A. Agency offers to Coachella Valley High School (CVHS) students enrolled with an interest

in the field of Public Safety, through the California State Department of Education

Partnership Academy and Career Technical Education , an opportunity to participate in

the CVHS Public Service Partnership Academy.

B. The DISTRICT operates certified training in the field of Public Safety within the Coachella

Valley.

C. Agency desires to provide to its students , an exploratory work-experience program,

which includes short-term industry certified training and job-site learning experiences

through the application of knowledge and skills.

D. Students are enrolled in a Coachella Valley Unified School District (CVUSD) approved

Career Technical Education curriculum at Agency.

E. DISTRICT can serve as Business Member for CVUSD, California Department of

Education, and CVHS Public Service Partnership Academy. As such, the DISTRICT can

participate with the Agency in a Program which is successful in connecting academics

to industry standards and entry-level employment opportunities ..

F. DISTRICT has agreed to provide a schedule of non-credit curriculum and training

activities that lead to industry certification at the DISTRICT'S Public Safety Academy

facility to those students identified by the Agency for such purposes.

G. CVHS Public Service Partnership Academy is a fully implemented and fully funded

California Department of Education Partnership Academy as directed by California

Education Code sections 54690-54697, since 2007.

DISTRICT AGREES TO:

1. Accept the students assigned to the Program by the Agency and cooperate in the orientation of all Program Participants.

2. Provide the opportunities for such students, who shall be supervised by the college and Agency's school personnel, to observe and assist in various aspects of the District's Public Safety Academy (PSA) Program.

3. Coordinate with the Agency's rotation and schedule with the DISTRICT'S own proposed schedule ( Exhibit #1- Proposed Schedule of Courses)

4. Provide each Agency supervisor, who is working with the Program , an orientation to the objectives of the Program . Each Agency supervisor is in facto a role model! mentor who can influence the Program Participant outcomes.

5. Assist Agency, upon request by the Agency, in the evaluation of each Program Participants performance in the Program . The Agency shall at all times remain solely responsible for the evolutions and grading of Program Participants.

6. Comply with OSHA and the Labor code, at all times , in regards to age and workplace restrictions. 7. Participate by sending appropriate representation to Steering Committee meetings mutually

scheduled with cooperation between the DISTRICT and Agency, at least four times per year. This committee; plans, directs and controls the communication of the exploratory work experience program .

8. Cooperate with the Agency in the implementation of the Partnership Academy Grant Components. Such as Advisory committee meetings, Curriculum input, Program evaluations, Steering committee meetings, and the DISTRICT's partner economic match that addresses the California Department of Education grant requirements.

AGENCY AGREES TO PROVIDE:

1. A Maximum number of 20 Students and timely Transportation of the students to the DISTRICT's PSA facility or to designated worksites.

2. Classroom theory and practical instruction to students prior to their exploratory work-experience assignment;

3. Preparation of a student's assignments and rotation plans for each student; 4. Proof that students have submitted a pre-employment drug screening, paid for by the Agency.

Such drug screening records wi ll be maintained by the Agency and wi ll be made available to the worksi te. Students must pass the drug screening to participate in the program .

5. Continuing oral and wri tten communication with the DISTRICT and any worksite, regarding student performance and evaluation , absences and assignments of students and other pertinent information;

6. Readily available, a school teacher/supervisor at the DISTRICT PSA faci lity or any worksite to address any student needs.

7. Participation with the students in the worksite's Quality assurance and related programs. Performance of such other duties as may from time to time be agreed between Agency and the DISTRICT,

a) Student Statements: Agency shall require each program participant to sign a Statement of Responsibility

b) Dress Code: Agency shall require the students assigned to worksites to dress in accordance the standards with the dress and personal appearance standards approved by Agency. Such standards shall be in accordance with the Human Resource policies of the DISTRICT.

c) Performance of service :. All faculty provided by the Agency shall be duly certified or otherwise qualified to participate in the Program. Neither the Agency nor any Program Participant shall interfere with or adversely affect the operation of the DISTRICT.

d) Training. Prior to a student's first assignment Student's shall participate in a DISTRICT lead orientation regarding worksite safety and OSHA requirements. This should be conducted by a representative of the DISTRICT.

HOLD HARMLESS CLAUSE

DISTRICT and Agency agree to defend, indemnify and hold harmless the other party, its board officers , agents, and employees, individually and collectively, from and against all claims, liabilities, obligations and cause of action of whatever kind arising in any manner whatsoever out of or in connection with this Agreement for the acts or omissions of its officers, agents and employees.

CANCELLATION POLICY

In case of rescheduling or cancellation of scheduled programs or workshops, Agency will notify DISTRICT as soon as possible. If cancellation of scheduled service delivery is 14 days or more from start date of service, no penalties will be applied. If cancella tion of scheduled service is less than 14 days but more than 7 days, the 50% of fees agreed upon for said assignment will be invoiced. If cancellation is received with fewer than 7 days notice, 100% of fees agreed upon for said assignment will be invoiced.

GENERAL CONTRACT TERMS AND CONDITIONS

1. Training will be conducted at the DISTRICT's Public Safety Academy

2. It is expressly understood and agreed that no personal liability whatsoever attaches to any member of the Board of the College of the Desert/Desert Community College DISTRICT, or any of the officers or employees thereof by virtue of this agreement.

3. Agency cannot directly hire DISTRICT subject matter experts (SMEs) contracted for this assignment for two years from instructor start date. All additional training contracts for DISTRICT SMEs contracted for this assignment must be contracted through the DISTRICT's Partnership and Community Education Center.

4. Agency can request a new SME if the SME does not meet standards and specifications.

5. The copyright to all materials produced as a result of this agreement shall belong to the DISTRICT.

b) The Agency may reproduce the materials but cannot sell the materials.

CONFIDENTIALITY

DISTRICT and its SMEs understand that in the performance of this contract , all information which may be considered proprietary or confidential will not be discussed with a third party. Any press release on the program that does not include proprietary infonmation must be approved by both parties.

COMPLIANCE WITH LAWS AND REGULATIONS

DISTRICT at its own expense shall comply with all laws, rules and regulations of competent public authority relating to its duties, obligations and perfonmances under this contract and shall procure all licenses, and pay all fees and other charges thereby required. DISTRICT shall comply with Executive Order 11246, relating to Equal Employment Opportunity, and all rules and regulations issued pursuant thereto .

Subject Matter Expert agrees not to discriminate in the selection of any studenVparticipant to receive instruction or consultation or otherwise impermissibly discriminate against a studenVparticipant on account of sex, ancestry, age, marital status , race, religious creed , mental disability, medical condition (including HIV and AIDS), color, national origin, physical disability, family or sexual preference status and other similar factors in compliance with Title IX, Sections 503 and 504 of the Rehabilitation Act. In the event of Subject Matter Expert noncompliance with this section, this agreement may be canceled , terminated or suspended, in whole or in part, by the DISTRICT.
