Draft Hornsby Local Environmental Plan (HLEP)
What is a Local Environmental Plan?
A Local Environmental Plan (LEP) is a legal document prepared by councils to guide planning decisions in their Local Government Area and establish the requirements for the use and development of land. Through zoning and development controls, LEPs allow councils to supervise the ways in which land is used and developed.
Why is the draft HLEP on exhibition?
State legislation now requires all councils to prepare new LEPs based on a new State Government template. The draft HLEP, now on exhibition, is a translation of Council’s existing Plan, the Hornsby Shire Local Environmental Plan 1994 into the new template. Using the new template, which promotes the same planning language and mapping in all council areas, the draft HLEP is easier to read and understand.
How does the draft HLEP affect me?
The draft HLEP zones every property in the Shire. For the majority of properties, zoning will be very similar to the current zoning and the land uses that can be carried out on that property will not change. For other properties, the new zoning will change how the land can be used. Council staff are available to assist property owners understand the proposed changes and how they may impact them.
What are some of the key changes?
�� The Shire’s waterways have been zoned to provide certainty to the community as to what can be developed.
�� Floor Space Ratio (FSR) controls have been removed for residential areas and replaced with building height controls as part of a suite of built form controls to guide the scale of development.
�� Consistent with the State Government’s new zoning approach, schools, churches, water reservoirs and other major infrastructure sites, which have traditionally been zoned “Special Uses”, have been zoned the same as the adjacent land.
�� A number of areas along Pennant Hills Road and the Pacific Highway have had a new “Enterprise Corridor” zone applied which permits new types of development and strengthens employment opportunities.
Draft Hornsby Development Control Plan (HDCP)
What is a Development Control Plan?
A Development Control Plan (DCP) is a non-legal document which supports the LEP with more detailed planning and design guidelines.
DCPs are important in the planning system because they provide additional controls to address development issues and provide the flexibility to promote better development outcomes.
Why has it been prepared?
The draft HDCP has been prepared because State legislation requires that only one DCP can apply to a parcel of land. Accordingly, Council has amalgamated its 32 existing DCPs into one comprehensive DCP. This streamlined approach will assist with informing and managing planning decisions and will complement the draft HLEP.
What are the improvements?
This new document is consistent with the draft HLEP. It reflects recent planning studies and legislation, consolidates controls and also provides links to other policy and legislation.
What has been added?
Some new controls have been added to support new provisions of the draft HLEP. Examples include: tree and vegetation preservation controls; storey height controls; built form controls to replace FSR provisions in residential zones; and controls for new permissible uses in rural zones such as secondary dwellings.
