The Lease

ALeaseisahousingcontractwhichsetsthecon-ditions in which you are allowed to stay in ahouse/#lat. It is mandatory in France that thisdocumentissignedbyboththelandlordandthetenantandthatcopiesaregiventobothparties.Thisdocumentisthelegalbasisforsettlingcon-#lictsbetweenlandlordsandtenants.Beforeyousigntherentalagreementorthelease,besuretoaskyourselfsomeveryimportantquestionsandbesurethatyouunderstandallrentalconditionsmentioned in the contract.Does the rent ‘loyer’includeadditionalchargeslikeheating,electrici-tyandbuildingmaintenance?Ifparticipatingtoa homestay are sheets and towels included? apartment,‘EtatdesLieux’The Etat des Lieux’ is a crucialnon-mandatory document that isusually annexed to the lease.Groupe INSEEC strongly advisesstudents to insist on having one.

Therearetwopartstothe‘EtatdesLieux’:the‘Etatdeslieuxentrant’(whenyouenterthe#lat)andthe‘Etatdeslieuxsortant’(whenyouleavethe#lat).Thetenantisresponsiblefordraftingthe‘etatdeslieuxentrant’withthelandlordoragency.Typi-cally,thetenantandlandlordvisittheapartmenttogetherandgoovereverydetailoftheapartmentaskingandansweringaseriesofquestions,suchas:Dothedoorsshutproperly?Arethereanyholesinthewalls?Hastheapartmentbeenfreshlypainted?Doestheshowerandsinkdrainproperly?Areanytilesbrokeninthekitchen?Istheapartmentclean?Arethereanymajorscratchesonthe#loorsetc...?Togetherthetenantandlandlordanswersanddocumentallofthesetypesofquestions.Oncethevis-itiscomplete,bothpartiessignthe‘etatdeslieuxentrant.’Whenthetenantisreadytoleavethe#lat,bothparties towillusethe ‘etatdes lieuxentrant’asareferencedocumentandtogethertheywilllookfornewproblemsordamagestotheapartment.Iftherearenonewdamages,thenthe‘etatdeslieuxsortant’willbeexactlythesameasthe‘etatdeslieuxentrant’andthedepositwillbefullyre-funded to the tenant. If therearenewdamages, then theywillbedocumenton the ‘etatdes lieuxsortant’andthetenantwillnotreceiveafullrefundofthedeposit.Thetenantwillhavetopayforthedamages.Forexample, if theapartmentwasverycleananddocumentedon the ‘etatdes lieuxen-trant’,butverydirtyanddocumentonthe‘etatdeslieuxsortant’,thetenantswillhavetopayforamaidservicetocleantheapartment.Itisthereforeimportanttocreateadetailed‘etatdeslieuxen-trant’ and to keep a copy so you knowwhat you are responsible for andwhatwas already therewhenyoumovedintothe#lat.IfyoudonotspeakFrenchandthelandlordisunabletospeakEnglish,GroupeINSEECrecommendsthatyoutakeaFrench-speakingfriendalongwithyou.Itisalsorecommendedthatyoutakedigitalpicturesofthe#latbeforeyoumoveinandsendthemtothelandlordtoavoidanyargumentsinthefuture.Ifyoudiscoveraproblem(‘vicecache’)afteryoumovein(duringthe#irst20days)immedi-atelyinformthelandlordbysendingthema‘lettrerecommandee’(A/R).Lastly,itisimportanttoaskifthelandlordoragencywillconducta‘pre-etatdeslieux.’ Iftheyagree,thelandlordwillvisitthe

• Obligingthetenants(aftertheyhavegivennoticetheywill leavethe#lat)toholdapartmentvisitsonbankholidaysorweekends.

Other Amenities

It is importanttoknowwhatamenitiesareincludedinyourrentandextracharges.It isalsoim-portant to know if you can transfer a contract from theprevious tenant to yourname, or if youmustopenupanewcontract.EDF/GDFElectricityandGasareprovidedbytheEDF/GDF(ElectricitedeFrance/GasdeFrance).YoumustaskthelandlordiftheEDFcontractneedstobeputintoyournameorifitisincludedinyourcharg-es.Toavoid trouble, landlordswhorent to foreignstudentsoftenkeep theEDFcontract in theirnameandsetanaveragemonthlychargeforthetenants.IfyoumustputtheEDFcontractinyounameyouwillneedtocallEDF.Iftheapartmentwasoccu-pied inthe last threemonthsthentheservicewillbeautomaticallyput intoyournameonceyoucallthemandyouwillgetelectricityandgasalmostimmediately.Iftheapartmenthasnotbeenoc-cupiedforthepastthreemonthsyoumustcallEDFandaskforanappointmentwithatechnicianwhowillinstallallofthenecessarymaterialsforyoutogetelectricity.TheEDFCompanymayre-quireacerti#icate fromthe landlordstatingthatyou live in theapartment; it istherefore,agoodideatoaskforthisdocumentinadvance.EDFwillbillyoueveryothermonthandcheckyourconsumptiontwiceayear.EDFhasaformulawhich allows them to anticipate howmuch electricity and gas the apartmentwill consume. Caissed'AllocationsFamiliales(CAF)The‘Caissed'AllocationsFamiliales(CAF)isasocialfundwhichhelpssubsidizestudenthousingonamonthlybasis.Theamountwilldependonhowmuch rentyoupay, yourpersonal situationandtypeofapartmentyourent.TheCAFcanbesentyouthebene#iciarydirectlyoritcanbesendtothelandlord,whichmeansyouwillpaylessrenteachmonth.EUstudentshavearighttoaskfortheCAFassoonastheyarriveinFrance.ForNonEUstudent,youreligibilitytotheCAFwilldependonwhat
