Terms and conditions

The University’s Terms and Conditions arereproduced below. Additional copies are availableon request from Student and Academic Services,City Campus, Howard Street, Sheffield S1 1WB,telephone 0114 225 5555. They govern thecontract between the University and its students.It is important that you read and understand theTerms and Conditions because any offer of aplace to study at the University is made subject toyour acceptance of them. These Terms andConditions apply from 1 August 2006.

1 DefinitionsIn these Terms and Conditions, the followingterminology shall have the following meanings

Academic Year means a calendar year runningfrom 1 August in one year to 31 July in the nextyear. The specific dates applicable to individualstudents are determined by their programme ofstudy.

Fees means tuition fees and, where relevant,additional fees or costs required for Programmesor Services such as module re-registration,examination, residential.

Collaborating Organisations means aninstitution or organisation with which theUniversity has an agreement in relation to theprovision of Programmes and/or the confermentof awards, degrees or diplomas.

Enrolment means the process by which aProspective Student or Student formally registerstheir participation or continued participation in aProgramme at the University and providesinformation required by the University. Completionof the enrolment process is required for theUniversity to grant access to the Programme andrelated Services (for example library, IT services,course materials, tuition etc).

Prospectus means the current Universityprospectuses (including online and printedversions) giving details of Programmes for thefollowing Academic Year.

Programme means a programme or course ofstudy at the University.

Prospective Student means a person who hasaccepted a place at the University, conditionally orunconditionally, and who has not yet enrolled fortheir first Academic Year at the University.

Regulations means the University’s Instrumentand Articles of Government, regulations, rules,codes, policies, procedures and other instructionsand administrative arrangements as are in forceand as amended from time to time, includingrelevant decisions of the Board of Governors andthe Academic Board and related committees.

requirements must be complied with as acondition of a Prospective Student obtaining theirplace at the University and other specialrequirements continue throughout the period ofthe Programme. These special requirements areoften imposed by law, accrediting or professionalbodies, or other third parties. For example, someProgrammes may require additional declarationsby the Student relating to their health, criminalconvictions and cautions. There may be arequirement for a check of criminal convictions(via the Criminal Record Bureau’s DisclosureService) and/or medical examinations. In addition,certain standards of behaviour and attendancerequirements may apply.

Details of any current special requirements thatapply to your Programme can be obtained fromthe University. Variations or new specialrequirements may be introduced by the Universityfrom time to time without notice to ProspectiveStudents or Students if they are required by athird party or by law, or where it is reasonablyconsidered by the University to assist in theproper delivery of education.

Failure to comply with any such specialrequirements may result in termination of yourcontract, with the consequence that you may notbe permitted to begin your Programme at theUniversity or you may be required to leave yourProgramme and/or the University.

3.3 Conditional offersSome offers of a place may be conditional on aProspective Student fulfilling certain requirementseither academic or otherwise, which will bestipulated when the offer of a place is made. If aProspective Student fails to meet theserequirements to the reasonable satisfaction of theUniversity, the contract between the ProspectiveStudent and the University shall, unless theUniversity agrees otherwise, automatically cometo an end and both parties shall be in the sameposition as if they had never entered into anycontract.

3.4 EnrolmentYou are required to enrol with the University at thestart of your Programme and to re-enrol as requiredby the University (normally annually).

4 Provision of programmes and servicesStudents will be notified of the date theirProgramme will commence. Unless this contractis terminated earlier, it will be completed on thelast day of the final Semester of the Student’sProgramme in the Student's final Academic Yearor the last day of any assessment of the Student’sperformance (whichever is later).

Semester means the two periods of theAcademic Year called semesters. The firstsemester runs from September to January andthe second semester runs from January to May.

Services means such educational services andfacilities which at its sole discretion are providedby the University for students (including but notlimited to the provision of library and IT services,participation in laboratories and field trips as partof the course and provision of student supportand guidance).

Student(s) means those students who arepursuing a Programme as an enrolled student ofthe University.

Terms and Conditions means the terms andconditions contained in this document and in theRegulations.

Tuition Fees means the fees charged by theUniversity specifically for the provision ofProgrammes to Students.

The University means Sheffield HallamUniversity.

2 Contract formationA contract on the Terms and Conditions is formedbetween you and the University at the point whenyou accept the offer of a place at the University.By accepting a place at the University you arealso agreeing to be bound by the Terms andConditions. It is therefore important that you readand understand them prior to accepting yourplace.

The contract will expire, subject to the provisionsfor early termination in the Terms and Conditions,on the completion of your Programme, whetheror not you are conferred with a University award.

3 Admission to the University3.1 Consideration of applicantsAll applications for a place at the University areconsidered on their merits in the context of thespecific and general guidance set out in theProspectus and any special requirements as setout in clause 3.2. All Prospective Students will berequired to declare unspent criminal convictions.The requirements stated in the Prospectus maybe varied from time to time without notice toProspective Students where it is reasonablyconsidered by the University to assist in theproper delivery of education. The University is notobliged to provide reasons for its decisions inrelation to applications.

3.2 Special requirementsStudents for certain specified Programmes mustcomply with special requirements. Some special

The University will use its reasonable endeavoursto deliver Programmes in accordance with thedescriptions set out in the relevant Prospectus.However, the Prospectus is produced at theearliest possible date to provide maximumassistance to intending applicants. It is inevitablethat changes will occur between the date ofprinting and the start of the Academic Year towhich they relate.

The University therefore4.1 reserves the right to make variations to thecontents or methods of delivery or assessment orlocations of Programmes, to discontinue orsuspend Programmes, to merge or combineProgrammes and to introduce new Programmes ifsuch action is reasonably considered to benecessary by the University. Such changes mayoccur either before or after enrolment of aStudent. Prospective Students and Students havea right to withdraw from the Programme if, afterthey accept a place, the course is substantiallyvaried from the description in the Prospectus; insuch circumstances our normal practice is torefund any Tuition Fees or deposit already paid ona pro rata basis for the unexpired period of theSemester or Academic Year for which such feeshave been prepaid once the University hasreceived written notice from you that you wish towithdraw from the Programme for that reason. Inthe event that the University discontinues orsuspends your Programme after an offer hasbeen accepted and at any time during yourProgramme the University’s normal practice is torefund any Tuition Fees and deposits you havepaid on a pro rata basis for the unexpired periodof the Semester or Academic Year for which feeshave been pre-paid. In addition, the University willuse its reasonable endeavours to provide asuitable alternative Programme at the University(for which fees will be payable) or suggest asuitable course at an alternative educationalinstitution but this shall be the full extent of itsliability.

4.2 reserves the right to make variations to orwithdraw Services if such actions are reasonablyconsidered to be necessary by the University. TheUniversity reserves the right to make additionalcharges and to vary such charges from time totime for Services.

4.3 aims to offer maximum flexibility of studywithin the relevant regulations but does notguarantee that all parts of and options withinProgrammes will be available to all Students whoare qualified to take them.

5 Rules and regulationsYou are required as a condition of accepting aplace at the University to abide by, and to submitto, the Regulations. These include regulations inthe following areas (although the list is not allembracing): academic; conduct and discipline;financial; health and safety; data protection;accommodation; library and computing; equalopportunities; intellectual property; complaints;and programme requirements. The mainRegulations are available from the Secretary andRegistrar and at http://my.shu.ac.uk

The University reserves the right to makereasonable changes to the Regulations where inthe opinion of the University it will assist in theproper delivery of education and/or it is in theinterests of the University. These changes willnormally come into effect at the beginning of thenext Academic Year. The University reserves theright to introduce changes during the AcademicYear when it reasonably considers it to be in theinterests of Students or it is required by law or bythe Funding Councils.

6 Payment6.1 FeesThe University charges Tuition Fees for thedelivery of its Programmes and you will haveprimary responsibility for payment, although inmany cases payment will be made on your behalfby a third party; for example a local educationauthority, the Student Loans Company or asponsor.

The University will invoice you or the third partypaying on your behalf for the Tuition Fees to bepaid on the date stipulated in the invoice. If thethird party does not make payment in full by thedue date you will be invoiced personally for anyoutstanding balance. If payment is not made,provisions of clause 6.4 may come into force.

You are contractually obliged to pay the TuitionFees and all other Fees on the dates they fall duefrom the moment the contract is formed, ie whenyou accept an offer of a place.

Tuition Fees are usually charged to Students inevery Academic Year of their Programme and youshould therefore ensure that the necessaryarrangements to pay your Tuition Fees have beenmade before enrolling for the next Academic Year.

The Tuition Fees for all Programmes are issued byStudent and Academic Services, which should becontacted for further details.

6.2 Level of fees and fee reviewThe levels of Fees are reviewed and may berevised on an annual basis prior to the beginningof the Academic Year in question.

6.3 Liability for tuition fees on terminationof contract/refunds

If you withdraw or transfer out of the University toanother institution before enrolment or within thefirst three weeks of your Programme all TuitionFees will be refunded subject to the Universityretaining all or part of any deposit as specified inclause 6.5.

If you withdraw from the University, transfer toanother institution or take time out from yourProgramme after the first three weeks but beforethe end of an Academic Year, refunds/credits ofTuition Fees paid are not automatically given. TheUniversity may refund a proportion of any TuitionFees pre-paid by you on a pro rata basis for theunexpired period of the Academic Year, subject tothe University retaining an amount to cover itsreasonable losses and costs as a result of thewithdrawal. The University will not refund any feespaid on your behalf by the Student LoansCompany.

You must formally notify the faculty officeimmediately in writing that you have withdrawnand any refunds/credits will be calculated from thedate the University receives such formalnotification.

6.4 DebtsIf you, or any third party who is supposed to payyour Tuition Fees on your behalf, fail to pay anyTuition Fees by the due date specified in theinvoice from the University, the University reservesthe right to charge you interest on anyoutstanding Tuition Fees on a daily basis at anannual interest rate of two per cent above thebase rate of HSBC until all outstanding TuitionFees and interest are paid.

The University reserves the right, at any timeduring the Academic Year, to withdraw you fromyour Programme and to withhold all services untilall outstanding Tuition Fees and interest are paidand/or terminate the contract between you andthe University. If at the end of an Academic Yearyou are in debt to the University for Tuition Fees,the University reserves the right not to allow youto enrol on your Programme for the nextAcademic Year. If you are in the final year of aProgramme, the University will not release yourcertificate, or a letter of confirmation of award,until all Tuition Fee debts to the University arepaid.

If you are in debt to the University for Fees relatedto any of the Services provided in associationwith your Programme, for example library fines,the University reserves the right to withdraw thatService until outstanding debts are paid.

6.5 DepositsThe University reserves the right to require a deposit forsome Programmes, as stated in your offer. Where adeposit is required your place will not be guaranteed untilit is paid and the University reserves the right towithdraw the offer of a place on the Programme withoutfurther notice to you if the deposit is not paid by the datestipulated in the offer. Under the Distance SellingRegulations 2000 you have a right to cancel your placewithin a specified period and details of this will benotified to you in your offer letter. If you withdraw beforethe expiry of the period notified to you in your offer letter,you will be entitled to a refund of any deposit paid. Ifhaving paid a deposit you cancel or withdraw from yourProgramme after expiry of the said period, then some orall of the deposit may be retained as a contributiontowards the University’s reasonable costs and losses.

6.6 Fees policy and proceduresFurther details about the University’s fees policiesand procedures may be found athttp://my.shu.ac.uk or by contacting the FinanceDirectorate. These Policies and Procedures, asvaried from time to time, form part of these Termsand Conditions.

7 Students’ UnionAll Students are automatically registered asmembers of the Students’ Union unless you notifythe President of the Students’ Union that you donot wish to register. Details of the procedures foropting-out of membership and other informationrelating to the Students’ Union are available fromthe Secretary and Registrar and athttp://my.shu.ac.uk. The University shall notunfairly disadvantage any Student because theyare not a member of the Students’ Union.

8 Ownership of students’ workIt is the policy of the University that the intellectualproperty rights to any original work created byStudents as part of their Programme willautomatically pass to the University, as set out inthe Intellectual Property Policy (details of whichare available from the Secretary and Registrar andat http://my.shu.ac.uk). The University undertakesto acknowledge appropriately the authorship andinventorship of such works created by Students.The University will share the net income derivedfrom the exploitation of such intellectual propertyrights with inventors, designers and/or authorswho are Students at the time of the work’s

creation. In line with our published IntellectualProperty Policy at the relevant time, thesearrangements will normally continue after the endof the Student’s Programme. The procedure forcalculating and distributing the sums payable toindividual creators is set out in the IntellectualProperty Policy. The provisions of this clause shallsurvive the expiry or termination of the contractbetween you and the University, however caused.

9 Collaborating OrganisationsIf you are studying at a CollaboratingOrganisation, you will be subject to certainadditional regulations and contractual terms ofthat Collaborating Organisation, includingdisciplinary regulations. Breach of these additionalregulations or contractual terms will be treated asa breach of the University’s Rules and Regulationsand may also result in the University requiring youto withdraw from your Programme and towithhold Services and/or terminate the contractbetween you and the University.

The University has agreements with CollaboratingOrganisations which set out the roles andresponsibilities of each in relation to youradmission, Programmes and Services. Wheresuch responsibilities rest with the CollaboratingOrganisation, the University excludes liability tothe fullest extent permissible by law for

• failure by the University or the CollaboratingOrganisation to carry out those responsibilities

• the negligent acts or omissions of theCollaborating Organisation’s staff or

• circumstances beyond the University’s or theCollaborating Organisation’s control, whichprevent or limit performance of the University’sor the Collaborating Organisation’s obligationssave that, the University does not exclude anyliability for any personal injury to or death of aStudent due to any negligent act or omissionof the University or its staff.

10 Data Protection ActThe University is registered under the DataProtection Act 1998 (DPA 1998) to hold personaldata (as defined under the DPA 1998 (PersonalData)) including sensitive personal data (asdefined under DPA 1998 (Sensitive Data)) on itsStudents and third parties such as individualsenquiring about University Services. TheUniversity will only hold and use Personal Data forthe purposes stated in the register entry and/or inline with the requirements of the DPA 1998. TheUniversity may disclose your Personal Data tothose third parties set out in the University Codeon Personal Data and shall only disclose your

Sensitive Data with your explicit consent and/oras permitted under the DPA 1998.

The Terms and Conditions incorporate theUniversity Code on Personal Data (DataProtection Code) which is available from theSecretary and Registrar and athttp://my.shu.ac.uk. The Data Protection Codesets out a policy statement and procedures toensure that you and the University abide by theDPA 1998 and the University follows goodpractice in its use of Personal Data and SensitiveData. The Data Protection Code also sets outinformation on the purposes for which PersonalData is held on students, the categories of dataheld, the safeguards in place, organisations towhom the University may disclose your PersonalData and Students’ responsibilities. The Universityand Students must comply with the DataProtection Code.

11 Liability11.1 GeneralStudents are advised to obtain insurance for theirown property before arrival at the University andshould note that sporting activities are undertakenat their own risk. In certain circumstances youmay be required to obtain other types ofinsurance, for example medical insurance. TheUniversity cannot accept responsibility, andexpressly excludes liability to the fullest extentpermissible by law, for

• all damage to your property (including vehiclesand bicycles parked on University campuses)unless it is caused by the negligence ordefault of the University or its staff

• the non-return of work submitted forassessment

• any modification or cancellation of Programmes

• personal injuries or death except in so far as itis caused by the negligence of the University orits staff

• all indirect and consequential losses, loss ofopportunity and loss of income or profit,however arising

In any event, save for any liability in negligence forpersonal injury or death, any remaining liability orany other liability of the University in contract, tort,breach of statutory duty, misrepresentation or anyother liabilities, however occurring, are limited tothe value of Tuition Fees paid by or on behalf ofthe Prospective Student or Student to theUniversity or the amount, if any, the Universityreceives from its insurers in respect of thatparticular loss, whichever is the greater.

11.2 Exclusion of liability for eventsbeyond reasonable control

Neither party shall be liable to the other for anyfailure or delay in performing its obligations underthis contract if such failure or delay is due to anycause beyond that party’s reasonable control.This will include (but will not be limited to)governmental actions, war, riots, civil commotion,fire, flood, epidemic, labour disputes (includinglabour disputes involving the workforce of anythird party) and acts of God.

11.3 Connecting Student’s personal ITequipment to the Universitynetwork

Students may not connect personal IT equipmentto the University network unless expressindividual consent has been obtained as set outin the Regulations for the Use of IT Facilities(available from the Secretary and Registrar and athttp://my.shu.ac.uk). Students connecting to thenetwork do so on the basis that they accept allrisks associated with the connection (for examplevirus attack) and that the University accepts noliability save for loss or damage caused directlyby the negligence or breach of contract by theUniversity or its staff and provided always that theUniversity accepts no liability for any indirect andconsequential losses.

12 Termination of Contract12.1 Termination of contract by the UniversityThe University may without liability terminate thisagreement at any time immediately by writtennotice if you are in material breach of the Termsand Conditions and in particular in the followingcircumstances

(a) if you have provided false, incomplete ormisleading information in relation to yourapplication for admission to the University

(b) if you fail to comply with requests forinformation, to make declarations, and/or to meetany specific requirements of your Programme

(c) where your circumstances change so that youare no longer able to meet the specialrequirements set out in clause 3.2, for example,you acquire a relevant criminal conviction ordevelop a condition so that you no longer meetthe occupational health requirements

(d) if you fail to meet the requirement to enrol inthe first year of your Programme or fail to re-enrolin subsequent years within the required timescale

(e) where it has been found that you havebreached the Disciplinary Regulations (availablefrom the Secretary and Registrar and athttp://my.shu.ac.uk)

(f) if you fail to meet the required standard ofStudents’ performance for your Programme,including but not limited to unsatisfactorystandard of work, failure to meet specifiedattendance requirements (for your Programme),failure to submit coursework and/or meetProgramme deadlines, failure to fulfil a specifiedcontract of studentship in a Programme andfailure to adhere to professional standards fortraining purposes.

(g) if you fail to pay any Tuition Fees by the duedate specified on the University’s official invoice.This includes where you have an agreement witha third party for them to pay your Tuition Fees onyour behalf since you are contractuallyresponsible for payment of fees.

The effect of the University terminating thiscontract under this clause 12.1 or under anyother provision of the Terms and Conditions willbe that you will either be refused enrolment to theUniversity or you will be required to withdraw fromthe University immediately and you will no longerbe entitled to commence or continue yourProgramme. The University may in its absolutediscretion refund or abate a proportion of anypre-paid Fees on a pro rata basis for theunexpired period of the Academic Year, subject tothe University retaining an amount to cover itsreasonable losses and costs as a result of thetermination.

12.2 Termination of contract by the studentIf you decide prior to enrolment in your firstAcademic Year not to take up a place offered toyou, you must notify us immediately and in anyevent prior to the date upon which enrolment isscheduled to take place. You may be entitled to arefund of all or part of any deposit paid (as setout in clause 6.5). Students withdrawing,transferring to another institution or taking timeout from their course after enrolment may beentitled to a refund of all or part of their TuitionFees (see clause 6.3). The University willendeavour to provide information and advice tosuch Students.

13 NoticesAny notice served by the University under theseTerms and Conditions and any correspondencefrom the University shall be deemed to have beenserved two working days after dispatching to theaddress notified to the University by you. TheUniversity shall be entitled to assume that the lasthome and term-time addresses notified by you toit are your current addresses, and therefore youmust keep the University informed of anychanges to these addresses.

Any correspondence from the Student to theUniversity should go to the address specified forsuch correspondence in these Terms andConditions or the Regulations or if an address isnot specified, to the general University addressSecretary and Registrar, City Campus, SheffieldHallam University S1 1WB. Suchcorrespondence shall be deemed to have beenserved on the University two working days afterposting.

14 Changes to Terms and Conditions14.1 The University reserves the right to makereasonable changes to the Terms and Conditionsfrom time to time, both before and after youenrol, where in the opinion of the University it willassist in the proper delivery of education, wherechanges are in the interests of the Universityand/or in order to

• comply with any changes in the law or to takeaccount of a ruling by a court or similar body

• comply with any changes requested by theHigher Education Funding Council for England,the Training and Development Agency forSchools or any other major funding body

• implement legal advice, national guidance orgood practice

• provide for the introduction of new or improvedmethods of operation, services or facilities

• reflect market conditions

• make them clearer or more favourable to you

• rectify any error that might be discovered in duecourse; and/or

• further to codify existing arrangements

These changes will normally come into effect atthe beginning of the next Academic Year,although the University reserves the right tointroduce changes during the Academic Yearwhen it reasonably considers it to be in theinterests of Students or required by law.

14.2 In the event that any term, condition orprovision contained in the Terms and Conditionsis held to be invalid, unlawful or unenforceable toany extent, such term, condition or provisionshall, to that extent, be severed from the contractbetween you and the University without affectingthe remaining Terms and Conditions which shallcontinue to be valid.

14.3 If the University permits you to transferbetween Programmes, such transfer shall betreated as a variation of your contract with theUniversity and will be subject to your continuedacceptance of the Terms and Conditions. Noother variation or amendment to this contract

may be made by you without the prior writtenconsent of the University.

14.4 Any new editions of the Terms andConditions shall be placed in University librariesand Student and Academic Services, published athttp://my.shu.ac.uk and may be publicised byother means so that you can be aware of anychanges.

15 Status of Terms and ConditionsThese Terms and Conditions represent the entireagreement between you and the University andshall supersede any and all prior agreements andall other documents or statements, written or oral,between you and the University.

In the event of inconsistencies between the Termsand Conditions in this document, the Regulationsand the Prospectus, the Terms and Conditions inthis document shall prevail over the Regulationswhich shall in turn prevail over the Prospectus.

Any failure of or delay by the University or aStudent in relation to the exercise of its rightsunder the Terms and Conditions shall notconstitute a waiver of such rights and any waiverin respect of one act or omission shall notoperate as a waiver in respect of any other orfuture acts or omissions.

It is not intended that any third party should beentitled to enforce any of the provisions of theseTerms and Conditions and in particular no thirdparty who would not have been so entitled exceptunder the provisions of the Contracts (Rights ofThird Parties) Act 1999.

16 Law and JurisdictionThis agreement shall be governed by andconstrued in all respects in accordance with thelaws of England and Wales and the parties agreeto submit to the jurisdiction of the courts ofEngland and Wales.

17 HeadingsThe headings in these Terms and Conditions areincluded for convenience or reference only andshall not affect the interpretation of thisagreement.
