Policy Requirements and Prohibitions The use of alcohol or drugs by employees

during working hours on the job site or on company property (including company vehicles) is absolutely prohibited.

Participants are required to submit to drug and/or alcohol testing in accordance with this policy.

Policy Requirements and Prohibitions

No participant will be tested for alcohol unless a reasonable suspicion exists that the person is under the influence of alcohol, or they are involved in an OSHA recordable on the job accident.

Participants subject to this policy continue to have access to the usual protections provided as part of their union membership.

Policy Requirements and Prohibitions

All members of the program shall be considered part of the testing pool and will be tested over a 2 year period.

Participants will be selected randomly from the 50% pool.

Participants who complete the testing process will not be returned to the 50% pool.

At the same time there will be an ongoing 10% Hair pool. Hair will be taken from anywhere on the body if head hair is not available.

Testing Procedures Designated Representative faxes/emails

Notification Sheet form back to ScreenSafe. Participants are given until end of next

business day to take test. If the test is negative, no further action is

taken.

Testing Procedures If the test is positive, the Medical Review

Officer (MRO) calls participant to validate reason for positive.

If no valid reason found, participant is in violation of program.

Marijuana and it’s active ingredient THC are illegal under federal law and accordingly are included in this policy. No Medical Marijuana use is allowed under this policy.

Testing Procedures - Safeguards Integrity of specimens insured by utilization

of one collection procedure at all sites

All labs have DHHS (Department of Health and Human Services) certification

All positives confirmed by GC/MS (Gas Chromatography Mass Spectrometry)

MRO reviews all drug test positives

Testing Occasions - Portability These provisions will apply to those individuals

working under the portability rules. All traveling craftpersons will be subject to:

Initial testing Random testing – 10% pool

Craftsperson will be allowed to report to work immediately after providing a urine specimen for testing.

A non-compliant test for any prohibited substance result in immediate termination.

Other Testing Testing will also be done when there is

“reasonable suspicion”.

Accelerated testing (follow-up) takes place (based on EAP/MAP recommendation) once a participant has been non-compliant and has returned to work.

Program Violations Program Violations can include;

Having a positive test result. Failing to take a test as scheduled Failing to keep a scheduled appointment with

EAP/MAP or Failing to participate in and/or complete the

assigned treatment or education program (continued);

Program Violations (continued) Program Violations can include

Substituting another substance or specimen

Providing a dilute specimen for a second time without a valid medical explanation

Providing a urine specimen which shows the presence of an adulterant

Non-Compliant Protocol ScreenSafe will inform the Designated

Representative from the union as well as the contractor that the participant is non-compliant and send paperwork for their records.

The member will need to be removed from the jobsite immediately.

The Designated Representatives will not be notified of any information other than the member is non-compliant.

Non-Compliant Protocol ScreenSafe will ask the contractor to have the

member contact ScreenSafe, Inc. Participants will receive written notices

confirming their test results and providing them with information to assist them in returning to compliance.

Once the participant is compliant ScreenSafe will notify the union and contractor designated representative and send documentation stating the participant may return to work.

Consequences Participant will be referred to the EAP for

evaluation Participant must complete recommended

treatment or education program to stay in compliance

The participant will be placed in an accelerated testing program.

Consequences (continued) Discipline is progressive

First non-compliance the participant has two choices Choice one go through the treatment program and in most

cases be returned to work prior to the program completion Choice two wait out 30 days from initial contact with Medical

Review Officer, with this option the participant will not be allowed to return to work for 30 days, must have a negative drug screen and the company will terminate the participant.

Second non-compliance treatment recommendations must be followed. The 30 day wait out is not available on a second or any subsequent non-compliance.

Consequences (continued) Third non-compliance the participant will be

suspended for 30 days and must follow treatment recommendations

Fourth non-compliance the participant will be suspended for 180 days and must follow treatment recommendations

Fifth non-compliance the participant will be suspended for 1 year and must follow treatment recommendations
