The American Bar Association Section of Antitrust Law and the International Bar Association Antitrust Committee are delighted to invite you to the Twelfth International Cartel Workshop, which will be held in Paris from February 14-16, 2018. Recognized globally as the premier international cartel conference, it is presented every two years. Each time, it takes place in a different major city, having last been in Tokyo in 2016 and attended by almost 400 people.

The Paris conference will continue the Workshop’s long tradition of instruction by demonstration and its growing use of multi-media. A faculty of highly experienced attorneys and enforcers from around the world will take you through a hypothetical global cartel investigation – from detection of a conspiracy to the ultimate disposition of the enforcement actions in jurisdictions around the world. The Workshop will highlight current developments in cartel enforcement in many jurisdictions. In addition to the demonstrations that will illustrate how these new developments impact cartel enforcement, the program will feature an enforcers’ roundtable where questions will be put to the top enforcers from the United States, the European Commission, Canada, Japan, France, Australia and Brazil.

The 2018 Workshop will cover three full days with twenty-four real world scenes. It will also feature a number of noteworthy new presentations. First, the pre-opening session will provide

two options, one on international cartel fundamentals and another on current developments and relative exposure with respect to private damage actions around the globe. Second, the Workshop will focus sharply on a variety of new developments, including a demonstration on how to address ability to pay with the US Antitrust Division. Third, we again present demonstrations of what happens if a company decides to contest the charges rather than plead guilty or settle. There will be a demonstration dedicated to the strategy and ultimate decision to contest the charges, as well as a demonstration of the direct and cross examination of a cooperating witness in a U.S. criminal case before Federal Judge Jon Tigar. Following the contested trial demonstrations, we will learn the view from the judge in a debriefing session with Judge Tigar. Finally, we have built into the program time for questions and commentary to enable putting questions directly to the presenters to understand why they took positions and what might be alternatives.
