    The Board vide resolution No. BOG-38(2014)-10(1), dt.17.01.2014 decided to extend the probation period of above faculty members up to December, 2014. Director was advised to guide faculty members to bring Sponsored & Research Projects in their respective fields in addition to teaching within two years of probation period. The Board further directed that the probation period should not be extended by more than one year. The Board vide resolution BOG-43(2014)-10: dt.22.11.14 directed that

    'decision may be taken by assessment committee approved by Director and its recommendation be put up to BOG meeting before 31.12.2014. Further it was decided that a policy on confirmation of faculty and officers, other employees of the institute may be framed by the institute.

    The recommendation of the Director was put up on the table. Some names were omitted inadvertently, a consolidated revised list was presented as given in the annexure. After deliberation, the Board decided the following."

    The BOG approved the recommendation of the Director for confirmation of 15 faculty members as given in the Annexure.

    1. The BOG directed that a suitable committee be formed to look in to the overall performance of the 27 faculty members under the broad heads of (1) Teaching (2) Research including sponsored projects and (3) Departmental responsibilities as given in the annexure. The BOG approved the extension of probation period of 27 faculty members until further order. BOG will take a decision after receiving the recommendation of the committee.

    The BOG further decided that the new faculty members will be mentored and guided by Sr. Professors for research and sponsored projects. A faculty book will be prepared which will be a guideline for faculty members for duties and responsibilities, criteria for confirmation etc. The administration was advised to present a policy on confirmation of employees after probation period.

    2. On the recommendation of Director considering the teaching, academic and research record of Prof M. Nurul Islam, of EC Dept., the Board decided to form an appropriate Committee representing experts, minority community and women to look into the various allegations against him. A show cause notice will be issued to Prof Islam immediately. The Board decided to extend the probation period of Prof M. Nurul Islam, EC until further order. A suitable decision will be taken after receiving the report.

    Confirmation of Officers.

    The Board may consider the confirmation of the Officers as given in the Annexure.

    The Board vide resolution BOG-43(2014)-10; dt.22.11.14 directed that reason for not confirming any Officers will be recorded in the recommendation and recommendation will be put up to BOG in the next meeting. The report was put up on the table as given in the Annexure.

    1) The Board confirmed the probation of 09 Officers as given in the Annexure.

    2) Confirmation of Mr. D. Behera, Engineer (Electrical Maintenance):

    Refer item No. BOG-44(2014) 11(5).'

    3) Confirmation of Dr. A. Debta, Medical Officer: There are allegations against Dr. A. Debta regarding dereliction of

    . duties as Medical Officer for which the students, faculty and staff members are suffering. The Board directed the administration to enquire in to the above allegations by an appropriate committee as

  • mentioned vide resolution No BOG-44(2014)-05 (point no. 3). Show cause notice will be issued to Dr. A. Debta immediately. It was decided to extend the probation period of Dr. A. Oebta until further order. A suitable decision will be taken after receiving the report.

    BOG-44(2014)-07: Disciplinary proceeding against Prof. U. K. Mohanty, Professor, MM Dept.

    The Board vide resolution No. BOG-32{2012}-03 dt. 18.12.2012 directed to proceed with disciplinary proceeding against Prof. U.K. Mohanty, MM Department and Prof. S.K. Agarwal, CH Dept. Accordingly Mr. J. M. Das, Retired District Judge was appointed as enquiry officer. Charges against Prof. U.K. Mohanty and Prof. S.K. Agarwal were confirmed by the enquiry officer and they were found guilty. Prof. U. K. Mohanty, MM Department and Prof. SX. Agarwal, CH Dept. were communicated accordingly along with the enquiry officer report vide letter NO.NITR/RG/L/679 & 680, dt.26.11.2014. The report of the enquiry officer is enclosed in the Annexure. -

    The reply received from Prof u.K. Mohanty and Prof S.K. Agarwal were put up on the table. Since in the reply given by Prof. U. K. Mohanty, there was no specific information sought, the request to supply with the left out . papers was set aside by the Board. The Board directed that the enquiry committee report to be sent to evo/ Registrar of the Institute for comments. After receiving the comments, the same will be put up to the Board.

    BOG-44(2014}-08: Approval of Policy on New Purchase Procedure.

    The purchase procedure was approved by the Board vide resolution No. BOG-J O(2006)-13( d) dt. I 6.06.2006. The procedure has been modified keeping in view of the requirements and change in policy of the Institute.

    The item was deferred.

    BOG-44(2014)-09: Approval of medical policy.

    The Medical Policy was approved by the Board vide resolution No. BOG-23(2010)-14 dt.09.07.20 1 O. The procedure has been modified keeping in view of the requirements and change in policy of the Institute.

    The item was deferred.

    E. MISCELLANEOUS ITEMS:

    BOG-44(2014H 1: Any other item with the permission of the Chair.

    1) Proposal for Honorarium for the Secretarial service at Chairman, BOG Office & an imperest account.

    For regular secretarial service and other miscellaneous work at Chairman, BOG Office, It is proposed that an honorarium of RS.1 0,0001- per month towards secretarial service in the Office of the Chairman and in addition to other sundry expenses such as stationery, computer consumables, postage etc. an imperest money of RS.10,0001- be maintained at Chairman, BOG Office to meet the daily expenses.

    The Board approved the proposal.

    2) CCS (LTC) Rules, 1988 - Relaxation to travel by Air to visit North Eastern Region (NER), Jammu & Kashmir(J&K), and Andaman & Nicobar ISland(A&N).

    In pursuance to the O.M. issued by the Ministry of Personnel, Public Grievances and Pensioners, Dept. of Personnel and Training, Govt. of India vide no. 31011/3/2014-Estt.(A-IVO dated 26.09.2014 and No. 31011/7/2014-Estt.(A-IV) dated 28.11.2014, relaxation to CCS(L TC) Rules, 1988 for a period of two years i.e. 26.09.2014 to 25.09.2016 has been given to visit to NER, J&K, and A& N Island by Air India Economy Class only and at L TC-80 fare or less and for a period of One year special relaxation (w;e.f. 28.11.2014 to 27.11.2015) to travel J & K by private airlines.

    As per the guidelines issued by the Ministry vide above O.M., Air tickets for traveling to the above places to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. "MIs Balmer Lawrie & Company", MIs Ashok Travels & Tours" and "(RCTC" (to the extent IRCTC is authorized as per DoPT's O.M. No. 31011/6/2002-Estt.{A) dated 02.12.2009) while undertaking LTC journey. Booking. of tickets through other agencies is not permitted.

    Since, there is no such authorized Travel Agents are operating in our locality, our Institute employees may be permitted to procure their LTC Air tickets for travelling to the above places from the registered local Travel Agents.

    The Board directed the administration to refer the proposal to MHRD.

  • 4) Review of the Financial Status of the Institute.

    The Financial Status of the Institute was given in the Annexure. The representation made by Mis Shapoorji Pallonji and Company Private Ltd was enclosed

    The Board reviewed the financial status of the Instittlte, and letter of M/s Shapoorji Pallonji Company (P) ltd. who is working on major projects. It was reported that Rs. 160 crores will be reqUired in the current financial year as given below:

    /t was informed that a copy of the letter has already sent to MHRD for necessary action. The Institute has taken loan of RS.21.90 Crore from Slate Bank of India al the beginning of the first quarter of the current fiscal to redeem its immediate obligations at that point of time. Due to shortage of fund, the Institute is not a· position to repay the loan. As a result of that, the interest liability till date is around RS.1.14 Crore. As per the contract the on going major projects being executed by Estimated payment to M/s Sapoorji Pa/onjee & Co. will be completed in 2015. In the event of failure to clear the bill by the Institute, the project may not be completed in time and there may be escalation of project cost, it may. also cause legal complications for violating terms and conditions of the contracl.     5) Disciplinary proceeding against Sri Debendranath Sehera, Engineer (Electrical), Estate Maintenance against financial irregularity.

    The Fact Finding Committee's report and its recommendation for initiation for disciplinary proceeding against Sri n Behera is given in the Annexure. It also states that every one accepts Sri ON Behera have admitted that approximately 10% less diesel was being filled at the filling station under the instruction of Sri D. N. Behera himself The entire monetary benefit thereof was paid to Sri D. N. Behera directly by the owner of the Filling Station. The committee fixed the responsibility on Sri ON. Behera.

    The Board accepted the report of the Fact Finding Committee involving financial irregularities. In view of the serious misappropriation of the Institute funds to the tune of RS.10 lakhs approximately, the Board decided to discharge Sri 0. Behera from Institute service with immediate effect for his dishonesty and lack of integrity. Further the Board directed the administration that an FIR be lodged in the Police Station for misappropriation of funds by Sri Behera. The Board also decided to lodge FIR against Mis Gram Filling Station, Jhirpani for complicity and terminate the contract with immediate effect. The Board directed Director to take appropriate action against other members who are found guilty by the committee as per rule

    Sub: Relation between NITA and NITAAA: A new and superior paradigm.

    Dear Mr. Mohanty,

    Around the globe, Alumni constitute one of the main element of an institution of higher learning; our institute is no exception. NIT Rourkela has a truly vibrant alumni fraternity and its bond with the institute is strong.

    NlTAAA has been the most effective organization among the independent professional societies. It is an integral' part of the institute. But like any other part of the whole body it takes care of a portion of the total business, Le. to make the life of our alumnus more meaningful. Other aspects of alumni relations, particularly large grants to the institute by successful alumni and stronger link between alumni and students in fields of research, entrepreneurships, and cultural activities need to be developed; they often need a slightly different set up. .

    The BOG, in its recent meeting, considered your letter addressed to Hon'ble Chairman, and seriously considered your observation that NITRAA has possibly been "derecognised" by the institute administration. Sir, I Sincerely apologise if any such impression has been created among some alumni. The reality is exactly opposite. NIT Rourkela administration will be really happy and benefitted, if our original proposal to make NITRAA the official interface of the administration is accepted by the NITRAA management. The proposal did not appeal to the NITRAA Secretariate; but nothing has been lost. We have adopted the so called liT -Kanpur model that is just as good.

  • Both would promote the growth of both, in their respective domains. Apparently two organisations, but serving the same purpose of alumni giving a helping hand to their younger siblings and to the unfortunate members of their own community, if any.

    NITRAA is doing an excellent job of bringing all alumni together, particularly organising successful members to help some distressed sibling. The AD..Net's focus, on the other hand, is to bring the existing students and faculty closer to the alumni and to link them together, to promote and manager alumni contributions for academic growth of the students. As our official body, ALNet will have greater access to institutional data (Nothing is hidden from NITRAA or any other organisation), and greater confidence in attracting alumni contributions.

    Sir, It is my honour to assure you that:

    a) There is simply no question of "de-recognition" of NITRAA or Yahoo group or any other independent alumni society,

    b) All alumni organisations will be proudly displayed on institute website and every visitor of the website of AQ.Net-NITR will be advised to take active part in working of NITRAA.

    c) The main functionaries of AlNet are senior alur:nni, very successful in their professional lives, who are also active members of NITRAA.

    d) NITRAA AQ.Net will share 100% of its resources with NITRAA at no cost.

    I am confident that good things will emerge for this arrangement and you will be happy that we .have adopted this model. NIT Rourkela shall be a path breaker for other NITs to follow.

    You will be happy to know that we have already filled up the top echelons of the AQ,Net. Sri. San dip Das Verma and his team has started working. We are lookjng forward to receiving

    Brief Report on the activities of the Institute since last BOG meeting held on 22.11.2014

    1) The School of Management Department, NIT Rourkela organized the International

    Conference on "Business Paradigms in Emerging Markets" during 12th - 13th

    December, 2014. Prof. Richarged Lynch Middlesex, University of London was the Chief

    Guest. Prof. R. Panda was the Programme Coordinator.

    2) 4th National Conference on Processing and Characterization of Materials [NCPCM-2014]

    was organized by the Department of Metallurgical and Materials Engineering during 5th -

    6th December, 2014. Prof. Yedla was the convener of the programme. was the

    Programme Coordinator

    3) Innovation in Science Pursuit for Inspired Research Winter Science Camp for School

    Students was organized by the Department of Chemistry during Nov. 30th - 5th Dec.

    2014. Prof. V. Sivakumar, was the Programme Coordinator. Shri G. S. Prasad, CEO,

    RSP Rourkela was the Chief Guest.

    4. Our New Chairman, BOG Dr. Vasantha Ramaswamy, Founder Director, Aprameya

    Associates, Pune visited our Institute during 2-4th December, 2014. She visited the

    Institute campus, interacted with Dean's & HOD's Faculty and Staff members,

    Research students and delivered talk to the Inspire Science Camp Students.

    5. One day seminar was organized on 11 th December, 2014 on "International and Global

    Expansion Strategy: what can we learn from McDonalds Restaurants and Tata Motors?

    ", by Dept. of Mechanical Engineering. Prof. Richard Lynch Emeritus Professor, .

    Middlesex University, UK was the speaker of the Programme. Prof. D. R. K. Parhi,

    Professor,- ME was\1ie programme coordinator.

    6. One day seminar was organized on 1st December, 2014 on "Recent Developments in

    Materials ", by Dept. of Mechanical Engineering. Dr. R. P. Tandon Professor and

  • Dr. (Mrs.) Anadita Debta's record as a physician is average. But she is a very reluctant

    worker. Staying home (with 25% non-practising allowance) to address to occasional

    emergencies is "house arrest" for her. I have personally received numerous oral complaints

    of her reluctance to see serious patients outside designated dispensary hours. She herself

    routinely complains against "house arrest", although on days of emergency medical

    responsibilities it is perfectly possible· for a physician- to move out of the c;;ampus with

    cooperation of doctor colleagues.

    If she is continned, it is ·our considered opinion that someday a serious mishap will happen

    because of her callous and reluctant attitude. We recommend to the institute that her service

    be terminated while she is on probation.

    In bath cases, in view of the impending new semester. the officers may be given one

    month's pay and allowed to leave the institute with immediate effect.

    . . PROBATION AND CONFIRMATION

    A person is appointed on probation in order to assess his suitability for absorption in the service to which he has been appointed. Probation should not, therefore, be treated as a mere formality. No formal declaratIon shall be necessary in respect of appointment on probation. The appoInting authority may declare successful completlon, extend the period of probation or terminate the servIces of a temporary employee on probation, on the basis of evaluation of performance.

    2. Probation is prescribed when there is direct recruitment, promotion from one Group to another or for officers re-employed before the age of superannuation. The probation shall stand successfully. completed on issue of orders in writing. It is, however, not desirable that a Government servant should be kept on probation for long periods.

    PERIOD OF PROBATlQt:l

    3. The period of probation is prescribed for different posts/services in Central Govemment on the following lines:

  • (A) DIRECT RECRUITMENT

    If a Government servant is appointed to another post by direct recruitment either in the same department or a different department, it may be necessary to consider him for confirmation in the new post in which he has been appointed by direct recruitment irrespective of the fact that the officer was holding the earlier post on a substantive basis. Further confirmation. in the new entry grade becomes necessary because the new post may not be in the same line or discipline as the old post in which he has been confirmed and the fact that he was considered suitable for continuance in the old post (which was the basis for his confirmation in that post) would not automatically make him sUitable for continuance or confirmation In the new post the Job requirements of which may be quite different from those of the old post.

    (B) PROMOTION

    (0 Persons who are inducted into a new service through promotion shall also be placed on probation but there shall be no probation on promotion from one grade to another but within the same group of posts, except when the promotion involves a change in the Group of posts In the same service, e.g., promotion from Group 'B' to Group 'A' in which case the probation would. be for the prescribed period.

    (ii) If the recruitment rules do not prescribe any probation, an officer appointed on regular basis (after following the prescribed DPC procedure, etc.) will have all the benefits that a person confirmed in that grade would have.

    PROGRESS DURING PROBATION

    4. Instead of treating probation as a formality. the existing powers to discharge probationers should be systematically and vIgorously used so that the necessity of dispensing with the services of employees at later stages may arise only rarely. ..

    5. Concentration of attention on the probationer's ability to pass the probationary or the departmental examination! jf applicable, should be an essential part of the qualification for confirmation but there should be a very careful assessment of the outlook, character and aptitude for the kind of work that has to be done in the service before a probationer is confirmed.

  • 6. A probationer should be given an opportunity to work under more than one officer during this period and reports of his work obtained from each one of those officers. The probation reports for the whole period may then be considered by a Board of senior officials for determining whether the probationer concerned is fit to be confirmed in service. FQr this purpose, separat~ forms of report on the probationers should be used. which are distinct from the usual Annual Performance Appraisal Report (APAR) forms. The probation reports, unlike APAR, are written to help the supervising officer to concentrate em the special needs of probation and to decide whether the work and conduct of the officer during the period of probation or the extended period of probation are satisfactory enough to warrant his further retention in service or post. The probation reports thus do not serve the purpose for which the APARs are written and vice versa. Therefore, in the case of all probationers or officers on probation, separate probation reports should be written In additional to the usual APARs for the period of probation.

    7. Save for exceptional reasons, probation should not be extended for more than a year and in no circumstance an employee should be kept on probation for more than double the normal period.

    8. A probationer, who is not making satisfactory progress, should be informed of his shortcomings well before the expiry of the original probationary period so that he can make special efforts at self-improvement. This can be done by giving him a written warning to the effect that his general performance has not been such as to justify his confirmation and that, unfess he showed substantial improvement within a specified peri,od, the question of discharging him would have to be considered. Even though this is not required by the ruJes, discharge from the service being a severe, final and irrevocable step, the probationer should be given an opportunity before taking the drastic step of discharge.

    9. During the period of probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions and to pass examinations, and tests (Including ,examination In Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation.

    TERMINATION OF PROBATION

    10. The decision whether an employee should be confirmed or his probation extended should be taken soon after the expiry of the initial probationary period, that is within six to eight weeks, and communicated to the employee together with the reasons in case of extension. A probationer who is not making satisfactory progress or who shows himserf to be inadequate ,for the service in any way shourd be informed of his shortcomings well before the expiry of the original probationary period so that he can make special efforts at self-Improvement.

  • 11. On the expiry of the period of probation; steps should be taken to obtain the assessment reports on the probationer to: w

    Confirm the probationer/issue orders regarding satisfactory termination of probation. as the case may be, if the proba~ion has been completed to the satisfaction of the competent' authority; or

    Extend the period of probation or discharge the probationer or terminate the services of the probationer as the case may be, In accordance with the relevant rules and orders, if the probationer has ,ot completed the period of probation satisfactorily.

    12. In order to ensure that delays do not occur in confirmation, timely action must be Initiated In advance so that the time Jrmit is adhered to.

    13. If it appears to the Appointing Authority, at any time. during or at the end of the period of probation that a Government s'ervant has not made sufficient use of his opportunities or is not making satisfactory progress,' the Appointing Authority may revert him to the post held substantively by him immediately preceding his appointment, provided he holds a lien thereon or in other cases may discharge or terminate him from service. -

    14. A Probationer reverted or discharged from service during or at the end of the period of probation -shall not be entitled to any compensation.

    EXTENSION OF PROBATION PERIOD

    15. If during the period of probation, a probationer has not undergone the requisite training course or passed the requisite departmental examinations prescribed (proficiency in Hindi,· etc.). if any, the period of probation may be extended by such period or periods as may be necessary, subject to the condition that the total period of probation does not exceed double the prescribed period of probation. --

    16. The ApPointing Authority may, if it so thinks fit, extend the period of probation of a Government servant by a specified period but the total period of probation does not exceed double the normal period. In such cases, periodic reviews should be done and extension should not be done for a long period at one time.

    17. Where a probationer who has completed the period of probation to the satisfaction of the Central Government is required to be confirmed, he shall be confirmed in the Service! Post at the end of his period of probation, having been completed satisfactorily.

A person appointed to a post .on probation shall be entitled to leave under the rules as a temporary or a permanent Government ,servant according as his appointment is against a temporary or a permanent post. Where such person already holds a fien on a permanent post before such appointment, he shaH be entitled to leave as a permanent Government servant.

    19. The period of joining time availed of by a probationer on return from leave shourd be counted towards the prescrjbed period of probation If but for the leave, he would have continued to officiate in the.post to which he was appointed.

    20. If, for any reason, it is proposed to terminate the'services of a probationer, any leave which may be granted to him shall not extend -

    (I) beyond the date on which the probation period as already sanctioned or extended expires, or

    (i/) beyond any earlier date on which his services are terminated by the orders of an authority competent to appoint him.

    CONFIRMATION

    21. If, during the period of probation or any extension thereof, as the case may be Government is of the opinion that an officer is not fit for permanent appOintment, Government may discharge or revert the officer to the post held by him prior to his appointment in the service, as the case may be.

    22. Confirmation will be .made only once in the service of an officIal Which will be in the entry grade post/service/cadre provided further confirmation shall be necessary when there is tresh entry subsequently in any other post/service/cadre by way of direct recruitment or otherwise. Confirmation is de linked from the avairability of permanent vacancy in the grade. In other words, an officer who has successfully completed the probation, as prescribed under relevant rules, may be considered for confirmation. A specffic order cif confirmation will be issued when the case is cleared from all angles.

The date from which confirmation should be given effect to is the date following the date of satisfactory completion of the prescribed period of probation or the extended period of probation, as the case may be. The decision to confirm the probationer or to extend the period of probation as the case may be should be communIcated to the probationer normally within 6 to 8 weeks. Confirmation of th~ probationer after cgmpletlon of the period of probation Is not aytomatlc but Is to b~ followed by formal orders. As long as no specific- orders of confirmation or satisfactorY completion of probation are issued to a probationer, such a probationer shall be deemed to have continued on probation.

    25. Where probation on promotion is prescribed, the app,0inting authority will on completion of the prescribed period of probation assess the work and conduct of the officer himself and incase the conclusion is that the officer is fit to hold the higher grade, he will pass an order declaring that the pe:rson concerned has successfully completed the probation. If the appointing authority considers that the work of the officer has not been satisfactory or ne~ds to be watched for some more time he may revert him to the post/service/cadre from which he was promoted, or extend the period of probation, as the case may be.

    26. Since there will be no confirmation on promotion before an official is declared to have completed the probation satisfactory, ;1 rigorous screening of his performance should be made and there should be no hesitation to revert a person to the post or grade from which he was promoted if the work of the officer during probation has not been satisfactory.

    27. A Government servant appointed by :transfer would dufy have been confirmed in the earlier post. In such a case further confirmation in the new post would not be -necessary and he could be treated as permanent in the new post. Where, however, a Government servant who has hot afready been confirmed in the old post is appointed by transfer, it would be necessary to confirm him in the new post. In such cases, he may -be considered for confirmation after watching him for two years. -Within that period of two yearsi the officer would earn two reports in the new grade and the OPC may consider his case for confirmation on the basis of these APARs.

    (a) whether onus of confirmation lies with the Central Government employee or the employer/organisation, the

    details of conditions/rules of confirmation may be given;

    (b) whether the post held could be treated as vacant even if the Central Government employee has rendered

    more than 25 years of continuous service and got promotions on the ground that he is not confirmed in service;

    (c) ifnot, the options open for the employee to seek redressal for his grievances; and

    (d) the minimum/maximum period during which an employee has to be confirmed to a post in Central

    Government organisation?

    ANSWER

    Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the

    Prime Minister's Office. (DR. JITENDRA SINGH)

    (a): The onus of confirmation lies with the Organisation concerned. As per the extant instructions on

    satisfactory completion of the period of probation or extension thereof, the Government i.e the

    employer/Organisation may confirm a temporary Government servant from the date of completion of the

    period of probation or extension thereof.

    (b): As per extant instructions, tIle confirmation of a Government Servant is delinked from the availability of

    permanent vacancy in the grade. In other words, an officer who has successfully completed the probation, as

    prescribed under relevant rules, may be considered for confinnation.

  • (c); Under Rule 23 of Cent raJ Civil Services (Classification, Control & Appeal) Rules, 1965, an employee has

    the right to appeal against any Order which denies or varies to his disadvantage his pay, allowances, pension or

    other conditions of service as regulated by rules or by the service agreement.

    (d); As per extant instructions save for exceptional reasons, probation should not be extended for more than a

    year and in no circumstance an employee should be kept on probation for more than double the normal period.

    SUBJECT: Timely confirmation in various Central Civil Services- issue of guidelines.

    The undersigned is directed to say that the Supreme Court in its judgement on 8.7.2010 in

    civil. appeal N9.596 of 2007 (appeal of Khazia Mohameed.Muzammil vIs State of Karnataka & - . -Anr.) examined the contention of automatic/deemed confirmation after the expiry of the

    probation period. After examining the various judgements, the Apex Court were of the

    considered opinion as to what view has to be taken would depend upon the facts of a given

    case and the relevant ruler in force.

    2. In para 22 of the judgement, the Apex Court observed as follows:-

    "Before we part with this file, it is required of this Court to notice and declare that the

    concerned authorities have failed to act expeditiously and in accordance with the spirit of the

    relevant rules. Rule 5(2)of 1977 .Rules has used the expression 'as soon as possible' which

    clearly shows the intent of the rule framers explicitly implying urgency and in any case

    applicability of the concept of reasonable time which would help in minimizing the litigation

    arising from such similar cases. May be, strictly speaking, this may not be true in the case of

    the appellant but generally every step should be taken which would avoid bias or

    arbitrariness in administrative matters. no matter, which is the authority concerned including

    the High Court itself. Long back in the case of Shiv Kumar Sharma vIs Haryana State

    Electricity Board(1988) Supp. SCC 669) this Court had the occasion to notice that due to

    delay in recording satisfactory completion of probation period where juniors were promoted,

    the action of the authority was arbitrary and it resulted in infliction of even double

    punishment. The Court held as under:

  • 'While there is some necessity for appointing a person in government service on probation for

    a particular period, there may not be any need for confirmation of that officer after the

    completion of the probation period. If during the period a government servant is found to be

    unsuitable, his services may be terminated. On the other hand. if he is found to be suitable,

    he would be allowed to continue in service. The archaic rule of confirmation, still in force,

    gives a scope to the executive authorities to act arbitrarily or rna lafide giving rise to

    I unnecessary litigations. It is high time that the Government and other authorities should

    think over the matter and relieve the government servants of becoming victims of arbitrary I

    actions.'

    ..IvVe reiterate this principle with respect and appro\lal and hope that all the authorities

    .x:oncerned should take care that timely actions are taken in comity to the Rules governing

    ~he service and every attempt is made to avoid prejudicial results against the

    r-mployee/probationer. It is expected of the Courts to pass orders which would help in

    .minimizing the litigation arising from such similar cases. Timely action by the authority

    concerned would ensure implementation of rule of fair play on the one hand and serve

    greater ends of justice on the other. It would also boost the element of greater

    'r.Inderstanding and improving the employer employee relationship in all branches of the

    'lItates and its instrumentalities. II

    ~ve already been issued to the effect that confirmation will be made only once in service in

    the entry grade, but for some' exceptions specified therein. Instructions on timely action to

    Jnfirm or extend the probation have also been issued vide O.M. NO.18011/2/98~Estt.(C) ~ted 28.8.1998. Seniority has also been . delinked from confirmation in the ,:)'v1.No.20011/5/90-Estt.(D) dated 4.11.92.

    I. The committee took a comprehensive look for confirmation of faculty members. The details of all faculty members of institute is presented in Annexure-I.

    2. The summary of recommendation! status is as under: a. The institute currently has 275 faculty members. Out of them 171 faculty members have been

    confirmed in their service at NIT Rourkelal REC Rourkela. b. 14 faculty me~bers are recommended for c~)Dfirmation. c. 28 faculty members are on contract (post PhDl pre PhD). Their case is not being considered

    for confirmation. d. 23 faculty members are serving with AGP8000 (under 4Tier recruitment). They have not

    completed Iyear service in their current grade. It is recommended to extend their probation till 30 June 2014, so that comprehensive recommendation can be made for all these faculty members.

    e. 26 faculty members who have completed their probation tenure have not secured a -project from funding agencies. It is requested-to be extended their probation till 31 December 2015 to enable them to secure project from funding agencies.

    £.. 12 faculty members joined in pre-PhD contract under the 3Tier scale. They will be placed under AGP 60001 7000 post PhD contract after completion of PhD since no regular post with AGP 7000 exist currently (in 4tier scale).

    3. It is recommended to terminate the service of one faculty member Dr M Nurul Islam, EC:I111002, Asst Professor (AGP 7000); Department of Electronics and Communication Eng; considering his performance in multiple angles. Detail report on performance of Dr M Nurul Islam is enclosed at Annexure-II.

    Securing Sponsored Projects is one of the essential functions of the faculty members. It is also an indicator of the performance of the faculty before national committees of senior scientists in the field. The faculty members enlisted in above lists are striving to secure sponsored projects and are expected to succeed. Their performance on other fronts is satisfactory.
