CITY HALL
Mayor Watson called the meeting to order at 6:00 p.m. with seven members present. Aldermabsent.
City Clerk Clausen gave the Invocation and led the Pledge of Allegiance.
MINUTES- September 17, 2013
Alderman Johnson moved to approve the minutes of the September 17, 2013 meeting. Aldeseconded the motion and it passed unanimously by all in attendance.
PUBLIC COMMENT
Jim Moreno, of 7 Southland Drive, stated the City's biggest problem was traffic. He proposlights near the 1430 bridge to help the problem.
William Page, of 12 Masters Place, presented facts regarding water usage from Lake WillasCouncil hard copies of his statement.
Alderman Mosley stated that he was trying to gather information from several parties on the
Steve Hillis, of 6 Thomas Court and board member of Maumelle Country Club, stated he wo
information the Council would need and felt the Country Club was a partner with the City.
Alderman Lewis asked what the cost of replacing the greens would be.
Mr. Hillis stated in 2008 for 18 holes it cost $150,000.

PROCEDURAL MOTION
Alderman Lewis moved to have all ordinances and resolutions read by title only. Alderman
the motion and it passed unanimously by all in attendance.
ORDINANCE 825 REQUIRING APPROVAL OF SPECIFIC PLANS
With no objections, Mayor Watson called for the second reading of the ordinance requiring a
plans by the Maumelle Planning Commission for above ground placement of any transmissiindustrial zoned areas. The City Clerk gave the reading.
ORDINANCE 826 CONCERNING BANNERS IN CERTAIN CITY PARKS
With no objections, Mayor Watson called for the second reading of the ordinance amending
Code concerning banners in certain City parks. The City Clerk gave the reading.
City Attorney JaNan Davis stated she had looked into content restriction on banners and advMrs. Davis stated its best to work out the details in the contract and not in the code.
RESOLUTION 2013-30 DISCLAIMING AND OR TRANSFERRING OWNERSHIP
With no objections, Mayor Watson called for the reading of the resolution disclaiming and o
ownership or interest in Tract C of the Villages of New Bedford. The City Clerk gave the re

RESOLUTION 2013-31 REGARDING SURPLUS PROPERTY
With no objections, Mayor Watson called for the reading of the resolution approving the disp
truck from the public works department. The City Clerk gave the reading.

RESOLUTION 2013-33 AMENDING THE 2013 SANITATION FUND BUDGET
With no objections, Mayor Watson called for the reading of the resolution amending the 201
Budget appropriating funds for the purchase of a sanitation truck. The City Clerk gave the r

RESOLUTION 2013-34 AMENDING THE 2013 GENERAL FUND BUDGET
With no objections, Mayor Watson called for the reading of the resolution amending the 201
Budget appropriating funds for the purchase of truck for animal control. The City Clerk gav

RESOLUTION 2013-35 AMENDING THE 2013 STREET FUND BUDGET
With no objections, Mayor Watson called for the reading of the resolution amending the 201
Budget appropriating funds for the purchase of a street sweeper. The City Clerk gave the re

City Clerk Clausen stated one bid came in at $182,239.96 and the other came in at $211,628
would need an additional $35,000 to purchase the street sweeper.
Alderman Mosley asked if the City really needed a street sweeper.
Mayor Watson stated the street sweeper is used daily to collect debris on the streets of the C
City Clerk Clausen stated the City hoped to recoup the additional funds through a trade in.
Alderman Lewis noted the street sweeper would also help the sewer systems and other City f

RESOLUTION 2013-37 AMENDING THE 2013 GENERAL FUND BUDGET
With no objections, Mayor Watson called for the reading of the resolution amending the 201
Budget appropriating STEP grant funds to the police department. The City Clerk gave the r
Aldeuuan Norris asked what innovative strategies the Police Department had planned to use
Chief of Police, Sam Williams, noted sobriety checkpoints and advertising would be used.
Alderman Lewis moved to approve the resolution. Alderman Kelley seconded the motion anunanimously by all in attendance.
ORDINANCE 827 DECLARING EXTRA TERRITORIAL JURISDICTION
With no objections, Mayor Watson called for the first reading of the ordinance declaring ext
jurisdiction by the City of Maumelle and adopting a map. The City Clerk gave the reading.
ORDINANCE 828 WAIVING COMPETITIVE BIDDING PROCEDURES
With no objections, Mayor Watson called for the first reading of the ordinance waiving the c
procedures for the purchase of a weather warning siren for the fire department. The City Clereading.
Alderman Lewis asked if this was an emergency. Chief Glenn stated it was not.
Alderman Mosley asked the cost of the new siren. Chief Glenn stated it is $27,000.
City Clerk Clausen noted that it was approved in the budget but that state law required a bid
bidding procedures.
Alderman Hogue asked where the location of the siren would be. Chief Glenn stated the sireend of Country Club Parkway by the ball fields.
RESOLUTION INTRODUCTION 2013-28 ADOPTING A STRATEGIC PLAN
Crafton Tull presented the strategic plan to the Council and took questions.

Alderman Lewis stated that there was no crisis here and that the agreement had worked fine

PLANNING COMMISSION REPORT
Alderman Saunders gave a report on the Planning Commission proceedings. He stated that a
storage facility was denied. He stated that two variances were approved in order to let one ho
in disrepair. He stated that a site and landscape plan were approved for BEI. He stated that t
jurisdiction map and strategic plan were approved.
ALDERMEN'S COMMENTS
Alderman Hague asked if the boat ramp was finalized.

CITY OF MAUMELLE NOTES TO FINANCIAL STAT
Note 1: Minimum fund balance policy for the general fund
Ordinance 438 states that the general fund shall maintain a level of fund balance equal to
20% of budgeted operating expenditures. Currently, this figure is $ 2,202,021
Note 2: Fund balance classifications
Effective with the January 31, 2011 financial statements, there are new fund balance classifications
for the General and Street funds. The new classifications and their definitions are as follows:
-Nonspendable - fund balance that can't be spent, such as inventory and prepaid items
-Restricted - use of these funds is restricted by external sources, such as law or grant
requirements-Committed - use of these funds is restricted by formal action of the city council
-Assigned - use of these funds is restricted by informal action of the city council
-Unassigned - fund balance that has not been restricted, committed, or assigned

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MAUM
COUNTY OF PULASKI, STATE OF ARKANSAS,
AN ORDINANCE TO BE ENTITLED:
ORDINANCE NO. 825
AN ORDINANCE REQUIRING APPROVAL OF SPECIFIC PLANS BY
MAUMELLE PLANNING COMMISSION FOR ABOVE GROUND PLACE
ANY TRASMISSION FACILITIES IN INDUSTRIAL ZONED AREAS IN TH
MAUMELLE, AND FOR OTHER PURPOSES
WHEREAS, The City of Maumelle requires that all transmission line
underground within the city and provides an exception to this standard only w
properties within industrial zoned areas, and
WHEREAS, it is an unnecessary burden on local businesses, organizations, a
to require approval from both the City Council and planning commission to pfacilities above the surface of the ground in industrial zoned areas;
WHEREAS, the City Council is committed to removing unnecessary regula
on local businesses, organizations, and residents; and
WHEREAS, The City Council does wish to defer approval on this
Maumelle Planning Commission finding that the Commission is better suited to
technical elements relevant to the approval of such overhead transmission lines zones.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TH
MAUMELLE, ARKANSAS, THAT:
SECTION I. Chapter 86 - Utilities, Article L In General, Section 86-1. - Restric
Maumelle City Code, is hereby amended to read as follows:

SECTION 3. All provisions of this ordinance of a general and permanent nature are
to the Maumelle City Code and the same shall be incorporated in the Code.
SECTION 4. Repealer. All other ordinances or parts of Ordinances in conflict h

WHEREAS, the City Council is committed to the safety, beauty, and pea

SECTION I. Chapter 58 Sign Regulations, Article I. IN GENERAL. Section 58
Placing Signs on Public and Private Property, of the Maumelle City Code, is h
amended to read as follows:
Sec. 58-13. - Placing signs on public and private property.
(a) Placing signs on public property. No signs other than signs approved by
council or its authorized representative shall be erected on any public
property. Banners on public property may be allowed according to t

Commission has recommended the declaration of extraterritorial planning jurisdictio
adoption of a map to show the boundaries of said jurisdiction; and

carts and live around the two golf courses in town; and
WHEREAS, the City Code allows certain usage of golf carts outside the
boundaries of the golf courses but limits the same to certain persons who are goin
from the golf course to their home; and
WHEREAS, the City Council wishes to expand and further clarify the al
usage of golf carts.

SECTION 1. Chapter 82. Traffic and Vehicles, Article L In General, Section
Operation of golf Carts, of the Maumelle City Code is hereby amended as follow
Sec. 82-5. - Operation of golf carts.
(a) Operation upon city streets. Pursuant to A.C.A. 14-54-1410, golf carts m
operated by the owner upon the city streets as set forth in this section.
(b) Operation without licensing authorized Any owner of a golf cart or his/h
immediate family members over the age of sixteen (16), may operate his golf car

The MWM board discussed the following items at their regularly scheduled boa
meeting:
Financial statement; Revenue projections were off due to a wetter than n
late summer.
The water production and distribution operations are going smoothly. N
problems in this reporting period, The new treatment processes have be
successful, however the chemical treatment costs are much greater than b
The TTHM regulations from EPA and ADEQ take effect soon. MWM's
have substantially reduced the TTHM's in the system overall. During diit was again noted that many water utilities will likely have difficulty in
the new testing requirements, thus violation notices. .MWM having take
active approach will be beneficial to the utility in the long run,
In the sewer treatment section, the system is running smoothly. Work w
soon on updating a sewer lift station in the Osage Falls area. Sludge rem
costs are still expensive, but options are limited regarding disposal.
The legal paperwork regarding the Simpson's sewer issues have been su
completed with the needed filings in the Pulaski county court to occur swork to relocate the sewer line on their property has already been compl
allowing them to proceed with construction.
No time lost accidents were reported for this month.
