecountry of origin is Vietnam. The rest 21,744 were requestsfor applications amendments (1,841), for assignments(475), for re-granting of protection titles (533), for renewalof protection titles (3,817), for amendment of protection

titles (4,225), for maintenance of protection titles (4,279), fortransfer of protection titles (1,510), for licensing of industrialproperty related claims (1,007), for cancellation of protectiontitles (222), for appeals (932), for searches (730), for opposi-tion of granting protection titles (747), and for other matters(1,451).

The handling of IP applications:

49,286 were the total applications of all types handled byNOIP in 2010. Accordingly, 21,797 titles were granted to dif-ferent IP subject matters, including international registration

of marks designating Vietnam. Specifically, protection titleswere granted to 822 patents, 58 utility solutions, 1,152 in-dustrial designs, 16,520 national trademarks, 3,237 interna-tional trademarks, and 8 GIs. There were 6,269 applications,including 999 for international trademarks that were refusedin the year. The formality examination of international ap-plications originating from Vietnam was undertaken to5 patent and 58 trademark applications. Moreover, NOIPalso handled 21,157 other requests, including requests foramendments (495), for assignment of applications (121), forre-granting of protection titles (562), for renewal of protec-tion titles (3,654), for amendment of protection titles (3,982),

for maintenance of protection titles (4,233), for transfer ofprotection titles (1,403), for licensing of IP rights includingamendment, renewal, and invalidation of protection titles(856), for cancellation and invalidation of protection titles

(524), for appeals (566), for searches (125), for opposition ofgranting protection titles (768), for renewal of internationalregistration (2,508), and for other matters (1,360).

In general, the IP filing trend in 2010 was still adversely af-fected by the world financial crisis. The recovery of the in-ternational and Vietnamese economies resulted in a slightincrease in numbers of applications filed with NOIP in com-parison with 2009 but it seemed not yet to be stainable. Thenumber of patent and utility solution applications increasedconsiderably by 23.5% versus its decrease by 9% in 2009.

Meanwhile, applications for trademark and industrial designregistrations decreased by 2.6% and 8.9%, respectively. Thesignificant increase in patent applications showed a desir-able transform in science and technology as well as in inno-vation activities and commercialization of research results inVietnam.

The receiving and handling of IP applications in 2010 werewell maintained that helped to promote IP activities in Viet-nam, especially the use and exploitation of IP rights to servethe socio-economic development and the integration intothe international economy. The number of protection titles

granted to patents and utility solutions rose remarkably by14.3%. In 2011, NOIP plans to implement comprehensivemeasures aimed at strengthening application-handling ca-pacity, eliminating the backlog.

AWARENESS RAISING, RESEARCH

AND TRAINING ON IP

Together with improvement and completion of the IP legislation system to meet requirements for anadequate and effective of the IP system, over the past few years, NOIP also paid a full attention to con-duct awareness raising and training activities for different target audience groups, namely IP rightsowner, staff from IP management and enforcement agencies and the public in order to help them fullyunderstand the role of IP in the socio-economic development of the country. The year 2010 was markedwith positive changes in IP awareness raising and training activities in terms of forms of activities andtarget stakeholders.

For NOIPs staff

With a view to unceasingly enhancing the capacity of IPsystem in terms of quantity and quality, in 2010, NOIP byitself and/or in cooperation with the European Patent Of-fice (EPO), the United States Patent and Trademark Office(USPTO), the Korean Intellectual Property Office (KIPO) andother partners organized trainings on different topics of IPfor 147 staff, including : a general training for 23 newly re-cruited staff, a training on patent search and classificationfor 34 staff, a training on patent examination for 29 staff, atraining on trademark examination for 61 staff and a train-ing on industrial design examination for 28 staff. Notably, atraining course on communication and teaching techniqueswas held to improve capacity and sharpen teaching skills for35 NOIPs staff.

For the public

With support of the WIPO, a Distance Learning Program onIP in Vietnamese language was launched to provide a newlearning tool for the public. So far, two training courses havebeen organized with the participation of 502 subscribersand Certificates were awarded to 169 learners.

The year 2010 has seen a big reform in IP trainings. Accord-

ingly, the NOIP paid greater attention to curve training pro-grams to make them suitable to target groups, taking practi-cal demand into consideration, and provide more practicalcases and field trip rather than pure theories. This orienta-

tion was clearly reflected in a range of short trainings for dif-ferent audiences, namely for management staff, for peoplefrom associations and producers as well as for staff and lead-ership from businesses, for researchers from institutions anduniversities, and for enforcement staff (in the framework ofProject Training on IP under the National IP Asset Devel-opment Program). Other 33 training courses (in cooperation

with provincial Departments of Science and Technology andother related agencies) on IP with the participation of 1,884people were also conducted in the new manner.

The public education and awareness raising on IP in 2010were frequently conducted focusing on current issues ofgreat attention of the public, such as development, manage-ment, exploitation and evaluation of IP assets. As the result,there were 635 people participating in 9 seminars on IPasset management in SMEs, Brand valuation in economicintegration stage, IP in R&D and socio-economic devel-opment, IPRs in Vietnams economic integration into the

global economy, IP and innovation, creation and IP Assetvaluation and technology transfer, etc

The public awareness raising on IP on mass media was alsostrengthened in terms of contents, time slot and frequency.The weekly game show Flying with brand on VTV3 contin-ued attracting a great attention from the public and has be-come one of the favorite TV programs of producers, tradersand consumers. Moreover, with financial assistance of theProgram 68, IP programs were also broadcasted regularlyand broadly over 23 provincial TV stations to disseminateknowledge on IP to the public. Annually, the World IP Day(26 April) with a various activities conducted on mass mediahas become familiar to different circles in the society. Cel-ebration meetings and IP talks were held on this occasion atmany places, such as NOIP, An Giang and Da Lat Universities,with the participation of more than 500 lecturers and stu-dents. The Seminar on IP for mass media agencies attract-ed large attention of journalists from different mass mediaagencies of Vietnam. Thus, there was an increase of quantityand quality of articles and reports on IP on mass media inthe year of 2010.

With the support of the Program 68, NOIP coordinated withDat Viet Newspaper to conduct a comprehensive dissemina-tion of IP on both electronic and paper pages of the News-paper. Being available on the first page, the IP column at-

tracted attention of many readers. Particularly, the NOIP inco-operation with Dat Viet Newspaper, the Vietnam Fund forSupporting Technological Creations (VIFOTEC), University ofEngineering and Technology Vietnam National University,

With a view to strengthening support for IP activities, theNOIP has been currently implementing a number of proj-ects, namely Project of Training on IP (under the National IPAsset Development Program), the Research on model andoperation of a Center for IP Asset Support DevelopmentCenter under the NOIP and the Study on the Enhancementof consultation on IP of NOIP. Apart from these Projects andresearches, the NOIP also focused on conducting studies on

urgent and hot issues relating to IP that helps to handle pro-fessional tasks of the NOIP better, namely Research themeson Strengthening searching capacity of WIPOs electronicdatabases in the field of industrial design, Protection ofsecond use of patents and Registration of certification andcollective marks.

exploitation of patents which attracted great attention ofaudiences and really helped strengthen awareness about IPof the public and provided guidance on the registration andexploitation of patents for businesses.

the Library, the NOIP had input of hundreds of book titles ofnational and foreign authors on intellectual property rights.

Development of databases and improve-ment of IP searching tools. As the focal point inIP, the NOIP has developed and improved, gradually, theindustrial property information system of Vietnam to serveorganizations and individuals interested in. This system

is kept updated and maintained regularly. By end of 2010,864 Vietnamese patent specifications and 3,846,058 foreignpatent specifications, including 2,868,964 Japanese patentspecifications in 2,600 CD-ROMs, were added to the system(most of them were backlog of previous years); 70 foreignindustrial property gazettes were received and exploited.During this year, 12 monthly industrial property gazettes ofNOIP were published sufficiently and timely in both paperand CD-ROM formats. In addition, NOIP continued imple-menting the Project on Digitalization of Vietnamese PatentDocuments to serve patent search activities throughout thecountry. The Project is expected to complete in March 2011.

Application of information technology. Data-bases, searching tools and administration system of industri-al property applications had been developed and improvedbased on the wide application of information technology(IT). One of NOIPs databases for searching and examiningapplications was integrated in the Industrial Property Ad-ministration System (IPAS system). Information administeredby the IPAS system was so huge. For the year of 2010 only,the IPAS undertook: (i) administration to 1,270 invention ap-plications, 123 utility solution applications, 1,414 industrialdesign applications, 23,065 trademark applications; (ii) draft-ed and sent 78,076 notifications and 18,552 protection titles.

In 2010, more than 300,000 applications were administeredby IPAS, and 259,000 applications of those were publishedin the NOIPs IP Digital Library (IP Lib) for search purpose. As

Maintenance and improvement of NOIPswebsite (www.noip.gov.vn). The NOIPs websiteis a key tool for disseminating and broadcasting NOIPs ac-tivities, as well as IP activities throughout the country. Byaccessing to the website, IP polices and legislations can beapproached easily, and therefore, it has contributed to aneffective implementation of such policies and legislations.Information available in the NOIPs website, such as Indus-

trial Property Gazette, industrial property database, etc. thatare updated regularly, has become an useful informationsource for individuals, organizations, institutions, universi-ties and enterprises for promoting creative and innovativecreativities and commercialization of IP assets for the socio-economic development.

Provision of industrial property information.The NOIP provides directly industrial prop-erty information to users throughout thecountry, upon requests. In 2010, the NOIP received

and handled 125 requests for patent searches; served nu-merous readers coming to NOIPs Reading Room for search-ing and references, provided printings of more than 3,000pages of patent specifications. The NOIP not only provideddirectly searches and information services upon request butalso participated actively in organization of on-the-job train-ings to provide agencies, organizations and individuals con-cerned with guidance on how to search and exploit indus-trial property information, e.g. providing guidance on searchand use of industrial property information to enterprisesand universities in Ha Noi, Dong Nai and An Giang, trainingcourses for officials in charge of industrial property at theDepartment of Science and Technology of Da Nang, train-

ing courses for enterprises within framework of the NationalProgram of Supporting Development of Enterprises IP As-sets (Program 68), etc. In order to improve service capacity of

data input activity was conducted quickly just in 2 or 3 daysfrom the filing date, the NOIPs IPAS was firmly under goodoperation to serve the process of application handling, thesearch system (IP-Sea) and the IP-Lib. In order to maximizethe role of IPAS, the NOIP has studied and prepared for an e-filing system that is to be launched in 2011-2012 tentatively.The NOIPs IP-Lib is available 24/7 and updated at least oncea month to serve the public.

Besides, the administration system of international trade-mark applications designating Vietnam has been initiatedand developed at NOIP, including software on administra-tion, examination and publication in order to keep the pro-cess of handling of international applications of marks time-

ly and accurately. In the coming time, in order to improve theadministration of applications, the development of databas-es, the NOIP was developing another system, namely IPAS.NET. The new system is, now, on pilot process and scheduledto be officially launched in 2011.

SUPPORTS FOR IP ASSETS DEVELOPMENT

General activities of the Program

In 2010, the NOIP improved its activities to support andadvise in various forms upon requests of enterprises,organizations and individuals, including the followings:

- Providing advices and guidance on establishment of in-

dustrial property rights to hundreds of organizations andindividuals;

- Providing guidance on patent drafting to Vietnameseinventors (at the first sentence, 14 invention applicationswere drafted and filed with NOIP); Providing guidanceand supports to scientists, businessmen in searching andexploitation of patent information to serve their studies ortheir application to manufacture and sales.

- Organizing and maintaining the operation of NOIPsStanding Office in Hoa Lac High-Tech Park to provide sup-ports and consultation to enterprises located in nearbyarea, including: providing advices and guidance on pre-

paring applications for industrial property rights or use of

Dissemination activities of IPRs and the Program 68 wereorganized regularly: the Programs website was main-tained and updated; 16 outstanding IP and life programswere broadcasted on local TV channels in 2010; Seminar onGuiding establishment of a project under the Program68was organized; a reportage on IPR was set up and broad-casted in VTV1 channel; Column on IPRs in Dat Viet onlinenewspapers which contained 20 news, 20 reports and 1 on-line talk was established.

In addition, activities on encouraging invention filing werealso focused on, including translation of guidelines for in-ternational patent registration from foreign languages into

Vietnamese; providing supports for registration of 40 inven-tions of Vietnamese inventors in foreign countries.

In 2010, the Program 68 (both implementation and administration perspectives) was implemented in promptly and timeprogress with highlights as follow:

Under the Program, some study visits were organized abroadin order to enhance administration capacity of officials atboth central and local levels, including a Delegation to theSeminar onOne Village One Brandin Seoul, Korea and aDelegation to the Training Course on Commercialization ofIPRs in Deajeon, Korea.

With significant achievements of the Program, by DecisionNo. 2204/QD-TTg dated 6 December 2010, the extension toperiod of 2011-2015 of the Program 68 was approved by thePrime Minister.

Administration activities under the Program 68

The administration activities under the Program 68 wereseriously implemented in accordance with prescribedrequirements and processes. Those activities included:Guidance for making requests; Collection and buildingup a list of projects under the Program for selection; Su-pervision and control of implementation of 21 projects

under the Program; Signing contracts and allocation offunds for 58 projects (with total amount of 20,151.685million VND); Checking and taking over 6 projects ful-filled under the Program and organizing a meeting onassessing the implementation of 2 other projects whichhave been completed.

Activities of management, propaganda, guidance and ad-vertisement of the Program were organized regularly invarious forms, therefore, they attracted interests of manylocalities. 21 provinces and cities approved their local pro-gram on supporting the development of IP assets; imple-mentation of projects activities under the Program were

broadcasted in local TV channels throughout the country;23 local TV channels broadcasted the Program onIPR andthe lifeand got some satisfactory results in the first step.

In the coming time, the followings shall be implement-ed: improvement of legal framework and managementteam for implementation of the Program, improvementof administration mechanism of the Program in period of2011-2015; improvement of activities on propaganda ofthe Program; enhancing supports for exploitation and ap-plicati on of inventions to R&D, manufa cture and trad ing;ensuring administration activities (supervision, control,checking and taking over, payment,) of the Program tobe undertaken legally and t imely.

IPR ENFORCEMENT ANDAPPEAL SETTLEMENT

In 2010, the NOIP received 927 appeals against Decisionsof the Office for various subject matters, 566 of whichwere successfully settled.

The NOIP received and handled 180 requests for invali-dation and 252 requests for terminating the validity of IPprotections titles

In its capacity, the NOIP received and provided expertiseconsultations to enforcement agencies to support themin accurately handling and settling IP rights infringe-ments. 183 requests were received, consisting of 32 re-quests from the Police, 13 from the Inspectorate of Sci-ence and Technology, 121 from the M arket Management

Office, 05 from Departments of Science and Technologyand 12 from the Customs, and among them 04 requestsrelate to inventions/utility solutions, 90 requests to in-dustrial designs and 89 to trademarks.

Cooperation in enforcement of IPRs

Handling requests for appeal,revocation and invalidation

The NOIP cooperated with relevant agencies to draft le-gal documents on handling industrial property right in-fringment within its competence as well as gave lectureson IPRs enforcement in training courses and seminars forIPRs enforcement forces.

MANAGEMENT OF LOCALINDUSTRIAL PROPERTY ACTIVITIES

Organizational structure and human resources for theStates management of industrial property

The establishment and promulgation of legal documents,policies and measures for industrial property management

In 2010, the number of enacted legal documents on in-dustrial property at provincial level were higher than thatof 2009 (43 papers/19 provinces to 17 papers/15 provinc-es in 2009). The content of those papers mainly focusedon provisions and rules on guiding the protection and de-velopment of local specialities (e.g. Binh Thuan provinceissued 9 documents guiding the management and ex-ploitation of geographical indication Phan Thiet for fishsauce, some papers of other provinces also concentratedon providing guidance for the management, exploitationof special products bearing geographical indications orcertification marks in localities such as Hai Phong withCat Hai fish sauce, Daklak with Buon Ma Thuot coffee, Tay

Ninh with Ba Den mangosteen, Thai Nguyen with Vo Tranhtea and Pho Yen tea, etc.

Organizational structure and mechanism for the Statesmanagement of industrial property in local provinces in2010 was not much different from that of 2009. Howev-er, the trend of setting up separate divisions responsiblefor intellectual property issues in provinces has becomeclearer and gradually happened in Departments of Sci-ence and Technology (DOSTs). So far, 10 DOSTs estab-lished independent divisions specialized on industrialproperty (intellectual property division) and many oth-er DOSTs made advancement by separating industrialproperty field from general management or gave newnames relating to industrial property.

In terms of quantity, number of officials specialized in-dustrial property issues in provinces has been increasingover the past 5 years. At present, the number of such of-ficials of all provinces are 84 in the total of 160 indus-trial property management officials (in 2009, this rate is70/146)

Because industrial property administration officials havebeen assigned to work in other areas in recent years, thishas caused adverse affects to the effectiveness of the

States industrial property administration activities insome provinces.

Particularly, some provinces made great efforts to es-tablish policies to directly facilitate the State manage-ment on industrial property, reflecting the resolution ofthe provincial leadership in the development of indus-trial property in general, the highlight of which was theconstruction by Da Nang City and Hoa Binh province ofthe Regulations on the interdisciplinary cooperation be-tween the Departments of Science and Technology andenforcement agencies in the protection of intellectualproperty, the Regulation on special treatment to attracttalents to participate creative activities, the Action Planon Strengthening the protection of IPRs, etc.
