    End Of Term 1 Fiqh Test

    1. Explain the following:a. Dalil Qatidecisive text and not open to the possibility of interpretation.b. Dalil Dhanni speculative text.c. Sunna al-Huda also known as Sunna Mu-akkada, an emphasised Sunnah is

    2. For the majority of the scholars Fardh and Wajib are same. The Hanafis however,have drawn a distinction. A Fardh is derived from Dalil Qati and if an act is

    derived from Dalil Dhanni then it is deemed Wajib. Denying a Wajib is deemed as

    corruption (fisq), though not Kufr (disbelief).

    6. Small quantity of water deemed filthy when it is STILL water into which animpurity has fallen. The water is deemed impure even if no trace of the filth

    appears therein. A small quantity of water is considered as LESS than ten by ten

    arms length.

    7. Remnant water of a human is pure in itself and is purifying for others, providedthere is no filth in his mouth at the time such as alcohol.

    8. Linguistic: Istinja is to wipe or wash the place where excrement is discharged.According to the Jurists: The removal of filth with water or itslike.

    9. Imam Shafi says it is Fardh and others say its Sunnah Muakhada.10.The Sunnah is to purify the area, and to use a prescribed number of stones is

    recommended and the recommended number according to the Hanafis is three,even if the area is cleaned in less than that. Imam Shafi said three is necessary.

    11.Explain the following:a. Istitabah and Istinja: to gain cleanliness from water or other substancesb. Istijmaar gain cleanliness from earthc. Istibra to wait after urinating.

    If none of the above occurs then one attains maturity at the age of:

    22.The Niyyah of Wudhu is Sunnah according to the Hanafis

    PROOF: The Prophet (saw) taught a Sahaba how to perform Wudhu and did not

    mention Niyyah.

    Though Imam Malik and Imam Shafi said that it is Compulsory-

    PROOF: Hadeeth of Niyyah.

    23.HanifisTo use three separate handfuls for rinsing the mouth and then threeseparate handfuls for the nostrils.

    ShafiTo rinse the mouth and nostrils with one handful. So in total three

    handfuls.

    24.The chronological order of ablution is Sunnah according to Imam Abu Hanifa-Imam Shafi and Imam Malik held it as obligatory.

    25.To wipe the ears even if it is with the water used for the head is Sunnahaccording to Imam Abu Hanifa.

    According to Imam Shafi it is Sunnah to use separate water to the ears.
