Plaintiffs, State Farm Mutual Automobile Insurance Company, State Farm Indemnity

Company and State Farm Fire and Casualty Company (collectively hereinafter "State Farm" or

"plaintiffs"), having moved this Court by Notice of Motion for an Order seeking entry of a default

judgment against defendant, PUGSLEY CHIROPRACTIC, PLLC, under Section 3215 of the

c.P.L.R., and this motion having duly come to be heard before the Court on the 7th day of June,

2016, and Anthony Troise of FREIBERG, PECK & KANG, LLP, having appeared for the

Plaintiff(s), and Nicholas Bowers of GARY TSIRELMAN, P.c., having appeared for Defendant,

after considering the papers submitted in connection with the application, the papers on file in

this action, and the authorities cited, the Court finds as follows:

The defendant is not a minor, incompetent person, or a current member of the military

service.

NOW, upon reading and filing the Notice of Motion dated the 11th day of February, 2016,

the affirmation in support of Yilo J. Kang together with affidavit, affirmations, and exhibits

annexed thereto; all in support of the motion; and due deliberation having been had thereon, it is

hereby

ORDERED, that the plaintiffs have established that they are entitled to a declaratory

judgment declaring that:

(i) PUGSLEY CHIROPRACTIC, PLLC submitted claims to State Farm for health service benefits that were allegedly rendered to individuals who were involved in automobile accidents and eligible for coverage under State Farm automobile insurance policies in New York;

(ii) State Farm conducted an investigation into the eligibility PUGSLEY CHIROPRACTIC, PLLC to collect No-Fault benefits under the subject policies and New York No-Fault Laws as well as its billing practices;

(iii) State Farm timely mailed requests for the EUOs as identified in the chart below and State Farm had reasonable and specific objective justifications to make the EUO requests identified in the chart below;

(iv) PUGSLEY CHIROPRACTIC, PLLC failed to appear for each of the duly scheduled EUOs referenced in the chart herein thereby breaching a condition precedent to No-Fault coverage and violating the No-Fault regulations;

(v) the bills identified in the chart below were timely and properly denied for the defendant's failure to appear for the EUOs; and

(vi) that PUGSLEY CHIROPRACTIC, PLLC has no right to receive payment for the bills submitted to State Farm and listed in the chart below:

PUGSLEY CHIROPRACTIC, PLLC, declaring, pursuant to c.P.L.R. § 3215, that:

(i) PUGSLEY CHIROPRACTIC, PLLC has no right to receive payment for any of the bills listed in the chart above submitted to State Farm seeking no-fault reimbursement under the policies because PUGSLEY CHIROPRACTIC, PLLC failed and/or refused to appear for an examination under oath requested by State Farm, and thus breached a condition precedent to coverage and violated its obligations under the No-Fault Laws; and

(ii) All the bills listed in the chart above submitted by PUGSLEY CHIROPRACTIC, PLLC to State Farm under the subject policies are deemed timely and properly denied and not payable.

ORDERED, that a copy of this order with notice of entry be served on all parties and proof

of service is to be filed with the Kings County Clerk.
