An agency worker who fell off a raised tail lift and suffered a brain injury on his first day in a new job had not been trained to use the equipment safely, a court was told. The 27-year-old man was working as a multi-drop delivery driver for pallet distribution firm H&M Distribution when the accident happened on 18 May 2017. The company pleaded guilty to breaching s 3(1) of the Health and Safety at Work Act and has been fined £60,000. Cheltenham Magistrates’ Court was told that the worker was given a ‘brief’ induction at the company’s Gloucester depot before starting work the same day. However, an address on his route was incorrect and the order of 12 beer kegs was undeliverable. The worker was moving the kegs with a pallet truck to access the next load when he fell from the raised tail lift on to the road, several kegs of beer fell and struck him, resulting in a traumatic brain injury and facial fractures that required metal plates to be inserted into his skull. Investigating, the Health and Safety Executive (HSE) found the worker had no previous experience with the type of pallet truck or tail lift involved in the accident, had not been trained to use the machinery safely, nor was he made aware of safe working practices for operating a pallet truck on a tail lift. It said H&M Distribution failed in its duty to carry out checks on the injured person’s competence and previous experience and, as a result, did not provide adequate training. The company was ordered to pay prosecution costs of £7,203 also. After the hearing HSE inspector Berenice Ray said: ‘Employers who use agency workers or contractors have a responsibility to firstly establish the workers’ competence, [considering] their level of experience and familiarity with the work and work equipment, and then provide the appropriate level of training to ensure the work is done safely. ‘If appropriate training had been provided, the life-changing injuries sustained by the agency worker could have been prevented.’ In August 2014 a H&M Distribution delivery driver was paralysed from the chest down when he was crushed between two vehicles at a yard in Sandy, Bedfordshire, resulting in a £150,000. An agency worker who fell off a raised tail lift and suffered a brain injury on his first day in a new job

had not been trained to use the equipment safely a court was told

A worker was killed in a crush incident after firms had

lsquofailed to properly plan the lifting operationrsquo

Andrew Bowes a 37-year-old metal fabricator

employed by Larkin Engineering Services Ltd died

while working at the companyrsquos premises on Meeting

Industrial Estate in Barrow in Furness

The incident happened during March 2012

Larkin Engineering Services Ltd had contracted

Cumbria Design Scaffold Ltd to collect two large

metal walkways and deliver them to a customer using

a flatbed lorry fitted with a mounted crane

Mr Bowes was directed to assist with the lifting

operation by his employer

The first walkway had been lifted onto the back of

the lorry but was not fastened down

As the crane moved to pick up the second walkway

a sling became snagged on the first walkway causing

it to tip over and fall from the back of the lorry onto

Mr Bowes who sustained fatal crush injuries

In respect of Cumbria Design Scaffold Ltd the

HSErsquos investigation found that the company

had failed to

bull Properly plan the lifting operation

bull Recognise the risks involved and did not have a

safe system of work for what was a complex lift

bull Supervise the lifting operation properly

As a consequence the lifting operation was poorly

organised and controlled placing those in the immediate

vicinity at significant risk

In terms of Larkin Eng Services Ltd the investigation found

it had failed in its duty to ensure the safety of Mr Bowes

It had directed Mr Bowes who had only been working for

the company a week to become actively involved whilst

the operation was taking place

Cumbria Design Scaffold Ltd of Ulverston Cumbria

pleaded guilty to breaching Section 3 (1) of the

Health and Safety at Work etc Act 1974 and was fined

pound60000 with costs of pound2746428

Larkin Eng Services Ltd of Barrow in Furness Cumbria

pleaded guilty to breaching Section 2(1) of the Health

and Safety at Work etc Act 1974 and was ordered to

pay fines of pound20000 and costs of pound2721109

Speaking after the hearing HSE Inspector Anthony Banks said

lsquoWe would like to thank Andrewrsquos family for their patience

throughout what has been a complex investigation

Companies should always ensure that lifting operations are

properly planned organised and conducted safely

Had this lifting operation been properly planned and

supervised then this tragedy could have been averted

HSE will take enforcement action against both clients and

contractors who fail to meet the required standardsrsquo

A construction firm has been fined pound600000 following the death of a workman

who was crushed by a dumper truck in Edinburgh

Vincent Ramsay 55 was killed on a building site in 2016 when a dumper truck

ran over him at the bottom of a dirt ramp

The father-of four had been crouching down to spray markings when he was hit

London-based Allenbuild Ltd pleaded guilty to health and safety failings

at Edinburgh Sheriff Court Sheriff Norman McFadyen said the purpose of

the pound600000 fine was to bring home to businesses the need to comply

with Health and Safety legislation He said

lsquoIt is not to put a value on a human life and that is not what the court is

doing it is punishing the companyrsquo

He concluded by expressing to the family his own condolences and sympathy

The incident took place at a former bus and tram depot in Leith known as Shrubhill

Allenbuild Ltd had been developing the site for housing and the accident

occurred at the bottom of a dirt ramp leading to an underground car park

Mr Ramsay was crouched down to respray a pile marker at the bottom of the

ramp when he was struck by a dumper truck

The court heard that the driver of the dumper truck had restricted visibility because

of the load of excavated earth it was carrying and had not seen Mr Ramsay

Sheriff McFadyen said the company should have recognised there were

instances where site personnel had to access the underground car park

on or near to traffic routes used by trucks and should have taken measures

to ensure that they were not at risk of being struck

The sheriff accepted that the company had been in business for over 70 years

had no previous convictions and had admitted guilt at the earliest opportunity

This led to him slightly reducing the size of the fine

Worker Died in Stairwell Fall after Construction

Company Failed to Provide Edge Protection

A quarry operator that failed to keep fixed guards in place

on moving machinery has been fined pound44000 after a new

employee sustained serious arm injuries

The Tudor Griffiths employee was injured on his first day

working at the quarry in Ellesmere in Shropshire when his arm

got caught and dragged into the nip point between the

conveyor belt and the rotating tail drum

The worker required multiple skin graft operations on his arm

and has been left with permanent scarring

A Health and Safety Executive (HSE) investigation found

the Ellesmere-based company had failed to ensure that fixed

guards were effective to prevent workers accessing the

dangerous parts of the machinery

The risk had been identified several months before the incident

on 9 December 2016 but the company had taken no action

to prevent access to what is known to be a danger area

Tudor Griffiths pleaded guilty to breaching s 2(1) of the Health

and Safety at Work Act at Telford Magistratesrsquo Court and

must also pay pound2866 costs

lsquoEntanglement in conveyor systems is a significant cause

of serious accidentsincidents in the quarry industry

Quarry operators should make sure they properly assess and

apply effective control measures to minimise the risk from

dangerous parts of machineryrsquo

A property developer that failed to provide edge protection

during the conversion of a west London warehouse into

residential flats has been fined over the death of a worker

who plummeted 75 m down a stairwell

The Formation Construction employee was using a concrete

breaker at Tech West House in Acton to make an opening for

the stairwell when he fell on 4thNovember 2015 and sustained

fatal head injuries

A Health and Safety Executive (HSE) investigation found the

company had not planned or supervised the work and had

failed to ensure it was being carried out safely

It served an enforcement notice stopping the work activity until

there were guardrails or barriers to prevent workers falling

Formation Construction pleaded guilty to breaching s 2(1) of the

Health and Safety at Work etc Act 1974 and was fined pound300000

plus pound17528 costs at Westminster Magistratesrsquo Court

Accounts filed for the year to 31 August 2017 showed a

turnover of pound209m thus classed as a lsquomediumrsquo organisation

under the safety and health sentencing guidelines

HSE inspector Kevin Smith said the accident was

lsquotragic and wholly avoidable caused by the failure of the

company to implement suitable and sufficient measures

to prevent fallsrsquo

Manufacturing Company Fined euro500k after

Fatal Accident at Quarry

A manufacturer of concrete and quarry stone products in the

Republic of Ireland has been fined euro500000 for three breaches

of Health and Safety legislation

The prosecution followed a fatal accident on 11 June 2015 at

Carrowscoilta Quarry Ballyhaunis Co Mayo

An employee of the company Mr Joseph Harrington was fatally injured

when he fell into an inadequately guarded stone crusher at the quarry

operated by Harrington Concrete (no relation) and Quarries ULC

Harrington Concrete and Quarries ULC had earlier pleaded guilty to

three offences under the Safety Health and Welfare at Work Act 2005

namely the failure to

bullAdequately guard the crusher and the area around it

bullEnsure there were safe systems in place to unblock the crusher

bullEnsure the safety statement contained safe operating procedures and

instructions for the operation of the crusher

Mark Cullen Asst Chief Executive of the Health and Safety Authority said

lsquoIt is vital that employers ensure that they provide safe plant and

machinery and that there are appropriate safe systems of work in

place designed to protect their employees Furthermore such measures

should be specified in the company safety statement The failures that

contributed to this incident are clear and the consequences for

Mr Harrington and his family were tragicrsquo

A quarry operator that failed to keep fixed guards in place

on moving machinery has been fined pound44000 after a new

employee sustained serious arm injuries

The Tudor Griffiths employee was injured on his first day

working at the quarry in Ellesmere in Shropshire when his arm

got caught and dragged into the nip point between the

conveyor belt and the rotating tail drum

The worker required multiple skin graft operations on his arm

and has been left with permanent scarring

A Health and Safety Executive (HSE) investigation found

the Ellesmere-based company had failed to ensure that fixed

guards were effective to prevent workers accessing the

dangerous parts of the machinery

The risk had been identified several months before the incident

on 9 December 2016 but the company had taken no action

to prevent access to what is known to be a danger area

Tudor Griffiths pleaded guilty to breaching s 2(1) of the Health

and Safety at Work Act at Telford Magistratesrsquo Court and

must also pay pound2866 costs

A Health and Safety Executive (HSE) investigation found the

company had not planned or supervised the work and had

failed to ensure it was being carried out safely

It served an enforcement notice stopping the work activity until

there were guardrails or barriers to prevent workers falling

Formation Construction pleaded guilty to breaching s 2(1) of the

Health and Safety at Work etc Act 1974 and was fined pound300000

plus pound17528 costs at Westminster Magistratesrsquo Court

Accounts filed for the year to 31 August 2017 showed a

turnover of pound209m thus classed as a lsquomediumrsquo organisation
