1 INTRODUCTION

1. Surkhan to Khodja Alwan 500kV Single-Circuit Transmission Line Project funded by Government of Uzbekistan is considered as an associated facility of the proposed Uzbekistan-Afghanistan Power Interconnection Project that is proposed for financing by the Asian Development Bank (ADB). Associated facility of the project located in Uzbekistan territory includes expansion of Surkhan substation, installation of 127 towers and 45 km transmission lines connecting Surkhan substation to the Uzbekistan-Afghanistan border with cost of $32 million.

2. As an associated facility to the ADB financed project, a social due diligence review (SDDR) was conducted to review the involuntary resettlement (IR) impacts and risks from the associated facility and agree on conducting measures to achieve the outcomes consistent with the ADB’s safeguards requirements.

3. The SDDR noted that while land allocation documents indicated that all the required land are state reserve lands and are not occupied by any land user, there are lands in the RoW of the project in Surkhandarya province that are used as orchards, agricultural lands, and pasture lands. Based on this finding, a corrective action plan (CAP) was agreed between ADB and NENU to comply with the Uzbekistan government’s regulations concerning permanent and temporary land acquisition impacts from projects. The CAP includes number of actions including hiring of resettlement specialist, conduct due diligence, conducting consultations with affected people, inventory of losses and identification of affected people, review of all land conversion transactions occurring after December 2017, hiring of evaluation organizations to assess the impacts, paying compensation and preparation/submission of completion report to ADB for review.

4. This CAP completion report prepared by NENU’s resettlement specialist, aims to provide the status of the actions and additional due diligence agreed in the approved SDDR as of 15 January 2020. This is the final report to show the progress in the CAP implementation. Resumption of civil works on the remaining stages and sections will be conditional to the ADB review and clearance of the CAP completion report.

2 CAP ACTIVITIES IMPLEMENTATION INFORMATION

2.1 Hiring of NENU Resettlement Specialist

5. Totally 4 persons were engaged for addressing land acquisition and resettlement issues described in the SDDR as follows: 2 persons in NENU headquarters in Tashkent city and 2 persons in Surkhandarya province office of NENU.

6. These officers are existing officers of NENU. 2 officers in headquarters in Tashkent city are resettlement specialist and his assistant which are mainly involved in other projects implemented by NENU. They were assigned with a new task to address the issues described in the SDDR. 2 officers in Surkhandarya province office of NENU are also existing engineers which were additionally assigned with a task to help resettlement expert of NENU. Durations of contract of all of these 4 officers are unlimited. All officers were mobilized for new task starting from 1 November 2019.

2.2 Inventory of Losses, Identification and Consultations with APs

7. As per the requirements of the SDDR exact number of affected parties and their losses were identified during the period of November - December 2019. Totally 9 farm enterprises (5 in

Djarkurgan and 4 in Termez district) were identified with the help of local cadaster departments of Djarkurgan and Termez districts using cadaster documents and maps. The identified farm enterprises were then contacted and met. It should be noted that 2 farm enterprises (from 4) in Termez district are government owned farm enterprises. Each site of the associated facility was visited together with APs to confirm that such sites are located (in Djarkurgan district) or to be located (in Termez district) on lands of the identified APs.

8. Initially the SDDR noted 12 land users including 5 land users in Djarkurgan district and 7 land users in Termez district. However, during the survey in November-December 2019 totally 9 land users were identified as mentioned above. As it is seen, during the survey in November-December 2019 number of APs in Termez district decreased from 7 to 4 compared to what was initially noted in the SDDR. Number of APs in Djarkurgan distrct remains similar to what was initially noted in the SDDR. The following is the reason of decrease of number of APs in Termez district.

9. All detailed design documents for the whole area in Termez district where the associated facility’s components will be constructed had been available only by the beginning of November 2019. Afterwards, APs in this district were identified based on such detailed design documentation. Number of APs initially noted in the SDDR was estimated based on preliminary assessment based on imperfect information on alignment of power line. As of August 2019, less than 50% towers in Termez district were installed. These towers were installed on deserted areas for which detailed design documents were ready by that time. Such deserted lands are free from any land users. Complete set of detailed design documents for remaining part of Termez district was available only by beginning of November 2019. Survey to identify APs in Termez and Djarkurgan district covered 100% of the area where the associated facility infrastructure had been/will be constructed.

10. Details of land losses of APs are given in the below tables.

11. As it can be seen from the tables above, scope of land losses by APs in the two districts due to the associated facility are very insignificant varying from 0.06% to 1.21% compared to total leased land holding.

12. Socioeconomic conditions of APs were not surveyed as it is not requirement of the national legislation. However, it can be assumed that the APs are from prosperous families because of the fact that they won competitive biddings to get rights to use the leased lands. And the main requirement of the government to award land lease contract is to have capital resources sufficient to manage the leased land.

13. All APs had been met and consulted during the process of inventory of losses. After obtaining information about land user from local cadaster departments in Djarkurgan and Termez districts all APs had been contacted and met. Each AP had been met several times: on their fields to confirm that associated facility infrastructure had been/will be located on lands leased by the APs and to measure size of land acquired/to be acquired, in local government offices during meetings for evaluation losses incurred/to be incurred etc. The below pictures illustrate meeting moments with APs in Djarkurgan and Termez districts.

14. All APs were informed about the proposed project as a whole and the associated facility in Uzbekistan, requirements of national legislation regarding compensation of losses including process of compensation calculation, compensation payment process, grievance mechanisms etc. During the meetings in local government offices the APs were closely consulted to share information on scope of losses and calculate amounts of compensations.

15. During the meetings, all APs expressed their no objections for construction of the associated facility components on lands leased by them taking in to consideration that lands acquired for these facilities are miserable compared to total area of lands leased by the APs. They agreed for the calculated amounts of compensations.

2.3 Review of Land Conversions or Farm Optimization in the Project Alignment

16. Land conversion transactions to “state reserve land” or “farm optimization” in the alignment of the associated facility after December 2017 which may have affected some farm leaseholders had been surveyed. This survey was carried out with the help of local cadaster departments and district hokimiyats of Djarkurgan and Termez district.

17. The survey revealed that there were no land conversion transactions to “state reserve land” or “farm optimization” in the alignment of the associated facility after December 2017.

2.4 Review of Permanent and Temporary Impacts

18. The survey to identify permanent and temporary impacts due to construction of the associated facility components in Djarkurgan and Termez district found out the following scope of permanent and temporary impacts: permanent - 2.6 hectares (including 1.67 in Djarkurgan district and 0.93 in Termez district) and temporary – 4.18 hectares (including 1.61 in Djarkurgan and 2.57 in Termez district). Details of impacts are given in the below table 3 and table 4.

19. Permanent and temporary impacts in Djarkurgan district. As it seen from table 3 totally 5 farm enterprises are under impact including 4 under permanent and 4 under temporary impact. Total area under permanent impact is 1.67 hectares and total area under temporary impact is 1.16 hectares. All the lands of farm enterprises which are under impact are irrigated agricultural lands with soil productivity varying from 42 to 48.

20. Most of the components of the associated facility (48 from 51) which require permanent land acquisition had already been installed in Djarkurgan district. No more irrigated agricultural lands will be acquired for the needs of the associated facility. The remaining 3 towers will be installed on the deserted areas which are not suitable for agricultural activity.

21. Permanent land impacts had been occurred in Djarkurgan district during installation of towers during the period of March 2018 – May 2019. Wheat and cotton were damaged during these works. Compensation amounts for permanent land impacts had been calculated in November 2019. The payment of compensations to APs is in process currently.

22. Temporary land acquisition in this district had not been occurred yet. The temporary land acquisition will be required for implementation the works related to stringing high voltage power lines on to the installed towers.

23. Permanent and temporary impacts in Termez district. As it seen from table 4, totally 4 farm enterprises are under impact including 3 under permanent and 4 under temporary impact. Total area under permanent impact is 0.93 hectares and total area under temporary impact is 2.57 hectares. All the lands of farm enterprises which are under impact are irrigated agricultural lands with soil productivity of 57 – 58. It should be noted that construction works related to stringing of power lines are expected to be implemented on territory of “Termiz Agropilla” farm enterprise without causing any damages. In this regard, no compensation was evaluated and paid to this government owned farm enterprise.

24. Neither permanent nor temporary impact have been occurred prior to suspension of civil works. Such impacts are expected to occur after commencement of civil works. The assessment was done for the whole project area in Termez district. No more APs are expected to be under impact in this district.

2.5 Evaluation of Losses

25. Losses of APs (damage of crops) due to permanent and temporary land acquisition had been evaluated by special team of experts from agriculture department, cadaster department and farmers association in the two districts. Losses had been evaluated in participation and consultations with APs. The compensations calculated for losses were acceptable by APs. Compensations for losses had been evaluated following the methodology described in the national law #146 dated 25.06.2011.

26. Evaluation reports in table format had been prepared (attached to this report) and officially formalized by signing by deputy hokim and representatives of agriculture department, cadaster department and farmers association of the two districts. In order to accelerate the CAP implementation process and based on mutual consent of all the parties involved, it was decided not to prepare another modification for land allocation resolution by governor of Surkhandarya province. The approved evaluation report had been considered as official basis for NENU’s payments of compensations to APs.

27. Compensation amounts (“missed profit”) for restriction of land use rights due to permanent land acquisition had been calculated by Surkhandarya province cadaster department based on official information from Surkhandarya province tax department regarding net profits of APs for previous years. Compensation amounts had been calculated based on the formula described in the #146 dated 25.06.2011 which is mentioned in the SDDR (Entitlement Matrix table, Section A, Column 3). Compensation amounts had been calculated in consultations with APs. Details of compensation amounts and payment statuses are presented in below section 2.7.

2.6 Grievance Redress Mechanism

28. From the first days of existence NENU established grievance redress mechanism to address directly any complaints received from legal entities and people according to the law of the Republic of Uzbekistan No. ZRU-378 “On Appeals of Physical and Legal Persons” dated 3 December 2014 which clearly determines types of queries, deadlines of submitting, requirements to review and resolve appeals and grievances of citizen. The main objective of the grievance mechanism is to ensure a timely and user-friendly solution to the complaints received from local communities with regard to the associated facility construction activities. The grievance redress mechanism does not prevent any people or legal entity to approach the national legal system to resolve their complaints at any stage of the grievance redress process. The following paragraphs describe the levels of the GRM established at the NENU which are also applicable to the persons affected by the associated facility activities.

29. Level 1. Surkhandarya province branch of NENU. Surkhandarya province branch of NENU has a General Affairs Department which deals with the grievances of local legal entities and people. Due to Surkhandarya province branch of NENU has only one customer – Regional Electric Networks company (REN) most of the grievances are received from the REN. REN receives electricity from Surkhandarya province branch of NENU and distributes to local communities including households and legal entities. Grievances from local people are received very rarely. In the year 2018 and 2019 no complaints were received from local people. Grievances received are reviewed and resolved in the timeframe mentioned in the above law.

30. Level 2. Main office of NENU in Tashkent. Most of the grievances received in Surkhandarya province are resolved locally. In case if a grievance cannot be resolved locally Surkhandarya province NENU contacts main office in Tashkent to seek assistance.

31. Level 3. The legal system of the country. Usually, grievances are resolved at level 1 or level 2. However, if an issue is not resolved or an applicant is not satisfied with the decision/resolution at either stage of the project level grievance redress process the aggrieved person can submit his grievance to a local court where the decision will be made in accordance with the relevant national legislation.

32. There was no any registered written or verbal complaint regarding activities implemented within the associated facility. No concerns were expressed received from APs during consultations.

2.7 Processing of Compensation and Expected Delivery

33. Payments of compensations to APs calculated for damage of crops due to permanent and temporary impacts started in February 2020 and completed in August 2020. Total calculated compensations amount is 53 282 182.68 UZS including 52 931 520 UZS compensation for damage of crops and 350 662.68 UZS compensation for restriction of land use rights due to

permanent land acquisition. Compensation amounts had been fully paid to APs. Details of evaluated compensation amounts and actually paid amounts are given in the below tables 5 and 6.

34. As the table shows, 100 % of the evaluated compensation amounts for crops damages due to permanent and temporary land acquisition was paid to APs by NENU. Amounts had been paid through bank transfer to accounts of farm enterprises.

35. Compensations to APs for restriction of land use rights due to permanent land acquisition also had been fully paid to affected farm enterprises by NENU. Totally 350 662.68 UZS had been paid. Details of the compensation are presented in the below table 6. Compensation amount evaluation report had been received by NENU on 21.08.2020 and the evaluated amounts had been paid on the same day through bank transfer to accounts of farm enterprises.

36. Compensation amounts for restriction of land use rights due to permanent land acquisition had been calculated as the average of three years’ net profit multiplied by four according to the Law # 146 dated 25.06.2011. This was stipulated in the entitle matrix of the Social Due Diligence Report (Table 4, Section A Permanent Land Acquisition, Column three, point two). Copy of the evaluation table approved by Head of Surkhandarya Province Cadaster Department, payment documents and their translations are attached as Annex 6. Copy of the letter of Surkhandarya province Tax Department with information of three years net profits of affected farm enterprises which was used for evaluation of the compensation is attached as Annex 5 to this report.
