Dear Colleagues,
I look forward to seeing you, virtually, at the Bar Association's 2021 Annual Meetingon Wednesday and Thursday, June 23rd and 24th. While this year’s hard-workingAnnual Meeting Planning Committee, ably chaired by Nicole J. Benjamin, had initiallyhoped to produce an in-person meeting this year, it was forced to change gears late lastyear due to the uncertainty of the pandemic. The Planning Committee turned thechallenge into a strength, and we are now able to present you with an incredibleprogram featuring a diverse schedule of workshops that has something for allpractitioners. While everyone in attendance will be experiencing our Annual Meeting inthis new virtual format on the interactive Eventmobi platform, we have focused on notstraying too far from what attendees appreciated and looked forward to during our pastin-person conferences.
Our program includes some of the usual favorites, including the always popular stateand federal court updates. I am eagerly looking forward to the presentation by ourThursday morning plenary speakers, the Honorable O. Rogeriee Thompson of theUnited States Court of Appeals for the First Circuit and the Honorable John J.McConnell, Jr., Chief Judge of the United States District Court for the District of RhodeIsland. As always, we have a variety of ethics-related topics, and attendees are able toearn as many as 9.5 credits over the course of the two-day program. We understand thatthe MCLE requirement has been suspended for the 2021 reporting year, but pleaseremember that credits can be carried over to 2022. I urge you to take advantage of theincredible and exclusive pricing we are offering for this event; you won’t find valuelike this anywhere, and we are so grateful for the hard work and preparation ourpresenters have contributed to create this fantastic program.
Traditionally, we have an Annual Awards Reception on the first day of our Meetingfollowed by our Annual Luncheon on day two. This year, we have decided that we willcombine the events into one in-person event, our Annual Meeting Luncheon, on Friday,June 25th at the Crowne Plaza in Warwick in their tented Pavilion. We will hear a briefupdate on Bar Foundation activities, honor our awards winners from 2020 and 2021,hear RI Supreme Court Chief Justice Paul A. Suttell’s traditional perspective on thestate of the Judiciary, and swear-in our incoming president, Lynda L. Laing. We hopeyou will consider joining us as we will ensure precautions are taken to ensure the safetyof our guests.

At the beginning of 2020, the force majeure clause was thought of, if at all, as aboilerplate checklist item and, occasionally, the subject of esoteric contract lawexam questions. Now, however, the legal concept is at the top of mind for manyas a result of the unprecedented response to the COVID-19 pandemic. Thisseminar surveys Rhode Island law, such as it is, concerning the basics of variouscontractual force majeure clauses, how they are interpreted by courts, andwhether and to what extent the related defenses of impracticability, impossibility,and frustration of purpose might excuse one or both parties’ obligations due to theongoing pandemic.

Circuit Judge O. Rogeriee Thompson currently serves as a Circuit Judge for theFirst Circuit Court of Appeals. Appointed by President Barack Obama andunanimously confirmed by the U.S. Senate in 2010, Judge Thompson is the firstAfrican-American and the second woman to serve on the First Circuit Court ofAppeals. Previously, she was an Associate Justice for the Rhode Island SuperiorCourt, a position she held from 1997 to April, 2010. Before that, she was anAssociate Judge with the Rhode Island District Court for nine years. During her 44-year law career, Judge Thompson has been a senior partner with Thompson &Thompson, assistant city solicitor for the City of Providence, an associate with thelaw firm of McKinnon and Fortunato, and a senior staff attorney for Rhode IslandLegal Services, Inc. An author and consultant, she has served on numerouscommittees and boards. Some of her current activities include the U.S. SupremeCourt Committee on Information Technology, the First Circuit Judicial Council andFirst Circuit IT Committee, Brown University Emeriti Council, Rhode Island SaveThe Bay Leadership Council, and College Unbound Board of Trustees. A recipient ofnumerous awards and honors, Judge Thompson earned her A.B. degree at BrownUniversity in 1973 and her J.D. from Boston University School of Law in 1976. Sheholds honorary degrees from the University of Rhode Island, Bryant University,Roger Williams University School of Law, and Johnson and Wales University. JudgeThompson was married to the late Rhode Island District Court Judge William C.Clifton, and she is the proud mother of Reza, William, Jr., and Sarah Clifton.
Chief Judge John J. McConnell, Jr. is the Chief Judge of the United States DistrictCourt for the District of Rhode Island. President Barack Obama nominated him tothe bench and the U.S. Senate confirmed the nomination in May 2011. He is nowone of three U.S. District Court Judges in Rhode Island. In addition to hisadministrative duties as Chief Judge, he hears both civil and criminal cases. U.S.Supreme Court Chief Justice John G. Roberts, Jr. appointed him to serve as a memberof the Committee on Codes of Conduct of the Judicial Conference of the UnitedStates. He is also a past member of the First Circuit Judicial Council and the FirstCircuit Jury Plan Committee. Before becoming a judge, Chief Judge McConnell wasa trial attorney for 25 years. He clerked for Associate Justice of the R.I. SupremeCourt Donald F. Shea. Chief Judge McConnell is chairperson of the Board ofCrossroads RI, the state’s largest provider of services to those experiencinghomelessness, and is on the Board of the Nonviolence Institute. Chief JudgeMcConnell, born in Providence, R.I., received his A.B. from Brown University in1980 with a concentration in Urban Studies and his J.D. from Case Western ReserveUniversity School of Law in 1983, where he received the Dr. Martin Luther King, Jr.Award. He is married to Sara Shea McConnell, and they have three children.

The U.S. Supreme Court has recently examined the limits of personal jurisdictionin a pair of consolidated cases involving Ford Motor Company. The Due ProcessClause permits a court to exercise specific personal jurisdiction over an out-of-state defendant when the plaintiff’s claims arise out of or relate to the defendant’sforum activities. This workshop discusses what Rhode Island practitioners need toknow about personal jurisdiction, and the local implications of the Court’sdecision in the Ford cases.

Most people believe (correctly) that both the United States and Rhode IslandSupreme Courts have ruled that it is unconstitutional to imprison a person simplybecause they are poor. But the devil is in the details. Lower courts not only inRhode Island but across the United States have found creative ways to do justthat. The presenters discuss and review: the “lay of the land” under both state andfederal law; legislation passed by the General Assembly in 2008 that reformed theways in which court costs, fees, fines, and restitution were supposed to behandled; ways to enforce these reforms are handled properly; and whether it iswise to use the state’s judicial system to raise money for the state.

Registration is available for a full day only.Attendees will have the option to attend andreceive credit for one seminar during eachsession. Tickets are not available forindividual seminars. The one-day fee is $75($50 for members admitted after 2016 andAssociate Members). The two-day rate is$150 ($100 for lawyers admitted after 2016and Associate Members.)
