Train the TrainerThe week starts with the Train the Trainer Conference – alearning event that will model the use of adult learningprinciples, providing an interactive experience for publicdefender trainers, supervisors, administrative staff andothers, anyone whose job responsibilities include thedevelopment or implementation of training.

Participants will join one of three training tracks:• Designing a Training Program• Developing Effective Presentations• Small Group Facilitation Skills & Giving Feedback as a Training Tool

Designing a Training ProgramFrom directors of organization-wide training programs tosupervisors developing a one-time training for staffattorneys or administrative staff, the design of the trainingprogram is critical to ensuring that the programparticipants enhance their knowledge, skills and abilities.This track will provide the participant with valuableinformation and practical steps for designing a trainingprogram from beginning to end. The track starts with thereasoning behind and mechanics of conducting needsassessments and designing curricula. As every programrests heavily on the skills and knowledge of its faculty, wewill then discuss the identification and development offaculty for your training program. The next portion of thetraining will focus on obtaining the funding and internaland external support required to bring a training programfrom an idea to an actuality. Finally we will discuss writtenand electronic materials, the use of evaluations and the finaltouches to complete your training program.

Developing Effective PresentationsBring your presentation idea and, at the end of this track,you will be well on your way to producing a presentationthat will impress your colleagues and engage your learners.This track will begin by exploring how to construct learningobjectives and lesson plans. The next step is making a well-designed presentation stand out. We will provide usefulpresentation tips for trainers on how to keep their studentsengaged and energized. Creative and appropriate use oftechnology can enhance the effectiveness of anypresentation. As most of us have experienced, a PowerPointpresentation can make a presentation exciting orexceedingly dull. We will explore ways to make yourtraining more effective using – but not overusing –technology. Finally, participants will perform a portion oftheir presentation and receive feedback from faculty andfellow participants.

Feedback as a Training Tool & SmallGroup FacilitationIt is common for training programs to include a chance forattorneys to break into small groups and practice basic trialskills such as voir dire, cross-examination and closingarguments. The trainers in these small groups may beexperts in the subject of the exercise, but they still need avariety of coaching techniques to get the most out of theirstudents. In this track we start by discussing and practicinghow best to give individual feedback to students. We thenmove to the next level – that of facilitating natural groupdynamics in order to provide a successful learningenvironment. We then explore the different settings inwhich these techniques can be used by giving examples ofhow they may apply to litigation, team management,investigation and other types of training programs.

AN EXCEPTIONAL WEEK OF TRAINING FOR DEFENDER PROGRAMS

This unique training opportunity allows maximum flexibility for participants to mold a schedule to fit theirneeds. The week is designed to operate both as two stand alone conferences and as an integrated weeklongexperience. You control the schedule to meet your goals.

•Identify and develop your management skills by building on your existingadvocacy skills

•Appreciate different working styles in your program and communicate moreeffectively with colleagues

•See problems as potential opportunities to support and train staff•Identify new strategies for building stronger teams inside the office and helpfulcoalitions outside your organization

•Hear about management challenges from across the country and collectivelystrategize ways to achieve lasting resolutions

BRING YOUR MANAGEMENT CHALLENGEPrior to arriving at the conference, you will be asked to write a short summary of amanagement challenge to work on throughout the conference. The instructions areon the back of the registration form. The purpose for this mandatory pre-conference assignment is to provide structured opportunities to apply the skill setstaught in the plenary sessions.

Individualized coaching will take place in small working groups of participantsfacilitated by experienced public defender managers. You will receive personalattention with time to explore the different dimensions of your managementchallenge, redefine the problem, assess your needs and work closely with others todevelop your own management plan for success. By the end of the conference youwill learn how to incorporate the theory of management ‘mindset’ into your dailyactivities and decision-making moments. This ultimately means better service toclients.

ADVANCED HOLISTIC MANAGEMENT TRACKHave you attended a previous Nuts & Bolts Training? Are you ready to lead youroffice team beyond just getting the best short-term dispositions for your clients?The goal of holistic management is to make it possible for you and your teammembers to begin making long-term differences in the lives of your clients, as wellas in your community. In this year’s Nuts & Bolts special track, we will focus onthe challenges to building a community-oriented, whole-client defender office. Wewill discuss how to develop holistic advocacy through interdisciplinary workgroups and through becoming a strong presence in your community. This uniqueNuts & Bolts track will be open to anyone whose managerial responsibilities areappropriate for this training.

INSTRUCTIONS FOR WRITING YOUR DEFENDER

MANAGEMENT CHALLENGEThink of a management or leadership incident in yourwork. It should be a challenging interpersonal encounter. Itmay be an incident where you doubted your effectiveness orwhere you felt frustrated. For example, you may have triedto encourage different conduct from a staff member, orperhaps had a difficult time providing a helpful performanceevaluation and the outcome was less than satisfactory. Beginthe description with a paragraph about the purpose of yourintervention, the setting, the people involved, and any otherimportant background information.

In considering which incident to choose for critical analysis,the following criteria should be considered:

• Pick a past incident or ongoing situation that you stillfind somewhat puzzling; you have not yet completelyunderstood why it turned out the way it did or why it isunfolding the way it is.

• Choose an incident that is not a no-win situation, wherenothing you might have done would have helped.

• Think of episodes in which the choice of a differentstrategy or manner of interacting might have resulted ina more favorable and satisfying outcome.

1.DESCRIPTION: Begin the description with a paragraphabout the purpose of your intervention,the setting, the people involved, andany other important backgroundinformation.

2.STRATEGY: Write a short paragraph about yourstrategy. Ask yourself: what were yourobjectives? How did you intend toachieve them? Why did you selectthose goals and strategies?

3.RESULTS: Briefly describe the results.

4.FRUSTRATIONS: Finally, write a few sentences on whatyou experienced as frustrating in theencounter.

Keep your responses to two typewritten pages. Be sure tonote if you are applying for the Advanced HolisticManagement Track. Management challenges should be sentto Jeff Sherr at [email protected] by Wednesday, March 5,2008. In the title of your email, please put “Nuts and BoltsManagement Challenge.”

Please bring twelve (12) copies of your managementchallenge to the conference in Kentucky to share with otherparticipants assigned to your small group. Thank you.

CONFIDENTIALITYWe expect that in the spirit of teamwork, helping others tosolve their management challenges and ultimatelyimproving representation for clients, there will be opencommunications throughout this management conference.

Our expectation is that full confidentiality will bemaintained among all conference participants. We hope allparticipants will be open to sharing their managementchallenges with their defender colleagues. As a member of asmall group you are expected to provide your other groupmembers with copies of your written managementchallenge and discuss the challenge with the facilitators andgroup members. If you wish your case to be confidential,please mask the setting and the participants as best you can.

The faculty recognizes that because several offices aresending a group of managers to this training it may bedifficult to mask the identities or scenario you would like touse as your management challenge. In this case, pleasechoose another management challenge that can bediscussed openly in your small group and feel free to raisethe more sensitive management challenge directly with yourfaculty facilitators outside of the small group meetings.

CLE:NLADA has applied for continuing legal education credits in most states that havemandatory CLE requirements. CLE forms, instructions and a list of accreditingstates will be included in the on-site registration packets.

Materials:The registration fee includes the conference materials on a CD-rom. Limitedmaterials will be provided in hard copy on-site. If you’re interested in reviewingthe complete set of materials on-site, please bring a laptop computer with you.The CD will be formatted for both PC and Mac.

Theinformation and materials provided represent the thoughts, opinions andstrategies regarding previous and ongoing cases and, accordingly, are protectedunder the attorney-client privilege and the work-product doctrine. It is critical thatparticipants understand the nature of the information/materials and regard allinformation as privileged. Participants attending must certify they are involved inthe defense of persons accused in criminal cases.

The National Defender Leadership Institute [NDLI] is an initiative of the National Legal Aid & Defender Association (NLADA),a non-profit membership association dedicated to quality legal representation for those who cannot afford counsel. NDLI hasthree primary goals: 1) to provide cutting-edge management and leadership training programs for public defender andassigned counsel leaders; 2) to build a national network of defender leaders; and 3) to support research and data collectionthat informs local, state, and national public policy debates. This training, networking and research to strengthen leadershipwill ensure that more public defense systems function efficiently and promote equal justice under the law.
