Made by the Governor in Executive Council.

1. Citation

These regulations are the Western Australian Meat Industry Authority Amendment Regulations 2015.

2. Commencement

These regulations come into operation as follows — (a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Western Australian Meat Industry Authority Regulations 1985.

4. Regulation 34 amended

In regulation 34(3A) delete “$0.41” and insert:

Local Government Amendment (Cats) Local Law 2015

Made by the Governor in Executive Council under section 3.17(1) of the Act.

1. Citation

This local law is the Local Government Amendment (Cats) Local Law 2015.

2. Commencement

This local law comes into operation as follows — (a) clauses 1 and 2 — on the day on which this local law is

published in the Gazette; (b) the rest of the local law — on the day after that day.

3. Ashburton local law amended

(1) This clause amends the Shire of Ashburton “Local Law Relating

to the Control of Cats” made by the Shire of Ashburton and published in the Gazette on 3 June 1998 at p. 3031-6.

(2) In clause 4(1) delete the definition of public place.

(3) In clause 7(6) delete “premises or public place.” and insert:

4. Busselton local law amended

(1) This clause amends the City of Busselton Keeping and Control of Cats Local Law 2014 made by the City of Busselton and published in the Gazette on 10 February 2014 at p. 307-11.

(2) In clause 1.5 delete the definition of public place.

(3) Delete Part 2.

(4) In Schedule 2 delete items 1 and 2.

5. Capel local law amended

(1) This clause amends the Keeping and Welfare of Cats Local Law made by the Shire of Capel and published in the Gazette on 3 August 2004 at p. 3141-9 and as amended in the Gazette on 1 February 2005 p. 554-5 and in the Gazette on 4 May 2010 p. 1686-7.

(2) In clause 3.1 delete the definition of Public place.

(3) Delete clause 6.

(4) In clause 16.1 delete “5.11, 6.1 (b), 6.2 (b)” and insert:

6. Donnybrook-Balingup local law amended

(1) This clause amends the Shire of Donnybrook-Balingup Keeping and Welfare of Cats Local Law 2007 made by the Shire of Donnybrook-Balingup and published in the Gazette on 13 April 2007 at p. 1673-81.

(2) In clause 3.1 delete the definition of Public place.

1. Citation

This order is the Local Government (Albany - Change of Ward Boundaries) Order 2015.

2. Commencement

This order comes into operation as follows — (a) clauses 1 and 2 — on the day on which this order is

published in the Gazette; (b) the rest of the order — on the day after that day.

3. Terms used Authority has the meaning given in section 9.69(1) of the Act; commencement day means the day on which clause 4 comes

into operation; Deposited Plan, followed by a number, means the deposited

plan of that number — (a) lodged with the Authority; and (b) certified by an authorised land officer, as defined in

section 9.69(1) of the Act; and (c) available — (i) in paper form at the Authority’s head office; and

(2) On next election day, the boundaries of the Frederickstown Ward in the district of Albany are changed so that the ward consists of the land delineated in red and coloured yellow on Deposited Plan 405587 version 1.

In this order — Authority has the meaning given in section 9.69(1) of the Act; commencement day means the day on which clause 4 comes

In this order — Authority has the meaning given in section 9.69(1) of the Act; commencement day means the day on which clause 4 comes

(1) On next election day, the boundaries of the Central Ward in the district of Wanneroo are changed so that the ward consists of the land delineated in red and coloured pink on Deposited Plan 405575 version 2.

(2) On next election day, the boundaries of the North Ward in the district of Wanneroo are changed so that the ward consists of the land delineated in red and coloured yellow on Deposited Plan 405575 version 2.

(3) On next election day, the boundaries of the South Ward in the district of Wanneroo are changed so that the ward consists of the land delineated in red and coloured green on Deposited Plan 405575 version 2.

6. Ward name changed

On next election day, the name of the ward described in clause 5(2) is changed to North Coast.

7. Number of councillors changed

(1) On and from next election day, the number of offices of councillor for the Central Ward on the council of the City of Wanneroo is 4.

(2) On and from next election day, the number of offices of councillor for the North Coast Ward on the council of the City of Wanneroo is 5.

8. Continuing councillors allocated

(1) In this clause — continuing councillor means a councillor whose term of office

as councillor continues beyond next election day.

(2) On and from next election day, a continuing councillor who was a councillor for the Coastal Ward in the district of Wanneroo immediately before its abolition under clause 4 is to be taken to have been elected as a councillor for the North Coast Ward in the district of Wanneroo.

9. Consequential directions

In order to give effect to clauses 4 to 8 — (a) Part 4 of the Act applies to preparing for and conducting

the next election as if the changes effected by this order take effect on commencement day; and

(b) the operation of Part 4 of the Act is modified to the extent necessary for the purposes of paragraph (a).

2. Commencement

This order comes into operation as follows — (a) clauses 1 and 2 — on the day on which this order is

published in the Gazette; (b) the rest of the order — on the day after that day.

3. Terms used

In this order — Authority has the meaning given in section 9.69(1) of the Act; commencement day means the day on which clause 4 comes

into operation; Deposited Plan, followed by a number, means the deposited

plan of that number — (a) lodged with the Authority; and (b) certified by an authorised land officer, as defined in

6. Number of councillors for new ward specified

On and from next election day, the number of offices of councillor for the Useless Loop/Pastoral Ward on the council of the Shire of Shark Bay is 2.

7. Continuing councillor allocated to new ward

(1) In this clause — continuing councillor means a councillor whose term of office

as councillor continues beyond next election day.

(2) On and from next election day, a continuing councillor who was a councillor for the Pastoral Ward in the district of Shark Bay immediately before its abolition under clause 4(b) is to be taken to have been elected as a councillor for the Useless Loop/Pastoral Ward in the district of Shark Bay established under clause 5(1).

8. Consequential directions

In order to give effect to clauses 4 to 7 — (a) Part 4 of the Act applies to preparing for and conducting

the next election as if the changes effected by this order take effect on commencement day; and

(b) the operation of Part 4 of the Act is modified to the extent necessary for the purposes of paragraph (a).

Notice to all owners and/or occupiers of land in the Shire of Dandaragan.

Notice is hereby given to landowners/occupiers within the Shire of Dandaragan that fire-breaks must be installed by 1st November 2015 and maintained clear of inflammable material up to and including 30th April 2016 as per the requirements in relation to Section 33 of the Bush Fires Act 1954.

Firebreak Standards

Properties 20 hectares (50 acres) or larger

1. Clear a firebreak consisting of mineral earth, to a width of no less than 3m, as close as practical, inside the external boundaries of the property.

2. Fire-breaks must be maintained to provide a vertical clearance of a minimum 4m so as to allow adequate access for fire appliances subject to the satisfaction of the Council’s appointed officers.

3. Construct a 5m mineral earth firebreak immediately surrounding all fuel and chemical storage areas.

4. Clear inflammable material within 20m of all dwellings to construct a 20m circle of safety. This can be maintained through domestic grass, mulch or slashed native grasses.

5. Areas cleared and piled for burning require a 20m mineral earth firebreak.

All other Non Urban Land

Properties 2,023m2 (half an acre) to 20 hectares (50 acres) (Rural residential, rural development)

This category relates to nearly all lots in all industrial estates and the subdivisions of Jurien Bay Heights, Alta Mare, Marine Fields, Kooringal Vale and Hill River.

1. Clear a 3m wide mineral earth firebreak (clear of all inflammable material) with a vertical clearance of 4m high, clear of any obstructions (no hanging tree limbs or objects) immediately inside or as close as practical inside all external boundaries of the land to allow for the unobstructed movement of Fire Appliances.

2. On heavily vegetated or grassed blocks, implement supplementary fuel reduction for a further 5m inside the firebreak. Subject to the satisfaction of Council’s authorised officers.

3. Clear all inflammable material within 20m of all buildings to construct a 20m circle of safety. This can be maintained through domestic grass, mulch or slashed native grasses.

Urban Land (All town sites)

Land 4,000m2 or less

Clear land of all inflammable material on the entire property shall be reduced and maintained to a height of less than (5) centimetre.

Land larger than 4,001m2

A firebreak of at least 3m wide shall be installed or constructed immediately inside all external boundaries of the land and so immediately surrounding all buildings situated on the land.

Plantations

Tree plantations of more than 3 hectares but less than 10 hectares

Construct a 10m wide mineral earth firebreak with a vertical clearance of 4m high; clear of all inflammable material immediately surrounding the plantation (adjacent areas of the same property subject to provisions as for rural areas).

Plantations larger than 10 hectares

Comply with the Code of Practice for Timber Plantations in Western Australia Guidelines for Plantation Fire Protection. A copy is available from the Shire of Dandaragan Administration Centre upon request.

Alternative Alignments and Variations to Firebreak Notices

If it is impractical to have a firebreak immediately inside a boundary, for environmental or any other reason(s), you are required to apply to the Shire of Dandaragan in writing, before 1st October to obtain permission for firebreaks to be installed in an alternative position or for alternative measures to be put in place. Once approval is granted, there is no need to re-apply each year, unless circumstances change or a duly appointed officer feels that the conditions of the Firebreak Variation notice are not being met.
