NEW DELHI Retail inflation eased to four-month low of 4.87 percent in April while industrial output slowed to a five-month low of 2.1 percent in March, raising hopes for an interest rate cut by the RBI. Retail inflation in April inched down to a four- month low of 4.87 percent as prices of food items, vegetables and fruits turned cheaper. On the other hand, facto- ry output, as measured by the Index of Industrial Production (IIP), contract- ed by 0.5 percent in March 2014, according to govern- ment data released on Tuesday. The twin macro-eco- nomic indicators strength- en government and indus- try's call to Reserve Bank of India Governor Raghuram Rajan to cut interest rates. RBI is scheduled to review its monetary policy on June 2. Delhi felt the tremors for 30 secondsNEW DELHI

The tremors were felt for over 30 seconds in thenational capital as a strong earthquake measuring 7.3 onthe Richter Scale hit Nepal again on Tuesday.

The tremors were also felt across northern India andseveral eastern parts of the country, including Assamand Nagaland.

LS Rathore, Director General of the IndiaMeteorological Department (IMD), said that the earth-quake's epicentre was 60 km east of Kathmandu.

He said that after the earthquake, three aftershockswere also reported at close intervals.

"The first aftershock was reported at 1.04 p.m. with anintensity of 5.4 on the Richter scale, the second one wasof 6.2 magnitude and came at 1.06 p.m., and the last onewas witnessed at 1.44 p.m. with a magnitude of 4.8 onthe Richter scale," he said and added that the after-shocks will continue for at least few more weeks ormonths.

Delhi Metro services were halted for few minutes dueto aftershock.

"At around 12.38 p.m., the earthquake was felt. Afterthat, train services were stopped which resumed at12.45 p.m.," a Delhi Metro official told IANS.

Officials of the fire department said that no casualtywas reported in the national capital.

"As of now, no casualty has been reported in Delhidue to earthquake which continued for a few seconds,"said an officials of Delhi fire department.

Panic gripped the city's residents after tremors werefelt.

"I was with my client at home when the quakeoccurred. We all ran outside the building and saw manyothers rushing out of their houses after feeling thetremors that lasted at least for 30-45 seconds," UttamDutt, a Delhi-based lawyer, told IANS.

Kushagra Dixit, a journalist with a news portal, saidthat he was lying on the bed when the floor started shak-ing.

"It was a horrible experience. I rushed outside thebuilding and reached a park," he said.

A minor fire broke out at a ground floor ward of AllIndia Institute of Medical Sciences (AIIMS) here onTuesday, said a fire official.

"We received a call at 9.35 am and five fire tenderswere rushed to douse the flames," the official told anews agency.

He said that the fire broke out due to an electric shortcircuiting in an air conditioner wire.

"Everything is under control and the fire tenders havenow come back. There is nothing to worry now," hesaid.

A fire broke out at an office of the Oriental Bank ofCommerce in Delhi on Friday.

The office is located in Harsha Bhavan in ConnaughtPlace. As per unconfirmed reports, five persons havereceived burn injuries. They have been rushed to a near-by hospital.

Eyewitnesses said that smoke was first reported fromnear the lift and later spread to more parts of the build-ing. Around 20 firetenders are at the spot and havebrought the situation under control.

NEW DELHIObserving that 'prima facie' the

Delhi Government circular, askingofficials to lodge complaints regard-ing defamatory reports, tends to"jeopardise" the freedom of press, thePress Council of India (PCI) hassought to know the reasons thatnecessitated such a move.

In a statement issued here by itschairperson Justice (retd)Chandramauli Kumar Prasad, PCIsaid it had learnt from reports aboutthe circular, issued on May 6, 2015,by the Delhi Government, which, itfelt, may have a bearing on the free-dom of press.

It obtained the circular issued bythe Delhi Government to "deal withthe instances of defamatory imputa-tions covered under section 499/500of the Indian Penal Code" against theChief Minister, ministers and func-tionaries of the government.

The circular "gives veiled threat tothe media for their prosecution underpenal provisions, which may preventthem from carrying out their profes-sional obligations honestly, diligent-ly, independently and with freedom",

the Council opined, and noted thatwhile it is mandated to preserve thefreedom of press, the circular tends to"jeopardise" that freedom.

Taking suo motu cognisance, theCouncil asked the Delhi governmentto furnish reasons, circumstance andnecessity of issuing the circular, with-in a week. Earlier, the ArvindKejriwal led Delhi Government hadasked all its officials to lodge a com-plaint with the Principal Secretary

(Home) if they come across any newsitem which damage the reputation ofthe Chief Minister or the government,so that further action can be taken.

According to a circular issued bythe Directorate of Information andPublicity Department, if any officerassociated with the Delhi governmentfeels that the published or aired newsitem damages his or the government'sreputation, he should file a complaintwith the Principal Secretary (Home).

Abench of Justice SureshKait was informed by theDeputy Commissioner ofPolice, Traffic (HQ) that incompliance of the court'sJanuary 27 order, a specif-ic direction was issued toall functionaries to takestrict action against e-rick-shaws found plying onDelhi roads in "true letterand spirit".

"...Pursuant to the direc-tion of the court, till May10, 2015 the Delhi Traffic

Police have impounded atotal of 11,439 e-rickshawsfor plying on the roads inviolation of the directionof the High Court underthe provisions of MotorVehicle (MV) Act, 1998and Delhi Police Act1978," the traffic policesaid in their status report.

The report further saidthat "out of these 11,439 e-rickshaws impounded,10,521 e-rickshaws havebeen impounded underDelhi Police (DP) Act and918 under MV Act.

"Further, 5,157 e-rick-shaws which wereimpounded under DP Acthave been released by theconcerned ACPs trafficand 516 e-rickshaws which

were impounded underMV Act have beenreleased by the variouscourts after fine."

The incident occurred inthe Golf Links area nearIndia Gate on May 11 fol-lowing an altercationbetween the cop, SatishChandra, and RamanjeetKaur, a mother of three,over a minor incident of

tured on camera and thevideo clip showed thewoman picking up a brickand hurling it at the police-man's bike while the con-stable was seen attackingher back with anotherbrick. Soon after the inci-dent, Chandra was initiallysuspended and then dis-missed from service with

immediate effect as theincident triggered wide-spread outrage. Chandrawas arrested after a crimi-nal case was filed againsthim and later remanded in14 days of judicial custodyby a trial court.

The woman had allegedin her complaint to thepolice that Chandrademanded a bribe of Rs200 accusing her of violat-

A Delhi Police sub-inspector rammed hisspeeding car into threewomen sanitation workerson a flyover in the capitalon Tuesday morningkilling them, police said.The official was arrestedfor rash driving, but wit-nesses said his car brakeshad failed leading to hislosing control over thevehicle.

The accident occurredaround 9.30 a.m. on theMehrauli-Badarpur flyoverin south Delhi.

Rishipal, 59, who isdeputed in the PoliceControl Room (PCR) andpresently posted at theDelhi Police Headquarters,was arrested on charges ofrash and negligent driving.

Witnesses said the sub-inspector apparently lostcontrol of his vehicle afterits brakes failed, and it hitthe three women sanitationworkers on the flyover.

According to a witness,the speeding car hit all thethree women one by onefrom behind and draggedone of them to some dis-tance.

The three deceased wereidentified as Meera, 55,Shakuntala, 55, and Maya,28. "Meera was killed onthe spot, while the twoother women succumbedto their injuries later at ahospital. An FIR has beenlodged against the sub-inspector who was arrestedfrom the spot and investi-gations are on in the case,"said a police official.

NEW DELHIIn a jolt to the Centre, the

Supreme Court on Tuesdayrejected its preliminaryplea that the NationalJudicial AppointmentsCommission (NJAC) issuebe heard by a larger benchof 9 or 11 judges.

According to PTI, theapex court also ruled thatthe arguments on petitionschallenging NJAC Act willcontinue before the five-judge bench.

The ruling comes a dayafter the apex court made itclear that it would firstdecide on the issue ofreferring the challenge tothe new system of appoint-ment of judges to a largerbench of nine or eleven

judges and then go into themerits of the case.

It also said it would passan order on appointment ofadditional judges of HighCourt, whose tenure wasending, because theNational JudicialA p p o i n t m e n t s

Commission was not inplace yet.

"We all have tentativelyagreed on this that we willfirst decide the issue of ref-erence (to a larger bench)and then take a call on theentire matter," a five judgeConstitution Bench headed

by Justice JS Khehar saidon Monday.

"If it is referred to a larg-er bench then the matterhas to be heard from begin-ning by a new bench," thebench, also comprisingJustices J Chelameswar, MB Lokur, Kurian Josephand Adarsh Kumar Goel,said.

Senior advocates Fali SNariman and RamJethmalani, who are argu-ing against the NationalJudicial AppointmentCommission (NJAC) Act,said the issue of referringthe matter to a larger benchis an exercise in futile as itis a delaying tactics by theCentre.

Nariman, who had a

heated exchange of wordswith Attorney GeneralMukul Rohatgi, demandeda stay on the operation ofthe NJAC.

However, the benchpacified him saying "noth-ing is happening in theNJAC and still the issue ofeminent members in thepanel has not been takenup.

"Since nothing is hap-pening, we are going topass an order (on the issueof appointment of existingadditional judges for highcourts whose tenure arecoming to end in immedi-ate future". The govern-ment assured the benchthat Additional Judges willnot be made to suffer.

NEW DELHIIrfan Ahmad, a key LeT and

Indian Mujahideen operative whowas recently apprehended byDelhi Police, had planned to flee toPakistan before he was arrested inNepal in 2010 for trying to acquireNepalese citizenship on forgeddocuments.

Ahmad was arrested fromBahraich near Indo-Nepal borderon May 7 by the Special Cell ofDelhi Police after he fled from ajail in Nepal following last month'sdevastating earthquake.

"The quake hit Nepal on April 25and he fled from Sindhupal Chowkjail on April 27. Following this, he

went to his home in Bhairwa onApril 29. He then went to NepalGunj where he stayed for a coupleof days with one Moin Ansariwhom he had met during his stayat Palpa jail.

"He then crossed the border andreached his native place inBahraich on April 5 to evade re-arrest in Nepal but was caught byus on April 7," said a senior policeofficer, associated with the probeinto the case.

Ahmad, who is on a 14-daypolice custody, had been on the runfor past 15 years and was alsotasked with recruiting Indianyouths and sending them to

Pakistan for training in handling ofarms and ammunition as well asfabrication of IEDs. Investigatorssaid he also worked for IndianMujahideen.

According to police, to takerevenge of Babri mosque demoli-tion, Irfan along with his associ-ates successfully executed bombblasts on various trains in Kanpur,Hyderabad, Indergarh inRajasthan, Surat, Lucknow andGulbarga.

In a surprise election outcome, the Conservative Partyled by David Cameron has been elected to govern theUnited Kingdom for the next five years, and this time on

its own majority. The results of the fiercely fought May 7elections belied pre-poll predictions of a tie between theLabour and Conservative parties and a hung Parliament inwhich the support of smaller parties would be key to craft-ing a coalition arrangement. The final outcome — predict-ed accurately only by the single exit poll published at 10p.m. after polling ended — has the Conservatives comfort-ably past the midway 326-mark in the 650-seat House ofCommons. The Labour Party, whose leader Ed Miliband rana bold and earnest campaign that focussed on a new andfairer deal for the working people, has come a far second.The party’s traditional stronghold of Scotland has been lostto the Scottish National Party (SNP), which has swept up allbut three of the 59 Scottish parliamentary seats. The LabourParty has also lost out to the Conservatives in England andWales. The Liberal Democratic Party — perceived asuntrustworthy for having reneged on its electoral promiseswhile in coalition — was decimated, its numbers downfrom 57 in the last Parliament to just eight, and with sever-al of its prominent leaders, including Vincent Cable, theSecretary of State for Business who had a prominent role inpromoting trade with India, defeated. The right-wing anti-immigration, Eurosceptic United Kingdom IndependenceParty has got only one seat; its leader, Nigel Farage, failedto win one. The Conservative Party takes credit for steeringthe country into economic recovery and creating two mil-lion new jobs. Its five-year mandate comes at a time whena million Britons depend on food banks for their survival,and where the numbers of people in poverty, according to areport from the New Policy Institute, have increased in thelast two years by 800,000, from 13.2 million to 14 million.The numbers in “deep poverty” have increased from 8.9million to 9.6 million, the same report states. TheConservative manifesto commits the party to welfare budg-et cuts of £12 billion to reduce the deficit. This comes overand above austerity measures that have already been under-taken. With Britain’s National Health Service in a financialand staffing crisis, higher education costs skyrocketing, aserious housing shortage on the cards, and utility costs soar-ing , the new government would appear to have its tasks cutout. Addressing these issues through the austerity route willrapidly abort Mr. Cameron’s promise of building “an evengreater Britain”. Moreover, the uncertainty created by thein-out EU referendum pledged before 2017 by theConservatives is likely to present a challenge for its interna-tional relations, even beyond EU.

Prime Minister Narendra Modi’sforthcoming visit to China,beginning May 14, is of consid-

erable interest not only to peoplesinhabiting the two countries, but alsoto leaders and strategic analysts glob-ally.

In China, Mr. Modi will be visitingXian, Beijing and Shanghai overthree days, before leaving forMongolia and South Korea. Mr.Modi’s visit follows ChinesePresident Xi Jinping’s trip to India inSeptember 2014. There is a great dealhinging on its outcome with Chinabeing viewed today as a pivot-state,and India the only nation in theregion capable of maintaining thebalance in the region.

For his part, Mr. Modi has, nodoubt, indicated that trade and eco-nomic ties with China would be hismain priority. However, there ismuch more to an Indian PrimeMinister’s visit to China than eco-nomic relations — unstated thoughthis may be. This visit is again takingplace at a time when China hasunveiled a new strategic vision, andelements of the strategy conform toSun Tzu’s principle of “winningwithout fighting”. It implicitlyincludes rewarding nations that itperceives as “friends” and, by impli-cation, excluding nations that standin its way.

New security paradigm

China is also currently affording anopportunity to nations in the region tobecome a part of a Beijing-contrived“security alliance”, holding out thepromise of a new Asian security par-adigm, previously embedded inChinese President Xi Jinping’s “Codeof Conduct for Asia” (2014). The lat-ter contained a veiled “warning” tocountries forging military alliances tocounter China. Perhaps, havingwaded too far out by its references tothe issue of maritime disputes in theSouth China Sea at various regionalfora, and more explicitly in the JointStrategic Vision for the Asia-Pacific

and the Indian Ocean region follow-ing the U.S. President BarackObama-Modi meeting in New Delhiin January this year, the PrimeMinister may, hence, need to indulgein some intricate balancing acts towin the confidence of his hosts.

Many Western analysts believethat China is presentlydemonstrating a degreeof “strategicautism”, result-ing from itsg r o w i n gp o w e r .T h eI n d i a nside needsto factorthis in itscalculations.Under PresidentHu Jintao andPremier Wen Jiabao,China had, by and large, dis-played a benign face. It was duringthis period, in 2008, that India andChina unveiled a “Joint StrategicVision for the 21st Century”. Thiswas considered unusual even then forChina generally finds it difficult toendorse a common vision.

Under Mr. Xi, China has movedaway from Deng Xiaoping’s injunc-tion “to hide our capabilities and bideour time and never claim leadership”.It now countenances the employmentof diplomacy as an instrument for theeffective application of Chinesepower in support of China’s ambi-tious and long-term foreign policyagenda.

Effectively, therefore, the 2008“Shared Vision Concept” is all butburied, and it would be useful to seewhat happens next. The Indian sidemust avoid falling into any kind oftrap of arriving at decisions on strate-gic issues, made seemingly easy bythe Chinese employing very simpli-fied, schematic representations ofhighly complex realities.

Meanwhile, current realities in theregion are becoming more complex

having entered a period fraught withchange.

The emergence of new dangers inWest Asia, the uncertainty inAfghanistan, with the Islamic State(IS) now siding with the

Taliban, tensions among differentnations in South-East Asia and EastAsia, and evidence of increasingChinese assertiveness, have producedan unstable equilibrium.

Impact of developments

Consequently, while there aremany issues that would be uppermostin Mr. Modi’s mind, the visit pro-vides an excellent opportunity forhim to assess, at first hand, whereChina is headed. It will give him achance to estimate the potentialimpact of recent developments onSino-Indian relations.

“ The ‘Maritime Silk Road’ con-cept is possibly an even more auda-cious move, with plans to connectmore than 50 countries via the seaand build a network of port citiesalong the Silk Road. ”

The Prime Minister could begin bymaking a realistic appraisal ofChina’s “Defence Posture” and thekind of threat this poses to India.Rising defence budgets (the 2015defence Budget is estimated at

$141.5 billion — the 26th year ofnormal double digit increases since1989), unveiling of a host of newstate-of-the-art weapons such as theDF-21D “Carrier Killer” anti-shipballistic missile (the Assassin’s Maceaccording to the United States) and

the J-20 stealth fightera i r c r a f t ,

employmentof asymmetric tactics

which conform to Sun Tzu’s pre-cepts, all send out a clear messagethat China is no longer willing towatch from the sidelines where itsimmediate and long-term securityinterests are concerned.

‘Outreach’ programme

Mr. Modi would also have theopportunity to understand, first hand,the implications of China’s“Outreach Programme”. The launchof the New Development Bank andthe Asian Infrastructure InvestmentBank has already demonstratedBeijing’s determination to build analternative financial architecture. The“One Belt, One Road” initiative(inclusive of a Silk RoadDevelopment Fund) aims to boostconnectivity with China’s CentralAsian neighbours, and establish aEurasian land corridor from thePacific Coast to the Baltic Sea, whichpossibly signals China’s determina-tion to undermine the U.S. Pivot toAsia.

The ‘Maritime Silk Road’ concept

is possibly an even more audaciousmove, with plans to connect morethan 50 countries via the sea andbuild a network of port cities alongthe Silk Road. This could well resultin circumventing and circumscribingIndia’s own outreach diplomacy.

The ambit of China’s “PublicDiplomacy” including the rapidexpansion of Confucius Institutes(there are over 415 such institutes

around the globe including around15 in India at present) also mer-

its the Prime Minister’s atten-tion. The interconnectinglinks between theseInstitutes and the authoritiesin China are matters which

require to be better under-stood in the context of China’s

current “soft power” offensive.As in the case of China’s “Peaceful

Rise”, there is room for worry andconcern.

China has already notched up sev-eral diplomatic successes — some ofthese will have an adverse impact onIndia’s external relations. The trans-formation in China-Russia relationsis clearly one. This has been facilitat-ed by the $400 billion gas deal, but itshould not be overlooked that Russiawas possibly the first overseas desti-nation for Mr. Xi. What should spe-cially concern India and Mr. Modi, isthat China and Russia are now deter-mined to deepen their “comprehen-sive strategic partnership” and “con-tribute to lasting world peace”.Likewise, China has gained a strate-gic beachhead in West Asia with itsIran connection. China is reaping thereward of standing by Iran. This willclearly put India on the back foot in aregion which it has carefully nursedfor a long time.

China-Pakistan connection

However, it is the further deepen-ing of the China-Pakistan connectionthat should be cause for graver con-cern, and Mr. Modi could seek fromhis Chinese host what exactlyChina’s intentions are. The $46 bil-lion promised by China for the

China-Pakistan Economic Corridor,which would link western China withthe Gwadar port in Pakistan throughPakistan Occupied Kashmir (PoK),by itself is worthy of India’s atten-tion, but it is also apparent that thequid pro quo includes China gainingstrategic access to the Gwadar port.The “pivot” to Pakistan in recentmonths, reflects Mr. Xi’s personalpreferences after the equivocation ofthe Hu-Wen period.

All in all, it might be useful for thePrime Minister to tread with cautionlest unexpected consequences followimprobable causes. This is speciallytrue when matters relate to the rulesof engagement between neighbour-ing states that have witnessed trou-bled relations in the past.

The underlying reason for concernis that China seems to be maximisingpower without purpose. The “logic ofstrategy” of such situations is that itinevitably provokes a confrontationalatmosphere.

In China’s evaluation, it is alreadythe predominant power in the region.It now seeks to translate its powerinto influence. Sharing power is far-thest from its mind, and “strategicaltruism” is not a quality that China— or for that matter most countries— possesses. India must remain alertto these eventualities when mattersconcerning strategic realities are dis-cussed.

The combination of an excess ofnationalism, belief in exceptionalism,and of the inevitability of a Sino-cen-tric world that is being fostered underPresident Xi Jinping, does haveinevitable consequences which coun-tries like India cannot overlook. Thisrequires Mr. Modi to focus clearly onthe strategic aspects of the relation-ship, and less on trade and economicties. It is the strategic content thatheightens the importance of a meet-ing of minds when the leaders ofIndia and China meet.

“Money is not important, access to itand misuse of it is,” said BharatiyaJanata Party leader and Jayalalithaa’s

f o e - t u r n e d - f r i e n d - t u r n e d - f o e ,Subramanian Swamy, in his written sub-missions to the Karnataka High Court.This was with regard to the former TamilNadu Chief Minister’s appeal againstconviction for possession of assets dispro-portionate to her income. The 919-pagejudgment of the Karnataka High Courttested precisely this proposition.

Ms. Jayalalithaa’s conviction by theSpecial Court, under Section 13 (1) (e) ofthe Prevention of Corruption Act 1988,had all the elements of a potboiler — apopular mother figure, an old accusationfrom an impetuous past, and a judgmentthat could be delayed no longer — butwith even more twists and turns than amovie script.

In 1995, when Ms. Jayalalithaa attendedthe lavish wedding of her now disownedfoster son V.N. Sudhakaran, she and herother co-accused in the case, Sasikala,would have hardly envisioned whatwould follow. Public revulsion at herunaccountable ostentation turned intoelectoral fury in 1996. Ms. Jayalalithaalost power and was arrested in severalcorruption cases.

Section 13 (1) (e) of the Prevention ofCorruption Act of 1988 states: “A publicservant is said to commit the offence ofcriminal misconduct, if he or any personon his behalf, is in possession or has, atany time during the period of his office,been in possession for which the publicservant cannot satisfactorily account, ofpecuniary resources or property dispro-portionate to his known sources ofincome.” It further explains “knownsources of income” as “income receivedfrom any lawful source and such receipthas been intimated in accordance with theprovisions of any law, rules or orders forthe time being applicable to a public ser-vant.” What this means is that at anystage, a public servant should be able toprove that assets owned or controlled byhim or her are attributable to proven, law-ful sources.

On a Re. 1 salary

When Ms. Jayalalithaa was Chief

Minister for the first time, between 1991and 1996, she took a monthly salary ofRe. 1 only. Her career as actor had endedin 1980, and seemed to yield no great sav-ings or assets beyond her house in PoesGarden in Chennai. Sasikala and her fam-ily were accused of possessing propertyon Ms. Jayalalithaa’s behalf.

A first-term Chief Minister often has noidea of the job requirements. Associatesneed to be strictly warned that proximityto powerful figures cannot turn familiari-ty into a revenue model. But a lonelyprima donna exalted to an empress mayperhaps be forgiven for indulging afavourite. However, when the indulgencewas extended to complicity with a wholefamily and tribe, it made a case for theprosecution. The essential premise of thecharge laid before the trial court was thatit was all for one and one for all.

Thus, assets of several companies inwhich Ms. Jayalalithaa, along withSasikala and her relatives, was a personalstakeholder, ended up being attributed inthe trial court judgment to Jayalalithaa.They could not be accounted for from herknown sources of income. It was urgedthat assets of around Rs. 3 crore in 1991could not legitimately metamorphose intoRs. 66 crore in 1996, even after account-ing for inflation in a newly liberalisedeconomy.

Added to the land and property assetswas the mind-boggling figure of 12,000saris, 28 kg of gold and 800 kg of silverfound in Jayalalithaa’s Poes Garden resi-dence. Explaining these against a slenderknown income made the case a matter ofdefendable accounting. An auditor mustbe a watchdog and not a bloodhound,ruled the House of Lords in a gentler cen-tury. But not all the Queen’s accountantsand all the Queen’s counsel could, in theSpecial Court, legally laugh away thesheer disproportion demonstrated by theprosecution.

From her first arrest on, Ms.Jayalalithaa has vigorously contested allthe cases against her. Her political for-tunes turned in 2001 when she led herparty to victory despite the pending cor-ruption cases. Her return to power beganto reflect in the special court in Chennai.Several witnesses turned hostile, and theprosecutor seemed to be going through

the motions of a trial. An acquittal for lackof evidence appeared imminent.

At this stage, the Dravida MunnettraKazhagam’s senior-most leader K.Anbazhagan moved the Supreme Court,saying a fair trial of the Chief Ministerwas not possible in Tamil Nadu. The courtagreed and transferred the trial toKarnataka. It also directed the appoint-ment of a Special Public Prosecutor bythe Karnataka government, who would beapproved by the High Court. An expedi-tious trial was ordered. One ofKarnataka’s most respected lawyers, B.V.Acharya, was persuaded to prosecute, andthe case commenced. However, a wholehost of issues was litigated from time totime by one or the other accused. Delay isa known defence tactic. The defence teamkept up a slew of dilatory motions. Theordered speedy trial was dragged and liti-gated at the Supreme Court at every stage.Five different special judges heard thecase over 18 years.

Lost steam

Curiously, after Ms. Jayalalithaa lostpower again in 2006, the prosecutionitself seemed to lack the vigour to pursuethe case. In 2010, ahead of the Assemblypolls of 2011, the case again picked upsteam. A second series of interim motionsand legal manoeuvring ensued. Theprocess also later led to the resignation ofMr. Acharya, who had brought the case tonear fruition. He was replaced by Mr.Bhavani Singh, who appeared to com-mand little praise and less love. Into thisbackground stepped Justice MichaelD’Cunha as the last trial judge, with a rep-utation for thoroughness and probity. InSeptember 2014, Jayalalithaa and herassociates were convicted. The trial courtheld that most of the assets were to betaken as held by the accused personally oron her behalf.

Ms. Jayalalithaa appealed immediately,but hearing on the admission and bail wasdelayed. Bail was denied by the HighCourt, but the Supreme Court in appealgranted it after 20 days of incarceration.The Supreme Court also made an expedi-tious disposal of the appeal a condition ofthe bail, thus eliminating any dilatory tac-tics by the defence.

The hearing of the appeals began again

in January this year and was concluded bymid-March. An issue then arose aboutwhether the Special Public ProsecutorBhavani Singh had been properlyappointed to conduct the appeal. Mr.Anbazhagan again approached theSupreme Court, seeking a fresh hearing ofthe appeal, with another public prosecutorbeing specifically authorised. With twojudges differing on the issue, the matterwent to a bench of three other judges, whofinally ruled that Bhavani Singh had beenimproperly appointed. The court saw noneed for a re-hearing of the appeal, butallowed all parties to make written sub-missions, which the appeals court wouldconsider with the evidence.

The judgment

The result of all this is the compendiousHigh Court judgment — exhaustive andalso thoroughly exhausting. The reason-ing can only be discerned from the last150 pages. Each transaction has beenanalysed; each explanation consideredand ruled on. The expenditure on the wed-ding is not attributed to Ms. Jayalalithaaalone, since she was on the groom’s sideof the event; the bride’s side of the fami-ly, including the late actor SivajiGaneshan, are seen to have contributed toit. Loans taken by Ms. Jayalalithaa toacquire property have also been consid-ered as reducing the disproportion in theassets. A detailed calculation of herincome and assets in tabular form wasconsidered, and the High Court concludedthat the property was acquired from law-ful sources. The footwear and apparelwere also not seriously taken intoaccount, as the prosecution had failed tosegregate them according to their individ-ual users, given that there were four peo-ple in the house. Overall, the High Courthas entertained reasonable doubt and heldthat the prosecution case is not proven.

But the story is not over; the appeal tothe Supreme Court remains. Ms.Jayalalithaa may play a political role for along time to come, but she will alwaysremain the first incumbent Chief Ministerto go to jail. That may have been a fittingclimax to a morality play, but Indian poli-tics is not always about morality.

Earthquake strikes...the second tremor that kept people on the

edge.According to the Indian Meteorological

Department (IMD), the first quake was fol-lowed by at least seven more tremors in aspan of less than two hours, as per PTI.

Police said several houses collapsed in thequake.

The fresh quake triggered massive panicamong the people, who have been staying inthe open since the 7.9-magnitude lethal tem-blor struck on April 25, killing over 8,000people and flattening thousands of buildingsbesides destroying whole villages.

Kathmandu airport was initially evacuatedas a precautionary measure, however, it laterresumed its normal business. Nepal's ForeignMinister Mahendra Pandey said that tele-phone lines have gone dead but efforts wereon to restore telecommunication servicesacross the country. Most of the people are outon the streets. The Nepal Cabinet will meetsoon for damage assessment, he added.

Quake rattles North IndiaStrong tremors were also felt across vast

stretches of east and northeast India. Thequake also jolted Afghanistan, China andIndonesia.

The quake had its impact in several cities inBihar, West Bengal, Delhi and UP etc. Delhiand the NCR region felt strong tremors at12:35 pm. Earth shook for over 20 seconds.Other areas in North India and East India,including West Bengal, Bihar, Jharkhand andAssam, felt the impact of the earthquake.

A Met official said the epicentre of theearthquake was 70 kms south-east of Nepaland measured 7.1 on the Richter Scale.However, he described it as an aftershock ofthe major one on April 25 that measured 7.9on the Richter Scale.

Eight dead in India due to massive earth-quake

At least eight people, including three chil-dren, were killed and nearly two dozen peo-ple were injured when a massive earthquakecaused walls to collapse in parts of Bihar,IANS quoted officials as saying. A labourerwas killed when an under-construction wallcollapsed in Danapur near Patna and a childwas killed in Siwan district when a wall col-lapsed. Another child was seriously injured,officials of state disaster management depart-ment said.

Two children were killed in Manigachi inDarbhanga district in a wall collapse and awoman was killed in Dumra of Sitamarhi dis-trict when she came under the debris of awall that fell. One person died in Hajipur inVaishali district, Nawada and Saran districtsdue to the quake.

Over half a dozen girl students of a govern-ment middle school at Bihya in Bhojpur dis-trict were injured when they were trying torush out of classroom.

In Forbesganj in Araria district, borderingNepal, at least 12 people were injured in astampede during the quake.

People in Patna, Darbhanga, Purnea,Kishanganj, Madhubani, Jehanabad andAurangabad felt the tremors for over aminute.

India says no rescue team till Nepal asks

for helpMeanwhile, said today that India will not

send any rescue team to Nepal to assist thelocal administration unless the neighbouringcountry seeks help in the wake of Tuesday'searthquake.

"Government will wait for a call fromNepal before sending any rescue team toNepal," a source privy to the deliberations atthe highest level of the government said.

The move bears significance as after about10 days of the April 25 earthquake, Nepalhad abruptly asked all foreign rescue teams,including India's National Disaster ResponseForce, to return home.

The government, however, has kept theNDRF and the Indian Air Force in full alertand on standby to respond to any emergencycall from Nepal.

Second quake part of chain reaction, sayscientists

On the other hand, the 7.3-magnitudeearthquake that struck Nepal today is part ofa chain reaction in a notorious seismichotspot, scientists said.

Like buttons popping off one by one froma shirt that is ripped open, a large quake dis-places stress to another part of a fault, caus-ing it to rupture, they said.

"Large earthquakes are often followed byother quakes, sometimes as large as the ini-tial one," said Carmen Solana, a volcanolo-gist at Britain's University of Portsmouth,AFP reported.

"This is because the movement producedby the first quake adds extra stress on otherfaults and destabilises them," she told theScience Media Centre (SMC), a not-for-prof-it organisation based in London. "It is a chainreaction."

"Since the first earthquake in April, after-shocks have been migrating more or lesssoutheastwards," Nigel Harris, a professor oftectonics at Britain's Open University, toldthe SMC.

Pascal Bernard, a seismologist at theInstitute for Planetary Physics in Paris, saidaftershocks in the region were unlikely to begreater than five magnitude.

Over 80 years prior to today's quake, east-ern Nepal had an 8.1 temblor in 1934.Around 10,700 people were killed in Nepaland neighbouring India.

"This means that pressure between the twotectonic plates in this region has significantlyeased," Bernard said.

At the interface of the two plates, theIndian plate is riding upwards at around twocentimetres a year.

The movement is not smooth but ratherladen with friction, leading to sharp andpotentially destructive jolts as stress buildsup.

It also said that in view of the importanceof Lokayukta, the "inaction" by ArvindKejriwal government and LieutenantGovernor Najeeb Jung for 18 months is"astounding" and a "clear reflection of thelack of respect" they have for existing lawsand democratic institutions.

Rana said that the "office of the Lokayuktahas been made a pawn in a political game"and the government "does not wish" to fillthe vacancy.

Driven by convenience,choice and low prices, theIndian e-commerce mar-

ket is poised to grow at a com-pound annual growth rate(CAGR) of 80 percent over thenext six years but for that to hap-pen, the government needs toallow foreign direct investment(FDI) in business-to-consumersegment.

"The Indian e-commerce mar-ket is poised to grow at a CAGR

of 80 percent or more over nextsix years, driven by convenience,choice and low prices," a reportreleased by India OpportunityAdvisors, a strategy consultingand communication company,stated.

"The sector has been witness-ing a growth of almost 100 per-cent year-on-year. To enable thesector to spur manufacturing forMake in India, create seven lakhjobs and also attract investment

of $25 billion (roughly Rs.1,60,754 crores), opening inven-tory-led B2C e-commerce to FDIis critical," Manish Sharma, man-aging partner, India OpportunityAdvisors, said.

"The industry cannot reach itsfull potential through one modelof B2B (business-to-business)marketplace. Both the modelsneed to co-exist and grow in anenabling environment for theoverall benefit of the economy,"

he added.

With increased penetration of3G and smartphones, the e-com-merce market can grow to beeven bigger than $60 billion(roughly Rs. 3,85,811 crores) by2020, it said.

"However, challenges remainin the form of lack of clear poli-cy and regulatory framework,over-dependence of sales on cashon delivery and under-developed

ecosystem. A stable regulatoryand policy environment canmake e-commerce one of largetriggers for lower prices of prod-ucts, development of Indianbrands, Make in India and be oneof largest foreign direct invest-ment into country," the reportsaid.

Per capita spending on e-com-merce is expected to increasefrom $138 now to about $345 bythe year 2020.
