FINDING YOUR WAY HOME AFTER PRISON Over the years, we have worked with many job seeking consumers that are trying to find a way to come home and to start their life over. It is a hard process because we live in a society that fears your return and out of that blind fear; society seeks to control or banish you. Society has forgotten that you are their next door neighbor, their cousins; their own children or that you are someone else’s children from here in our community. Society has successfully turned you into stereotype, not a real people. This is society’s way of mitigating its lack of concern for you and/or its unwillingness to give you a second chance. One of the hardest parts of your effort to return to a normal life centers upon your need of employment and towards your ability to earn a decent living in order to support your family and build a better future. Many of your former careers and many professions are now closed to you without any concern to the question if you pose any danger to society or our community or not. The employment path is slow and fraught with frustration, setbacks and minimum wage jobs.

THE CHANGING JOB MARKETAs we move down the road to the economy and jobs returning, the job market is changing and so are employers’ attitudes towards you. Many employers are finding a need to be more concerned with you are now, what skills you bring to the table and that is because there are already shortages (here in Phoenix) in several industries like construction.CONSTRUCTION:The lack of skilled workers in construction is leading employers to become more liberal in who they accept than they needed to be before the industry improved.These days you are more likely not to get hired in construction because of the lack of transportation, tools and your ability to pass a drug test than you are because you were in prison.Now granted…you are not gonna work at the new INTEL Plant or for the Mesa School District but, you would be hard pressed to get those jobs even if you had a clean background. There is no shortage of applicants that want to make $25-30/HR.If you have transportation and some tools, it is easy to get a building trades’ job from entry to journey level. Journey level applicants (5 or more years in a trade) are now being offered signing bonus from $500-$2,000 - we run them in the Use Job Shack almost daily.

RESTAURANT & SERVICEThe Restaurant and Service Industry is having its biggest boom in a generation with new venues opening every week. This is driven by the fact that we lost so many venues when the economy went south and as times get better there is a big demand for dining. Also, has the economy improves, people travel, business people travel and this can be seen in the vast numbers of ads posted every week by the hotels and resorts here in the valley.Even in bad times, these industries welcomed you if you were able to sell them upon your skill(s) and/or your ability to answer the question “Why should we hire you?” correctly.The resorts have always welcomed you (with a few exceptions based upon your crime – which comes down to whether or not your crime related to the job you applied for…car thieves are unlike to become valet parkers or burglars to become room attendants). Resorts love you because they are very aware of all those government give-a-ways to FREE MONEY if they hire you. This is why they ask you all of those very pointed questions about you and/or your family’s background.Why would the Hilton Corporation, a billion dollar company, care about you and your little tax credit? That’s easy if you think about how many people the Hilton hired (nationwide) just last week.

Say they hired 1,000 people. Now do the math. $2,400+ per new hire.That is $240,000 for just one week.Remember these are tax credits so the $240K is really like $500K. That is a half-of-a-million dollars per week. We are all in the wrong business!RETAILAs the economy improves, people are returning to the stores and this is another opportunity for you. The stores are not opening new stores as much as they are increasing their support staff to assist the sales staff.GROCERY – RETAIL STORES:The only grocery store that WILL NOT hire you because of your past is WinCo. Every other grocery store does a background check but, if your crime(s) do not related to the job you are applying for…it is not a concern.The stores will look at the nature of the crime, the age of the crime and now they are starting to ask about the circumstances about the crime.Circumstances of the crime? Yes! As the economy improves and people start to be harder to find, employers need to distinguish between a people who killed someone and someone who killed someone to protect their family. As the economy gets better, employers have to move away from blanket “no hire” policies in order to get enough people on the worksite. With the grocery stores, you need to use common sense to realize that if I have theft, fraud or ID Theft

background, I will not get that job as a cashier but, I could have been a stocker, I could have been a receiver (warehouse) or even been a courtesy clerk.Getting hired at a store comes down to availability (you need open availability or have the illusion of open availability to work FT), your desire to do the job and your dependability.In each of their job openings, dependability and desire are much more important that actual experience. They are looking for you to having enough basic skills (math skills, money handling, customer service skills…ETC…) needed to teach you to do the job.DISCLAIMER: If you have violent crimes, domestic violence and/or sex offences you need to look into other industries because of the insurance liability of hiring you…you greatly increase their rates).Many times charges like shoplifting, theft and related will roadblock you from many jobs UNLESS you can make a strong case for “…that was then and this is now…” Or if you can make a compiling case based upon the circumstances, you have a good chance. Here is an example:(THIS DOESN’T WORK) “I was convicted of shoplifting that big screen TV.”(THIS DOES WORK) “Several years ago, I was in a very bad situation and I stole that food to feed my babies. I knew it was wrong and to this day I live with the

consequences of that bad decision…but, in many ways it was truly a Godsend in that it made me stop and see who and what I was becoming and I didn’t want this for myself nor for my babies. Since then, I had so radically changed my life and I am proud of how far I come from that trouble young girl…”THIS IS WHAT CIRCUMSTANCES OF THE CRIME MEANS. See the difference? WHAT HASN’T CHANGED?Some industries have not come to the point where they need to be more liberal in considering you.CLEANING JOBS: Most cleaning companies will NOT hire because of the nature of their business or their contracts. But, you can work at a hotel or resort…Makes no sense…right?SOCIAL SERVICE/PEER SUPPORT:Here the key is the age of your offence and if you can get an AZ Fingerprint Clearance Card. If you can get the clearance card, you are golden and can work in this industry.MANUFACTURING: Your skill set is much more important and depending upon how much the company needs a person with your skill set, will determine how liberal they are willing to be. With companies with government contracts, the age of your crime (being at least 7-10 years old), the nature of your crime (if they want you…) and they may cut corners and say that a Felony DWI is something that they can work with. Get it?

THE MYTH OF BACKGROUND CHECKSOne of the largest barriers to you getting a job is your own belief in the myth of background checks. This is barrier because when you see it…you stop and walk away. Sadly, you have walked away from many jobs that you could have gotten if you had just applied.Background checks is a term that means something different to each employer.Every company will run a background check on you for different reasons and result in totally different outcome.Aramark, a billion dollar corporation, does a background check. They run this check to prove how honest you are. They demand total disclosure and will work with you if you do. If you forget or don’t list an offence; they cannot hire you EVER!They do this because they are more concerned with who you are instead of what you did back then. They are more concerned with the skills that you bring to the table. But, if you are lying to them before they hire you, they know that they can never trust you and thus, they don’t hire ya!Take a chance and as the old man use to say…”the worst thing that they can do is hire ya!”

APPLICATION TIPSThere are a few things that you need to keep in mind about doing

applications and in dealing with this as an issue. Always remember what Bill Clinton use to say: “Ya only answer the part of the question that they asked ya!”There are three varieties of how this question gets asked:

1. Have you been convicted in the past five years? This is conviction date not release date or off of parole date.2. Have you been convicted in the past seven years?3. Have you ever been convicted?

So, if I was just released after ten years, I would answer “NO” to both one and two. I would have to answer yes to number three. If I need to discuss this issue, check out the below technique(s) to successfully address the issue of CIRCUMSTANCES OF THE CRIME.

HOW TO DEAL WITH THE ISSUEAs a part of years of working with Veterans who have yet to be released and with a general population of returnees, we have developed inroads into how to deal with the issue of “where have I been for the past years?” We have developed a series of techniques as a means to not rationalize, defend or deny responsible for what has happened (in fact to embrace it) but to bump employers from their preconceive assumptions about you as a returnee and to successfully move you (in their

eyes) from the stereotype image to the human being that you are.

This is critical because once you are seen as a human being instead of a cartoon stereotype; it is easier for people to offer you help, support and forgiveness because:1. It is commonly accepted that there has never been a perfect human being…we all know people who think that they are but…2. If you agree with the above statement. Then you must accept that we all have make mistakes.3. If you accept this, then it is not a great leap to say that everyone deserves second or even third chances. Our working title for this technique is the Humanization of my crime. It is a technique that makes a strong case for putting a human face on what happened to you and strongly makes the case that that was then and I am a very different person than I was then. It is a three step process that addresses the past, the present and the plan for the future. Here is an example of how this was created… STEP ONE A young man came into my office one day and he was very upset, mad and sad all at the same time. I asked him what the problem was. He said that he has put in hundreds of applications and no one will give him a chance.

I asked why and he told me straight up that he had just recently got out of prison for murder and no one would give him a chance. I asked him what he was telling people and he told me that he was upfront with them like he was with me. He was tired and thought that going back to prison was a more agreeable thing because he understood the yard and could navigate through that better than he could in this world with its entire mean people who will never let him get back to the life he once had. He was dead serious about this and he was only days away from whooping that old woman over the head at Circle K and he had it so planned out that he would make it back to the yard in time for dinner. We started talking about his charges and it turns out that the full story (that he had edited out) was that several years ago, someone broke into his home. He thought that he was defending his family and a jury disagreed with him. I said “why don’t we start the conversation with this instead of I just got out of jail for murder...” Think about it. If I come in and tell you that I am a murderer, you would probably be scared and would not have anything to do with me. Right? Now, say that I come in and tell you that several years ago, someone broke into my home and I thought that I was defending my family, you

would be thinking if you would have done otherwise, yourself. Importantly, I would have bumped you off of looking at me as a stereotype ex-killer and moved you closer to looking at me as a human being that made a mistake. Start to see the difference?

STEP TWO We live in a vindictive society that believes in punishment without end and sometimes, I believe that if could figure out a way to punish people after their death we would and keeping with that, we added to the conversation a summary of what he has lost. This young man has lost everything. He lost his career, his home, his family, friends…anything that he treasured and love is gone. If I have you already bumped off of your stereotype image of me; then, this adds to the conversation that I have lost greatly and may have been overly punished for a mistake that I made years ago.

STEP THREE To re-enforce the concept of “that was then and this is now” part of the equation, this is where we put forward a plan to going forward, bring into play what efforts have been made to learn and move on with his life. Here he explains that his goal going forward is to restore as much of his previous life that he can. He wants to have a career, get another home but, most importantly goal was to again

have his family and friends to be proud of him, again. This is why he is here today, this is why he WANTS this job and he applied for this job because… {Insert talking points on skills and abilities}. This become a complete, powerful message and has been successfully mixed with positive employer trigger words like “WANT” instead of “Need” and “plan going forward” instead of “help.” Then throw in his talking points on his skills and abilities and he is bringing a lot to the table that he offers in being focused, dedicated and implies that he would be a productive, dependable and has the possibility to go places within the company. All this was wrapped together in a neat little script, practiced till it flows with the right delivery and then tested on a local employer who agreed and hired him. This same employer would not have crossed the road to help a murderer other than to the door makes it his personal mission to offer this young man a fresh start and the opportunity to rebuild his life. It is now up to the young man to restore his life or not but, now, he has the chance to try. I called the employer and asked him why he hired the young man. Did he know that he had been in prison for murder? The employer scolded and corrected me by retelling me the young man’s story and how it was an injustice that this young man would

lose everything for trying to defend his family. Once you move people off of their stereotype perceptions and they see the returnee as a human being; the better angels of our nature are called out…Abraham Lincoln said that. Interestingly I see more employers starting to be concerned with who the applicant is instead of who they were in the past. I see more and more employers concerned with what skills and abilities that they bring to the table. This is especially true if you introduce the returnee by means of a skill based resume where you front load the conversation with the skills and abilities that they have to offer. The concept is to hook them on skills and after they want the returnee; then you say: “Oh by the way…there is something that I need to discuss with you…” This has been an increasing productive methodology due to a slight rebound in the economy and especially with returnees with specific industrial skills or abilities. The “Humanization of my crime” works with other offences with a slight rewriting of the script to the particulars of what happened to the person. I had a young lady who had 5-6 felonies that was having a hard time finding anyone to hire her. An employer would only hear 5-6 felonies and that would end the interview.

Her story was that several years ago, she got mad at her bonehead, abusive husband and took a tire iron to the headlight of his truck and killed them headlight very good, thank you! Next thing she knows is that the police show up and everything went south…very quickly and she ended up with 5-6 charges (felony flight…endangerment, resisting arrest and assault on a police officer among them). She had a public defender who told her that her children would have grandchildren the next time she would be free but, she could do a deal. She pleaded guilty and served only a couple years. When we started the story with the below script, she got hired!“several years ago, I got mad at my abuse husband and I killed the headlights on his truck, the police showed up, I panicked and everything went terribly wrong afterwards but, now I am trying to build a new life for my children and that is why I am here and I am applying for this jobbecause… {Insert talking points on skills and abilities}...” Another young man was arrested for being involved in wholesale, curbside pharmaceutical sales and we developed a script for him that involved a very strong connection with “that was then and this is now.” “When I was much younger I got caught up in what I thought was a cool, fast and furious lifestyle of fast money, rock and roll. How I got so

deeply involved in it…I am still trying to figure out but the bottom line is that I did do what I did and I stood

tall and accepted my punishment. I have since grown up a lot and have

discovered that what I really want is a normal life and a job that I can make into a career.

This is why I appreciate this opportunity to talk with you and demonstrate why I would be a good candidate for this opening because… {Insert Talking Points]…” The possibilities are endless and employers are starting to respond by asking for not only what you did but for the story behind what you did and if you take responsibility for your actions, have grown from the experience and if you have an action plan going forward; many are starting to consider second chances.
