CITES - Convention sur le commerce international des espèces de faune et flore sauvagesmenacées d’extinction

La Convention sur le commerce international des espèces de faune et flore sauvages menacéesd’extinction (CITES) fournit un cadre juridique international pour le contrôle et la réglementation ducommerce de certaines espèces de faune et flore sauvages, parties et dérivés inclus. Les 143pays ayant adhéré à ce jour à la Convention sont appelés Parties à la Convention. En outre, 41pays n’ayant pas adhéré à la Convention procèdent néanmoins à des contrôles CITES similaires àceux des Parties.

Les espèces relevant de la CITES sont classées dans trois Annexes de la Convention, selon ledegré de protection dont elles font l’objet :

• Annexe I : espèces menacées d’extinction : les spécimens capturés à l’état sauvage ne peuvent être commercialisés sous quelque forme que ce soit. • Annexe II : espèces n’étant pas nécessairement menacées mais pouvant le devenir si leur commerce n’est pas réglementé; commerce autorisé. • Annexe III : espèces protégées dans les pays qui les ont inscrites dans cette Annexe, et qui

sollicitent ainsi la coopération des autres pays pour le contrôle du commerce.

La nature du document exigé en matière de la CITES pour le commerce de spécimens d’espècesinscrites dans les listes dépend de l’Annexe dont relève l’espèce en cause et de sa source, c’est-à-dire, sauvage, élevée en captivité, reproduite artificiellement, etc.

Les permis et certificats sont délivrés par l’organe de gestion de la CITES de chaque pays.Toutes les Parties signataires de la Convention ont désigné des organes de gestion et certainspays en ont même plusieurs. Toute expédition de spécimens CITES doit être couverte par ladocumentation CITES appropriée qui doit être présentée avant ou au moment du dédouanement.Il existe des règles stipulant la nature des renseignements à faire figurer sur un document CITESet sa durée de validité.

Le présent document a pour seul objet d’indiquer que l’expédition des marchandises classéesdans l’une des sous-positions du SH mentionnées dans le tableau ci-après peut exiger unedocumentation CITES. CITES - The Convention on International Trade in Endangered Species of Fauna and Flora

The Convention on International Trade in Endangered Species of Fauna and Flora (CITES)establishes an international legal framework for the control and regulation of international trade incertain species of wild fauna and flora, including their parts and derivatives. There are currently143 countries who have joined the Convention and these are referred to Parties to the Convention.Additionally, 41 countries who have not joined the Convention operate CITES controls in a verysimilar way to the Parties.

Species subject to CITES are included in three Appendices to the Convention depending on thelevel of protection :

• Appendix I which contains those species that are endangered. No commercial tradein wild-taken specimens is permitted;

• Appendix II which contains species that are not necessarily endangered but maybecome so if trade in them is not regulated. Commercial trade ispermitted;

• Appendix III containing species that are protected in the countries that have listedthem, thereby seeking co-operation of other countries in the control oftrade.

The type of document required under CITES for trade in specimens of listed species depends onthe Appendix to which the species belongs and its source, e.g. wild, captive-bred, artificiallypropagated, etc.

Permits and certificates are issued by a designated CITES Management Authority in each country.All Parties to the Convention have Management Authorities and some countries have more thanone. Each shipment of a CITES specimen must be covered by appropriate CITES documentation,which must be presented before clearance. There are also rules governing the information thatmust be shown on a CITES document and its period of validity.

This document is solely to indicate that any shipment of commodities classified in one of the HSsubheadings mentioned in the following table may require CITES documentation. The documentis not designed to cover all aspects of CITES control - officers in many countries have beentrained in CITES controls - but to make clear that, in the case of all shipments effected under theaforementioned subheadings, the local regulations regarding CITES shipments should beconsulted. The local CITES Management Authority in each country will be able to assist ifrequired.

RECOMMANDE que les administrations membres, les Parties contractantes à la Conventionsur le Système harmonisé et les Unions douanières ou économiques, compte tenu deséléments de la structure type des travaux de classement qui figure dans l’appendice ci-joint, prennent toutes les mesures utiles pour améliorer les travaux de classementqu’elles effectuent dans le cadre du SH :

a) en mettant en place une infrastructure appropriée afin d’effectuer les travaux declassement de manière efficace;

b) en entreprenant des travaux de classement de façon à faciliter les échanges

internationaux et les investissements et en assurant parallèlement le respect de laréglementation tant fiscale que commerciale, l’accent étant mis sur les mesures àprendre avant la déclaration des marchandises et après leur dédouanement maisnon pas seulement au moment du traitement de la déclaration;

c) en fournissant une formation adéquate aux fonctionnaires des douanes et aux

opérateurs économiques, en favorisant l’éthique professionnelle et en rendant lesrenseignements sur la classification accessibles au public pour permettre à la douaned’atteindre les objectifs ci-dessus;

d) en mettant en place un dispositif de recours pour le règlement des différends en

matière de classement qui donne satisfaction aussi bien à la douane qu’auxopérateurs économiques,

RECOGNIZING that correct and uniform application of the Harmonized System in an efficientmanner would facilitate international trade and investment and promote compliance withfiscal and trade rules or laws,

RECOGNIZING that classification practices should be objective, predictable and transparent forensuring voluntary compliance by the trade community,

REALIZING that achieving the above objectives requires well-defined and effective classificationpractices and infrastructure therefor,

RECOMMENDS that Member administrations, Contracting Parties to the Harmonized SystemConvention and Customs or Economic Unions, taking into account the elements of a goodtariff classification work model set out at the Appendix hereto, take all appropriate steps toimprove their Harmonized System classification work by :

(a) Establishing an adequate classification work infrastructure to carry out classificationwork in an efficient manner;

(b) Carrying out classification work so as to facilitate international trade and investmentand to ensure compliance with both fiscal and trade rules or laws with emphasis beingplaced on the pre-entry and post-clearance stages and not only on the declaration-processing stage;

(c) Providing adequate training for Customs officers and the trade community,encouraging integrity and making classification-related information available to thepublic in order to enable Customs to achieve the above objectives;

(d) Setting up appeal procedures satisfactory both to the Customs administration and tothe trade community for the settlement of classification disputes,

APPENDICE

Principaux éléments d’une structure type destravaux de classement tarifaire

Introduction

1. Une démarche rationnelle doit présider aux travaux de classement tarifaire afind’assurer un classement rigoureux et uniforme des marchandises dans le Système harmonisé(SH). Une telle démarche faciliterait les échanges internationaux et les investissements,favorisrerait le respect de la législation et de la réglementation fiscales et commerciales ainsiqu’un traitement égal de tous les opérateurs économiques. Ceci pourrait notamment réduireau minimum les pertes fiscales et commerciales dues aux erreurs de classement.

2. Pour atteindre ces objectifs, il est indispensable de mettre en place une infrastructureappropriée pour effectuer les travaux de classement, aussi bien au sein de l’Administrationcentrale qu’à l’échelon régional ou local, et de créer un centre de classement desmarchandises.

3. Les travaux de classement peuvent être effectués à trois moments différents : avant ledépôt de la déclaration, lors du traitement de cette dernière et après le dédouanement, (aposteriori). La détermination du classement avant déclaration et sa vérification a posterioricontribuent à réduire le temps consacré au classement lors du traitement des déclarations.

4. Les milieux commerciaux doivent disposer de voies de recours appropriées.

5. Une formation appropriée dans le domaine du classement est indispensable pouracquérir et conserver des connaissances adéquates dans ce domaine. Cette formationpermettra aux fonctionnaires des douanes d’accomplir leur tâche dans le respect des règlesd’éthique professionnelle.

Main elements of a good tariff classification work model

Introduction

1. A good tariff classification work model is essential to promote correct and uniformclassification of goods in the Harmonized System (HS). Such a model would facilitateinternational trade and investment and promote compliance with fiscal and trade rules or lawsas well as equal treatment of all members of the trade community. This would result in,among other things, a reduction in losses to the revenue and to businesses due tomisclassification.

2. Adequate classification work infrastructure at both headquarters and regional/locallevels, including the establishment of a classification centre, is a prerequisite for achievingsuch objectives.

3. Classification work can be carried out at three different stages : pre-entry, declaration-

processing and post-clearance stages. The determination of classification at the pre-entrystage and checking of classification at the post-clearance stage help reduce classificationdelays at the declaration-processing stage.

4. Appropriate appeals systems should be available to the trade community.

5. Adequate training in classification is a prerequisite for developing and maintaining goodclassification skills. Such training should assist Customs officers in achieving a high level ofcommitment and integrity when performing their duties.

6. Customs officials and the trade community should be provided with updatedclassification aids in order to ensure accurate and uniform classification. As more informationis made available to the trade community, the level of voluntary compliance will improve.

Part I

Classification infrastructure

7. Classification infrastructure consists of the offices or departments within a Customsadministration or a Customs or Economic Union, responsible for determining the classificationof goods for the purposes of HS-based Customs tariffs and statistical nomenclatures.

8. It should be supported by an adequate number of classification experts with clearly

defined functions and responsibilities. The experts should be provided with classification aidssuch as national tariffs, the HS Convention and Nomenclature, HS and/or nationalExplanatory Notes, Compendium of Classification Opinions, national classification rulings andguidelines and a classification database. In a modern Customs environment, the classificationaids are made available on a computer terminal to officers involved in classification work (e.g.,the HS Commodity Data Base).

Headquarters and classification centre

9. The classification work may be co-ordinated by the headquarters. This co-ordinationfunction may be performed, for example, through a classification committee composed ofappropriate members. The committee may invite comments from the trade community andgovernment departments interested in classification matters. Ad hoc meetings could be heldfrequently within the department to discuss classification questions.

10. A classification centre that is responsible for ensuring the correct and uniformclassification of merchandise throughout the importing country or the Customs or EconomicUnion may also be established at the headquarters’ level. The centre may, among its otherduties, provide useful guidance to the classification officers in the field. It may also act as atechnical advisory body to higher-level management (and, if appropriate, to the classificationcommittee) on classification matters, particularly on the settlement of classification disputes.At the headquarters’ level, the following functions may be performed :

(a) Examining classification questions referred by the regional or local offices, as well as pre-entry classification requests from the trade community and issuing classification rulingsfor uniform application throughout the country or Customs or Economic Union.

(b) Updating the national tariffs and complementary classification-related publications.

(c) Preparing and updating centralized information (including a database) on tariffclassification matters and disseminating it to the field offices and to the trade community.

(e) Serving as a liaison with the WCO and the HS Committee, and facilitating theimplementation of the HS Committee’s classification decisions.

(g) Co-ordinating with other government departments and agencies on tariff, statistical andother nomenclature related matters.

(h) Maintaining contacts with manufacturers, scientific institutions, universities, etc. to keepabreast of developments in technology and changes in patterns of international trade.

(i) Co-ordinating training activities on the HS.

11. At the headquarters’ level (including the classification centre), centralized information(such as a database) on suspected or known classification fraud, or on goods for whichmisclassification frequently occurs, may be kept to assist the field officers with riskmanagement. In many administrations, however, the responsibility for gathering, analysingand disseminating intelligence and information to field units is carried out by an independentunit or agency at the headquarters’ level. Such a unit or agency has overall responsibility forcollecting intelligence and conducting investigations of suspected or alleged Customsoffences (including commercial fraud) and consulting with other Customs administrations andregional or international organizations on these matters.

12. In a Customs or Economic Union, regional classification centres may be established at theheadquarters of the individual members for co-ordinating the classification work between thefield offices and the headquarters of the Union.

Regional or local classification offices

13. At the regional level of the Customs organization or at major Customs offices, where theactual tariff classification of goods takes place on importation or exportation, the followingunits may be established :

(a) A classification unit composed of classification experts to give advice to declaration-processing units, to issue pre-entry classification information at the request of the tradecommunity, and to serve as a liaison with the headquarters or classification centre.

(b) Declaration-processing units which handle routine tariff classification work. In majorCustoms offices, such units may be organized on the basis of industry sectors or HSChapters. Where classification disputes or problems occur, the entry-processing unitsshould refer the matter to a classification unit for advice or a ruling (which may, in turn,decide to refer the matter to headquarters or the classification centre).

(c) Risk assessment units which should help target suspect or high-risk declarations on tariffclassification fraud or help target goods for which misclassification frequently occurs.This might be achieved by, for example, marking high-risk commodity categories,screening the cargo manifests, gathering intelligence, keeping surveillance, keepingimporters’ profiles, etc. and alerting the declaration-processing units or post-clearanceaudit units. The risk assessment function may be centralized at headquarters’ level forhigher efficiency.

(d) Post-clearance audit units. These units may be established in order to checkclassifications on the basis of risk assessment or random selection. Audits may becarried out in the Customs offices or at importers’ or exporters’ premises. Audits may bemore effectively performed at an importer’s or exporter’s premises because the recordsand operations of the company can be more easily and comprehensively examined.These audits may include checking and comparing the classification of a company’sgoods cleared by any Customs office. Reviewing all the importing and exporting activitiesof a given company will increase the probability of detecting possible Customs offences.

Dans tousles cas, il convient d’encourager la concertation entre la douane et les opérateurséconomiques ainsi que la consultation des organes compétents pour les questions techniques(laboratoire des douanes, experts des milieux industriels, par exemple).

Classement avant déclaration*

a) Des renseignements tarifaires avant déclaration devraient être fournis par l’administrationdes douanes (Administration centrale, centre de classement, bureau régional ou local). Lenombre d’autorités ayant le pouvoir d’émettre des renseignements tarifaires contraignantspeut être limité afin d’assurer une interprétation uniforme des règles de classification.

soient enregistrés dans une base de données centralisée de façon à pouvoir être vérifiéspar l’Administration centrale, le centre de classement, les bureaux de classementrégionaux ou locaux, afin d’éviter que des bureaux différents ne publient desrenseignements contradictoires concernant un même produit.

c) Des renseignements en matière de classement de nature contraignante sont hautement

souhaitables et doivent être publiés dans les délais prescrits et demeurer valables pendantune période déterminée sauf à se révéler inexacts ou à être modifiés ou supprimés. Ilconviendrait d'instituer une procédure permettant au destinataire d'une décision en matièrede classement de différer l'application d'une modification de cette décision lorsque cetopérateur peut apporter la preuve qu'il a continué à appliquer de bonne foi la décisioninitiale.

d) Il est hautement souhaitable que tout renseignement (ou décision) de classement avant

déclaration ou contraignant communiqué à un importateur, un importateur potentiel ou unexportateur soit également publié pour fournir au public des orientations au sujet demarchandises analogues ou apparentées.

Classification procedure

14. The classification of goods is one of the basic requirements in Customs procedures andin international trade and investment. This is a specialized job requiring expertise andinvolving various aspects such as checking of Customs declarations and other relevantdocuments, examination of goods, laboratory analysis, referring to technical literature andclassification aids. However, delays in clearance of goods on account of classification shouldbe minimized to the extent possible for facilitating international trade and investment.

15. Therefore, a combination of all the three following procedures is recommended in orderto achieve a balance between trade facilitation and compliance. In all these cases,consultation between Customs and the economic operator as well as reference to competenttechnical bodies for advice (e.g., Customs laboratory, experts in the industry) should beencouraged.

Pre-entry classification *

(a) Pre-entry classification should be furnished in the Customs administration (headquarters,classification centre, regional or local office). The number of authorities having the abilityto issue binding classification information may be limited to ensure uniform classification.

(b) Details of pre-entry classification information issued should be included in a centralizeddatabase so as to enable checking by others (headquarters, classification centre or otherregional/local offices) and thus avoid issuance of conflicting information on the sameproduct by different offices.

(c) Binding classification information is highly desirable, and ideally it should be issued withina prescribed time and should remain valid for a specific period unless found to beincorrect, altered or withdrawn. It is also highly desirable to institute a procedure fordelayed application of a change or modification of a ruling for the recipient of the originalruling who has satisfactorily demonstrated that it has relied on the original to its detriment.

(d) It is highly desirable that any pre-entry or binding classification information (or ruling)issued to an importer or prospective importer or an exporter should also be published inorder to provide guidance to the general public on the classification of similar or relatedmerchandise.

Classement après dédouanement

17. Les contrôles a posteriori peuvent servir :

a) à vérifier le classement tarifaire lorsqu’aucune vérification n’a été effectuée lors dutraitement de la déclaration

b) à rectifier toute erreur de classement commise lors du traitement de la déclaration c) à vérifier l’existence éventuelle d’une fraude en matière de classement

Ces contrôles sont effectués dans les bureaux de douane ou dans les locaux de l’importateur,en utilisant la technique de l’évaluation des risques ou de la vérification par larges épreuves,ou les deux à la fois.

Declaration-processing stage classification

16. A 100 % classification check at this stage may cause delays and interfere withfacilitation of trade. It is therefore recommended to :

(a) introduce selectivity on the basis of risk management and/or suspect declarations and/orof the random selection method;

(b) refer classification doubts or problems to tariff classification experts (headquarters,classification centre or regional/local classification units);

(c) consult the declarant before a change of tariff classification is effected by Customs;

(d) allow the declarant to amend classification mistakes with or without fine;

(e) leave time-consuming tariff classification checks to the post-clearance stage provided thatan appropriate security measure is taken to avoid losses of revenue or non-compliancewith trade regulations.

Post-clearance stage classification

17. Post-clearance audits may be carried out :

(a) to check tariff classifications where no checks were performed at the declaration-processing stage;

(b) to correct any classification mistakes made at the declaration-processing stage;

(c) to check possible classification fraud;

either in Customs offices or at importers' or exporters’ premises on the basis of riskmanagement, random selection method or both.

Règlement des différends

18. Des différends en matière de classement peuvent survenir avec les opérateurséconomiques à divers stades, que ce soit avant déclaration, au moment du traitement de ladéclaration ou après dédouanement. Un dispositif approprié permettant une concertationentre les opérateurs économiques et la douane devrait permettre dans une large mesure deréduire les différends. Par conséquent, pour régler les différends en matière de classement, ilest recommandé de mettre en place des procédures de recours. En ce qui concerne lesprocédures administratives, il importe que le règlement de la question soit rapide, objectif etefficace.

a) Procédure de concertation : elle peut être appliquée avant déclaration, au moment dutraitement de la déclaration ou après le dédouanement. S'il y a lieu, le service responsabledoit consulter l’importateur ou l'exportateur sur les points qui appellent des précisions et luifaire part de ses premières conclusions concernant le classement des marchandises encause. Si l'importateur ou l'exportateur n'est pas d'accord avec ces premières conclusions,il convient, avant de se prononcer définitivement sur le classement, de lui donner unepossibilité raisonnable de communiquer dans des délais raisonnables verbalement ou parécrit tous les renseignements et tous les arguments nécessaires. Les intéressés doiventpouvoir faire appel de la décision suivant la procédure régulière de recours.

b) Procédure régulière : elle doit être clairement définie et les prescriptions ainsi que les

procédures légales à respecter doivent être précisées aux entreprises si elles en font lademande. Au premier degré, une autorité de l’administration peut être désignée, pour lesautres degrés de recours, il peut s’agir d’une autorité judiciaire indépendante.L’Administration centrale ou le centre de classement doivent fournir tous lesrenseignements techniques ou d'ordre général nécessaires dont ils disposent si l’autoritécompétente le réclame.

19. Lorsqu’un différend est réglé au sein de l’administration des douanes, le service ou lefonctionnaire chargé de la question doit être différent de celui qui a pris la décision initiale.

Part III

Dispute settlement

18. Classification disputes with the trade community can arise at various stages such as thepre-entry classification, the declaration-processing stage or the post-clearance stage. Anappropriate mechanism for consultation between the trade community and the CustomsAdministration should reduce such disputes to a great extent. Therefore, a combination ofconsultation and formal appeal procedures is recommended for settlement of classificationdisputes. Speedy, objective and efficient handling of the matter is important in the case ofdepartmental procedures.

(a) Consultation procedure : This is applicable within the Customs department at any of thepre-entry, declaration-processing or post-clearance stages. If appropriate, theresponsible unit or office should consult with the importer or exporter on points requiringclarification and convey to him or her its preliminary findings on classification of themerchandise under consideration. If the importer or exporter disagrees with thepreliminary findings, he/she should be given a reasonable opportunity to present, within areasonable time, all relevant information and arguments (both orally and in writing),before a final decision is taken on the classification of the merchandise. A final decisionshould be appealable under the formal appeal procedure.

(b) Formal procedure : The formal appeal procedure should be clearly outlined, and thelegal requirements and procedures should be explained to the trade community, if sorequested. The first appeal may be to a designated departmental authority whereas thesecond appeal or further appeals should be to independent judicial authorities. Theheadquarters or classification centre should provide all necessary background ortechnical information at its disposal to such an authority, if so requested by the authority.

19. When a dispute is handled within the Customs administration, a unit or officer which isdifferent from the original unit or officer processing the declaration should handle the matter.

Formation et autres questions

Formation

20. Dans toute administration, une formation est indispensable pour enseigner toutes lesconnaissances voulues au personnel. Indépendamment d’une formation dans les autresdomaines connexes du contrôle douanier, il convient de dispenser au personnel chargé destravaux de classement tarifaire une formation appropriée dans ce domaine. Dans la mesuredu possible ou lorsque c’est approprié, le programme du cours doit porter notamment sur laConvention sur le SH, la structure du SH, les règles de classement, une analyse détaillée deschapitres du SH, des études de cas sur le classement, les décisions prises par le Comité duSH, les décisions en matière de classement, les domaines dans lesquels une fraude enmatière de classement peut être commise, les analyses effectuées par les laboratoires desdouanes, etc. En fonction des besoins de chaque administration, il y a lieu de prévoir descours de formation de base ainsi que des cours sur les lieux de travail.

21. L’organisation des cours de formation doit relever du service de la formation ou ducentre de formation et le programme du cours doit être conçu en concertation avec desspécialistes du classement des marchandises de l’administration centrale ou du centre declassement ou les deux à la fois. L’idéal serait que la formation soit dispensée par desformateurs expérimentés spécialisés dans le domaine du classement. Les documents deformation à utiliser en l’occurrence comprennent notamment le tarif national, les modules deformation sur le SH, les Notes explicatives sur le SH, toutes les publications complémentairessur le SH ainsi que les lois et les réglementations douanières pertinentes. La douane peutapporter également toute l’assistance voulue aux entreprises en formant les membres de leurpersonnel chargés des travaux de classement tarifaire.

Ethique professionnelle

22. Pour que l’infrastructure utilisée à des fins de classement conserve toute son efficacitéet que les travaux de classement des marchandises demeurent efficaces, il est primordial quele personnel de la douane exerçant dans ce domaine respecte les règles d'éthiqueprofessionnelle. Bien que l’on ne puisse pas préconiser de règle simple pour inculquer ledévouement et l’honnêteté, on peut obtenir beaucoup de résultats en assurant une formation,en récompensant la qualité du travail, en assurant le maximum de transparence dans lestravaux de classement tarifaire.

20. Training is indispensable for the staff in any organization for the development ofnecessary skills. Soundly based classification training, in addition to training in other relatedareas of Customs control, should be provided to the staff assigned to tariff classification work.The course content should include the HS Convention, the structure of the HS, classificationprinciples, detailed analysis of HS Chapters, case studies on classification, HS Committeedecisions, classification rulings, possible areas of classification fraud, Customs laboratoryanalysis, etc., to the extent possible or appropriate. Basic and on-the-job training coursesshould be designed to meet the needs of the Customs administration.

21. The responsibility for organizing the training courses should be with the departmentaltraining division or institute and the course content should be designed in consultation withclassification experts at the headquarters and/or classification centre. Ideally, the trainingshould be given by experienced trainers who are specialized in classification. Trainingmaterials should include national tariffs, the HS Training Modules, the HS Explanatory Notesand other complementary HS publications and other relevant Customs laws and regulations.The Customs may also provide classification training to the trade community.

Integrity

22. Integrity of the Customs staff engaged in classification work is vital for the successfulmaintenance of an effective classification infrastructure and for the efficiency of tariffclassification work. Though no simple rules can be prescribed to inculcate commitment towork and integrity, a great deal can be achieved by training, and providing incentives for goodwork, and providing maximum transparency in tariff classification work.

Providing the necessary and accurate information on tariff classification matters to thetrade community and public is very important for enhancing the efficiency of Customs work.All relevant classification aids, rules, regulations, guidelines, binding tariff information andother relevant details concerning tariff classification should be published, due account beingtaken of confidential information. This could be in the form of priced publications, officialgazettes, bulletins, notices or, if appropriate, through an electronic information system such asInternet. Regulatory changes affecting tariff classification should be made available to publicbefore implementation. There may be a public relations mechanism where the tradecommunity and the public can obtain information and clarification without delay.
