2008MINI Hardtop andClubmanTheMINIMaintenance Program

The MINI Maintenance Program is a benefitdesigned to help reduce the cost of scheduledand unscheduled maintenance. The programhas been devised with the following objectives:to maximize vehicle safety, reliability, and resalevalue by minimizing breakdowns resulting fromwear, and minimizing cost and inconvenience bycomputing maintenance intervals based uponthe specific manner in which each individualvehicle is driven.

MINI Cooper and MINI Cooper S passenger carspurchased from any authorized MINI dealer inthe United States are covered by the MINI Main-tenance Program for 36 months or36,000 miles, whichever occurs first. Coveragebegins on the date of first retail sale or the datethe vehicle is first placed into service as a salesdemonstrator, service loaner (SLP) or companyvehicle, whichever is earlier.

Any authorized MINI dealer in the United Stateswill perform the scheduled or additional mainte-nance services on your vehicle at no expense toyou.

Coverage

The MINI Maintenance Program covers all fac-tory recommended maintenance, as determinedby the Condition Based Service (CBS) system.Additional items that need replacement due tonormal wear and tear, and that are not coveredby the original MINI New Passenger Car LimitedWarranty - such as brake pads, brake rotors, andwiper blades - are included, provided wear andtear exceeds MINI specifications. Any adjust-ments required due to normal operating condi-tions are also included. See pages 6 - 8 of thisbooklet for additional information.

Exclusions from coverage include the following:� Items reimbursable under your MINI New

Passenger Car Limited Warranty� Gasoline and gasoline additive

� Windshield washer additive (except when inconjunction with scheduled maintenance)

� Tires, wheel alignment, tire balance androtation

� Reset Run Flat Indicator� Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, door pan-els and all chrome trim

� Damage detected when performing the rustperforation inspection

� Damage which results from negligence,improper operation of the vehicle, wear andtear or deterioration due to driving habits orconditions, improper repair, environmentalinfluences, flood, accident or fire damage,road salt corrosion, alteration, installation ofnon-genuine MINI accessories, or use ofimproper, poor quality or contaminated fuel.

� Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined

� Maintenance or repair after the vehicle isdeemed a total loss

� Maintenance or repairs performed by otherthan an Authorized MINI dealer within theUnited States

� Vehicles used in competitive events� Oil changes performed outside the recom-

mended maintenance intervals as indicatedby the CBS

Maintenance UpgradeOption

Please contact your authorized MINI dealer forinformation and availability on the optional Main-tenance Program Upgrade for coverage up to6 years and 100,000 miles.

Intervals

Time intervals should be followed using themaintenance interval as indicated by the Condi-tion Based Service data.

Maintenance intervals on motor vehicles haveconventionally been specified based upon accu-mulated mileage. However, the type of drivingconditions has a major influence on routinemaintenance requirements; distance traveled isonly one of the significant factors. A vehicledriven for 50,000 miles of short trips in the citywith numerous cold starts, prolonged periods ofidling, stop-and-go driving, and high enginespeeds during acceleration requires more fre-quent maintenance intervals than a vehicledriven for 50,000 miles for long distances at lowengine speeds primarily at operatingtemperature.

The advanced technologies at MINI have led tothe development of the Condition Based Ser-vice (CBS) system which computes the actualoptimum maintenance requirements based notonly upon the accumulated mileage, but takinginto account important factors such as high orlow engine speeds, short or long trip driving,and condition of the engine oil and brake pads.

Condition Based Service (CBS)

CBS is a further development of the ServiceInterval Indicator System. Sensors and sophisti-cated algorithms take even more detailedaccount of the various conditions of vehicle use.

The remaining times for selected maintenancetasks as well as any legally prescribed dates aredisplayed to you individually:� Engine oil� Brakes - front and rear separately� Brake fluid� Vehicle check� Required State Inspection(s)

CBS thus determines the current and futuremaintenance requirements.

The vehicle’s current service status is automati-cally saved in the remote control key. The MINIService Advisor at your MINI dealer has a devicecalled a key reader. When your MINI ServiceAdvisor inserts your key into the key reader, allpertinent vehicle and servicing data will be avail-able, and a customized maintenance checklist isprinted out based on the specific operationscalled for by the Condition Based Service.

Have maintenance and repair work performedby your MINI dealer. Make sure that the mainte-nance work is stamped in this Service and War-ranty Information Statement. These entries arethe evidence of regular maintenance of yourvehicle and a requirement for warranty claims.

Disconnecting the battery during periodsof long-term storage will interrupt the

calculation of time-based services. Have allitems requiring time-based maintenance, suchas brake fluid and coolant, and possibly also theengine oil brought up to date by your MINIdealer. Also see the section on battery care onpage 18 of this statement.

Service Interval Display

The remaining driving distance and the date ofthe next schedule service are displayed brieflyimmediately after you start the engine or switchon the ignition.

For specific maintenance operations, you canview the respective distance remaining or duedate individually in the tachometer.

1. With the engine running, press the button inthe turn indicator lever repeatedly until“SET/INFO” appears.

2. Keep the button pressed until the displaychanges.

3. Briefly press the button until the corre-sponding symbol and “SERVICE-INFO”appear.

4. Keep the button pressed until the displaychanges.

5. Briefly press the button to display the indi-vidual service requirements.

Special Note

The maintenance requirements for your vehicleare determined dynamically by the ConditionBased Service (CBS) system . The maintenanceitems stated herein reflect the latest informationavailable at the time of the printing of this state-ment, and are subject to change. The most cur-rent maintenance recommendations areavailable from your authorized MINI dealer.

The performance of certain subsequent mainte-nance elements, as required by the MINI NewPassenger Car Limited Warranty, will be speci-fied at intervals computed by the MINI ServiceInterval Indicator.� Oil Service: Engine oil should be changed

with the engine at operating temperature.Note: Change oil at least once a year.

Your MINI is factory-equipped with a newly-de-veloped synthetic engine oil. At the time of theprinting of this booklet, the following oils arestrongly recommended and approved by theMINI Division of BMW of North America, LLC.for the Cooper and Cooper S models.� MINI High-Performance Synthetic 5W-30 Oil

(Part Number 07 51 0 143 829)� Mobil 1 5W-30� Mobil 1 5W-40

MINI recommends that you check your engineoil level whenever you add fuel to your vehicle. Ifyou need to add oil between oil changes andare unable to obtain MINI High PerformanceSynthetic Oil, Mobil 1 or another special oil onthe list, use a synthetic oil with an API rating ofSJ or higher.

The following maintenance elements must beperformed at the mileage/time stated (timeintervals begin from the vehicle’s productiondate):� Brake Fluid Service: Change brake fluid every

two years, or when specified by CBS.

� Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced at the followingintervals to maximize vehicle fuel economyand minimize exhaust pollution. Replace at120,000 miles.

� Spark Plug Service: Replace at the followingintervals:Cooper: 100,000 milesCooper S: 60,000 miles

� The engine coolant has a lifetime rating anddoes not need to be changed except for sys-tem repairs.

For your convenience, you may also wish tohave your MINI dealer perform any necessaryoperations to fulfill any state inspection require-ments in your area concurrent with the mainte-nance elements specified above during otherrepairs. Should you request more frequentmaintenance service, the cost of these ser-vices will not be covered by the MINI Mainte-nance Program.

Your MINI dealerhas made a substantial investment in uniqueMINI special service tools to enable its MINI fac-tory trained service technicians to perform qual-ity repairs on your MINI in minimal time. YourMINI dealer looks forward to serving your everyservice need and to help maximize your satisfac-tion with your MINI, its longevity, and resalevalue.

For a detailed list of items inspected, refer to theQuality Certification I form provided to theOwner at time of delivery. A copy of the form ison file at the selling MINI dealer.

Maintenance Summary

The CBS system will determine the requirementfor performance of the maintenance servicesdescribed on this and the following page. Theseservices may be required either individually or inconjunction with other maintenance services.

Depending on the vehicle’s use, CBS may cal-culate service intervals which are different fromthe guidelines listed.

UnscheduledMaintenance

Only use fuels advertised to have adequatedetergency and low alcohol content. Use offuels with insufficient detergent and/or excessalcohol can cause driveability problems thatnecessitate cleaning intake valves and fuelinjection valves, and when applicable, adjustingthe engine idle. We suggest having this workperformed by your authorized MINI dealer, per-haps while regular maintenance is performed.Your MINI dealer can also recommend a gaso-line additive that will provide sufficient deter-gency. While this recommended unscheduledmaintenance is not required in order to maintainthe emission warranty, cleaning of intake valvesor, when applicable, fuel injection valves, oradjustment of engine idle, necessitated by useof inappropriate fuel, is not covered by warrantybecause no defect in material or workmanshipor component failure is involved.

EngineOil

Maintenance work:� Change the engine oil and oil filter. We rec-

ommend MINI High Performance 5W-30 Syn-thetic Oil P/N 07 51 0 143 829.

� Replace ventilation microfilter.� After every 2nd engine oil change: Intake air

cleaner: replace air filter element (reducereplacement interval in dusty operatingconditions).

� Parking brake: check function and burnishpads.

Front Brake

Maintenance work:� Replace brake pads, clean brake pad contact

points in calipers.� Brake discs: Check surface and thickness, if

necessary replace at extra charge*

Vehicle Check

Maintenance work:� Check operation of horn, headlight flasher

and hazard warning flashers.� Check instrument and control lighting, and

heater/air-conditioning blower.� Check lighting system: turn signals, back-up,

license plate, interior (incl. map, readinglights), glovebox, flashlight, luggage arealights.

� Safety belts: check condition and function.� Check windshield wiper and washer jet

positions.� Body: check for corrosion (except cavities).� Tires: check tread depth, wear pattern, outer

condition, inflation pressure. If necessary, cor-rect pressure.

� Battery: check state of charge (magic eye)and charge if required.

� Visually inspect all SRS airbag units for torncovers, obvious damage or attachment ofstickers.

� Rear-view mirrors� Coolant: check fluid level and concentration.� Windshield washer and intensive cleaning

system: check protection level, fluid level, topif necessary.

� Brake system connections and lines: checkfor leaks, damage and correct positioning

� Underbody, incl. all visible parts (i.e. transmis-sion, rear axle, fuel lines, exhaust system),check for damage, leaks and corrosion

� Steering components: check for clearance,damage and wear.

� MINI Mobility System: check expiration dateon sealant bottle. Change sealant bottle ifnecessary.

Evidence ofmaintenancework

This MINI Service and Warranty InformationStatement should be presented to your MINIdealer when maintenance is required. Make surethat confirmation of maintenance work is alwaysentered in this Service and Warranty InformationStatement. You may need this for any warrantyclaims that become necessary, and later on asevidence that your car has been given the cor-rect and regular maintenance that justifies itsresale or trade-in value.

BatteryCare

If your car is driven only for short distances ofless than 10 miles over a prolonged period oftime, without an occasional drive at highwayspeeds, the engine’s charging system will notmaintain the battery. Insufficient use of the vehi-cle could result in short-term starting problemsand in the long-term could damage the battery.

In case the car is not operated for more thanfour weeks it is advisable to:� consider using a proper trickle charger, fol-

lowing the charger manufacturer’s instruc-tions, to maintain the battery’s state ofcharge; or

� consult your MINI dealer regarding batteryremoval. Once removed, the battery must becharged and stored in a cool, dry place whereit can be protected from freezing. If the bat-tery will be stored for over 3 months, it mustbe recharged every 3 months, or else it willbecome damaged and useless.

Corrosion Protection

Extensive corrosion protection measures nowmake it possible to offer a twelve-year unlimitedmileage anti-corrosion warranty against rust per-foration on your vehicle provided that the vehicleis maintained in accordance with the provisionsof the MINI New Passenger Car Limited War-ranty as outlined in the Warranty Section of thisStatement (page 38).

The major degree of corrosion protection is dueto the electrophoretic dip painting processwhich cathodically deposits paint particles on allbody parts, attracting paint particles into theminutest cavities or seams. Body parts aredesigned to provide optimum corrosionprotection.

During manufacture, exterior body parts receivean additional corrosion protection coat. Hood,trunk, doors and other body parts with metalfolds are coated with PVC and sealed from theoutside.

All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during andafter assembly.

Requirements for maintaining the twelve-yearunlimited mileage anti-corrosion warranty areoutlined in the Warranty Section of this State-ment (page 39).

Restoring Corrosion Protection

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

MINI will not accept any liability for any partsand accessories not approved by the MINIDivision of BMW NA.

UnderbodyMaintenance

The underbody has to be cleaned at least oncea year, in spring, with plain water in order toremove mud, chemical sediments and otherdeposits. If those materials are not removed,corrosion (rust) will occur.

Your MINI dealer will do this anti-corrosion ser-vice for you.

Do not apply additional undercoating orrust-proofing on or near the exhaust

manifold, exhaust pipes, catalytic converter orheat shields. During driving, the substance usedfor undercoating could overheat and cause afire.

CustomerAssistance - Notification

During a specific period (usually the earlier of12 months or 12,000 miles, though this periodvaries by state), some states require us or ourauthorized MINI dealer, to repair in a reasonablenumber of attempts, any defect or conditionwhich substantially impairs the use, value, orsafety of a new vehicle sold, leased or registeredin that state.

A “reasonable number of attempts” is generallydefined as: (i) four or more attempts to repair thesame defect (the number of attempts vary bystate); or (ii) the vehicle is out of service by rea-son of one or more repair(s) for more than acumulative total of 30 days (this period varies bystate), except for delays created by conditionsbeyond our control.

If we are unable to correct a defect or conditioncovered by these statutes in a reasonable num-ber of attempts, we may be obligated either toreplace the vehicle or reimburse the owner/les-see in an amount equal to the purchase price orlease payments paid by the owner/lessee, lessthe amount directly attributable to use of thevehicle by the owner/lessee.

BBB AUTO LINE is a disputeresolution program administered by the Councilof Better Business Bureaus. BBB AUTO LINEresolves disputes through mediation or arbitra-tion. Mediation is an informal proceedingwhereby a neutral third party (mediator) helpsthe parties to find an acceptable resolution.Arbitration is also an informal proceeding inwhich an impartial third party renders a decisionafter a hearing at which both parties have anopportunity to be heard. 4. In order to file a claim with BBB AUTO LINE,you will have to provide your name andaddress, the brand name and vehicle identifi-cation number (VIN) of your vehicle, and astatement of the nature of your problem orcomplaint. If mediationis not successful, or if you do not wish to par-ticipate in mediation, claims within the pro-gram’s jurisdiction may be presented to anarbitrator at an informal hearing. The arbitra-tor’s decision should ordinarily be issuedwithin 40 days from the time your complaint isfiled; there may be a delay of 7 days if you didnot first contact MINI about your problem, or adelay of up to 30 days if the arbitratorrequests an inspection/report by an impartialtechnical expert or further investigation andreport by BBB AUTO LINE.

6. You are required to use BBB AUTO LINEbefore asserting in court any rights or reme-dies conferred by California Civil Code Sec-tion 1793.22. • The same nonconformity [a failure to con-form to the written warranty that substan-

tially impairs the use, value or safety of thevehicle] results in a condition that is likelyto cause death or serious bodily injury if thevehicle is driven AND the non conformityhas been subject to repair two or moretimes by MINI or its agents AND the buyeror lessee has directly notified MINI of theneed for the repair of the nonconformity;OR

• The same nonconformity has been subjectto repair 4 or more times by MINI or itsagents AND the buyer has notified MINI ofthe need for the repair of the nonconfor-mity; OR

• The vehicle is out of service by reason ofrepair of nonconformities by MINI or itsagents for a cumulative total of more than30 calendar days after delivery of the vehi-cle to the buyer.

For your convenience a decal, showing thesame information as the ID card, has beenaffixed in the trunk compartment.

In a few weeks you will receive a permanentMINI Roadside Assistance ID card by mail. Theoriginal in-service date and the vehicle identifi-cation number (VIN) are embossed on the card.

This card should be carried by the driver of yourMINI passenger car.

The toll-free MINI Roadside Assistance numberis answered by a MINI Roadside Assistance ser-vice representative. In order for you to receivequick and reliable services, it is essential thatyou provide detailed and accurate information tothe service representative.

(found on your vehicle registration, your per-manent MINI Roadside Assistance ID card oron the bottom driver’s side of yourwindshield)

Dispatch Service

A service provider will be dispatched to the siteof your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements such asflat tires, dead batteries, and out of fuel condi-tions is provided by MINI Roadside Assistance.

The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. TheMINI New Passenger Car Limited Warranty doesnot cover any of the above on-site services.

Lock-Out

Please contact MINI Roadside Assistance forlockout situations. MINI Roadside Assistancewill attempt to reunite the owner with a sparekey by calling someone at customer’s residenceor by sending a taxicab to pick you up. (Cost oftaxi is not reimbursable.) Be sure the vehicle isin a safe location in the above situations. As alast resort, we will have your MINI towed to adealership. The MINI dealership can assist withkey replacement. Towing services will be pro-vided up to a maximum of $100.00 per incident.The cost for replacement keys is the responsi-bility of the owner/driver.

Towing Service

In the event of a mechanical breakdown nor-mally covered under the MINI New PassengerCar Limited Warranty, your vehicle will be trans-ported (at no cost) to the nearest authorizedMINI dealer. Your vehicle is also covered in theevent of an accident or collision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to the nearestauthorized MINI dealer on the next business day.

If you request that the vehicle be taken to alocation other than the nearest authorized MINIdealer, any additional expense will be yourresponsibility.

Towing requests for vehicles disabled becauseof casualty, fire, act of God, acts of war (declaredor undeclared), or violation of law (federal, stateor local) are accepted at the expense of theowner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contact MINI Roadside Assistance forprior authorization and instructions on claimprocedures. All claims must be submittedwithin sixty (60) days of the disablement oroccurrence, accompanied by the originalreceipts. Claims received after that time periodmay not be honored and are subject to the fulldiscretion of MINI Roadside Assistance. If MINIRoadside Assistance is not contacted for “prior”authorization, the maximum coverage for towingsituations is $50.00.

Sign-and-Drive

In most instances, services provided under theMINI Roadside Assistance Program do notrequire immediate payment.

Usually, you will be able to sign a receipt, so theprovider of the service can be reimburseddirectly by MINI Roadside Assistance.

Parts, materials, and fuel should be paid for byyou directly to the provider of the services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:� Breakdowns that are warranty related, and;� Must occur in excess of 100 miles from the

driver’s residence, and;� Repairs cannot be completed during normal

business hours on the same day ofbreakdown.

Reimbursements will be made for meals, lodg-ing, car rentals, and alternate transportation tobring the driver and the MINI passenger cartogether after the vehicle has been repaired byan authorized MINI dealer. Original receipts anda copy of the vehicle repair order must accom-pany all reimbursement requests.

Trip interruption coverage is limited to $750.00per incident, for a maximum of five days perincident.

Always contact MINI Roadside Assistance fortrip interruption benefits. They will assist inmaking all the necessary arrangements.

Exclusions

Specifically excluded from coverage are:� Fines, taxes, or impound towing fees caused

by a violation of local or state law.� Expenses related to extreme adverse weather

conditions, including, but not limited to,floods, hurricanes and tornadoes (removalfrom water, snow, ice, etc.).

� Expenses for the removal of snow tires, andmounting or removal of snow chains.

Warrantor

The MINI Division of BMW NA warrants 2008U.S. specification vehicles distributed by theMINI Division against defects in materials orworkmanship to the first retail purchaser, andeach subsequent purchaser.

Warranty Period

The warranty period is 48 months or50,000 miles, whichever occurs first.

WarrantyBegins

Coverage begins on the date of first retail sale,or the date the vehicle is first placed into serviceas a sales demonstrator, service loaner (SLP) orcompany vehicle, whichever is earlier.

WarrantyCoverage

To obtain service under this warranty, the vehi-cle must be brought, upon discovery of a defectin material or workmanship, to the workshop ofany authorized MINI dealer in the United Statesor Puerto Rico, during normal business hours.The MINI dealer will, without charge for parts orlabor, either repair or replace the defectivepart(s) using new or authorized remanufacturedparts. The decision to repair or replace saidpart(s) is solely the prerogative of the MINI Divi-sion. Parts for which replacements are madebecome the property of the MINI Division.

In all cases, a reasonable time must be allowedfor warranty repairs to be completed after thevehicle is received by the authorized MINIdealer.

SafetyBeltWarranty - Kansas

Safety belts are covered under the MINI NewPassenger Car Limited Warranty for defects inmaterial or workmanship for a period of10 years, unlimited mileage from the date ofpurchase. In order to be eligible for this cover-age, the vehicle must be a new vehicle retailed

in the State of Kansas and the repair must beperformed by an authorized MINI dealer inKansas.

Other Items

Wheel alignment, balancing and wiper bladeinserts are covered up to 2,000 miles.

Items which are subject to wear and tear ordeterioration due to driving habits or condi-tions, such as brake pads/linings, brakediscs, clutch disc, pressure plate, filters,upholstery, trim and chrome items, paint fin-ish, drive belts, glass, and similar items, arespecifically limited to defects in material orworkmanship.

This warranty does not apply to thefollowing:

Damage which results from negligence,improper operation of the vehicle, improperrepair, lack of or improper maintenance, environ-mental influences, flood, accident or fire dam-age, road salt corrosion, or use of improper orcontaminated fuel.

Damage to the engine, transmission or anyrelated component caused by improper shiftingof the transmission.

Maintenance services and parts when replacedduring maintenance such as spark plugs, lubri-cants, fluids, engine tune-up parts, replacementof filters, coolant, and refrigerant.

Failure to maintain the vehicle properly in accor-dance with the instructions in the Owner’s Man-ual or the Service section of this Statement, thatresults in the failure of any part of the vehicle.

Modification of the vehicle or installation of anyperformance accessories or componentsattached to the vehicle which alters the originalengineering and/or operating specifications orwhich result in damage to the other originalcomponents, electrical interference, electricalshort, radio static, water leaks, or wind noise.

Tires are warranted by their respective manufac-turer as detailed in the applicable tire manufac-turer’s warranty statements. Instructions forproper tire care and maintenance are containedin the Owner’s Manual. Should you experience

difficulty in obtaining warranty service from a tiremanufacturer, your authorized MINI dealer willassist you in resolving the difficulty.

Non-genuine MINI Parts - While you may electto use non-genuine MINI parts for maintenanceor repair services, the MINI Division is not obli-gated to pay for repairs that include non-genu-ine MINI parts or for any damage resulting fromthe use of non-genuine parts.

MINI will not accept any liability for any partsand accessories not approved by the MINIDivision of BMW NA.

This warranty shall be null and void if thevehicle identification number has beenaltered or cannot be read, if the odometerhas been replaced or altered and the truemileage cannot be determined, if the vehiclehas been declared a total loss or sold for sal-vage purposes, or if the vehicle has beenused in any competitive event.

General

These warranties give you specific legal rights,and you may also have other rights which varyfrom state to state.

THE DURATION OF ANY IMPLIED WARRAN-TIES, INCLUDING THE IMPLIED WARRANTYOF MERCHANTABILITY, IS LIMITED TO THEDURATION OF THE EXPRESS WARRANTIESHEREIN. THE MINI DIVISION OF BMW NAHEREBY EXCLUDES INCIDENTAL AND CON-SEQUENTIAL DAMAGES, INCLUDING LOSSOF TIME, INCONVENIENCE, OR LOSS OF USEOF THE VEHICLE, FOR ANY BREACH OF ANYEXPRESS OR IMPLIED WARRANTY, INCLUD-ING THE IMPLIED WARRANTY OF MER-CHANTABILITY, APPLICABLE TO THISPRODUCT.

Some states do not allow limitations on howlong an implied warranty lasts, or the exclusionor limitation of incidental or consequential dam-ages, so the above limitations and exclusionsmay not apply to you.

LimitedWarranty - RustPerforation 2008Models

The MINI Division of BMW NA warrants thisoriginal vehicle against defects in materials orworkmanship which will result in rust perforationof the vehicle body for a period of 12 years,without mileage limitation, commencing on thedate of first retail sale, or the date the vehicle isfirst placed in service as a demonstrator or com-pany vehicle, whichever is earlier.

REQUIREDMAINTENANCE:

In order to keep this warranty in effect, the vehi-cle must be inspected at every MINI vehiclecheck or at least every two years.

The Inspection/Maintenance consists of:• Repairing any damages to undercoating orpaint due to stone chips, gravel erosion,scratches, or other external influences.

This inspection/maintenance is excludedfrom the Rust Perforation Limited Warranty.Any areas requiring preventative mainte-nance must be repaired, and are at the own-er’s expense.

The MINI Division of BMW NA makes no otherexpress warranty on this product except the newvehicle warranty or the warranty as to the emis-sion control system. This warranty does not apply to thefollowing:

a. Damage caused by negligence, improperaccident damage repairs, or improper use.

b. Damage attributable to failure to performrequired inspections/maintenance at thespecified intervals or in accordance with theMINI rust inspection/maintenance programinstructions. Proof must be provided by apaid invoice or filling in the appropriate boxesin the Service Section of this Statement.

MINI will not accept any liability for any partsand accessories not approved by the MINIDivision of BMW NA.

This warranty shall be null and void if thevehicle identification number has beenaltered or cannot be read, if the odometerhas been replaced or altered and the truemileage cannot be determined, if the vehiclehas been declared a total loss or sold for sal-vage purposes, or if the vehicle has beenused in any competitive event.

Federal Emissions SystemDefectWarranty (Valid only in the U.S.A.and Puerto Rico)

This limited warranty applies only to U.S. speci-fication vehicles distributed by the MINI Divisionof BMW NA.

In accordance with the defect warranty provi-sions of section 207(b) of the Clean Air Act,MINI warrants to the first retail purchaser, andeach subsequent purchaser, that the passengercar: (a) was designed, built and equipped so asto conform, at the time of sale, with all regula-tions of the U.S. Environmental ProtectionAgency applicable at the time of manufacture;and (b) is free from defects in materials andworkmanship which would cause it to fail toconform with applicable regulations for a periodof 2 years or 24,000 miles, whichever occursfirst, except for specific emission control com-ponents (as listed on page 43), for which thewarranty period is 8 years or 80,000 miles,whichever occurs first.

Coverage begins on the date of first retail saleor the date the vehicle is first placed into serviceas a sales demonstrator, service loaner (SLP) orcompany vehicle, whichever is earlier.

Warranty claims must be made as soon as rea-sonably possible after a defect is discovered. Tomake a claim, the car must be brought to anyauthorized MINI dealer during normal businesshours.

The MINI dealer will, without charge for parts orlabor (including diagnosis), either repair orreplace the defective part, if any. The decisionwhether to repair or replace said parts is solelythe prerogative of the MINI Division of BMW NAand must be expected to correct the failure ofthe warranted part. Parts for which replace-ments are made become the property of theMINI Division. In all cases, a reasonable timemust be allowed for warranty repairs to be com-pleted after the car is received by the MINIdealer.

It is the owner’s responsibility to have all sched-uled inspection and maintenance services per-formed (at the owner’s expense), as prescribedin the maintenance schedule for the MINI Emis-sion Control System. Service intervals are com-puted by the onboard MINI service intervalindicator and displayed on the instrument panel.The instructions for proper maintenance anduse can be found in the Owner’s Manual. It isstrongly recommended that any replacementparts used for maintenance, repair or replace-ment of emission control systems be certifiedMINI Service Parts or MINI Authorized Remanu-factured Parts. Without invalidating this war-ranty, the owner may elect to have maintenance,repair or replacement of the emission controlsystems performed by any automotive repairestablishment, or elect to use parts other thancertified MINI Service Parts. However, the costof such service or parts will not be coveredunder this warranty, except in emergency situa-tions. In an emergency situation, where anauthorized MINI dealer or a warranty replace-ment part is not reasonably available (within30 days), repairs may be performed at any avail-able service establishment using any equivalentpart. The MINI Division of BMW NA will reim-burse the owner for such emergency repairs(including labor, parts and diagnosis not toexceed the MINI Division’s rates for labor, parts,and diagnosis in said area) that are coveredunder this warranty. Replaced parts and paidinvoices must be presented at an authorizedMINI dealer as a condition of reimbursement foremergency repairs not performed by an autho-rized MINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof the emission control system. If other than cer-tified MINI Service Parts or MINI AuthorizedRemanufactured Parts are used for mainte-nance, repair or replacement of componentsaffecting emission control, the owner shouldobtain assurances that such parts are warrantedby their manufacturer to be equivalent to genu-ine MINI parts in performance and durability.The MINI Division of BMW NA assumes no lia-bility under this warranty with respect to partsother than genuine MINI parts.

However, the use of non-genuine MINI replace-ment parts or non-EPA certified parts does not

invalidate the warranty on other components,unless non-genuine MINI parts or non-EPA cer-tified parts cause damage to warranted parts.

What Is NotCovered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, improper adjustment, modification,alteration, tampering, disconnection, improperor inadequate maintenance, use of leaded fuelor fuels containing more than 10% ethanol, orother oxygenates with more than 2.8% oxygenby weight (i.e., more than 15% MTBE or morethan 3% methanol plus an equivalent amount ofco-solvent).

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services, the repair orreplacement of maintenance parts beyond thefirst required inspection/maintenance, or if thepart has been replaced earlier for reasons otherthan it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

Federal Emission PerformanceWarranty (Valid only in the U.S.A.and Puerto Rico)

In those states and jurisdictions that have estab-lished periodic vehicle emissions tests toencourage proper vehicle maintenance andrequire the vehicle to pass an emissions testapproved by the U.S. Environmental ProtectionAgency and:

1. The passenger car was distributed by theMINI Division of BMW NA; and

2. The car has been maintained and operatedin accordance with the instructions forproper maintenance and use set forth in theOwner’s Manual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judgedby an EPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penaltyor other sanction (including the denial of theright to use the car) under local state or fed-eral law if the non-conformity is not reme-died within a specified period of time.

Then, in accordance with the provisions of sec-tion 207(b) of the Clean Air Act, MINI Division ofBMW NA warrants that if the car is eligible forcoverage under this warranty, any non-conformi-ties in the car, which cause it to fail an EPA-ap-proved emissions test will, without charge forparts or labor (including diagnosis), be adjusted,repaired, or replaced, at the option of the MINIDivision of BMW NA to proper specifications, inorder to make the car comply with applicableemissions standards. The decision to adjust,repair or replace parts is solely the prerogativeof the MINI Division and must reasonably beexpected to correct the failure of the warrantedpart.

Coverage begins on the date of first retail sale,or the date the vehicle is first placed into serviceas a sales demonstrator, service loaner (SLP) orcompany vehicle, whichever is earlier. This lim-ited warranty continues for a period of 2 years or24,000 miles, whichever occurs first, except forspecific emissions control components (aslisted on Page 43), for which the warranty periodis 8 years or 80,000 miles whichever occursfirst.

This limited warranty is made subject to theterms and conditions that apply to the EmissionControl System Warranty and the MINI NewPassenger Car Limited Warranty.

No claim under this warranty will be denied onthe basis of use of a properly installed EPA cer-tified emission part for maintenance and repair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in the mainte-nance or repair of a vehicle only if the vehiclemanufacturer presents evidence that the uncer-tified replacement part is either defective inmaterials or workmanship or not equivalent froman emission standpoint to the original equip-ment part.

Maintenance, replacement, or repair of emis-sion control devices and systems may beperformed by any automotive repair estab-lishment or individual using any certifiedpart.

Immediately after the car has failed an EPAapproved emission short test, your claim can bemade at any authorized MINI dealer. The MINIdealer will honor or deny your claim within thetime period specified by local or state laws (notto exceed 30 days), to avoid further penalties orsanctions. If the claim is denied, the MINI dealerwill notify you in writing of the reason(s). Theauthorized MINI dealer is required by law tohonor the claim if notice of denial is not receivedby the owner within the specified time period.

The California Air Resources Board and theMINI Division of BMW NA are pleased to explainthe emission control system warranty on your2008 vehicle. In California, new motor vehiclesmust be designed, built, and equipped to meetthe State’s stringent anti-smog standards. TheMINI Division of BMW NA must warrant theemission control system on your vehicle for theperiods of time listed below provided there hasbeen no abuse, neglect, or improper mainte-nance to your vehicle.

Your emission control system may include partssuch as the fuel injection system, the ignitionsystem, catalytic converter, and engine com-puter. Also included may be hoses, belts, con-nectors, and other emission-related assemblies.

Where a warrantable condition exists, the MINIDivision will repair your vehicle at no cost to youincluding diagnosis, parts and labor.

Manufacturer’sWarrantyCoverage:– For 3 years or 50,000 miles, whichever occursfirst:

1. If your vehicle fails a Smog Check inspec-tion, all necessary repairs and adjustmentswill be made by the MINI Division to ensurethat your vehicle passes the inspection. Thisis your emission control system PERFOR-MANCE WARRANTY.

2. If any emission-related part on your vehicleis defective, the part will be repaired orreplaced by the MINI Division. This is yourshort-term emission control systemDEFECTS WARRANTY.

For 7 years or 70,000 miles whichever occursfirst:

If an emission-related part, specially noted onpage 47 as having coverage for 7 years or70,000 miles is defective, the part will be

repaired or replaced by the MINI Division. This isyour long-term emission control systemDEFECTS WARRANTY.

Owner’sWarrantyResponsibilities:– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owner’s Manual. The MINI Divi-sion recommends that you retain all receiptscovering maintenance on your vehicle, but theMINI Division cannot deny warranty solely forthe lack of receipts or for your failure to ensurethe performance of all scheduledmaintenance.

– You are responsible for presenting your vehicleto an authorized MINI dealer as soon as aproblem exists. The warranty repairs should becompleted in a reasonable amount of time, notto exceed 30 days.

The MINI Division of BMW NA warrants to theoriginal purchaser and each subsequent ownerthat the vehicle is:

a. designed, built and equipped so as to con-form with the applicable California AirResources Board emission standards.

To obtain service under this warranty, the vehi-cle must be brought, upon failure of a SmogCheck test or upon discovery of the defect, tothe workshop of any authorized MINI dealer,during normal business hours. The MINI dealerwill honor or deny your claim within 30 days. Ifthe claim is denied, the MINI dealer will notifyyou in writing of the reason(s). The MINI dealeris required by law to honor the claim if notice isnot given to the owner within 30 days.

The MINI dealer will, without charge for parts orlabor (including diagnosis), either adjust, repairor replace the defective part and other partsaffected by the failure of the warranted part, ifany. If your vehicle failed the California SmogCheck test or an EPA approved short test, then

the MINI Division will repair your vehicle so thatit will pass this test. Items that require sched-uled replacement are warranted up to thereplacement interval specified in the Servicesection of this Statement. The MINI Divisionmay repair a part in lieu of replacing it when per-forming warranty repairs. Parts for whichreplacements are made become the property ofthe MINI Division. After 3 years or 50,000 miles,and in accordance with paragraph (c) above,such repairs are limited to the repair or replace-ment of those parts identified in the CaliforniaEmission Control System Limited Warranty List.

If your California registered vehicle is between7 and 8 years old and has been driven less than80,000 miles, then your vehicle is eligible foradditional warranty coverage under the FederalEmissions Warranty.

A repair performed as the result of a smogcheck test failure due to a defect in a part, whichis warranted for 7 years/70,000 miles, iscovered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repair tobe completed, after the car is received by theMINI dealer.

It is the owner’s responsibility to have allrequired maintenance services performed (atthe owner’s expense), as prescribed in themaintenance schedule for the MINI EmissionControl System. Service intervals are computedby the service interval indicator and displayed onthe instrument panel.

However, the MINI Division will not deny yourwarranty repair claims solely because you do nothave maintenance records or you did not per-form the required maintenance unless the MINIDivision demonstrates that such lack of requiredmaintenance is a direct cause of the emissioncontrol system failure. The instructions forrequired maintenance and use can be found inthe Owner’s Manual and in the Service sectionof this Statement.

It is strongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems begenuine MINI Service Parts or MINI AuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to have mainte-nance, repair or replacement of the emissioncontrol systems performed by any automotiverepair establishment, or elect to use parts otherthan MINI Authorized Remanufactured or genu-ine MINI Service Parts. However, the cost ofsuch service or parts will not be covered underthis warranty, except in emergency situations. Inan emergency situation, where an authorizedMINI dealer is not reasonably available or a war-ranty replacement part is not available within30 days, repairs may be performed at any avail-able service establishment or by any individualusing any replacement part.

A repair not completed within 30 days consti-tutes an emergency. The MINI Division ofBMW NA will reimburse the owner for suchemergency repairs (including labor, parts anddiagnosis not to exceed MINI suggested retailprice for all warranted parts replaced and laborcharges based on the manufacturer’s recom-mended time allowance for the warranty repairand the geographically appropriate hourly laborrate) that are covered under this warranty.Replaced parts and paid invoices must be pre-sented to an authorized MINI dealer as a condi-tion of reimbursement for emergency repairs notperformed by an authorized MINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof emission control systems. If other than genu-ine MINI Service Parts or Authorized Remanu-factured Parts are used for maintenance, repairor replacement of components affecting emis-sion control, the owner should obtain assur-ances that such parts are warranted by theirmanufacturer to be equivalent to genuine MINIparts in performance and durability. The MINIDivision of BMW NA assumes no liability underthis warranty with respect to parts other thangenuine MINI parts.
