"No" on SB 131: Archbishop Gomez is asking all Catholics to contact their Assembly members and Senators and urge them to vote “No” on Senate Bill 131. Simply tell your elected officials to vote “No” because this legislation fails to protect all victims of child-hood sexual abuse, discriminates against Catholic schools and other private employers, and puts the social services and educational work of the Church at risk. The Bishops of the California Catholic Conference believe it is urgent for all Catho-lics to act now. The facts about SB131: 1. Senate Bill 131, now before the California Legislature, would suspend for one year a deadline (called a “statute of limitations”) to

give childhood sexual abuse victims the chance to sue their abusers’ employers for damages resulting from their abuse. 2. SB-131 is not good legislation because it does not protect all children. In fact, the bill only allows lawsuits to be filed by children

who were abused in religious and other private schools and organizations such as the YMCA or Little League. Children who were abused by public school teachers or other public employees are specifically not protectedby SB 131. That means this legislation offers no protection for the 92 percent of California’s children who attend public schools or for children in foster care or in other public settings.

3. SB-131 unfairly targets only Catholic-run and other private institutions because it only allows lawsuits against private schools and organizations and specifically exempts public schools and other public institutions. The sexual abuse of children is a social reali-ty. It is not limited to private institutions. Any legislation that seeks to deal with this grave problem should be applied to protect victims in all institutions in society — public and private— equally.

4. SB-131 does nothing to increase penalties against the actual abusers of children. The bill allows for monetary damages to be imposed on private employers. But it does not impose any civil or criminal penalties on the perpetrator.

These young people are from every continent, they speak many languages, they bring with them different cultures, and yet they also find in Christ the answer to their highest aspirations, held in common, and they can satisfy the hunger for a pure truth and an authentic love which binds them together in spite of differences. Christ offers them space, knowing that there is no force more powerful than the one released from the hearts of young people when they have been conquered by the experience of friendship with him. Christ has confidence in young people and entrusts them with the very future of his mission, “Go and make disciples”. Go beyond the confines of what is humanly possible and create a world of brothers and sisters! And young people have confidence in Christ: they are not afraid to risk for him the only life they have, because they know they will not be disappointed. Here it is common for parents to say, “Our children are the apple of our eyes”. How beautiful is this expres-sion of Brazilian wisdom, which applies to young people an image drawn from our eyes, which are the win-dow through which light enters into us, granting us the miracle of sight! What would become of us if we did-n’t look after our eyes? How could we move forward? I hope that, during this week, each one of us will ask ourselves this thought-provoking question. Young people are the window through which the future enters the world, thus presenting us with great chal-lenges. Our generation will show that it can realize the promise found in each young person when we know how to give them space; how to create the material and spiritual conditions for their full development; how to give them a solid basis on which to build their lives; how to guarantee their safety and their education to be everything they can be; how to pass on to them lasting values that make life worth living; how to give them a transcendent horizon for their thirst for authentic happiness and their creativity for the good; how to give them the legacy of a world worthy of human life; and how to awaken in them their greatest potential as builders of their own destiny, sharing responsibility for the future of everyone.”

"No" a la propuesta de ley SB-131: El Arzobispo Gómez está pidiendo a todos los católicos que contacten a sus respectivos miembros de la Asamblea y senadores del Estado de California para urgirlos a que voten "NO" a la propuesta de ley del Senado 131 (SB-131). Simplemente dígales a sus re-presentantes populares que voten "NO", porque la legislación no cumple con el deber de proteger a todas las víctimas de abuso se-xual; discrimina contra las escuelas católicas y otros empleadores privados; y pone en riesgo la labor de los servicios sociales y edu-cativos de la Iglesia. Los obispos de la Conferencia Católica de California consideran que es urgente que todos los católicos actúen ahora. Hechos sobre la SB-131: 1. La propuesta de ley 131, que se encuentra ahora en la Legislatura de California, suspendería por un año un límite llamado "ley

de prescripción civil", con el objetivo de dar a las víctimas de abuso sexual infantil la oportunidad de entablar una demanda con-tra los empleadores de los que perpetraron el abuso, por los daños ocasionados..

2. La propuesta de ley 131 no es una buena propuesta legislativa ya que no protege a todos los niños. De hecho, la propuesta de ley sólo permite que las demandas sean presentadas únicamente por las víctimas que fueron abusadas en escuelas privadas y otras organizaciones como la "YMCA" o "Little League". Sin embargo, los niños que fueron abusados por maestros en escuelas públicas, o por otros empleados públicos concretamente, no estarán amparados por la propuesta SB-131. Eso significa que esta legislación no ofrece protección al 92% de los niños de California que acuden a escuelas públicas o a niños que viven en casas de cuidado infantil, o en otras instituciones públicas.

3. La propuesta de ley SB-131 se dirige únicamente a las instituciones católicas y a otras instituciones privadas, pues únicamente permite que se entablen demandas contra las escuelas y organizaciones privadas, pero exime específicamente a las escuelas públicas y otras instituciones públicas. El abuso sexual de menores es una realidad social que no se limita a las instituciones privadas. Cualquier propuesta legislativa que busque enfrentar este grave problema, debe aplicarse de tal forma que proteja a las víctimas en todas las instituciones de la sociedad, públicas y privadas por igual.

4. La propuesta de ley SB-131 no solamente no hace nada por incrementar las sanciones contra los que realmente cometieron el abuso, sino que permite imponer a los empleadores privados indemnizaciones por daños y perjuicios, sin imponer ninguna san-ción civil o penal contra los que perpetraron el abuso.
