Happy New Year to all!!

Wow! 15 years just flew by! Seems like yesterday (07/01/2000) that Abate of Floridafought and won for you, the freedom of choice to wear helmets. This year, and everyother year since, someone in Tallahassee will want to take away that right. We won't letthat happen, with the help and continued support all of our members and officers in theDaytona Beach chapter and the other 31 chapters in Florida!!!!

There's a lot happening this year in the Capitol, so come to a meeting...get involved and"fight for you're rights" as a motorcyclist in the great sunshine state!!

I attended the state meeting with John and the big push is on for theBike Fest the first weekend in Oct. The town of Avon Park has approvedeverything and are awaiting the event.The state will need as many volunteers as they can get for the ride to thecapitol which will be on April 20th this year. There will be nocampground by the stateWishing everyone a very Merry Christmas and a Happy and Safe NewYear.Hoping to see more members faces next year at the meetings

New Business – Discussed the legislative priorities that Daytona chapter wants put on the 2015 legislative agenda forABATE of Florida Inc. and voted on the following to be priorities: (1) Biker Profiling (2) Equal Access (3) Reduc-tion in the mandatory max fines directed at motorcyclist (e.g., wheelies, burnouts, etc.). Also voted on NOT wastingABATE of Florida’s resources on a Vulnerable Road User bill. We voted and DO NOT want Government to havemore power of us.

Suggested relocating the ABATE Daytona meetings to a location within Daytona City limits that will allow for amore dynamic crowd and better visibility. Currently researching several options.

Legislative Report December 15, 2014 John BantaOut of date as soon as I write it

Ideally you would get the latest legislative news and press releases, but it is not as active as some would hope. Contactthe State Legislative Trustee, Darrin Brooks, to get on his email list.

He sends news reports of legislative activities on a myriad of topics.

Tallahassee Committee hearings start Jan 5, Session begins March 3, Jan. 3 deadline for submitting requests for drafts of Housegeneral bills and joint resolutions, including requests for companion bills. Tentative Rights Rally April 20. Sen. Thasher resignedalong with Rep. Hutson & Rep. Renuart (they will be running for the Senate position. Democrat David Cox will also be running).Special primary Jan 27, special election April 7, estimated cost $820000 as reported in the News-Journal. (Estimated cost figuresare somewhat political; in newer articles it is now 1 million).

DHSMV is seeking to reinstate mandatory motorcycle helmet law. DHSMV will find a sponsor.

ABATE of Florida supports enhanced penalties for those who injure or kill vulnerable road users.

ABATE of Florida will still seek funding for ABATE’s Motorcycle Safety and Awareness Program and will try to monitoringfunding for the DHSMV Florida Rider’s Training Program and Florida Motorcycle Safety Program funded by the $2.50 addedlicense fee paid only by motorcyclists.

At the chapter meeting, it was voted that our chapter delegates provide the following input on our legislative priorities:

1. Back off on any vulnerable road users enhanced penalties legislation. Some of us are tired of these mandatory minimums. Iassume that this also applies to the recent texting and cell phone bills filed

2. Get profiling and equal access legislation. Be aware that this will require two separate bills.

3. Get the $1000 fine for popping a wheelie reduced to something more realistic.

Profiling is an issue that needs to be addressed and prioritized. Can we add this to the plate with all of the above pending? Canour participation in rallies convince the average motorcyclist that this affects them too (Motorcycle Checkpoints)? Suppose abill can get filed but goes nowhere. What will be the message to those that embrace profiling? The State of Washington’s Anti-profiling legislation does nothing concerning Equal Access. A.B.A.T.E. of Minnesota, which was able to get Equal Access legis-lation passed (however it has been reported that nothing has really changed), is currently looking into legislation about profiling(MRF Reports Nov/Dec 2014).

And you get an email reply, and then you find out who is administering this portion of theprogram:“Any questions, comments, or inquiries can be directed to” MotorcycleSafe-

We believe that adults should be able to decide when to wear a motorcycle helmet.

DHSMV will present misleading numbers on deaths and economic costs. They have not posted their legislative priorities. Theyare up to something. Locally, only Sen. Hukull and Rep. Hudson have received our Fact Sheets #1 & #2. We also have theMRF July 2014 News release on registrations and the 2014 MRF Fact or Fiction handout. The best report, on the subject ofcosts is the CODES report from 1995. There is a confusing, contradictory and basically very unreadable NHSTA conglomera-tion on the NHSTA website. Try to make sense of it. With HIPPA, agencies really can spout anything they want and we cannotnot verify their claims.

DHSMV has finally released the 2013 Traffic Crash Facts.

Gone are is the chart showing accidents and fatalities thru the years, they just mention that

Motorcyclist’s fatalities are up 4.47% and crashes are up 3.18%

Here are the numbers for just motorcyclists, not passengers; mopeds are ATVs, for 2013:

The fatality/Accident ratio for DOT Helmet users is 5.04%. For No Helmet Users it is 5.05%; For Combination of No Helmet, Other, andunknown it is 4.18%. That Helmet still does not make a difference

Washington DC Lame Duck session ends in December; do not expect muchMotorcycle only check points, by law enforcement is harassment and discriminatory and has very little with safety. If you want aroad block, pull everybody over. Here are the bills. New ones will have to be filed

HR 1861, Stop Motorcycle Checkpoint Funding Act.

Sponsored by Congressman James Sensenbrenner (Wisconsin). This bill would prohibit the Department of Transportation (DOT)from providing funds to state and local authorities for the purpose of creating motorcycle only checkpoints. This bill also containslanguage to force the DOT to focus motorcycle safety efforts on crash prevention programs, not national helmet mandates. 50 co-sponsors, no one from Florida. Rep. DeSantis said he will keep my comments in mind if this hits the House floor.

S.2078, Stop Motorcycle Checkpoint Funding Act

Sponsored by Senators Shaheen (D-NH). Co-sponsors Johnson (R-WI), Manchin (D-WV) and Ayotte (R-NH) introduced. I didget a generic non-committal reply from Sen. Nelson.

LocalRichard Mathew (Hathew) Shea, 27 Deland, hit John Corbin, 64 Deland, from behind when Corbin slowed at for an intersection. Corbin died3 days later. Shea had 15 citations between 2006 and 2014. He had been charged with careless driving which is a 166.00 fine. His judge isRobert Saunders Jr.

Pled Guilty Paid $189 on Dec. 11. Fine 166.00; Delinquency Fee 16.00; D-6 Affidavit 7.00

Listed on the citation: Injury to another Yes; Serious Bodily NO; Fatality NO

From DHSMV website:What proof of insurance is required?

The department is advising law enforcement to accept a health insurance card (or actual policy or declarations page) from a HMO or BlueCross/Blue Shield or some other recognized health insurance provider as proof. The card must show current insurance. In addi tion, limitedmotorcycle medical coverage will also suffice. Contact your insurance carrier for more information. However, PIP coverage under a personalpassenger vehicle policy would be insufficient for either the operator or passenger on the motorcycle.

Can I get stopped by law enforcement just for not wearing a helmet?

Like Florida's seat belt law, our department has determined that enforcement for this provision of law should be secondary. That is, an officershould not initiate a traffic stop only to determine if a person has insurance coverage. However, a trooper or other law enforcement officermay stop a motorcycle operator or passenger riding without a helmet based on reasonable suspicion the operator or rider is under 21. A lawenforcement officer should not stop someone riding a motorcycle without a helmet only to check his or her age.

The Myth that Motorcycle Helmets Greatly Reduce Fatalities #2

Myth: “Helmets are estimated to be 37-percent effective in preventing fatal injuries to motorcycle riders”Traffic Safety Facts 2012 Data June 2014 DOT HS 812 035

This 37 percent effectiveness has been out for awhile. It is the basis for NHSTA estimates of determining lives saved, lives thatcould have been saved and recently “costs to society” saved and what could have been saved.In 2000, Florida allowed adults the freedom to choose when to wear a motorcycle helmet. The Florida Dept. of Highway Safety andMotor Vehicles (DHSMV) has published the numbers of motorcycle accidents, injuries and fatalities in their annual Traffic CrashFacts. If that 37% was accurate, why are the fatality per accident ratios between helmeted and non-helmeted riders within 1 percentand not 37 percent? In the year 2004 there were 3827 accidents involving helmet motorcyclists resulting in 200 fatalities. The sameyear there were 3745 accidents involving non-helmeted motorcyclists resulting in 188 fatalities?The 2004 fatality per accident ratios:Helmeted motorcyclists 5.23; Non-helmeted motorcyclists 5.02The 2004 incapacitating injury per accident ratios:Helmeted motorcyclists 27.44; Non-helmeted motorcyclists 27.66

This effectiveness percentage is outlined in Motorcycle Helmet Effectiveness Revisited, March 2004 DOT HS 809 715. 10 years ofaccident data (1993-2002) involving both a rider and passenger, with a fatal outcome, were given ratios on the four combinations ofthe motorcyclist and passenger being helmeted or not helmeted. The effectiveness was the difference in the ratios between the non-helmeted and helmeted motorcycle “occupants”.Here is the computed effectiveness for a rider based on the average between non-helmeted and helmeted passenger, table 5.

The report does not mention anything about standard deviation or variance, which gives an indication of how reliable that numberis. The range of yearly effectiveness means that 37% effectiveness is ludicrous.

The NHSTA estimates of lives saved or could have been saved is published in many of their reports. Those estimates are onlybased on this 37% and are thus inaccurate. The Determining Estimates of Lives and Costs Saved by Motorcycle Helmets March2011 DOT HS 811 433 says that “society” in Florida, would of saved $163849006, if there was 100 percent helmet use. This againis based on that 37% and 2000 figures of $5941 minor injury, $135634 serious injury and $957787 fatality. Is that dollar figuresupposed to be a shock number to infuriate the general non-riding public? The Center for Urban Transportation Research (CUTR)Motorcycle Crash Trends in Florida 2010 shows that 91% of the 2009 hospitalizations in Florida for non-fatal injuries sustained inmotorcycle traffic crashes had a payer source. That is better than other portions of the population. The 2002 Senate staff reportfor S.704 states that the DHSMV says that 18.8% of automobiles are uninsured.

ABATE of Florida is not against helmets. We believe that each adult should have the choice on when to wear a helmet. The in-crease of motorcycle and automobile registrations has resulted in more accidents. That is what needs to be changed. Decrease theaccidents, decrease the fatalities.
