EXECUTIVE SUMMARY
1. After three decades of conflict, Afghanistan’s power sector is slowly recovering, but more than 70 percent of the population does not have access to the grid. Even those connected to the grid suffer from frequent power blackouts of up to 9–15 hours a day in some areas, which impacts residential and commercial users and severely limit development across all sectors of the economy. The Afghan government wants to move away from its heavy reliance on imported power, which accounts for 78 percent of their supply, and develop its own natural gas resources in the country.
2. In order to meet the development challenge above, Da Afghanistan Breshna Sherkat (DABS) executed North-South Power Transmission Enhancement Project aiming at building of 500 kilovolt (kV) transmission line straddling 238 kilometers across the Hindukush mountain range from the northern town of Dashte Alwan to Kabul in the south. It will include a substation connecting to the grid in the capital, Kabul. It will also complement a separate 500-kV substation to be built in the north by ADB under its Energy Sector Development Program.
3. The most significant expected project-level impacts are to (i) increase the supply of domestic power generation capacity, resulting in a decrease in load-shedding and an improvement in quality of the life of the people well as industrial and commercial customers, (ii) enhance energy security by reducing reliance on other countries for electricity imports (iii) increase private sector participation in the energy sector, encouraging other potential investors to enter this untapped market. The project is further expected to optimize the use of the existing gas supply and electricity distribution infrastructure
4. This project is divided into three sections (Kabul, Parwan and Baghlan), the LARP of section three (Baghlan) was already approved by the ADB.
The main objective of this report (section three Baghlan) is to elaborate theimplementation
compliance with the approved LARP for this section under North-South Power Transmission
Enhancement Project (NSPTEP).
5. The results of affected households Satisfaction Survey aiming to determine the extent of their satisfaction on the payment of compensation and LARP implementation process are also provided. The following conclusions are derived from the LARP implementation compliance study.
1) Land acquisition and resettlement within the scope of LARP implementation process was undertaken in compliance of the ADB Safeguard Policy Statement (2009), ADB approved LARP and in accordance of the Afghanistan Land Law.
2) The DABS has established institutional arrangements for the preparation, finalization and implementation of LAR activities. However, these are weak with respect to social and resettlement considerations as the DABS has not recruited any Resettlement Specialist and other social staff in the PMO to deal with the LAR related activities. The DABS-PMO is carrying out the LAR activities (preparation and implementation of LARPs) with active assistance and support from the CSC and individual consultants.
3) The GRC played an instrumental role in the implementation of LARP; by mobilizing and assisting all the affected households in getting completed their compensation forms validated from the local land offices.
4) As a result of verification of affected households from the land office records, the actual numbers of affected households were 118, as assessed in the LARP.
5) An amount of 37,102,644 AFN payable to the 118 affected households for their permanent losses was approved through the LARP.

6) Out of the total 118 eligible AHs 97 AHs have been paid an amount of 36,391,177 AFN as compensation for their permanent land, crops, trees losses and allowances. The rest 21 AHs have not been located yet and are absent. Compensation amounts for these absent AHs have been deposited in an escrow account so that once they are located, their documents processed, they can be paid immediately from this account. Efforts in locating these absentee AHs have been made by provincial and central government offices including MUDL and district and provincial governor’s offices and community level sources through announcements in the mosques, radios, Community Development Councils (CDCs) and other available sources to locate these AHs. These absentee AHs’s compensation would be processed once they are located and submit their land ownership documents to DABS for payment through the collective escrow account already established in Baghlan province. For further details on the specs of the escrow account, please refer to annexes 1 and 2.
7) In a quest to ensure transparency in compliance of SPS 2009 and approved LARP provisions, the DABS directly transferred the compensation amounts to the Bank Accounts of the AHs, after receiving confirmation of the status of ownership in favour of the claimant from the offices of relevant District Land Department.
8) The 97 paid affected households showed their satisfaction over the compensation and the payment process during the post-payment surveys conducted by the project supervision consultant. The project temporary losses i.e. for the temporary access roads and RoW, have been fully compensated by the contractor as per provisions of the Project Contract and the approved LARP.

1 Project Background
6. To support the potential of industrial growth in all three Provinces, better connectivity of townships and villages, towns with adjoining areas is very much required. The economy of these three Provinces is mainly based on agricultural and trading activities. The industrial and agricultural developments have led to higher demand for electricity. With the higher demand of electricity, and the expansion of the existing development activities, there is a growing mismatch between the rapid population growth and availability of electricity related infrastructure, which has resulted in reversing the development of the area. As a result of the aforementioned growth and need to fulfil the mismatch, various new infrastructure development activities including power transmission enhancement Projects have been planned across the country. The Government of Afghanistan through the DABS and other Government Agencies has taken the needful actions to meet the challenges.
2 Description of 500 kV North South Power Enhancement Project
7. This Power Transmission line Project in Afghanistan has been classified as a Category
B Project in accordance with ADB Safeguards Policy Statement 2009. Baghlan is one of 34
provinces of Afghanistan and is located in the north of the country, surrounded by Bamian,
Parwan, Takhar, Kunduz, and Samangan Provinces. Baghlan is divided into 15 districts and
covers an area of 21,112 km2. Nearly half of the province is mountainous or semi-mountainous
terrain and one-third is flat land. The population is approximately 741,690 and 80% live in rural
districts and 20% in urban areas.
8. The population of Baghlan province was reported at 863,700 in the year 2013. Tajiks
make up 50% of the population, followed by 20% Pashtuns, 5% Turkmens, 20% Hazaras, 5%
Uzbeks, and others. Most of the populations speak Persian, followed by Pashto-speaking
Pashtuns, Uzbeks and some Tatars. Baghlan is also home to a small community of Ismaili
Muslims led by the Sayeds of Kayan.
9. Baghlan Province has a population of Kuchis (or nomads) whose numbers vary in
different seasons. In winter 97,500 individuals, or 4% of the overall Kuchi population, stay in
Baghlan in six communities. Half of these are short-range partially migratory, and the other half
are long-range partially migratory. In summer, approximately 820 long-range migratory Kuchi
households come from Parwan and Kapisa Provinces to the Khenjan and Doshi districts of
Baghlan..

3 Objectives of the LARP Implementation Compliance Report
11. The LARP Implementation Compliance Report aims at to report the successful
implementation of the ADB approved LARP of the 500 kV North South Power Enhancement
Project Double Circuit Transmission Line, elaborating on topics such as the scope of land
acquisition and affected households, the extent of stakeholder engagement activities, the
structure of the compensation framework and compliance in the payment of compensation for
permanent impacts; and elaborate and expand on the content of previous monitoring reports
prepared for LARP implementation covering the period from January 2019 to September 2019..
Specifically, the report verifies that:
• The LARP for the project was prepared and got approved from the ADB and disclosed
on as per provisions of the ADB approved LARF for the NSPEP, based on the final
design.
• The LARP and other LAR related information was shared with the stakeholders.
• Affected Households and other stakeholders were consulted during preparation and implementation of LARP.
• The Grievance Redress Mechanism was in place during project implementation.
• The Institutional Arrangements as envisaged in the approved LARP were in place.
• The compensation for the assessed losses of the project were according to the
entitlement matrix for the project.
• The required funds were allocated by the DABS to implement the resettlement budget.
• All the affected households were paid for their losses as determined in the approved
LARP.
12. The report provides details on the implementation compliance of LARP, as well as
opinions of affected households, whose interests and rights were affected in this process.
4 Approach and Methodology
13. The monitoring of LARP implementation has been made by adopting the following
approach and methodology.
• Undertook a thorough review of the entitlements with regard to its compliance with the
provisions of LARP, identification of project impacts on land, crops and structures;
provision of compensation based on entitlements, compensation payments processes,
grievance redress mechanism and monitoring of LARP implementation.
• Carried out surveys with active participation of DABS offices with affected households
(AHs) to identify their level of satisfaction on estimation of affected land and crops,
determination of price of affected land, entitlement, and time taken to process
compensations, availability of GRM and working of GRC, compensation payment
process and impacts on their livings.

5 Findings of the LARP Implementation Compliance Report
5.1 LARP of the project and Its Updating
14. A draft Land Acquisition and Resettlement Plan (LARP) for the entire Transmission Line
Component of the Project was prepared by the DABS in Aug 2013 based on preliminary design
to address social and resettlement impacts of the transmission lines component.
5.2 Update of the LARP
15. Upon completion of detailed design, the transmission line length was divided into three
sections for final LARPs preparation. The final LARP for Baghlan section was prepared in July
2019, by the PMO-DABS through its PMPIC. The LARP was based on the final design of the
project; and in accordance with provisions of the laws in Afghanistan, ADB SPS 2009 that was
updated to comply with the requirements of SPS 2009.
16. The LARP identified, quantified and valued the impacts of HVTL on land, crops and
structures in order to determine the compensation package and accordingly its implementation.
The LARP elaborated on the assessment of type and magnitude of LAR impacts, eligibility and
entitlement of compensation; institutional arrangements for the implementation of LAR activities
as well as the grievance redress mechanism, resettlement cost, implementation schedule and
conducting monitoring and reporting in accordance with the revised LARP.
17. Land and Resettlement (LAR) Impacts of the Project.
18. The LAR impacts as identified in the approved LARP for project are summarized in
Table-2.

19. Public disclosure of information and maintenance of transparency by the Project with all
stakeholders, especially the affected households are basic policy requirements of the LAL and
ADB SPS. When the approaches become transparent and open, the chances for establishing
mutual trust between the Project and the stakeholders are greater. This process had salutary
effect on all activities of the project unlike to the suspicion and mistrust caused by closeness of
affairs that end up with serious negative effects on project implementation.

5.3 Determination of Land Price
20. The district or provincial valuation committee determined the market value of the land
with assessment of (a) the market value, specified in the LAL for the registration of sale deeds
or agreements to sell, as the case may be, in the area, where the land is situated; or (b) the
average sale price for similar type of land situated in the nearest village or nearest vicinity area;
or (c) consented amount of compensation as agreed upon, whichever was acceptable to the
AHs.
A. Valuation of Building and Structure:
21. The cost of buildings Identified based on updated market negotiated cost Schedule of Rates (SR)
as on date without depreciation. Since, all the affected structures belong to non-titleholders; no Solarium
added to the market value of the structure as it is provided to only the titleholders.
B. Valuation of Trees and Crops:
22. Compensation for trees and crops determined based on their full replacement cost. The valuation
committee for the purpose of determining the market value of trees and plants attached to the land
acquired, use the services of experienced persons/agencies in the field of agriculture, forestry,
horticulture, sericulture, or any other field considered necessary.
5.4 Public Consultations
23. The preliminary discussions held with the heads of Province and Districts yielded good
results in respect of developing a dialogue with all project stakeholders and affected persons.
District level awareness sessions provided an opportunity to lay a foundation for a continuing
dialogue with affected persons and other stakeholders on project related issues. Summary of
the consultations during LARP preparation and post-LARP implementation are provided in table
3 below.
24. The consultation process is summarized in Table-3.

25. Their attitude towards the proposed project was positive. Generally, people were found
to be aware of the electricity need and the importance of the proposed TL project in this respect.
The concerns and suggestions of the affected communities were considered in project design
and were implemented as an integral part of resettlement activities. The local communities and
affected households main views (awareness, perceptions and preferences) relating to Land and
Crops Compensation and resettlement related matters.
26. The views and suggestions of the stakeholders were considered in preparation of
compensation package for the affected persons.

Institutional Arrangements for LARP Implementation
5.4.1 General
27. Involuntary resettlement planning, implementation and monitoring involve various
ministries and agencies in Afghanistan; however, overall implementing responsibility of the
project lies with the GoA and DABS which is the line agency for the regional development being
the execution agency for national development Projects including NSPEP.
28. Da Afghanistan Breshna Sherkat (DABS)
Several agencies in Afghanistan are involved in matters related to land administration and land
rights. However, they are currently not in a position to fully exercise their mandates due to
capacity issues and weak institutional structures. To overcome this weakness, DABS has been
entrusted with the overall responsibility for the Program including preparation, implementation
and financing of all LAR tasks and cross-agency coordination. DABS will execute its Program
related activities through Project Management Office (PMO).
29. Project Management Office (PMO)
Within DABS, the Project Management Office (PMO) has been established to deal with day to
day responsibility for preparation, implementation and monitoring of LARP. As necessary the
PMO will coordinate with the Ministry of Urban Development and Land (MUDL), Cadastre
Survey Department, local Governorates, NGOs and the community shuras, locally elected
councils. The PMO will undertake the LAR activities through the Environmental and Social Unit
(ESU) that will be established in the PMO exclusively to deal with the safeguard’s issues.
30. Environmental and Social Unit (ESU)
The ESU supported by the PMPIC to manage LAR activities. The ESU was responsible
internally to monitor LARP preparation and implementation (including surveys, asset valuation,
and community consultation), LAR-related cross-agency/inter-departmental coordination, LARP
approval, prepare internal monitoring reports.
31. Program Management and Project Implementation Consultants (PMPIC)
The PMPIC supported the PMO-ESU in managing the LAR activities and assisted in LAR
planning/implementation, internal monitoring and evaluation (M&E), and training on impact
assessment and ADB resettlement policy requirements. The PMPIC engaged one international
and one national social development/ resettlement specialist to work with the PMO-ESU on all
resettlement and consultations tasks and to liaise with the contractor to ensure smooth
implementation of related social development/ resettlement requirements.

32. Other Agencies and Institutions
Several other agencies and institutions had a role in the preparation and implementation of the
LARP. These are:
33. Community Shuras, Local Jirgas and Community Development Councils
These local entities assisted in various ways the communication between DABS and the
affected communities. This includes facilitating public consultation, monitoring the management
of complaints and grievances, vouching as needed for the land occupation status of the AHs
and assisting in the definition of land compensation rates where no clear land markets are
established.
34. Provincial Government
This entity was engaged to ensure government functions at the provincial level, and following
the land valuation survey or negotiation, provided official endorsement of land compensation
rates.
35. Ministry of Finance (MOF)
The MOF was responsible to release the finances needed for LARP implementation.
36. Asian Development Bank (ADB)
ADB provided approval of LARP and this LARP implementation compliance report.
37. The institutional arrangements for the preparation and implementation of LARP have
been structured as depicted in Figure 4.

5.5 GRIEVANCE REDRESS MECHANISM
38. To ensure timely grievance resolution at community level, a GRC was established as part of the
LARP preparation process. The salient features of the GRM were widely publicized by the local DABS
offices in the project areas and among the local communities along the RoW of the transmission line.
39. The GRM required the formation of a GRC to address grievances of the AHs during LARP
implementation. Accordingly, DABS formed the GRCs in Baghlan province including the representatives
from the DABS, provincial councils, governor’s office, security office and community members as recommended by district governor, to address the complaints and grievances of AHs during LARP
implementation. Notifications and respect of formation of GRC in Baghlan province is provided as Table
No.4 respectively. People were informed about the functions and rule of GRCs by the project social staff
during the conduct of census and socio-economic surveys, at the Jirga held for the determination of land
prices and through announcements in the local mosques at Juma congregations. The composition of
GRC in Baghlan province is provided in table 4.

40. The GRC actively performed its duties in coordination with the Land Identification,
Valuation and Verification (LIVV) Committee and all its members remained involved during the
process of preparation of compensation forms. The committee members explained to the AHs
about the procedure that was set by the DABS for payment of compensation. The committee
members mobilized the AHs to approach to the Land Department for obtaining the verified
documents of land ownership and to open their bank accounts. The process of LARP
implementation was accomplished smoothly with the active participation of GRC members
without any complaints/ grievances from the AHs.
5.6 Arrangements for Financing Resettlement Budget
41. Pursuant to provisions of the grant agreement, expenditures on Land Acquisition and
Resettlement Plan (LARP) were all to be borne 100 percent from share of the Afghanistan
Government except for the temporary impacts i.e. access roads and RoW which were paid by
the contractor. To make sure the availability of funds vide the resettlement budget, the DABS
pursued the Ministry of Finance (MoF). The government decided that the resettlement budget
will be borne by the DABS from its own sources. Consequent upon the decision, the DABS
allocated the resettlement budget for the sub-project as provided in Table 5.

5.7 Approval of Resettlement Budget by DABS for Permanent Losses
42. The resettlement budget of the 500 kV North South Power Enhancement Project double Circuit
Transmission Line (Baghlan section) required a total amount of AFN 37,102,644
5.8 Information to the affected households about Compensation Amounts
43. The affected households were fully informed about the compensation amount that was
to be received by them individually through disclosure of LARP, distribution of LAR Pamphlet,
consultations and personal meetings and the local members of the GRC.
5.9 Procedure Adopted for Payment of Compensation
44. In order to ensure transparency in compliance of SPS 2009 and approved LARP
provisions, the DABS directly transferred the compensation amounts to the Bank Accounts of
the AHs, after receiving confirmation of the status of ownership in favour of the claimant from
the office of Land Departments of the Khinjan, Dushi and Pulikumri districts as well LARC. The
AHs were mobilized through the GRC and social teams of PMO and local DABS office to get
their land ownership proofs according to the official records from the land office and open their
bank accounts. As a result of active participation of the PMO and local DABS office social teams
and the GRC members, all the AHs opened their accounts in the bank and provided the details
to the concerned DABS office.
5.10 Verification of Affected Land and Its Owners
45. During the process of completing the compensation forms, the DABS-PMO with
assistance from GRC and Social team of CSC undertook a process to verify the affected land
and its owners as recorded in the LARP with the active involvement of the affected households.
The calculation of affected land under the towers were found to be correct and the affected
households also shown their satisfaction on the measured land. However, some variations in
the names of the land owners were observed as compared with the names provided in the
LARP. This was due to misreporting to the social teams by the AHs at the time of census survey.
46. It has been found that the along the project i.e Baghlan section, total 4 affected
households were physically displaced who were residing under the transmission line and who
were considered as severely affected households and allowances for relocation and severely
impact allowance (7,500 AFN each which made 60,000 AFN) in total have been paid to these

affected households (table 6). All the entitlements have been fully paid to all the present AHs as
per the approved LARP. However, there are some absent AHs (21) who have not been located
yet despite several efforts by the local DABS, provincial/district governor’s office and project team. Table 6 below reflects summary of the impact as per the approved LARP and the actual
impact:

5.11 Payment of Compensation
47. Payments have been made to 97 AHs out of the total 118 AHs as approved in the final
LARP and the remaining 21 AHs have not yet been paid yet. The remaining affected households
due to the fact that these people were not located by the DABS and provincial government and
were declared to be absent and/or out of the country. Efforts in locating these absentee AHs will
continue through announcements in the mosques, through radios and other available sources
to locate these AHs The remaining AHs would be paid as soon they are located and submit their
land ownership documents to DABS for further process through the collective escrow account
already established in Baghlan province where their compensation amounts have already been
deposited by DABS. See annex 1, establishment of escrow account letter.
48. The AHs’ land identification, valuation and ownership documents called ‘Forms” were submitted to the Provincial Governors for their concurrence. The provincial governments have
accorded approval to these forms and sent these to the MUDL for necessary action (review and
final approval) at its end. The MUDL submitted these approved forms to the DABS. The DABS
reviewed and approved these forms and forwarded them to its finance department. for
transferring to the individual AHs’ bank accounts. Status of compensation payments against the
approved LARP entitlement matrix to the AHs is reflected below:

7 Monitoring of LARP Implementation
49. In accordance with the LARP provisions, the PMO-DABS carried out internal monitoring of LARP
implementation process regular and results were reported in the monthly progress reports.
8 Conclusions
50. The following conclusions are derived from the LARP implementation compliance study.
1) Land acquisition and resettlement within the scope of LARP implementation process was undertaken in compliance with the ADB Safeguard Policy Statement (2009), approved LARP and in accordance of the Afghanistan Land Law. All the payments to the present AHs as per the approved LARP were transferred to every single AH’s Bank account and there are no pending claims. However, there are 21 absentee AHs, who have not been located yet despite several efforts by the local and central government offices and project team. The compensation amounts of these 21 AHs have been deposited in a collective escrow account in the Baghlan province so that once these absentees are located and their documents are processed, they could be paid immediately.
2) The resettlement process principles in respect of (i) disclosure and dissemination of information to the AHs, (ii) establishment of channels for participation and involvement of AHs, (iii) negotiations and agreements with the Affected households on the appropriate and acceptable prices of land (iv) establishment and operation of mechanisms ensuring transparency in the payment of compensation process, monitoring of LARP implementation process and redressal of grievances have been adequately adopted or at least in a way that fulfilled the expectations of the AHs.
3) The DABS has established institutional arrangements for the preparation, finalization and implementation of LAR activities. DABS have recruited the resettlement specialist and other social staffs in the PMO to deal with LAR related activities with PIC.

4) The GRC played an instrumental role in the implementation of LARP; by mobilizing and assisting all the affected households in getting completed their compensation forms validated from the local land offices.
5) In a quest to ensure transparency in compliance of SPS 2009 and approved LARF provisions, the DABS directly transferred the compensation amounts to the Bank Accounts of the AHs, after receiving confirmation of the status of ownership in favour of the claimant from the office of District Land Department.
6) All the 97 AHs have been fully compensated. Payments have been made via their individual bank accounts and no any further claims have been received from these affected household. There are 21 absentee AHs who have not been located despite several efforts by the central and provincial level government offices and project team. These absentee AHs’ compensation amounts have been deposited collectively in an escrow account in a commercial bank in Baghlan province so that once they are located and their documents processed, they can be paid immediately. Efforts in locating these absentee AHs will continue through announcements in the mosques, through radios and other available sources to locate these AHs.
