MINUTES REGULAR MEETING OF THE BOARD OF DIRECTORS

Wednesday November 4, 2015 - 2 p.m. 7811 University Avenue, La Mesa, CA 91942-0427

1. President Verbeke called the meeting to order at 2 p.m. The roll call showed Directors Verbeke, Hedberg, Linden and Scalzitti present. Vice President Muse was absent due to a conference.

Staff present: Lugo, Tomasulo, Stoia, Umphres, Hayman, Bryant, Janzen, Olney, Gutkowski, Herrera, Palechek, Salois, Uhrhammer, Lawler, Lunde, Doubrava and Annett. General Counsel Elizabeth W. Hull was also present.

Others present Customers Susan Nichols, Larry Nichols and Tom Brady.

2. President Verbeke gave the invocation and led the Pledge of Allegiance.

3. General Manager Carlos V. Lugo reported there were no additions or deletions to the agenda. The agenda was approved 4:0.

4. President Verbeke provided opportunity for members of the public to address the board on any item under the subject matter jurisdiction of the district. President of the Grossmont-Mt. Helix Improvement Association Susan Nichols stated that during the October 21, 2015, regular board meeting she requested an action item be placed on the next board agenda. She expressed disappointment that the requested item was not placed on the November 4, 2015, agenda and stated there had been little communication regarding the procedure to add an agenda item. She also expressed dissatisfaction with district staff for not forwarding an email addressed to the board secretary and overall lack of communication regarding her concern. General Manager Carlos V. Lugo and Board Secretary Sandra L. Janzen addressed Ms. Nichols' comments. President Verbeke stated that a discussion item regarding board decorum would be placed on the next agenda. Director Scalzitti and Director Hedberg requested email communication also be placed on the agenda. General Manager Lugo stated an agenda item regarding email would not be necessary as staff has been working to provide email options that will be communicated shortly and could be activated in approximately two weeks.

Director Scalzitti inquired if district staff had responded to Mr. Tejeda via email communication. General Manager Carlos V. Lugo stated there had been email communication. Director of Operations Tristan D. Hayman stated he communicated verbally with Mr. Tejeda

6. The board appropriated funds in the amount of $40,000 from schedule 84, item 2, of the fiscal year 2015-16 capital budget for the information systems firewall software replacement, Work Order 4660 The motion passed 4:0.

Director Hedberg and Director Scalzitti clarified that funding of Work Order 4660 was not part of the Cayenta software upgrade. Enterprise Architecture Manager Michael A. Herrera stated the firewall software would be needed with or without the Cayenta software upgrade and will work with the new software.

7. The board cast its ballot for the following seven candidates for the San Diego East County Chamber of Commerce Board of Directors 2016 Election: Brett Almquist; Ramona Bommer; Nancy Dennison; Odie Goward; Don Parent; Bryan Shull and Michael Stowers. The motion passed 4:0.

Director Hedberg requested clarification regarding sections: 1.2; 2.12-2(B)(2); 2.12; 2.14-4(E); 2.16-4 (C)(4); 3.1-4(B); 3.1-7(A)(1); 4.10-9(A)(14)&(15); 5.3-5; 8.1-5(1); 8.1-56(0)(7) & (8); 8.1-8 (E); 8.1-8(K); 8.1-13(C)(24); 9.1-14(B) Director Scalzitti requested clarification regarding section 3.17(0) and mentioned there had been no new changes to the drought response policy and procedure. General Manager Carlos V. Lugo, Director of Administrative Services Lisa S. Stoia, Director of Engineering James A. Tomasulo and District Counsel Elizabeth W. Hull addressed all questions.

Discussion ensued regarding section 9.1-14(B). The board of directors agreed webinars will be paid at the regular per diem amount, count toward the total number of monthly meetings and fall under the regular reporting requirements. Designated alternates will be paid a per diem for attending meetings. The California Special Districts Association chapter and committee meetings will be specifically included in section 9.1-14(B)(1).

DISCUSSION:

A. President Verbeke reported that Executive Director of the Water Conservation Garden resigned to accept a position with the Friends of Balboa Park. The board of directors each commented on the great work Mr. Bolthouse has accomplished at the Garden. President Verbeke also reported that Executive Director of the Association of California Water Agencies Timothy Quinn will conduct a meeting for the ACWA Region 10 Board of Directors and general managers at 10 a.m. on November 18 in the Helix Water District boardroom.

B. President Verbeke, Vice President Muse and Director Linden provided written reports. Director Hedberg reported she enjoyed the 2015 East County Excursion on October 29, 2015.

C. General Manager Carlos V. Lugo recognized Director of Administrative Services Lisa L. Stoia. Ms. Stoia provided an update regarding the Cayenta software upgrade. The board was told to expect a detailed email on November 9, 2015, regarding the steps to go live, billing inserts, and the reduced fees for credit card payments and money grams. Ms. Stoia stated on November 16 customer service will focus on the implementation of the new system and will be closed to the public. A customer service representative will greet customers in the lobby, accept drop-off payments and provide customers with a cookie in appreciation for them coming by. General Manager Lugo provided the board of directors with a copy of the application submitted to the Special Districts Leadership Foundation for the District Transparency Certificate of Excellence.

D. General Counsel Elizabeth W. Hull had nothing additional to report.

E. Board Secretary Sandra L. Janzen highlighted the action items to be covered at the November 18, 2015, regular board meeting, stated that the December 9, 2015, meeting will be held at 4 p.m. and rs the only December board meeting due to conference schedules. Ms. Janzen stated the Committee of the Board meeting at 3 p.m. on January 27, 2015, will cover the strategic work plan, district goals and objectives and mid-year adjustments.

President Verbeke adjourned the meeting to closed session at 3:32 p.m.

ACWA Special Webinar Briefing: Proposition 218 Issues

ACW A has been working with a coalition of local government organizations to address issues related to Proposition 218. The coalition began exploring options earlier this year to provide additional flexibility for local water agencies to finance stormwater capture and flood control infrastructure and pursue voluntary conservation based water rates and lifeline rates.

At a special meeting on Oct. 13, the ACWA Board of Directors authorized staff to continue working with the coalition to examine the options. It also called for creation of a Board-level advisory committee to provide guidance to staff.

Recommendation:

The board adopt Resolution 15-71 authorizing the quitclaim of four aligned easements in the city of El Cajon, county of San Diego, state of California, assessor parcel numbers 400-140-06, 07, 31, 44 and 46; 400-141-15 and 16; and 400-160-01, 02, 09, 10 and 11.

Background:

The aligned easements are located over portions of lots 24, 34 and 35 of Peerless Orange Lands Subdivision, according to map 1247, filed in the office of the county recorder April 2, 1910, and over portions of lots 1, 2, 9, 10 and 11 of Lone Palm Terrace Subdivision, according to map 3856, filed in the office of the county recorder April 2, 1958, each located in the city of El Cajon, county of San Diego, state of California. Three of the easement documents were recorded February 9, 1955, in book 5526, pages 108, 119 and 129, as document numbers 19240, 19242 and 19244, and the fourth easement document was recorded January 26, 1956, in book 5954, page 364, as document number 11670.

District pipelines and appurtenant underground structures originally installed within the subject easements in 1955 were relocated in the spring of 2015 as part of the district's cast-iron pipeline replacement program, Work Order 2579. There are no current or future

plans for pipelines to be replaced within the old easement alignment. Therefore, the easements are no longer needed and they can be quitclaimed. If authorized by this action, the easements will be quitclaimed to the following property owners:

OF HELIX WATER DISTRICT DECLARING CONSTRUCTION COMPLETE AND AUTHORIZE FILING A NOTICE OF COMPLETION FOR

THE LOWELL PLACE PROJECT WORK ORDER 3940

WHEREAS, Helix Water District has heretofore entered into a contract with LOWELL PLACE, LLC, for a private development of the Lowell Place project. The project consisted of the installation of 185 feet of 8-inch PVC pipe, one residential fire hydrant and seven 1-inch water services, Work Order 3940 within the boundaries of the district in the city of La Mesa, state of California; and

WHEREAS, such work for the project has been completed successfully by the contractor (W E G Engineering) and it is in the interest of the district to accept such work and to file a notice of completion.

NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the board of directors of Helix Water District as follows:

1. That said work be hereby accepted by the district, provided that such acceptance not be construed as constituting any waiver of any rights of the district, and provided further that such acceptance shall not in any way affect the warranties and guaranties given by the contractor and/or owners of the property as to the quality of the work performed and as to the proper functioning of said facilities.

2. That the president and secretary be and they hereby are authorized and directed to execute a notice of completion in the office of the county recorder of the county of San Diego.

The board authorize the general manager to obtain three quotes, award and execute a contract with a general contractor to repair the failed 36-inch concrete cylinder pipeline located near the Slaughterhouse Canyon connection number 2, Work Order 4691.

Background:

The district's 36-inch raw water concrete cylinder pipeline near the Slaughterhouse Canyon connection number 2 was installed in 1958. This 36-inch pipeline is a raw water supply line from the San Diego County Water Authority to the flow control facility numbers 6, 7 and 8 located on El Monte Road. The pipeline experienced a failure on Monday, November 9, 2015, while San Diego County Water Authority was re-energizing the pipeline after an inspection of their facilities. The pipeline was depressurized immediately for district inspection to evaluate the condition and determine the extent of repairs necessary. Although this pipeline is historically used as main raw water supply, the district can temporarily draw raw water through the redundant Moreno Lakeside pipelines 6 and 7 from the Helix number 1 connection. Repair of this pipeline is urgent to restore system redundancy.

Recommendation:

The board authorize the general manager to execute the amendments to the agreement for professional services between Helix Water District and Raftelis Financial Consultants Inc. for the district's cost of service study.

Background:

On June 18, 2014, the district issued a request for proposal from qualified firms to conduct a comprehensive water cost of service rate study. The intent of the study was to independently assess and perform a complete review of the district's existing water rates and charges and provide recommendations. The broad objective of the study was to ensure that the district's rate structure adequately covers revenue requirements in compliance with industry best practices, legal parameters, debt service rate covenants and district policies. The district's water rates and charges include fixed charges, variable charges and fees.

Other fees and charges were also included as part of the scope of work for this study, including annexation, miscellaneous customer and engineering service fees The board authorized the general manager to execute an agreement for professional services between Helix Water District and Raftelis Financial Consultants Inc. in the amount of $99,773 which included $87,634 for the cost of service study and miscellaneous fees review and $12,130 for an optional water budget analysis. The

district did not request Raftelis Financial Consultants Inc. to perform this additional water budget analysis.

On March 6, 2015, Raftelis requested a first amendment for $22,320 for Raftelis attendance at board workshops and public meetings, as well as additional work required to complete the miscellaneous fee review and cost of service study.

Raftelis completed their work, including their cost of service study and issued their final report on October 7, 2015. Subsequent to the first amendment but prior to the completion of this work, Raftelis informed the district that they had incurred additional time, citing the following factors: "Governor Brown issued an executive order for Mandatory Conservation Statewide (Executive Order B-29-15). This executive order caused multiple iterations to the model as part of finalizing rates. As such, this was an unforeseeable event that generated additional analysis and time that was not included within our scope of services and budget. It also caused the estimated completion date of the study to be pushed back four months from what was envisioned as part of our first amendment. Therefore, additional effort was expended over the extended project timeline that concluded with the Public Hearing on October 7, 2015."

Additionally, Raftelis mentions the incorporation of the five year projection model, the San Diego County Water Authority's new reliability supply charge into the model and the revenue offsets that the district put into place to mitigate rate increases. Raftelis notes that "these tasks could not have been anticipated by either RFC or the District. .. "

The second and final contract amendment is for $14,332 and would complete payment for professional services performed by Raftelis for its review of the district's miscellaneous fees and charges and for the district's cost of service study and related meetings and activities. Total payments under this contract and amendments are $124,286.

The contract with Raftehs has concluded, however, there will be periodic updates to the five year projection model that may require assistance from Raftelis in the future. That additional work will be negotiated at the time the consulting services are needed.

RAFTELIS FINANCIAL CONSULT ANTS, INC.

THIS FIRST AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN HELIX WATER DISTRICT AND RAFTELIS FINANCIAL CONSULTANTS, INC., (hereinafter referred to as "First Amendment") is made and entered into this 5th day of March, 2015, by and between the HELIX WATER DISTRICT, an Irrigation District organized and existing under the Irrigation District Law, California Water Code Section 20500, et seq. (hereinafter referred to as "District"), and RAFTELIS FINANCIAL CONSULTANTS, INC., a financial consulting firm {hereinafter referred to as "Consultant").

RECITALS

WHEREAS, on or about August 20, 2014, District and Consultant entered into that certain Agreement for professional services (hereinafter referred to as "Agreement"); and

WHEREAS, the Agreement Section 11 provides that it may not be modified or altered except in writing signed by both parties; and

WHEREAS, District and Consultant now desire to amend the Agreement to amend the Scope of Work.

NOW, THEREFORE, in consideration of the Recitals and mutual obligations of the parties as herein expressed, District and Consultant agree as follows:

1 Services/Compensation.: The description of services is hereby amended as follows· additional Consultant onsite and remote meetings, project work and future as-needed meetings as outlined in the attached letter from Consultant (Attachment A). The compensation is hereby amended as follows: additional $12,000 for amended scope of work. In addition, establish as-needed meetings at a cost of $1,290 per additional meeting, based upon mutual agreement of District and Consultant. 2. Term of Agreement: Due to the timing of the next anticipated rate increase, extend the Schedule of Performance as outhned in Exhibit C of the agreement until November 2015 to allow Consultant and District to effectively work through the public noticing and hearing process for the proposed rates to be effective January 1, 2016.

3. Provisions of the Agreement. Except as specifically provided in this First Amendment, all other terms and conditions of the Agreement shall remain in full force and effect.

Dear Ms. Bryant:

In connection with the Water Rate Study Agreement between Raftelis Financial Consultants, Inc. (RFC} and the Helix Water District (District) (the "Agreement"), please accept this letter as a formal request to amend the Agreement, pursuant to Section 3 of the Agreement, which requires a written request for an amendment. As part of the study, we spent substantially more time on the User Fees then what was originally budgeted as a result of an extra in-person meeting and webinars with certain District departments. Based on our actual level of work, we incurred a total cost of $22,040 versus $10,040 ($12,000 difference), which was definitely necessary given that the District's User Fees were reviewed - in detail - and restructured to ensure that the effort incurred tied to the charges imposed. Even though we were currently within budget for the entire project at that time, I was concerned that the level effort expended on Task 5 would affect the total budget for the remaining tasks within our scope. I discussed my concerns with the District as part of my November invoicing. In addition, to date, we have conducted all of the budgeted in-person meetings identified within our scope.

At this point in time, we still need to finalize the Cost of Service as well as draft the Rate Study Report and update rates as part of the District's Fiscal Year 2015-16 budget. The Agreement identified an original completion date of December 2014. Incorporating updates based on Fiscal Year 2015-16 budget numbers was not expected; however, through the course of this engagement, RFC's primary goal is to provide value to the District and exceed the District's overall expectations. As such, we do not mind making additional modifications or updates. As Project Manager, I have kept the District informed of our progress and overall effort. Given our effort to date, and remaining tasks, I have also attached a schedule of required effort- by remaining tasks - to complete this project as Exhibit "A." In summary, our request is for an additional $12,000, which corresponds to the additional effort expended on the User Fees. We also included a fee per meeting to provide the District flexibility with our attendance at as many meetings as the District desires moving forward.

THIS SECOND AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN HELIX WATER DISTRICT AND RAFTELIS FINANCIAL CONSULTANTS, INC., (hereinafter referred to as "Second Amendment") Is made and entered into this 9th day of November, 2015, by and between the HELIX WATER DISTRICT, an Irrigation District organized and existing under the Irrigation District Law, California Water Code Section 20500, et seq. (hereinafter referred to as "Distriot"), and RAFTELIS FINANCIAL CONSULTANTS, INC., a financial consulting firm (hereinafter referred to as "Consultant").

RECITALS

WHEREAS, on or about August 20, 2014, District and Consultant entered into that certain Agreement for professional services (hereinafter referred to as "Agreement"); and

WHEREAS, on or about March 6, 2015, District and Consultant entered into that certain First Amendment to the Agreement for professional services (hereinafter referred to as "First Amendment''); and

WHEREAS, the Agreement Section 11 provides that it may not be modified or altered except in writing signed by both parties; and

WHEREAS, District and Consultant now desire to amend the Agreement to amend the Scope of Work.

NOW, THEREFORE, in consideration of the Recitals and mutual obligations of the parties as herein expressed, District and Contractor agree as follows:

1. Services/Compensation. The description of services Is hereby amended as follows: additional Consultant project work performed through October 7, 2015 as outlined in the attached letter from Consultant (Attachment A). This additional work included the incorporation of the Five Year Projection format Into the rate model, revisions to the cost of service study and rates resulting from adjustments to water demand assumptions as a result of the Governor's Executive Order mandating water use reductions for the State and the District, modeling of new reliability supply charge from San Diego County Water Authority and additional iterations for building scenarios with the inclusion of revenue offsefs for the five year period. The compensation Is hereby amended as follows: additional $14,332 for amended scope of work.

2. Provisions of the Agreement. Except as speclflcallyprovided in this Second Amendment, all other terms and conditions of the Agreement, as prevlously amended by the First Amendment, shall remain In full force and effect.

In connection with the Water Rate Study Agreement between Raftelis Financial Consultants, Inc. (RFC) and the Helix Water District (District) (the "Agreement"), please accept this letter as a formal request to amend the Agreement, pursuant to Section 3 of the Agreement, which requires a written request for each amendment.

A month after our first requested amendment, which covered extra meetings and effort expended on updating the District's User Fees, Governor Brown issued an executive order for Mandatory Conservation State-wide (Executive Order B-29-15). This executive order caused multiple iterations to the model as part of finalizing rates. As such, this was an unforeseeable event that generated additional analysis and time that was not included within our scope of services and budget. It also caused the estimated completion date of the study to be pushed back four months from what was envisioned as part of our first amendment. Therefore, additional effort was expended over the extended project timeline that concluded with the Public Hearing on October 7, 2015. To date, we have been very consciousness of our billed time to the project and our request for this amendment is $14,332. This effort was associated with the following additional tasks that were not originally scoped within our agreement or our first amendment.

• Incorporation of new budget file "Five Year Projection" in April

• This required additional effort and multiple iterations to connect this new internal worksheet into the model that could have been mitigated if included from initiation.

• Revisions to cost of service and rates resulting from adjustments to water demand assumptions as a result of the Executive Order.

• Modeling of new reliability supply charge from SDCWA.

o Additional iterations for building scenarios with the inclusion of revenue offsets for the five year period.

Please note, these tasks could not have been anticipated by either RFC or the District and the tasks listed above are primary drivers to the request; however, the extension of the timeline through October 2015 also generated additional time and effort associated with updates and conference calls. Through this engagement, our goal was always to be responsive to the District's needs and not hold up deliverables due to additional tasks. The board receive an update on the district's drought action plan for October 2015.

Background:

As part of Governor Jerry Brown's emergency executive orders issued this year in response to ongoing drought conditions, Helix Water District has been mandated to reduce water use by 20 percent from June 2015 through February 2016 when compared to the same months in 2013.

On May 20, 2015, the district's board of directors adopted an emergency drought action plan and resolution to meet the state mandated water use reductions. The plan includes increased public outreach and increased water restrictions.

Monthly Production:

Total potable water use in October 2015 was 2,356 acre-feet compared to 3,031 acre­ feet in October 2013, a decrease of 22 percent for the month of October. With October's data, the cumulative water use reduction for the district is 27 percent for the period between June and October 2015. The district's rolling 12-month total gallons

per capita per day continues to decline and reached 92.8 as of October 2015, the lowest ever recorded for the district.

Summary:

Ms. Ziernicki was recognized for coming to Ms. Moskovics' home and providing exemplary customer service.

October 30 ECEDC Bus Tour with LEAD San Diego The day's tour started at the Student Center at Cuyamaca College and arrived at the RM Levy Treatment Plant at 11:45 for lunch, a presentation by Sandy Kerl, Deputy General Manager, SDCWA, and Mark Umphres, Director, Water Quality and System Operations, Helix Water District, and a short tour conducted by Larry Lyford, Water Treatment Plant Manager, and Michelle Berens, Plant Operations Supervisor. The class was well informed and engaged in water issues in San Diego County.

November 6 East County Chamber of Commerce Breakfast (E) Held at Sycuan Casino with speakers on upcoming events fund and enhance businesses and organization in East County. In the networking card exchange, I had the opportunity to meet Chris Larkin, Family Health Centers of San Diego; Gerry Minor, FBS Property Management; Humbert Cabrera, Cabrera & Associates; and two potential new members from BitLogic. I was also able to explain our new water rates as approved by the board to several chamber members.

November 7 Water Conservation Garden Plantstravaganza Open to member from 9-10 a.m. and the general public from 10-2. The event was well attended and displayed plants and other garden items from many vendors. The JPA water agencies each had an exhibit with giveaways and information. I spoke with Chris Timmer, Water Conservation Representative from Helix who was doing a great Job assisting customers. Also, attended a gardening workshop at 11:00 presented by Nan Sterman. November 8 Toast to East County- East County Chamber of Commerce Did anyone attend this event? It was the first annual and fantastic. Held in the pavilion at Cottonwood on a beautiful sunny afternoon, there was wine from many East County vineyards and yummy food samples. It was relaxed and comfortable with opportunity to meet and greet east county residents in a beautiful setting.

November 10 ACWA Special Webinar Briefing on Prop 218 Issues (P) As stated in the attachments to this report, ACWA is working with a coalition of local government organizations and others to address issues related to Prop 218 originally passed by voters in 1996. ACWA & coalition have put forth a strategy to accomplish three goals:

1. Enhance the ability of local agencies to finance storm water and flood control infrastructure. 2. Provide more flexibility for the voluntary establishment of conservation-based rate structures. 3. Allow public agencies, at their discretion to implement lifeline water rates for low-income households.

The purpose of the webinar was to inform ACWA membership of their proposal to amend Article X of the California constitution to provide a separate and voluntary financing track for public water agencies that treats storm water and flood control infrastructure the same as water and sewer infrastructure and expressly authorizes conservation based on tiered water rates and lifeline rates. An advisory committee has been formed and chaired by Larry McKenney, Region 10 Chair. The political process is that the proposal can be passed by initiative or enacted by constitution amendment passed by 2/3 vote of both houses and approval by voters {Nov. 2016). ACWA External Affairs is developing materials and media strategy timed with submission of the initiative to the Attorney General. ACWA will ask members to reach out to their legislators and there will be informative webinars in November and information at the ACWA region meetings at conference in December. {See attachments)

Proposition 218 Issues and Challenges

ACWA has been working with a coalition of local government organizations and others to address issues related to Proposition 218.

The coalition began exploring options earlier this year to provide additional flexibility for local water agencies to finance stormwater capture and flood control infrastructure and pursue conservation-based water rates and lifeline rates. Specifically, the coalition is discussing the concept of creating an alternate financing path in Article X of the California Constitution to enhance the ability of local agencies to finance stormwater capture and flood control infrastructure, provide more flexibility for the voluntary establishment of conservation-based water rates and to allow agencies, at their discretion, to implement lifeline rates for low-income households.

At a special meeting on Oct. 13, the ACWA Board of Directors authorized staff to continue working with the coalition to examine the options. It also called for creation of a Board-level advisory committee to provide guidance to staff.

Along with the League of California Cities and the California State Association of Counties, ACWA anticipates being a co-sponsor of a potential statewide ballot measure and/ or legislation to create an alternative financing mechanism that provides local agencies with the tools to adequately fund stormwater capture and treatment and more flexibility to pursue conservation­ based rates and lifeline rates.

Background on Proposition 218

Proposition 218, officially titled the "Right to Vote on Taxes Act," was approved by California voters in 1996. It amended the California Constitution to establish additional procedural requirements and limitations on adopting new and/ or increased taxes, assessments and property-related fees and charges.

The measure requires a strong nexus between property-related fees, such as water and sewer rates, and the cost of providing those services. This strict-proportionality requirement means that water rates for any class of water users must be proportionate to the costs of providing that service.

An appellate court decision earlier this year in Capistrano Taxpayers Assn v. City of San Juan Capistrano brought attention to the need for local agencies to have more flexibility in implementing tiered rate structures to encourage water conservation.

Unintended Consequences

ACWA agrees that water agencies should be accountable for the revenues they raise through rate setting and that those revenues should be commensurate with the costs of providing service. However, the strict-proportionality requirement and other provisions of Proposition 218 have had some unintended and undesirable consequences for many ACWA member agencies.

One concern raised by member agencies is the need to finance stormwater and flood control infrastructure. Environmental regulations under the Clean Water Act are making it increasingly necessary to capture and manage stormwater, but Proposition 218 treats some stormwater infrastructure differently than other water and sewer infrastructure. The strict-proportionality requirements also make it challenging for local water management agencies to establish conservation-based tiered rate structures to encourage conservation or to implement lifeline water rates to make water service more affordable for low-income households.

To address these concerns, ACWAjoined a coalition with the League of California Cities, the California State Association of Counties, and the California Water Foundation to identify and implement a strategy to accomplish three goals:

1) Enhance the ability of local agencies to finance stormwater and flood control infrastructure

2} Provide more flexibility for the voluntary establishment of conservation-based rate structures

3) Allow public agencies, at their discretion, to implement lifeline water rates for low­ income households.

Gathering Member Input

ACWA members have expressed a range of views regarding existing law and whether it poses a problem. Some member agencies have adopted uniform rate structures consistent with existing law and utilize strategies other than conservation-based rates to meet conservation goals. Some member agencies have adopted conservation-based rates under the existing law. Others have expressed concern that more flexibility is needed in the ratemaking requirements for conservation-based rates.

Some agencies have identified a need for new authorities to finance stormwater management and flood control infrastructure. In addition, some agencies have identified a need for authority and discretion to establish lifeline rates, which currently are prohibited under existing law.

ACWA will continue to solicit member feedback and explore options to provide flexibility for agencies to finance stormwater and flood control infrastructure and voluntarily implement conservation-based rates and lifeline rates if they choose to do so.

A: ACWA agrees that water agencies should be accountable for the revenues they raise through rate setting and that those revenues should be commensurate with the costs of providing service. The proposed amendments to Article X carefully preserve accountability of public agency ratemaklng: rate revenues still must reflect the costs of service. However, the proposal allows public agencies the flexibility to implement additional water management tools such as conservation-based tiered pricing and lifeline rates, if they choose to do so.

A: No. The proposed amendments would leave existing law intact. ACWA strongly believes that local agencies should have the right to determine what rate structure works best for their water users. This proposal would do nothing to change that. Agencies that wish to use uniform rates or other structures that work for them could continue to do so. The point of the proposal is to provide an alternative path for agencies that would like to implement conservation-based tiered rates.

Q: What is the justification for changing the way stormwater and flood control infrastructure is financed? Does the proposal take away voter input?

A: Under current law, fees or charges for stormwater and flood control infrastructure are

treated differently than water and sewer infrastructure. The proposed amendments to Article X make stormwater and flood control infrastructure fees and charges subject to the same protest threshold that applies to sewer and water fees and charges.

Q: Why are lifeline rates part of this proposal? A: Lifeline rates to assist low-income customers are clearly prohibited under Proposition 218.

Some ACWA member agencies are interested in pursuing lifeline rates to assist their customers. The proposal would provide flexibility for agencies to voluntarily implement

lifeline rates if they choose to do so. There would be no requirement for agencies to implement lifeline rates if they do not wish to.

Q: Why doesn't the proposal seek to amend Article xm to fix the problems in Proposition 218 directly?

A: The coalition that includes ACWA, the league of California Cities and the California State Association of Counties considered modifying the constitutional provisions in Proposition 218 directly, but ultimately rejected this approach. The proposal to create an alternate finance track in Article X preserves the ability for public agencies to continue establishing rates under existing law. We have structured this proposal to maximize the discretion of ACWA members to set rates that work for their constituencies.

Q: What action has the ACWA Board of Directors taken relative to this proposal? A: The ACWA Board of Directors acted in a special meeting in October to authorize staff to

sponsor an initiative measure or legislation for a constitutional amendment consistent with specified policy direction. The Board also authorized creation of a Board-level advisory committee to provide guidance to staff.

Q: What happens next? A: The coalition is working toward the goal of finalizing a proposal that can be filed with the

Attorney General's Office in the coming weeks as a potential ballot initiative. The coalition also intends to pursue a legislative strategy next year as well to preserve all options. ACWA anticipates being a co-sponsor of the potential statewide ballot measure and I or legislation along with the league of California Cities and California State Association of Counties.

ACWA will continue to gather input from members through the regions and webinars. ACWA's State Legislative Committee will review and consider any legislative proposals that emerge in early 2016.
