WHEN you take an insurance policy
over your jewellery and some otherables against theft, loss or damage, onee policy conditions is that you shouldall 'reasonable steps' to safeguard thered property against loss or damage.rance companies however sometimeso ridiculous extent to interpret thisdition, in order to repudiate the claime policy holder.
Here is one such case where the
sumer had to seek the interventione consumer court to get the insuredunt. The chain of events leading up
he claim and the grounds on whichinsurer denied the claim, tells yout about the attitude of insurancepanies. The whole story begins withconsumer, Sachin Bhardwaj, buyingpolicies in September 2004 - a
seholders Policy and a Vyavasayi/
kari Suraksha Kavach Policy, covering
ousehold goods, including jewelleryother valuables. After due inspection,
nsurance company issued the policies
cover for jewellery and other valuablesled Rs 2,68,000
Two months hence, when Sachin, adent of Noida, was returning with hisand child, from a wedding in Aligarh,
ar stalled. Sachin then decided to putwife and child in a bus so that theyd go home without delay. Since theye carrying valuables such as jewellery,o camera and a digital camera, Sachinked these in a suitcase, put it in the car
eware of breach of policy
onsumer Rights Different Strokes
and locked it before getting into a bus thatwas passing by to reach the nearest busstop from where his wife and child couldleave for Noida.
On his return, he found that the car, which had stalled due to overheating of theengine, started without much trouble But akilometer ahead, an ambassador jammedinto his car from behind. . Even as he got
out of the car to check the damage and talkto the driver, some men got out of it, got intohis car and drove away. The ambassadortoo disappeared. Sachin then took a ride insomeone else's car and went to the policestation to lodge a complaint. Subsequently, the car was found abandoned somewhere, but the suitcase had disappeared. WhenSachin asked the insurer to indemnify hisloss, a surveyor was rst appointed to
assess the loss. After a detailed survey,
he came up with the gure of Rs.1,49,342,
but observed that the claim need not bepaid as the insured had not taken adequatecare in safeguarding the valuables. Morethan a year later, the insurance company
rejected his claim, citing breach of policycondition number 3, holding that the policyholder should not have left the suitcase inthe car while boarding the bus. "Moreover, you have failed to spell out the reasons fornot carrying the bag while leaving the car",the insurance company said.
The District Consumer DisputesRedressal Forum directed the insurancecompany to pay the complainant s 2,48,500towards his claim, along with interest at 9per cent per anum. The highest consumercourt, the National Consumer DisputesRedressal Commission, in response to therevision petition of the insurance company, pointed out that in the circumstances, the
steps taken by Sachin were reasonableenough to protect the insured property.Besides, the suitcase was not stolen whenthe insured had locked the car and goneto drop his wife and child at the bus stop.It happened much later when the insuredwas also in the car. The Commission alsodisagreed with the insurance company thatSachin should not have got off the car toexamine the damage and talk to the driverof the car that had rammed into his car, leaving the ignition key in the socket. Itis impractical to contend that the insuredshould have rst secured the windows,
locked the car and then gone ahead totalk to the driver or inspect the damage, the Commission said. (In any case, evenif he had done it, the miscreants whooutnumbered him could well have snatchedthe key from him)
It however differed with the lowerconsumer courts on the valuation of theloss and said Rs 1,79,400 along with 9 percent interest would meet the ends of justice. It also awarded costs of Rs 10,000.
So whenever you buy insurance, readthe policy conditions and the exclusionclauses carefully and ensure that you do notgive any scope to the insurance companyto repudiate your claim on grounds ofbreach of policy conditions. If however, the insurer is found to be unreasonable,as in this case, then the consumer courts
are there to protect your interest.- Pushpa G - TNS
Actions speakYou must have heard people say that
actions speak louder than words, well theysay it right! Apart from what you speak
through words, you also continuouslytalk through your physical appearance, that is your body language. Around half
of your conversation is done by yourbody. Your body language includes your
hand movements, your eye movements, your posture, your face expressions, etc.Even when youre not speaking, you may
unintentionally be depicting your thoughtsthrough your body language. So, its veryimportant that we learn how to control ourbody language and also to learn how tounderstand the body language of others.
Reading body language is almost thesame as reading minds and to know whatothers are thinking. Here are some of the
explanations of the tiny gestures we comeacross almost every day:
If youre travelling in the bus, observe
the people who are sitting if you want toknow when exactly they will get up to leave. The moment they stiffen their bodies, pick
up their bags and start looking out withconcentration, it means that the momenthas arrived when he/she will get up, leavingthe standing ones to ght for the seat.
In the bus, the standing ones who
are desperate to sit will keep their eyes onevery person sitting. As soon as they get
the slightest hint of someone getting up,they will start preparing themselves to gethold of their seat. Their level of desperationcan be easily judged through their bodylanguage. Mind it, if the desperation is toomuch, you better not come in their way.
When youll talk to somebody about
something that they love most, be it anidea, a person or a thing, youll see their
iris grow slightly in size with a pleasanttwinkle in them.
People who are extremely nervous
or who lack condence will continuously
touch and settle their hair while speaking inpublic. Girls may do this with their dupattasas well.
People who secretly admfeel nervous when youre talkiand will make less eye contpeople avoid eye contact whupset with the person theyreand sometimes also when thabout something.
Some movements of the can be generalised to a certainwell. Different postures, moveactions of various body parts convey different messages founderstand.
Here are some of these:
