Dionis is just 3 miles from Town, and is positioned on the north west side of the Island, on Nantucket Sound. Dionis is highly sought after not only for its proximity to Town, but also because the area remains largely undeveloped, particularly along Eel Point Rd where this home is located.

The Linda Loring Nature Foundation owns about 300 Acres of open land along Eel Point Rd; the Loring property is under permanent conservation easement and will never be developed. Other landowners along Eel Point Rd (some of whom helped to fund the permanent preservation of the Linda Loring land) have also placed their properties in conservation easement; the net effect of the conservation effort has been to significantly reduce the amount of open land in Dionis which might be developed in the future, and to thus significantly increase the value of existing homes in Dionis, particularly along the ocean side of Eel Point Rd, where this home is located.

In addition, Dionis is very highly sought-after for its quiet, uncrowded beaches. There is a public beach with facilities at the end of Dionis Beach Rd; the balance of the beachfront in Dionis is less well-known and less accessible than other beaches on the South side of the island, such as Surfside and South Beach.

Along the beach in Dionis, the beach slope and the surf are very gentle; as a result Dionis does not draw people like the southside beaches, which have greater exposure to weather and accordingly, more larger waves. The gentle surf at Dionis appeals primarily to those who seek a quiet, uncrowded beach day.

Many of the homes along the north side of Eel Point Rd, including this Residence, have immediate access to the beach by foot, and also have drive-on access at several points along the westernmost (unpaved) portion of Eel Point Rd (a beach permit and four wheel-drive are

required to drive onto the beaches).

A unique benefit of the location of this Residence (and one not to be overlooked), is being at the end of the paved section of Eel Point Road … just past this property, Eel Point Rd is unpaved. Erosion which occurs naturally during the year gives the unpaved section of Eel Point Rd a rutted washboard surface, and travelling any distance (ie to reach homes which are further west along the road), can sometimes be quite a jarring ride.

Because Dionis is positioned along the northwestern coastline of Nantucket, the unobstructed views of sunsets each day are absolutely spectacular, with colors so vivid and beautiful that they draw watchers and photographers all summer. Views of Nantucket Sound from the homes along the north side of Eel Point Rd are similarly sweeping, unobstructed, and absolutely beautiful. And seeing the night sky over the island, filled with stars and shooting stars, is something you’ll remember forever.

In terms of its proximity to other points on-island, Dionis is located within about 10 minutes of Nantucket Cottage Hospital, within about 5 minutes of a 24/7 veterinary facility, and within about 5 minutes of both the 40-acre dog park at Tupancy Links, the Westmoor Club, and the network of hiking trails which traverse the Sanford Farms conservation property.

The charming village and the beaches of Madaket (and the marina at Madaket Marine) are within about a 10-minute drive. It is about a 15 minute drive to Bartlett’s Island Farm Market and the Cisco Brewery. The Stop n Shop grocery market -- an island institution -- is about a 10-minute drive. Nantucket Memorial Airport is about a 15-minute drive.

Perhaps the furthest points from Dionis are the lovely historic village of Sconset (with its beautiful rose-covered homes and tree-lined streets) and the Great Point Lighthouse, both to the east of Dionis at the opposite end of the Island, and about a 20-minute drive and a 45 minute-drive respectively.

B E A C H A C C E S S A beach path extends from the back lawn, through the balance of the western part of the Property, to Alliance Lane (as previously noted, a “paper street” which has been acquired from the Town via the ‘Yard Sale’ program ; each of four Alliance Ln Yard Sale parcels has been acquired by each of the four abutting owners).

A condition established by the Town for transfer of these parcels to private ownership is that each of the four deeds is subject to an 8’ wide pedestrian easement which assures that a ‘beach path’ will exist in perpetuity all the way from Eel Point Rd to the bluff, thereby providing perpetual by- right access for the owners of 55 Eel Point Rd to walk to the beach across land which is now owned by 57 Eel Point Rd.

From the back door of 55 Eel Point, the walk to the beach stairs is less than 2 minutes!

Construction of the beach stairs was approved by Massachusetts DEP and the Town of Nantucket (DEQE File SE48-989). The stairs are currently maintained by the owners of 55 Eel Point for private use (the beach stairs are not owned or maintained by the Town).

The beach stairs themselves are constructed of a modular heavy- grade aluminum frame, brackets, treads, and handrails, and thus the stairs do not require any painting. The support trestles and landing at the top of the bluff are constructed of pressure treated CCA lumber ; the lumber does not need painting either, but the wooden trestles and the wooden landing may need to be re-set in spring, depending on the extent of any erosion over the winter.

The new owners of 55 Eel Point are under no obligation to continue to maintain the beach stairs. The current owners have always felt it is beneficial to do so, given the convenience and the enjoyment of being able to walk to the beach right from the backyard!

Even better, the beach in this location is always extremely peaceful, quiet, and uncrowded -- even at the height of the summer season in August, you’ll usually see only a handful of people – it’s almost like having your own private beach!

H D C P O O L P L A N A plan to construct a heated pool (with spa ; outdoor kitchen & dining area, pool terrace and firepit was approved by the HDC on January 29, 2015, (HDC Plan Approval # 63-107), and this approval is valid for 5 years. TYPES OF AGENCY REPRESENTATION

SELLER’S AGENT

A seller can engage the services of a real estate agent to sell his property (called the listing agent) and the real estate agent is then the agent for the seller who becomes the agent’s client. This means that the real estate agent represents the seller. The agent owes the seller undivided loyalty, reasonable care, disclosure, obedience to lawful instruction, confidentiality and accountability, provided, however that the agent must disclose known material defects in the real estate. The agent must put the seller’s interests first and negotiate for the best price and terms for their client, the seller. (The seller may authorize sub-agents to represent him/her in marketing its property to buyers, however the seller should be aware that wrongful action by the real estate or sub-agents may subject the seller to legal liability for those wrongful actions).

BUYER’S AGENT

A buyer can engage the services of a real estate agent to purchase property and the real estate agent is then the agent for the buyer who becomes the agent’s client. This means that the real estate agent represents the buyer. The agent owes the buyer undivided loyalty, reasonable care, disclosure, obedience to lawful instruction, confidentiality and accountability, provided, however, that the agent must disclose known material defects in the real estate. The agent must put the buyer’s interests first and negotiate for the best price and terms for their client, the buyer. (NON-AGENT) FACILITATOR

When a real estate agent works as a facilitator that agent assists the seller and buyer in reaching an agreement but does not represent either the seller or the buyer in the transaction. The facilitator and the broker with whom the facilitator is affiliated owe the seller and buyer a duty to present each property honestly and accurately by disclosing known material defects about the property and owe a duty to account for funds. Unless otherwise agreed, the facilitator has no duty to keep information received from a seller or buyer confidential. The role of a facilitator applies only to the seller and buyer in the particular property transaction involving the seller and buyer. Should the seller and buyer expressly agree a facilitator relationship can be changed to become an exclusive agency relationship with either the seller or the buyer.

DESIGNATED SELLER’S AND BUYER’S AGENT

A real estate agent can be designated by another real estate agent (the appointing or designating agent) to represent either the buyer or seller, provided the buyer or seller expressly agrees to such designation. The real estate agent once so designated is then the agent for either the buyer or seller who becomes their client. The designated agent owes the buyer or seller undivided loyalty, reasonable care, disclosure, obedience to lawful instruction, confidentiality and accountability, provided, however, that the agent must disclose known material defects in the real estate. The agent must put their client’s interests first and negotiate for the best price and terms for the client. In situations where the appointing agent designates another agent to represent the seller and an agent to represent the buyer then the appointing agent becomes a dual agent. Consequently a dual agent cannot satisfy fully the duties of loyalty, full disclosure, obedience to lawful instructions which is required of an exclusive seller or buyer agent. The dual agent does not represent either the buyer or the seller solely only your designated agent represents your interests. The written consent for designated agency must contain the information provided for in the regulations of the Massachusetts Board of Registration of Real Estate Brokers and Salespeople (Board). DUAL AGENT
