For safety precautions, we are asking all teams to pay their fees electronically (i.e. by E-transfer);

v. Teams can always add to their roster, as needed, until the week before playoffs. g. A Statutory Declaration needs to be filled out by every registered player INDIVIDUAL on

each team and must be provided to YKSA Executive BEFORE JUNE 20, 2020. PLAYERS WHO HAVE NOT COMPLETED THE DECLARATION ARE NOT ALLOWED AT ANY YKSA SANCTIONED GAME OR EVENT.

h. League Start Date is anticipated to be June 21, 2020. i. Will report on YKSA website and Facebook when fields are playable for practices. j. 2020 Tournaments: NONE SCHEDULED DUE TO COVID RESTRICTIONS (Territorials TBD). k. League play finishes end of August with playoffs carrying on until the second week in

September. l. Year End Wrap Up: September 12 or TBD. m. Umpire Certification: To receive reimbursement for taking the test, league members

must complete the SPN umpire certification for the 2020 year before: July 31, 2020. Once certified, email a copy of the certificate and receipt of payment to [email protected] and you will be reimbursed. If certification is completed after this date, no reimbursement will be given. Any certificates shall be submitted prior to umpiring any paid games for their certification to be recognized.

n. Washrooms at Fritz Theil Ball Park: i. Due to current COVID restrictions, the washrooms will be closed;

ii. Repairs are also required before reopening of the washrooms once COVID restrictions have been lifted.

o. Porta Potty at Parker Park. There will not be a porta potty put at Parker Park for the 2020 season.

p. All teams will be supplied with an initial 12 balls. These are your game balls to be used when you’re out in the field and brought out of play when you go up to bat (i.e. other team will use their game balls). Defending team must retrieve balls.

q. Possibility of combined divisions to be discussed after looking at number of teams that register in each division.

r. Captains to ensure ALL players are signed up on the YKSA website so MVP’s can be recorded properly and tallied for final recognitions at end of year wrap-up.

6. House Rules and SPN Rule Changes

a. Review of YKSA COVID Related League changes. i. All teams will be provided a case of their own balls to be labelled and use for the

season.

ii. All teams will be provided a bottle of hand sanitizer at the beginning of season. iii. Each player prior to the beginning of the season will be required to sign a

declaration confirming that they have not travelled outside of the NWT in the last 14 days, nor are they self-isolating, or showing any COVID-19 symptoms (fever, short of breath, sore throat, runny nose, cough).

iv. As described in the Emerging Wisely document, for Phase 1, each team will only be allowed 12 players at the field at one time. They will have the option to have substitute players remain in their vehicle in the parking lot, or arrive late to replace a departing player. Upon implementation of Phase 2, these limits will be reviewed.

v. Require all players to maintain the 6-feet rule while not in play. vi. Umpires, batters, and back-catcher will maintain the 6-foot distancing.

vii. All teams will be required to sanitize the softballs with disinfectant after every inning.

viii. Mandatory disinfectant wipe downs of shared bats after every at-bat. ix. Staggering our start times for each field, with 20 minute “breaks" between games,

allowing time for teams to depart / arrive ensuring the maximum of 25 people per field.

b. Review of Attachment 1 - SPN COVID-19 Game Related Suggestions c. Review of House Rules:

i. Default scores are 99-0 (no notification or after 3:00 pm); ii. A forfeit loss is 77-0 (notification was given prior to 3:00 pm);

1. The only games that will be rescheduled are those that the league cancelled due to rain, playing conditions, or any other reason they deem to be unfit playing conditions.

2. If two teams are in agreement, they can reschedule a game to a Saturday or Sunday time slot, this will not be organized by the league. The date and time slots to make these games up will be identified by Exec/Scheduler and posted on our public sites.

3. If two teams decide to reschedule a game, it must be done within 7 days of the cancellation.

iii. Max of 5 runs per inning to help move the game along. iv. MANDATORY *Game times of: 6:00 – 7:40 PM and 8:00 – 9:40 PM*. v. League is a 6 and 4 format

1. Batting order will be M-W-M-W… vi. Playoff Format – Double Knockout – Qualified umps will be paid $40/game.

d. All team Rosters on SPN AND YKSA website must match and will be considered final the week before playoffs.

e. During regular season play, players may play 1 division up or 1 division down from the division they are registered in.

f. During playoffs games, a team may pick up 3 players for the duration of playoffs (minimum 7 own team) from the same division (after their team has been eliminated). The players must be registered on the YKSA and SPN websites to play on that team. A player can only be picked up by one additional team. THESE PLAYERS MUST BE DISCLOSED PRIOR TO START OF GAME PLAY TO THE OPPOSING TEAM. i. Teams have until the start of the 4th inning to challenge the roster. All finalized

Yellowknife Slopitch Association Treasurer’s Report

For the Year ended December 31, 2019 As members of the Yellowknife Slopitch Association (YKSA), it is important for everyone to have an understanding of the financial operations. A set of the financial statements, including reconciliation of values shown has been distributed for your review. Our overall net income for the current year was $7,062.

As of December 31, 2019, we have $55,300.94 in our bank account, with a balance owing on outstanding accounts of $2,100 and a balance owing on receivable accounts of $1,172.32.

Overall, our operating revenues increased from the prior year (only league fees saw a decreased). Highlights include:

• League Fees: Saw a slight decrease in teams compared to 2018 (from 39 to 37 teams).

• Collection of default fees ($2,460): Increased slightly from 2018 as a number of teams topped up their default fees.

In relation to the expenses, event costs increased as the umpires from Alberta were brought up for the 2019 Territorials. The accounts that saw the biggest changes include:

• Return of default fees: Resulted from a decrease in the number of returning teams.

• NWT Affiliation fees with NWT Softball: With an decrease in membership, there was an associated decrease in fees owed (amount is based on number of registered teams).

• Parker Field Fees: Invoice was received late and paid after the fiscal ended. This was brought up to the accounts and has been captured in the account.

• Garbage: Increased substantially with purchasing the porta potty and general maintenance of the washrooms (includes pump outs and supplies).

• Accounting Fees: A new category created to capture the professional fees paid (i.e. to get financials completed). This amount is now separated from the Annual General Meeting costs.

Fixed Assets There is currently only one item recorded as a fixed asset and that is the quad. 2020 Budget Changes The budget has been changed to account for the current situation, that is COVID 19 (minimal teams and field availability) as well as for field upgrades against the budgets of 2019.

The primary changes are:

• A decrease in the budget line item for the League Fees as the number of teams will be limited with the loss of 2 fields.

• A decrease in the budget line item for the Affiliation fees with a decrease in the number of teams.

• An increased budget line item for Equipment Costs to account for the field upgrades planned for Fritz infields.

• A decreased budget line item for Parker Field fees as we will not be playing there this year.

• A decreased budget line item for Garbage as washrooms will be closed at Fritz field and there will not be a Porta Potty at Parker Park.

• An increased budget line item for Postage and freight to account for the shipment of the material to be used in the upgrades of Fritz infields.

• A decreased budget line item for Events as no tournaments are currently scheduled.

• A decreased budget line item for the Year End as it is currently ‘TBD’.

With these changes, the 2020 budget will be operating at a deficit. In past years, the budget has run at a surplus. With this surplus, the executive is upgrading the Fritz infields. In the future, any additional surplus will be used for further upgrades, and the executive will continue to assist teams from the Yellowknife region to participate in National Tournaments.

1. This is a binding legal agreement. Clarify any questions or concerns before signing. As a Participant in activities, programs and events of Yellowknife Slo-Pitch Association (YKSA), Slo-Pitch National Softball Inc. (SPN), Softball Canada (SC) and its affiliated Provincial/Territorial Softball Organizations, teams, clubs and leagues, and the sport of softball (collectively the “Activities”), the undersigned acknowledges and agrees to the following terms outlined in this agreement:

Disclaimer 2. Yellowknife Slo-Pitch Association (YKSA), Slo-Pitch National Softball Inc. (SPN), Softball Canada (SC), its affiliated Provincial/Territorial

Softball Organizations, teams, clubs and leagues, and their respective directors, officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facility in which the Activities take place, and representatives (the “Organization”) are not responsible for any injury, property damage, expense, loss of income, damage or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

I have read and agree to be bound by paragraphs 1 and 2. Description of Risks 3. I understand and acknowledge that

a) The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life;

b) The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming;

c) The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and

d) The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that the Participant will not become infected with COVID-19. Further, attending the Activities could increase your risk of contracting COVID-19.

4. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers

and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to, injuries from: a) Contracting COVID-19 or any other contagious disease; b) The sport of softball; c) Executing strenuous and demanding physical techniques; d) Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements; e) Exerting and stretching various muscle groups; f) Dry land training including weights, running, bands and circuit; g) Falls to the ground due to uneven or irregular terrain or surfaces; h) Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment; i) Grass, turf and other surfaces including bacterial infections and rashes; j) Collisions with fences, poles, stands and softball equipment; k) Spinal cord injuries which may render me permanently paralyzed; and l) Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of my body or to my general health and well-

being; m) Abrasions, sprains, strains, fractures, or dislocations; n) Privacy breaches, hacking, technology malfunction or damage; o) Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma; p) Physical contact with other participants, spectators, equipment, and hazards; q) Not wearing appropriate safety or protective equipment, such a helmet; r) Failure to act safely or within my own ability or within designated areas; s) Negligence of other persons, including other spectators, participants, or employees; t) Weather conditions; u) Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities; and v) Negligence on the part of the Organization, including failure on the part of the Organization to take reasonable steps to safeguard or

protect me from the risks, dangers and hazards associated with my participation in the Activities. Terms 5. In consideration of the Organization allowing me to participate in the Activities, I agree:

a) That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental or physical condition;

b) That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select; c) To comply with the rules and regulations for participation in the Activities;

d) To comply with the rules of the facility or equipment; e) That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring such to the attention of a The

Organization representative immediately; f) The risks associated with the Activities are increased when I am impaired, and I agree not to participate if impaired in any way; g) That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and

accept the suitability and conditions of the Activity; h) That I am responsible for my choice of protective equipment and the secure fitting of that equipment; and i) That COVID-19 is contagious in nature and I may be exposed to or infected by COVID-19 and such exposure may result in personal

injury, illness, permanent disability or death and voluntarily agree to assume all the foregoing risks.

I have read and agree to be bound by paragraphs 3 -5. Release of Liability and Disclaimer 6. In consideration of the Organization allowing me to participate, I agree:

a) That the sole responsibility for my safety remains with me; b) To ASSUME all risks arising out of, associated with or related to my participation; c) That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or

in individual conversations, to agree to be involved in the Activities; d) To WAIVE any and all claims that I may have now or in the future against the Organization; e) To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related

loss, including loss of income, resulting from my participation in the activities, events and programs of the Organization; f) To FOREVER RELEASE AND INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages

(including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;

g) To FOREVER RELEASE AND INDEMNIFY the Organization relating to becoming exposed to or infected by COVID-19 which may result from the actions, omission or negligence of myself and others, including but not limited to the Organization;

h) That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;

i) That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and

j) This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction I agree that in the event that I file a lawsuit against the Organization, I agree to do so solely in the province/territory of Northwest Territories (NT), Canada and further agree that the substantive law of NT will apply without regard to conflict of law rules. I further agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

I have read and agree to be bound by paragraphs 5-7 Acknowledgement 7. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to

be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.

6) If I travel, or if anyone in my household travels, outside the Province/Territory of Northwest

7) This document will remain in effect until the Organization, per the direction of the provincial/territorial government and provincial/territorial health officials, determines that the acknowledgements in this declaration are no longer required.
