That sigh of relief you hear in the wind is coming from me! The California State Legislature just broke for their month-long summer recess! Besides making the streets of Sacramento safe to walk through once again, this will be a time for me to catch up, re-group and get ready for the final month-long onslaught that will occur upon their return in mid-August. Oh, and there certainly will be "Phil time" over the next month when I can morph into my true character, "Delta Phil!"

I should also mention that the last month between mid-August to mid-September is when "gut and amends" of bills happens with regularity and authors and sponsors of all of the surviving "bad bills" will "pull out their bag of tricks" to help get their legislation to the governor. So too, most of the bills that make it to the governor will then have another month to linger on his desk awaiting his final decision.

This will become another of my annual rituals when I will be "pulling out all the stops" to either convince the governor to sign or veto legislation.

Kalb's Q&A for Contractors By David Kalb President of Capitol Services, Inc. Updated Exams, Nevada & C-10

It’s nice to know people benefit regularly from our back and forth. Helping contractors overcome challenges is one of the primary goals of this Q&A. Readers also know where to find answers they need when questions come up. This contractor’s first inquiry may provide significant help to others looking to increase the reach of their business. Another contractor helps illustrate that what works in California isn’t always applicable over the state border…

Q: This is the first time I have contacted you with a question, although I’ve been reading your column for years and even have your book.

I’ve been an “A” contractor for over 30 years and would like to get the “C-10” (Electrical) license. I’ve talked to a few “schools” and all they want to do is sell me a study course. I know I’ve read about getting a waiver of the exam and want to know if you think this would be possible?

A: You could apply for an additional classification and take the trade exam or you can apply for a waiver under Code Section 7065.3. You should be in a good position to secure a “C-10” exam waiver if in the course of your general en-gineering projects, you’ve performed electrical work such as placing underground electrical wiring, erecting transmis-sion lines, installing signals or connecting electrical wires, fixtures, apparatus, etc. A portion of 7065.3(c) allows for a waiver if the qualifying individual is associated with a licensed General Engineering (“A”) or General Building (“B”) contractor and is applying for a classification that is a “significant component of the licensed contractors construction business as determined by the Registrar”.

It is my understanding that the registrar has determined that the “C-10” is “a significant component” of the “A” class. There are over a dozen other classifications that fall within the “significant” category including the ‘C-34” (pipeline), “C-8” (concrete), ‘and “C-51” (structural steel) classifications.

If you have further questions regarding the CSLB requirements to apply for this “C-10” or which classifications may be subject to a waiver, please call me toll free at 866-443-0657. Keep in mind that although the Registrar has made this determination, the CSLB is under no obligation to approve a waiver request (i.e. you could still end up being re-quired to sit for the trade test).

Q: I have had the “A” license for many years in CA and NV. Can I waive the Electrical exam in NV if I want to add that classification?

A: Unlike CA, Nevada will not allow a waiver of the electrical classification under any circumstances. However, my understanding is that the NV Contractors Board may consider a waiver of the following trade tests if you already hold the General Engineering classification: Concrete, Landscape, Steel Reinforcing and Erection, Masonry, Fencing & Equipping Playgrounds, Individual Sewerage, Fabricating Tanks, and Installing Industrial Machinery. As with CA, this determination is on a case-by-case basis and dependent on various factors including years of experience and project background.

FYI: A joint CSLB and Nevada Contractors Board sting netted 13 unlicensed contractors in Truckee recently. $86,000 in bids were made by these criminals who were crossing state lines in the mistaken belief they wouldn’t get caught taking work away from those operating legally.

The CSLB regularly updates their exams and tries to address each classification at least once every 5 years. They’re presently in the process of updating the “C-4” (boilers), “C-16” (fire sprinklers), “C-21” (building moving and demo-lition) and “C-47” (manufactured housing) trades. The Board is seeking contractor participation and will be mailing letters to all licensed contractors in these four classifications. SAFETY TOPIC: BACKHOE & CRANE SWING RADIUS To prevent the backhoe or crane from striking or crushing employees, always barricade areas within the “swing radius” of the rear of the crane’s rotating superstructure.

This barrier can consist of orange reflective traffic cones or barrels which marks and warns both the crew members and the uninformed public of the dangers of these machines.

Each operator is responsible for the placement of the swing radius barriers when the machine is being operated. These markers are to be kept with the machine when not in operation and are to be placed by the operator when making the walk around safety check, prior to operation.

All employees are to be instructed in the purpose of the barriers and no work is to be conducted inside the barriers when the machine is in operation. If repairs to the machine or maintenance is required, the machine should not be in operation. If work is necessary adjacent to the machine, the operator should stop and assist in the work.

Equipment operators can work to prevent accidents. Each operator should develop a habit of walking around their equipment before operation. Check the equipment itself and the area where you will be operating the equipment. Are there any obstacles such as depressions or poles that might effect how you operate your machine…are the barricades sufficient and still in place.

Esta barrera, puede consistir de conos anaranjados de tráfico reflectivos o barriles que marcan y advierten a los miembros del equipo y al público no informado de los peligros de estas máquinas.

Cada operador es responsable por la colocación de las barreras de radio de oscilación cuando se opera la máquina. Estos marcadores deben de guardar se con la máquina cuando no está en operación y deben de ponerse, por el operador, cuando se hace la revición de seguridad de la máquina, antes de operarla.

Todos los empleados deben ser informados del propósito de las barreras y nada de trabajo se debe de hacer dentro de las barreras cuando la máquina está en funcionamiento. Si se requieren reparaciones a la máquina o se requiere mantenimien-to, la máquina no debe estar en funcionamiento. Si se necesita trabajo enseguida de la máquina, el operador debe pararla y ayudar en el trabajo.

Los operadores de equipo pueden trabajar para prevenir accidentes. Cada operador debe desarrollar el hábito de caminar alrededor de su equipo antes de operarlo. Revise el equipo mismo y el área donde operará el equipo. ¿Hay cualquier obstáculo tal como depresiones o postes que puede afectar cómo opera su máquina?…las barricadas ¿Son suficientes y en su lugar?

course as defined by the California Stormwater Quality Association (CASQA) for individuals intending to become Qualified SWPPP

Practitioners (QSP), or Qualified SWPPP Developers (QSD).

This 2 and 3 day course is intended for anyone dealing with Stormwater whether or not they intend to take the exam and become a State Certified QSP or QSD. The QSP course is intended for inspectors

and is focused more on the field application of the General Permit, while the QSD course is intended for those wishing to write and

implement SWPPP's and is also a great source of information for those reviewing and certifying SWPPP's.
