Discussion was held concerning the notice of non-selection received from the State of Nebraska Dept of Economic Development regarding the Community Block Grant application submitted in January. The Village will con- tact the Panhandle Area Development District for help to proceed with another application and a community survey as required for the applica- tion. Savely moved that the Village Board should sus- pend the statutory read- ing of Ordinance 200 (An ordinance to amend sec- tion 11 of the ordinances of the municipal code of the Village of Lodgepole, Nebraska pertaining to accessory buildings) on three different days, sec- onded by Suhr; Runge, Savely, Bondegard, Misegadis and Suhr voting yes, none voting no, motion approved. Ordinance 200 was then read by title and thereafter Savely moved for final passage of said Ordinance, seconded by Suhr; Savely, Suhr, Runge and Bondegard voting yes, Misegadis voting no, ordinance adopted. ORDINANCE NO. 200 AN ORDINANCE TO AMEND SECTION 11 OF THE ORDIANCES OF THE MUNICIPAL CODE OF THE VILLAGE OF LODGEPOLE, N E B R A K S A , PERTAINING TO ACCESSORY BUILDINGS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF LODGEPOLE, NEBRASKA: Section 1. That § 5.07,5.08,6.07,6.08,7.0 7,7.08 of the Village of Lodgepole Zoning and Subdivision Ordinance of the Municipal Code of the Village of Lodgepole, Nebraska, is amended to read as follows: 11-209 1. Front yards: The front yards in Residential Districts (“R-1”, “R-2”and “R-3”) shall be adjusted in the following cases: a. Where fifty per- cent (50%) or more of the frontage on one side of a street between two inter- secting streets is devel- oped with buildings that have observed a front yard either greater or smaller than required then: (1) Where a build- ing is to be erected on a parcel of land that is within fifty (50) feet of existing buildings on both sides, the minimum front yard shall be a line drawn between the two closest front corners of adjacent building on the two sides. b. In cases where corner lots with more than two (2) frontages, front yard requirements shall be subject to the fol- lowing limitations: (1) At least one front yard shall be provid- ed having the full depth required generally in the district; and (2) No other front yard on the lot shall have less than half the full depth required generally. 2. Accessory Buildings: a. No accessory uses, buildings or struc- tures shall be erected in any required front or side yard, and no detached accessory building shall be erected closer than five (5) feet from any other building. b. Accessory build- ings may be located in the rear yard, but shall not be closer than five (5) to the rear or side lot line; unless otherwise specifically per- mitted, any accessory building requiring vehicle access from an alley way shall be a minimum of five (5) feet from the rear property line. All acces- sory buildings and a lot collectively shall not cover more than thirty (30) per- cent of the required yard. In addition, no accessory building shall be con- structed upon a lot until the construction of the main building has been started. Finally, no acces- sory building shall be used for dwelling purposes. c. Detached acces- sory storage buildings for residences shall not have area dimensions with a gross floor area greater than thirty (30) percent of the required rear yard, shall be permanently anchored and shall not exceed eighteen (18) feet in height. d. An accessory building shall not be con- structed of or be part of any of the following: (1) Mobile homes; (2) Grain bins; (3) Pickup toppers; and (4) Railcars. b. An accessory building shall not be part of or consist of a vehicle, trailer or portions thereof, originally designated for travel or use upon a pub- lic roadway. c. An accessory building may not consist of any recycled or sal- vaged materials unless the structure meets all building codes. The exte- rior siding of an accessory building shall consist of new materials, with the exception that logs, bricks, cement blocks, non-rusted sheet metal or recomposed plastics are exempt from the need of new material exterior siding. d. Enclosed sealed mobile storage containers, including but not limited to, sea containers, cargo containers, shipping con- tainers, and any other storage containers, may be permitted for perma- nent storage in the com- mercial zoning areas only with approval of the Board prior to placement. Said mobile storage containers will not be allowed in resi- dential zoning areas. e. Any cargo con- tainer utilized as an acces- sory building shall not be permitted on any lots which are included within a residential zoning area. Such cargo containers will be permitted upon lots in commercial zoning areas subject to the following restrictions: (1) Only one (1) cargo container per lot unless the Village Board of Trustees approves more than one (1) container; (2) No stacking of containers; (3) Not to exceed 8’ x 8’ x 40’ in size; (4) Shall be free of dents, rust and/or graffiti and shall be maintained in good condition and painted to blend in with surroundings; (5) Shall be per- manently and adequately anchored; anchor much be a minimum of 32 inches deep. (6) Shall be secure- ly locked at all times, other than during actual loading or unloading; (7) If airtight, an air vent must be installed; and (8) Under no cir- cumstances shall the cargo container be used as a dwelling unit, or hous- ing unit, pet housing or containment units or ken- nel. f. In the event of an emergency, such as a fire or natural disaster, a cargo container may be placed on a property for up to thirty (30) days without approval of the Village Board; provided however, the Clerk of the Village of Lodgepole must be notified within five (5) working days of the placement of a cargo container by either the property owner, the ten- ant or the contractor. If the Village of Lodgepole is not so notified, the cargo container must be imme- diately removed. After the initial thirty (30) days has expired, the Village Board may extend the permit another thirty (30) days upon applica- tion and Hearing before the Board. The permit must be renewed in the same manner every thir- ty (30) days and may be renewed up to a total of five (5) times. If after six (6) months the cargo con- tainer is still present, the cargo container must be removed unless applica- tion is made and approval obtained from the Village Board prior to the end of said six (6) month period. Section 2: That any other ordinance or passed and approved prior to the passage, approval and publication of this Ordinance and in conflict with the provisions of this Ordinance, is hereby repealed. Section 3: This Ordinance shall go into full force and effect upon its passage, approval and publication or posting as required by law. Passed and approved this 1st day of April, 2013. Savely reviewed some of Roberts Rules for meet- ing procedures. Reports were heard from the Village Attorney, Housing Authority, Old Settlers, road & street dept., sewer & water dept., parks, sanitation, fire dept., community hall and clerk. At 8:10 PM a motion by Suhr seconded by Savely to go into executive ses- sion for employee reviews; Runge, Misegadis, Savely, Bondegard and Suhr vot- ing yes, none voting no, motion passed. At 8:29 PM a motion by Savely seconded by Misegadis to go back into open session; Runge, Savely, Misegadis, Bondegard and Suhr vot- ing yes, none voting no, motion passed. The Board has adopted an employee evaluation form presented by Suhr as a tool to help with employee reviews. Klipfel will have his one year employee review at the May meeting with all employee reviews to start in June, to be conducted annually in June. Runge asked for any other items for discussion; Savely reviewed items from the Chamber of Commerce meeting; Suhr reported on the Lodgepole Lions Club. At 8:34 PM a motion by Suhr seconded by Bondegard to adjourn the meeting, Suhr, Misegadis, Runge, Bondegard and Savely voting yes; none voting no; motion passed. A short discussion was held concerning the building permit applica-tion submitted by Richard Burge. A motion by Savely; seconded by Suhr to present and read an ordinance vacating 30 ft of Cleveland Street along block 4 in Oberfelder’s second addition and vacat-ing the alley between lots 6&7 and lots 5&8 in block 4 of Oberfelder’s second addition at the May meet-ing; Savely, Bondegard, Runge, Misegadis and Suhr voting yes, none vot-ing no, motion passed.

A motion by Bondegard, seconded by Misegadis to approve the building per-mit for 620 Bates Blvd as presented on the applica-tion; Runge, Savely, Suhr, Bondegard and Misegadis voting yes, none voting no, motion passed.

A motion by Savely, seconded by Bondegard to approve the building permit for 802 Bates Blvd with the restriction of extending the 6ft privacy fence from the north east corner of the house to the east property line instead of the south east corner of the house as noted on the application; Bondegard, Suhr, Runge, Misegadis and Savely voting yes, none voting no, motion passed.

A motion by Bondegard, seconded by Misegadis to approve Advanced Work Zone’s request to use Lodgepole streets for a detour during the repair of the railroad crossing on Link 17 April 8 thru April 10, 2013; Savely, Runge, Suhr, Misegadis and Bondegard voting yes, none voting no, motion passed.

Discussion was held concerning the notice of non-selection received from the State of Nebraska Dept of Economic Development regarding the Community Block Grant application submitted in January. The Village will con-tact the Panhandle Area Development District for help to proceed with another application and a community survey as required for the applica-tion.

Savely moved that the Village Board should sus-pend the statutory read-ing of Ordinance 200 (An ordinance to amend sec-tion 11 of the ordinances of the municipal code of the Village of Lodgepole, Nebraska pertaining to accessory buildings) on three different days, sec-onded by Suhr; Runge, Savely, Bondegard, Misegadis and Suhr voting yes, none voting no, motion approved. Ordinance 200 was then read by title and thereafter Savely moved for final passage of said Ordinance, seconded by Suhr; Savely, Suhr, Runge and Bondegard voting yes, Misegadis voting no, ordinance adopted.

AN ORDINANCE TO AMEND SECTION 11 OF THE ORDIANCES OF THE MUNICIPAL CODE OF THE VILLAGE OF LODGEPOLE, N E B R A K S A , P E R T A I N I N G TO ACCESSORY BUILDINGS.

BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF LODGEPOLE, NEBRASKA:

Section 1. That § 5.07,5.08,6.07,6.08,7.07,7.08 of the Village of Lodgepole Zoning and Subdivision Ordinance of the Municipal Code of the Village of Lodgepole, Nebraska, is amended to read as follows: 11-209

1. Front yards: The front yards in Residential Districts (“R-1”, “R-2”and “R-3”) shall be adjusted in the following cases:

a. Where fifty per-cent (50%) or more of the frontage on one side of a street between two inter-secting streets is devel-oped with buildings that have observed a front yard either greater or smaller than required then:

(1) Where a build-ing is to be erected on a parcel of land that is within fifty (50) feet of existing buildings on both sides, the minimum front yard shall be a line drawn between the two closest front corners of adjacent building on the two sides.

b. In cases where corner lots with more than two (2) frontages, front yard requirements shall be subject to the fol-lowing limitations:

(1) At least one

front yard shall be provid-ed having the full depth required generally in the district; and

(2) No other front yard on the lot shall have less than half the full depth required generally.

2. A c c e s s o r y Buildings:

a. No accessory uses, buildings or struc-tures shall be erected in any required front or side yard, and no detached accessory building shall be erected closer than five (5) feet from any other building.

b. Accessory build-ings may be located in the rear yard, but shall not be closer than five (5) to the rear or side lot line; unless otherwise specifically per-mitted, any accessory building requiring vehicle access from an alley way shall be a minimum of five (5) feet from the rear property line. All acces-sory buildings and a lot collectively shall not cover more than thirty (30) per-cent of the required yard. In addition, no accessory building shall be con-structed upon a lot until the construction of the main building has been started. Finally, no acces-sory building shall be used for dwelling purposes.

c. Detached acces-sory storage buildings for residences shall not have area dimensions with a gross floor area greater than thirty (30) percent of the required rear yard, shall be permanently anchored and shall not exceed eighteen (18) feet in height.

d. An accessory building shall not be con-structed of or be part of any of the following:

(1) Mobile homes;(2) Grain bins;(3) Pickup toppers;

and(4) Railcars.b. An accessory

building shall not be part of or consist of a vehicle, trailer or portions thereof, originally designated for travel or use upon a pub-lic roadway.

c. An accessory building may not consist of any recycled or sal-vaged materials unless the structure meets all building codes. The exte-rior siding of an accessory building shall consist of new materials, with the exception that logs, bricks, cement blocks, non-rusted sheet metal or recomposed plastics are exempt from the need of new material exterior siding.

d. Enclosed sealed mobile storage containers, including but not limited to, sea containers, cargo containers, shipping con-tainers, and any other storage containers, may be permitted for perma-nent storage in the com-mercial zoning areas only with approval of the Board prior to placement. Said mobile storage containers will not be allowed in resi-

dential zoning areas.e. Any cargo con-

tainer utilized as an acces-sory building shall not be permitted on any lots which are included within a residential zoning area. Such cargo containers will be permitted upon lots in commercial zoning areas subject to the following restrictions:

(1) Only one (1) cargo container per lot unless the Village Board of Trustees approves more than one (1) container;

(2) No stacking of containers;

(3) Not to exceed 8’ x 8’ x 40’ in size;

(4) Shall be free of dents, rust and/or graffiti and shall be maintained in good condition and painted to blend in with surroundings;

(5) Shall be per-manently and adequately anchored; anchor much be a minimum of 32 inches deep.

(6) Shall be secure-ly locked at all times, other than during actual loading or unloading;

(7) If airtight, an air vent must be installed; and

(8) Under no cir-cumstances shall the cargo container be used as a dwelling unit, or hous-ing unit, pet housing or containment units or ken-nel.

f. In the event of an emergency, such as a fire or natural disaster, a cargo container may be placed on a property for up to thirty (30) days without approval of the Village Board; provided however, the Clerk of the Village of Lodgepole must be notified within five (5) working days of the placement of a cargo container by either the property owner, the ten-ant or the contractor. If the Village of Lodgepole is not so notified, the cargo container must be imme-diately removed. After the initial thirty (30) days has expired, the Village Board may extend the permit another thirty (30) days upon applica-tion and Hearing before the Board. The permit must be renewed in the same manner every thir-ty (30) days and may be renewed up to a total of five (5) times. If after six (6) months the cargo con-tainer is still present, the cargo container must be removed unless applica-tion is made and approval obtained from the Village Board prior to the end of said six (6) month period.

Section 2: T h a t any other ordinance or passed and approved prior to the passage, approval and publication of this Ordinance and in conflict with the provisions of this Ordinance, is hereby repealed.

Section 3: T h i s Ordinance shall go into full force and effect upon its passage, approval and

publication or posting as required by law. Passed and approved this 1st day of April, 2013.

Savely reviewed some of Roberts Rules for meet-ing procedures.

Reports were heard from the Village Attorney, Housing Authority, Old Settlers, road & street dept., sewer & water dept., parks, sanitation, fire dept., community hall and clerk.

At 8:10 PM a motion by Suhr seconded by Savely to go into executive ses-sion for employee reviews; Runge, Misegadis, Savely, Bondegard and Suhr vot-ing yes, none voting no, motion passed. At 8:29 PM a motion by Savely seconded by Misegadis to go back into open session; Runge, Savely, Misegadis, Bondegard and Suhr vot-ing yes, none voting no, motion passed. The Board has adopted an employee evaluation form presented by Suhr as a tool to help with employee reviews. Klipfel will have his one year employee review at the May meeting with all employee reviews to start in June, to be conducted annually in June.

Runge asked for any other items for discussion; Savely reviewed items from the Chamber of Commerce meeting; Suhr reported on the Lodgepole Lions Club.
