Letter from the President, Stephanie D. Moore This year is flying by so fast! Can you believe there’s only six more months until the Christmas
season! There are only five more HADOA luncheons left in this speedy year and we sure hope
that you can make a few of them. Yoli Bazan has worked diligently this year to bring great top-
ics and entertaining speakers to you. Thanks so much for all of your hard work Yoli. In fact, I
would like to thank all of the 2015 HADOA Board Members for their dedication as well as all of
you for sticking with us, especially with the May luncheon cancellation and the June Manager’s
Appreciation reschedule. Mother Nature is keeping us on our toes this year for sure!
The HADOA Board would like to sincerely apologize for the last minute cancellation of the May
luncheon featuring Kacie Bevers, Attorney with Steptoe & Johnson LLC. Ms. Bevers presenta-
tion on “A Matter of Trusts” has been rescheduled for later this year.
If you missed the June Manager’s Appreciation Luncheon, you missed a great presentation from
Dr. Nguyen “Tom” Griggs and his pointers on handling those less than fabulous moments in life.
Managers were presented navy and white golf umbrellas sporting the new HADOA logo. If you
haven’t taken the time lately to thank your boss and those around you, do it now, as many of us
wouldn’t be able to do what we successfully do at work each day without them.
Looking at the rest of 2015, there is still so much to do. The HADOA Board has been contem-
plating a move from our registration database “Wild Apricot” and will be putting together a com-
mittee to look into other options. If you would be interested in assisting on this committee or
have any questions or concerns about this, please let any of our Board members know.
The Board of Directors continues to work on the goals we set at the beginning on 2015: Increas-
ing membership, continued improvements on the website and the history of HADOA but most of
these we can’t achieve without you. Cheryl Hampton has some great information about Mem-
bership in this newsletter and improvements continue with our website. The one goal we really
need your assistance with is HISTORICAL HADOA. If you have friends who have recently
retired from our great industry that have been a part of HADOA and may have assisted on the
Board or Committees, please reach out to them to see if they have copies of old newsletters, pho-
tos, even stories so that we may share them with you all!
Last but not least, if you haven’t yet registered for this year’s NADOA
Institute, be sure to do so quickly, as rooms are becoming scarce! Ame-
lia Island looks to be a beautiful place to visit and NADOA has some
really great speakers lined up for you! If funds are tight, consider room-
ing with a friend so that you don’t miss out!

Cancelled May Luncheon
Due to the flood warnings for the Greater Houston area and State of Emergency is-
sued for Harris County, the HADOA board decided to cancel the May luncheon. Due
to an unforeseen issue with our email server, the notification of cancellation email
was sent to some of our members much later than anticipated. We apologize to any of
you who were inconvenienced by the delayed communication. If you had already
paid for the May luncheon, you should see a credit you can apply when you go in to
register, but please email Chris Ramsey at chris.ramsey@bhpbilliton.com to inform
him when you apply your credit.
On Tuesday, April 28th, 2015, Steptoe & Johnson presented a ½ day seminar that covered probate
for several states. "Introduction to the Probate Process" presentations were covered as follows:
Texas- presented by Don Hueske Louisiana- presented by Giustina Persich
Kansas- presented by Sarah Trainer Oklahoma- presented by Matt Schlensker
All of the presentations respectively covered topics such as community and separate property, the
probate process, intestate succession, and testamentary trusts.
Also membership was provided with a very useful Texas conversion chart for matching the “old”
Probate Code and the “new” Estates code which had become effective January 1, 2014. The con-
version chart noted that the “new” Estate Code applies to all probates and Guardianships in admin-
istration on the effective date, and to wills of decedents dying after the effective date. The “old”
Probate Code covered construction of wills of decedents dying before the effective date, including
appeals of lower court decisions.
Overall the half day seminar was well received by the membership and several requests
were made to have introductory probate presentations covering other states. These types of re-
quests are fully encouraged since if HADOA is unable to find a local speaker to cover these topics,
they may be used as topics for future NADOA webinars. The June 30th NADOA Webinar titled
“Wyoming Probate & Title Curative” as presented by Nicol Krammer with Beatty & Wozniak
came about from a handful of HADOA members at the April seminar. Should you have any ideas

At the HADOA's June Manager's Luncheon, Dr. Nguyen “Tom” Griggs delivered his presentation on
dealing with painful uncertainty, continuing bad news about oil prices, layoffs, and overall worries
about the economy.
Dr. Griggs entertained the crowd by using humor, slapstick comedy, and facts to deliver his message on
combating fear and conquering uncertainty by advising the audience to do the following practices:
• Becoming "mentally" prepared by reading, studying trends in the industry, and by researching what is
needed to stay competitive in the oil and gas industry.
• Becoming "emotionally" prepared by sharing with others our challenges and asking others for advice.
• Becoming "spiritually" prepared by faith, meditation, books, affirmations, new tasks/challenges, and
belief.
If any HADOA member's company (companies that have members in HADOA) reach out to Dr.
Griggs and secure a contract during the month of July, he will give them the 10% discount. He will also
provide the executive leadership (of those companies) complimentary copies of Fight For Your
Dreams, The Power of Never Giving Up as presented by Les Brown, which features Dr. Griggs. The
workshops and engagements do not have to happen in July, but the agreement and contract do need to
happen during the month of July.

An interview with Noemi Peralta, this year’s NADOA Institute Committee Chairman. Noemi currently
works at Concho Operating LLC as a Division Order Supervisor.
HADOA: What are you looking forward to most at this year’s institute?
Noemi: I look forward to seeing the attendees enjoy such a beautiful venue and the great speak-
er lineup.
HADOA: Since you’ve already visited Amelia Island a few times, what are a few of your favorite
places that the attendees should check out?
Noemi: Fort Clinch is a must. It is an experience heightened by the soldiers reenacting life dur-
ing the Civil War. It has a beautiful shoreline view as you climb the Fort walls. The shops are a lot of
fun for boutique and souvenir shopping. The Fort is definitely at the top of my list.
HADOA: Given the current climate of our industry, what unexpected challenges has your com-
mittee faced when planning this year’s Institute?
Noemi: The greatest concern is being watchful of producing a quality Institute while keeping an
eye on budget. The hotel personnel has worked very well with us in working to stay under budget
while at the same time we have been able to maintain the high quality in programing an Institute filled
with excellent speakers, a calculations workshop, an evening event full of fun, and a golf outing at
what is named by Condé Nast Traveler as one of the top five golf resorts in Florida.
HADOA: I’ve heard some exciting things about the Thursday night event! What in particular do
you think will make it an event for the attendees to remember?
Noemi: We are excited about Thursday night’s event. The treasure hunt will surely be a fun
time and I am sure will bring lots of laughter. Treasures include instant prizes plus prizes finding the
most items as well as best costumes. Keep a watchful eye throughout your stay for possible treasures!
HADOA: Most importantly – education, what is one speaker/session that you personally plan on
attending and why?
Noemi: There are so many great classes it is hard to pick a favorite.
HADOA: What else would you like share about the 2015 NADOA Institute with HADOA?
Noemi: The Wednesday Reception is a great opportunity to network with old friends and make
new ones. To add to the fun, don’t miss out on the opportunity to have your picture taken with Captain
Aury and Amelia the Bird!

As I began my journey 2015 Employment Networking Director, I have witnessed the market for oil
and gas professionals decline in the first six months of the year. The market for oil and gas profes-
sions usually coincides with the price of crude oil which on January 1, 2015 was $53.45 in compari-
son to the $93.96 on January 3, 2014. As a result of the low price of oil, some oil and gas compa-
nies’ budgets were strained and employment opportunities were placed on hold. To date, I have re-
ceived a total of nine request to place employment opportunities on our website. These employment
opportunities include entry level land profession, Lease Analyst, Division Order Analyst and Senior
Division Order Analyst. Office locations of these employment opportunities are mostly in the Hou-
ston Area with some in Dallas, Austin and Tulsa. If anyone has some opportunities that need the
expertise of our members, please contact me at elisia_mccall@fmi.com.
Now that I have place a little damper on the outlook of employment opportunities, there is a silver
lining to this dark cloud. Now might be a good time to review our notes and sharpen our skills.
HADOA and other professional organizations such as HADOA have great seminars and/or classes
from the basis to new legislation that affect our business every day. The luncheons hosted by these
organization have great speakers that can provide a great source of review material for some of us
and new material for others. There is always something to learn from these luncheons and/or semi-
nars. If we are not learning, we are not growing. And we are always wanting to grow, regardless
of our age.
House & Hospitality

This year on the board I have been serving as a director and taking on the responsibilities of House and
Hospitality. House and Hospitality oversees registration and check in at all luncheons. Further duties
include questions regarding registration and cancelations, as well as creating name tags and making
sure everyone registered is entered into the door prize drawing.
Registration has been extremely low this year and I would like to thank all members and non-members
who have come to the luncheons making them a success.

man of The Board for the Boys and Girls Harbor, for extending complimentary
tickets to HADOA members for the musical drama play: This American Family,
at The Hobby Center, back in May.
It was emotionally powerful. The play showcased strong women whose individual
courage, sacrifice, and faith lead their families through tragic losses, allowed them to heal, and experi-
enced a deeper truth about life and God’s relationship to us. I saw the play and it was fantastic! It made
me laugh, made me cry, and touched on sooo many things that we can all relate to. It was THAT incredi-
ble!!!
I’d like to create more awareness of the Boys and Girls Harbor. Their mission is to provide healthy,
comprehensive care for children and families in crisis. For children who are experiencing family hard-
ship, neglect, abandonment or abuse, the Harbor provides a family environment in a home setting.
Through its programs, the Harbor strives to help children learn to overcome self-destructive patterns,
break cycles of abuse, develop social skills, learn responsibility, and work towards becoming healthy,

Fort Worth’s Hyder family won its million-dollar fight in the Texas Supreme Court against
Chesapeake Energy, with the state’s high court narrowly ruling that the Oklahoma City-
based energy giant improperly deducted post-production costs from their royalty checks.
In a 5-4 decision, the majority ruled that the agreement the Hyder family signed with the
original production company, a lease that was bought by Chesapeake, specifically barred
the company from subtracting the money from the checks.
The justices upheld a 2014 San Antonio appeals court ruling that awarded the Hyder family
at least $1 million in royalties, interest and attorney fees.
“Generally speaking, an overriding royalty on oil and gas production is free of production
costs but must bear its share of post-production costs unless the parties agree otherwise,”
Chief Justice Nathan Hecht wrote for the majority. “The only question in this case is whether
the parties’ lease expresses a different agreement. We conclude that it does.”
The case was being widely watched by the oil and gas industry and by property owners su-
ing Chesapeake for millions of dollars over how it deducts the post-production costs from its
royalty checks.
“It’s been a five-year journey for the Hyders. We are pleased with the outcome,” said David
Drez, the family’s attorney. “This is the third court to agree with us.”
Gordon Pennoyer, a spokesman for Chesapeake in Oklahoma City, declined to comment
on the court’s decision Friday.
But during its arguments before the Supreme Court, Chesapeake said that charging the Hy-
ders post-production costs was standard procedure and that not overturning the appeals
court’s decision would create a “sea change in Texas oil and gas law.”

The powerful Texas Oil and Gas Association had argued that if the decision goes
“uncorrected,” it will “generate confusion and inefficiencies for the oil and gas industry.”
Broad impact
It is unclear how broad an impact the Supreme Court’s decision will have on other cases
challenging Chesapeake’s practice of charging for post-production costs when the leases
stated they would not be subtracted from royalty checks.
Lawyers monitoring the case had said its impact will depend on whether the justices tackle
concerns about a previous Texas Supreme Court ruling — in Heritage Resources v. Na-
tionsBank — that permits post-production costs to be deducted even when contracts don't
appear to allow it.
But Hecht steered clear of Heritage, saying that it did not influence the majority’s conclu-
sion, but he pointed out that even Heritage said that “parties may modify this general rule by
agreement.”
Drez argued that this case involved a specifically negotiated, heavily tailored lease, and that
the court’s decision states “that each lease and contract will have to stand on its own.”
Still, the case “is an important guidepost for royalty owners because the general perception,
whether it be right or wrong, is that they don’t stand a chance against the operator,” Drez
said.
Straightforward deal
The Hyders were defending what they considered to be a straightforward deal for the gas
beneath about 1,000 acres in Tarrant and Johnson counties.
In 2004, they entered into a lease with Four Sevens Oil Co. The nine-page, single-spaced
document says the family would receive royalties of 25 percent of the gas’ value at the well,
free of any costs from production and processing.
Sophisticated investors, the Hyders also negotiated for 5 percent of what Four Sevens got
for any gas taken from a neighbor’s property through a well sitting on their land. Known as
an overriding royalty interest, the lease was supposed to be cost-free except for taxes.

But Four Sevens sold the lease to Chesapeake in 2006, and the family contends that prob-
lems ensued “almost immediately.” Chesapeake, applying the same process it has used
throughout the Barnett Shale, sold the gas to affiliates and paid the Hyders a “weighted av-
erage sales price” based on what it was paid by an unaffiliated third party, less post-
production costs.
In 2010, the Hyders sued Chesapeake for improperly subtracting post-production costs from
their royalty checks. In 2012, state District Judge Melody Wilkinson awarded the family
nearly $1 million.
In its arguments before the Supreme Court, Chesapeake’s attorney argued against the ap-
peals court ruling only as it applies to the overriding royalty interest payment. While the Hy-
der lease was specific about costs charged on gas taken from their property, it was less de-
fined regarding gas from somewhere besides the physical location of the wellhead on their
property.
Chesapeake’s lawyer said the Hyders had to pay their share of post-production costs. In
court documents, it said that those costs hit about $584,000 at one point and that during
that time, the Hyders were paid $17 million in total royalties and overriding royalties under
the lease.
In a dissenting opinion. Justice Jeff Brown wrote that Chesapeake’s deductions were prop-
er, saying that post-production activities added value to the Hyders’ overriding royalty. “That
Chesapeake undertook to market the gas should not saddle Chesapeake with post-
production costs or entitle the Hyders to more than the royalty for which they bargained.”
Joining Hecht in the majority were justices Paul Green, Phil Johnson, Jeff Boyd and John
Devine. The dissenting justices were Brown, Don Willett, Eva Guzman and Deborah Lehr-
mann.
