    ELECTION COMMISSION OF PAKISTAN

    NOTIFICATION

    Islamabad the 28th May, 2013

    No.F.6(1)/2013-Cord.-WHEREAS, Article 51 of the Constitution of Islamic Republic of

    Pakistan provides for number of seats reserved for women and Non-Muslims in the NationalAssembly and also provides that the members to fill seats reserved for Women and Non-Muslims shall be elected in accordance with law through proportional system of PoliticalParties lists of candidates on the basis of total number of general seats secured by eachpolitical party from the Province concerned in the National Assembly.

    AND WHEREAS, section 47A of the Representation of the People Act, 1976provides that for the purpose of election to seats reserved for Women and non-Muslims in theNational Assembly and Provincial Assemblies, the political parties contesting elections forsuch seats shall within the period fixed by the Election Commission for submission ofnomination papers, file separate lists of their candidates in order of priority for seats reservedfor Women and non-Muslims with the Chief Election Commissioner or, as he may direct, withthe Provincial Election Commissioner concerned.

    AND WHEREAS, the political parties were required to file their lists ofcandidates in order of priority in respect of seats reserved for women in the NationalAssembly with the concerned Returning Officers by 31-03-2013.

    AND WHEREAS, such lists of candidates filed by the political parties with theconcerned Returning Officer by 31-03-2013are at Annex-A for information of all concerned.

    AND WHEREAS, the President has promulgated the National Assembly andProvincial Assemblies Allocation of Reserved Seats for Women and Non-Muslims(Procedure) Rules, 2002, thereby laying down the method and procedure for working out the

    quota of seats reserved for Women and non-Muslims in National Assembly and ProvincialAssemblies in respect of each political party, which is reproduced hereunder:

    3. Election for reserved seats for women and non-Muslims.(1) Elections to thereserved seats for women and non-Muslims in the National Assembly and ProvincialAssemblies shall be held on the basis of proportional representation system of politicalparties lists of candidates in accordance with the provisions of these rules, the Orderand the Act.

    (2) The members to fill seats reserved for women in the National Assembly allocated to aProvince shall be elected through proportional representation system of political partieslists of candidates submitted to the Election Commission on the basis of total number ofgeneral seats won by each political party from the Province concerned in the NationalAssembly.

    (3) The members to fill seats reserved for women allocated to a Province shall beelected through proportional representation system of political parties lists of candidateson the basis of total number of general seats won by each political party in the ProvincialAssembly.

    (4) The members to fill seats reserved for non-Muslims in the National Assembly and theProvincial Assemblies shall be elected through proportional representation system ofpolitical parties lists of candidates on the basis of total number of general seats won byeach political party in the National Assembly on as the case may be, in the ProvincialAssembly.

    (5) For the purpose of this rule the expression total number of general seats won bypolitical party shall include the independent returned candidate or candidates who mayduly join such political party within three days of the publication in the official Gazette ofthe names of the returned candidates:

    Provided that the independent candidate applies to the leader of political party forjoining his party and the leader of political party forthwith informs the ElectionCommission of his joining through a letter to be delivered to the Election Commission.

    4. Commission to declare seats won by each Political party.(1) The Commissionshall, by notification in the official Gazette declare the total number of reserved seats

    won by each political party in the National Assembly and the Provincial Assembliesrespectively.

    (2) The per centum share of each political party shall be worked out with reference tototal number of general seats in the National Assembly or as the case may be therespective Provincial Assembly.

    (3) In calculating the number of seats, the highest fraction shall be taken as one seat tillthe allocation for total reserved seats in the concerned Assembly is completed.

    (4) The seats reserved for non-Muslims and women shall be divided among the politicalparties on the basis of their per centum share as worked out in sub-rule (2) and in orderof priority of the names of candidates mentioned in the party list:

    Provided that the list submitted by a political party shall not be subject to changeor alteration either in the order of priority or through addition or subtraction of new namesafter expiry of the date of submission of nomination papers.

    Explanation. For the purpose of this rule the expression political party means apolitical party to which as symbol has been allocated by the Commission.

    5. Procedure where a nominee of political party is elected on more than onegeneral seats, etc.(1) If a contesting candidate, being nominee of a political party hasbeen elected on more than one general seats, whether in the same or differentAssemblies, all the seats won by him shall be counted for the purpose of calculation ofgeneral seats won by that party in the National or the Provincial Assembly, as the casemay be.

    (2) The seats won by independent candidates and the seats referred to in sub-rule (1)shall be excluded from the total number of general seats in the National Assembly for thepurpose of determination of share of each political party:

    Provided that if an independent candidate duly joins a political party under sub-rule (5) of rule 3, he shall not be excluded for the purpose of calculation of total numberof general seats of such political party.

    6. Declaration of result by the Commission.(1) The Commission shall calculate thetotal number of seats won by each political party separately in the National Assemblyand each Provincial Assembly in the manner specified in rule 4 and shall then ascertainthe proportion of each political party of the seats reserved for women and non-Muslims.

    (2) On the basis of the calculations done under sub-rule (1), the Commission shall

    ascertain the number of seats to which each political party is entitled.(3) The Commission shall then declare elected to the National Assembly or, as the casemay be, the Provincial Assembly such number of candidates belonging to each politicalparty, in order of priority in which their names appear in the lists provided by a politicalparty as is equal to the number of seats to which that party is entitled under sub-rule (2).

    AND WHEREAS, a statement containing number of general seats won by eachpolitical party and their respective share in the National Assembly of Pakistan is also atAnnex-B.

    NOW THEREFORE, in exercise of powers conferred under Article 51 of theConstitution of Islamic Republic of Pakistan, section 47A of the Representation of the PeopleAct, 1976 read with relevant provisions of the National Assembly and Provincial AssembliesAllocation of Reserved Seats for Women and Non-Muslims (Procedure) Rules, 2002 and allother powers enabling it in that behalf, the Election Commission hereby publishes the names
