    Introduction

    Today, Illinois stands at a crossroads. Our

    state faces mounting debt and troublesomeunemployment. Signicant budget challenges

    have been caused and are now intensied bydestructive overspending habits and a job-killing regulatory approach.

    In the midst of this crisis, Illinois citizens andtheir leaders must turn the states affairs aroundand put Illinois back on the path to prosperity.

    Policy changes livesand at the Illinois PolicyInstitute, were working to promote policies

    that change lives for the better. Voters electand inuence policymakers; in turn, lawmakersset the policies that affect our day-to-day lives.Illinois citizens have great power to shapepolicy, yet few have the time to follow General

    Assembly votes from the House and Senategalleries in Springeldor even from mediareports and Internet accounts.

    In an attempt to shed more light on state policy,the Illinois Policy Institute has put together its

    rst annual Legislative Vote Card. The Vote Cardhighlights some of the most important piecesof legislation affecting scal, transparency,regulatory, and education policy deliberatedin the 96th session of the Illinois General

    Assembly.

    In 2010, the bicameral General Assemblydiscussed and voted on multiple key measures

    that either advanced or detracted from positivechange in Illinois. Of the many bills votedon by Illinois lawmakers in this years regular

    session, the Vote Cardhighlights nineteenmeasures brought before the House ofRepresentatives and eleven bills considered bythe State Senate. These measures were deemed

    to have a particularly important impact onfree market principles and liberty-based publicpolicy. The Vote Cardindicates the position ofevery legislator on each particular bill, offering

    a snapshot of members positions on keylegislation.

    Illinois Policy Institute

    The Illinois Policy Institute is a non-partisan

    research organization focused on improvingpubic policy in Illinois. The Institute focuseson improving public policy by applying liberty-advancing principles to all levels of government

    with the understanding that free societies andfree markets allow individuals to ourish andprosper. The Institute is dedicated to fosteringeconomic freedom, increasing government

    transparency and accountability, and betteringthe health and living standards of all Illinoisans.

    The Illinois Policy Institute supports practical,

    common-sense solutions to rein in out-of-control spending, improve governmenttransparency, and break down roadblocks to

    economic opportunity.

    Bill Selection

    This Vote Cardassesses roll call votes on keybills that have an identiable impact on the free

    market in one of the following areas: budgetand taxes, government regulation, transparency

    and accountability, and education. Bills notrelated to the Institutes mission were notincluded.

    The 2010 Legislative Vote Cardincludes roll call

    votes on bills that received a recorded oorvote in at least one chamber. The Vote Carddoes not account for bill sponsorship or billsthat did not receive a related oor vote. All bills

    were chosen for consideration based on theirpolicy merits.

    Reading the 2010 LegislativeVote Card

    Legislative progress is not always easy to follow,

    especially for the vast majority of residentswho do not prowl the halls of the StateCapitol on a daily basis. With that in mind, we

    present and elucidate each bill covered in theVote Cardbefore providing the results. Eachbills background and relevance is explained,followed by a small synopsis of the free-

    market position on the bill and an update onwhat ultimately resulted from the deliberation.Each summary is intended to give a succinct

    illustration of the measure and how it impactsIllinois and its citizens. Following the billdescriptions is the bill-by-bill voting record ofindividual members of each chamber.

    The Vote Cardis divided into two tables,the rst displaying the Illinois State

    Senate, followed by the Illinois House ofRepresentatives. State Senators and HouseRepresentatives are arranged alphabetically bylast name.

    From left to right, the bills of focus areorganized by issue category. The Vote Cardlists education measures rst, budget and

    tax measures second, regulation third, andtransparency and accountability measures last.

    Y denotes a yes vote on that particular voteon a particular bill, and N denotes a novote. It is worth noting that procedural rulescan result in legislators voting no in some

    instances, such as a motion to sustain an effortto table a bill, even when they seek to pass a

    bill. Other votes, such as absent and presentvotes, are indicated.

    Votes that align with the free market positionare colored green, while votes that do not align

    with the free-market position are colored red.

    HB0859 was passed by both chambers in May2010. In July 2010, the Governor used an item/reduction veto to reduce the bills spending by

    $155 million.

    SB1946: Pension Benet Reform

    Free-Market Position:Vote Yea

    Relevant Vote Outcome: 48-6-3

    Result: Passed both chambers and signedinto law by the Governor in April 2010

    SB1946 provides for public employee

    pension benet reforms, but it only applies

    to newly hired state employees. It increasesthe retirement age for full benets to 67(with at least 10 years of service credit), caps

    annual pensions at $106,800, and prohibitssimultaneously receiving a pension and a publicpaycheck (double dipping). While these reforms

    were the bare minimum of the pension benetreforms needed, they are a step in the rightdirection. SB1946 passed the House and theSenate in March 2010 and was signed into law

    by the Governor in April 2010.

    SB0044: Tobacco Tax Hike

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 30-26-0

    Result: Passed the Senate

    SB0044 would increase the state tobacco tax by

    25 mills per cigarette and widen the denitionof cigarette to include little cigars. Increasesin cigarette taxes have a history of falling

    short of their revenue projections, and harmsmall businesses as more consumers buy theircigarettes in lower-tax states. Because cigarettetaxes are an unreliable source of funding, otherstate tax increases may be necessary in the

    future if revenues from a tobacco tax hike fallshort. SB0044 passed the Senate in April 2009,but has not been voted on in the House. It is

    currently in the House Rules Committee.

    SB2494: Opportunity

    Scholarships

    Free-Market Position:Vote Yea

    Relevant Vote Outcome: 33-20-3

    Result: Passed the Senate, but stalled inthe House

    SB2494 would allow students attending thelowest-performing 10 percent of elementaryschools in the Chicago Public School system to

    receive vouchers of approximately $4,000 fortuition on any private school of their choice.This legislation would give parents in Chicagosfailing elementary schools new educational

    choices for their children. The free-marketposition is yea for this bill. SB2494 passedthe Senate, but stalled in the House. Supporters

    of SB2494 plan to bring the bill up for a Housevote during future legislative sessions.

    Illinois State Senate: Budget & Taxes

    HB0859: FY 2011 Appropriations

    Bill

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 31-26-0

    Result: Passed both chambers andreceived item/reduction veto from the

    Governor

    HB0859 is the main appropriations bill for the2011 scal year; the bill included more than

    $26 billion in spending and very little by way ofsignicant spending reforms. Illinoiss currentscal situation cannot be resolved withoutaddressing the states out-of-control spending.

    HB0859 continues to feed the states budgetshortfalls instead of making the necessaryspending cuts to truly balance the budget.

    HB0543: Pension Payment Skip

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 31-26-0

    Result: Passed both chambers and tabledin the Rules Committee as of May 2010

    HB0543 originated in the House as a billunrelated to pension funding and was passed.The Senate placed an amendment on the bill

    overriding the original content, which allowsfor the state to skip the $4 billion pensionpayment for scal year 2011. Skipping the2011 pension payment would result in over $30

    billion in additional costs to taxpayers over 30years. The spirit of this bill is a vivid reectionof the policy decisions that have led the state

    into its current scal mess. HB0543 passed theSenate in May 2010. The bill is currently in theHouse pending concurrence with the Senateamendment and has been tabled in the Rules

    Committee as of May 2010.

    Illinois State Senate: Government

    Regulation

    HB5783: Hair Braider Licensing

    Free-Market Position:Vote Yea

    Relevant Vote Outcome: 44-8-0

    Result: Passed both chambers and signed

    into law by the Governor in July 2010

    HB5783 reduces the cosmetology education

    requirement for hair braiders from 1500 hoursto 300 hours. This will allow hair braiders

    to practice their craft with less burdensomelicensing requirements. Holding hair braiders

    to the licensing requirements of cosmetologistsis not logical; braiding is non-invasive and doesnot include the use of dangerous chemicals ortools. Reducing the licensing requirements for

    hair braiders will enable these small businessowners to ourish in their communities andact as beacons for entrepreneurship. The bill

    passed both chambers in April 2010 and wassigned into law by the Governor in July 2010.

    The bill becomes effective January 1, 2011.

    SB3660: Emergency Budget Act

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 32-23-1

    Result: Passed both chambers and signedinto law by the Governor in July 2010

    SB3660 gives the Governor unprecedentedpowers to reduce and reserve funds for thescal year 2011 budget. These powers end on

    January 9, 2011. This public act would give theGovernor power to make unilateral budgetdecisions without question. Check and balancesserve as crucial tests needed in government;

    regardless of our states nancial situation, ourlawmakers are elected and paid by taxpayers tomake the tough decisions vital to state order.

    The free-market position is nay on this bill.SB3660 passed both the House and Senate inthe spring of 2010, and was signed into law bythe Governor in July 2010.

    SB1215: Additional FY 2011

    Appropriations

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 35-20-0

    Result: Passed both chambers and signed

    into law by the Governor in July 2010

    SB1215 included $145.2 million in additionalappropriations for scal year 2011. Legislators

    refused to make the difcult spending cutsnecessary to close the states decit. Theincreased 2011 appropriation from the states

    general revenue fund is another example of

    this missed opportunity to chisel away at themounting decit. The free-market position onthis bill is nay. SB1215 passed both chambers

    in the spring of 2010 and was signed by theGovernor on July 2010.

    The Governors amendatory veto adds

    four Governor-appointed members to theCommission, inserts social services, health care,labor, and education professional categories tothe list of required backgrounds, includes that

    the Commission shall hold at least six publicmeetings allowing for public comment, and theCommission shall submit its ndings online.

    One of the Governors changes draws a redag: The four Governor-appointed positionswould now include social services, health care,labor, and education professionals. The intent

    of the Commission was to provide an unbiased,

    outside review of government programs andstate executive branches. The inclusion ofprofessionals afliated with, or directly affected

    by, programs subject to review represents apotential conict of interest and could stallor disrupt the reviews conducted by the

    Commission. As such, the free-market vote willbe to override the Governors amendatory veto.

    HB5154: Public Employee Review

    Transparency

    Free-Market Position:Vote Nay

    Relevant Vote Outcome: 45-9-1

    Result: Passed both chambers andreceived an amendatory veto from theGovernor in July 2010

    HB5154 prohibits the disclosure of stateemployee performance evaluations under theFreedom of Information Act. This legislation is

    a step backwards from the goal of a transparent

    and accountable state government. Taxpayersfund the state government. They should be

    able to see whether the public employees theypay are meeting job performance standards.HB5154 passed both the House and Senatein the spring of 2010, and the Governor

    amendatory vetoed the bill in July 2010. The

    Governors veto amended the bills scope to

    only exempt state and local law enforcementpersonnel reviews from access through theFreedom of Information Act.

    Illinois State Senate: Transparency &

    Accountability

    HB5241: Medicaid SpendingTransparency

    Free-Market Position:Vote Yea

    Relevant Vote Outcome: 58-0-0

    Result: Passed both chambers and signedinto law by the Governor in July 2010

    HB5241 allows for the creation of an onlinetransparency database of Medicaid claims thatcan be accessed by program administrators and

    the public. Identifying characteristics wouldbe withheld from the database to protectindividual privacy. The legislation wouldprovide administrators with more information

    on how Medicaid resources are utilized toimprove health outcomes. The legislation wouldhelp taxpayers better understand how theirresources are spent by the state government.

    HB5241 passed the House and the Senateunanimously in the spring of 2010 and wassigned into law by the Governor in June 2010.

    HB4836: Sunshine Commission

    ActFree-Market Position: Vote Yea

    Relevant Vote Outcome: 54-0-0

    Result: Passed both chambers andreceived an amendatory veto from the

    Governor in July 2010

    HB4836 would create the SunshineCommission, an eight-person committee,

    to review the relevance, efciency, andeffectiveness of each state executive branchprogram. The eight-person Commission would

    consist of four volunteer public members withbackgrounds in banking, nance, or accounting,and four legislators. HB4836 would helpeliminate waste and better direct the states

    limited resources, offering a win-win situationfor government, taxpayers, families andbusinesses. HB4836 unanimously passed theHouse and Senate, but the Governor placed an
