I represent 3 Boys Farms, LLC ('3 Boys" or "Applicant"), d/b/a One Plant. 3 Boys is one of the vertically integratedMedical Marijuana Treatment Centers (.MMTC) licensed by the State of Florida. 3 Boys has entered into a leaseagreement for the property located at '1830 Cordova Road, Fort Lauderdale, FL 33316 for a 2,550 square foot bay inan existing one-story, three-bay building (the "Property"), Folio No. 5042-14-53-0010, in the Harbor Shops shoppingcenter. One Plant will operate as a licensed MMTC pursuant to Florida Statute Section 381.986. Please see a detailedsummary below.

l. Background and Project Description

The Harbor Shops is a 221 ,768 square foot shopping center on Cordova Road south of SE 1 7th Street Causewayon a roughly 1 9. 1 1 acres (832,595 square feet) parcel. The Property is located within the Port Everglades DevelopmentDistrict ('PEDD) zoning district with an underlying land use of Transpo(ation. The PEDD zoning district only permitsretail sales and service as an accessory use that is incidental or subordinate to a permitted use within the PEDD.However, on June 27,2OO1, the City's Board of Adjustment approved a use variance tc aiii.u.' retaii sales and grocerystore establishment as a principal use on the Property. ("SOL Global"), (CSE: SOL) (OTCQB:SOLCF) (Frankfurt: 9SB). 3 Boys proposes operating a One Plant branded medical cannabis dispensing facility to; -:',':-'l q';a!i{!ed patients and caregivers with convenient access to premium, organically cultivated medical cannabisand an exceptional retail experience complete with a robust multimedia-driven educational platform for easypurchasing. e*e Plant is a chain of nationally recognized cannabis dispensaries with additional planned locationsthroughout Califomia, Florida, and Michigan. The patient-centric dispensary will offer an assortment of consumer-favorite brands.

Apart from identification signage on the exterior of the building, 3 Boys proposes only interior changes to the 2,550square foot bay formerly occupied by a restaurant to comply with Florida Statute Section 38'1 .986 The intended simpletenant improvement plan will be for interior walls that go to the ceiling. Plumbing and electrical are in place. The interiorwill be a modern retail space with elegant finishes and high{ech display kiosks and space to accommodate qualifiedpatients and caregivers.

ll. Security Requirements and Hours of Operation

Applicant will operale the medical marijuana dispensary as a licensed MMTC pursuant to Florida StatuteSection 381.986. Florida Statute regulations require onsite security both in design and continuing operations, ensuringthat the MMTC dispensary use will not be hazardous to the community. One Plant will operate from g:00am to 7:00pmfrom Monday to Friday, 10:00am to 6:00pm on Saturday, and 11:00am to 5:00pm on Sunday. One Plant is required toensure the safety and security of the premises with fully operational lighting, security alarm system, and videosurveillance system to ensure the safety of palrons and to prolect the premises from theft. The MMTC's outdoorpremises will include 360-degree security surveillance and maintain suffrcient lighting from dusk until dawn. The indoorpremises where dispensing occurs will be monitored with overhead anri directional c€]meras. The waiti*g area andprivate consultation room will also be video surveilled and have sufftcient space and seating to eccommodate qualifiedpatients and caregivers. Medical marijuana and authorized delivery devlces will be stored in a securecl, lr:L:d ',.aultand will not be displayed nor dispensed in the waiting area. The video surueillance recordings will be kept for sixty (60)days. An unarmed security guard will be on site during all business hours.

lll. Unified Land Development Regulations Analysis

The proposed development is subject to a Site Plan Level lll and conditional use review. ln terms of thedevelopment review, the Property and the proposed development are sulrject to the following sections of the ULDR:

An analysis addressing each of the pertinent land use and zoning regulations is below.

A. Port Everglades Development District (Sec. 47-151

The Property has an underlying land use designation of Transportation and is zoned Port Everglades DevelopmentDistrict ('PEDD). Pursuant to the Use Variance attached hereto, any permitted and conditional uses allowed in theBoulevard Business ("8-1") and General Business ('B-2") Districts are permitted on the PEDD zoned Harbor Shopsshopping center.

a. Proposed Use {Sec. 47{..111

Medical cannabis dispensing fucility uses operated by a state-liceruied dispensing organization are permitted inthe B-1, B-2, and B-3 district with conditional use approval. Pursuant to ther Use Variance attached hereto and the City'sinterpretation, any permitted and conditional uses allowed in the B-1 and General Business B-2 Districts are permittedon the PEDD zoned Harbor Shops shopping center. Thus, with a demonstration that the Project complies with themedical cannabis dispensing facility criteria, conditional use criteria, adequacy and neighborhood compatibilityrequirements, as discussed below, the proposed use is permitted on the premises.

b. Dimensional Requirements (Sec.47-15.21)

The existing approved Harbor $hops shopping center site plan will not change with the proposed use. Applicant isproposing interior building improvements only. The existing structure connplies with the dimensional requirements forthe existing approved Harbor Shops shopping center site plan. Applicant is not proposing any redevelopment orexpansion of the existing building area the MMTC will occupy.

As discussed above, the proposed project satisfies the zoning district requirements of the ltLDR.

B. Medical Cannabis Dispensing Facility (Sec.4Z-18.46)

Sec" 47-18.46 defines a medical cannabis dispensing facility as a building or structure where medical cannabisand medical cannabis delivery devices are dispensed. Development of medical cannabis dispensing facilities operatedby a state-licensed dispensing organization are permitted in the B-1, B-2, and B-3 zoning districts subject to the

separation requirements and approval process set forth in ULDR, Sec.47-18.46. Applicant hereby provides thefollowing information for the proposed medical cannabis dispensing facility:

1. Medical cannabis dispensing facilities operated by a stateJicensed dispensing organization shall bepermitted in the following zoning districts subject to separation requirements and approval processset forth in this section:

The proposed medical cannabis dispensing facility will be operated by 3 Boys, a state-licensed dispensingorganization. Pursuant to the Use Variance attached hereto and City's interpretation, any permitted and conditionaluses allowed in the B-1 and B-2 Districts are permitted on the PEDD zoned Harbor Shops shopping center. Therefore,the proposed medical cannabis dispensing facility is a permitted conditional use on the Prope(y.

2. Distance separation requirements:

The proposed facility is not within five thousand two hundred eighty feet (5,280') of another dispensing facility.,"..l"liiJ;,,aily, the proposed medical cannabis dispensing facility is outside of the one thousand five hundred feet (1 ,500')restricted bu{fer areas from a school or child day care facility, park, and library in the City of Fort Lauderdale. Based onthe City of Fort Lauderdale's Medical Cannabis Dispensing Siting Map, which delineates the proposed one thousandfive hundred feet {1,500') restricled area buffers from a recognized school or child day care facility, park, and library,the Property is within an eligible location. Applicant has submitted a radial distance survey illustrating compliance withall distancc requirements.

3. No more than one (1) medical cannabis dispensing facility shall be permitted for every forty thousand(40,000) residents as determined by population figures published by the United States Census Bureauand no more than one (1) medical cannabis dispensing facility shall be permitted to be located withineach city commission district:

There are anrently no medical cannabis dispensing facilities located in the City of Fort Lauderdale.

4. The hours of operation shall be allowed between 7:00 a.m. and 9:00 p.m. daily pursuant to state law:

The hours of operation will comply with state law. One Plant will operate from g:00am to 7:00pm from Monday toFriday, 10:00am to 6:00pm on Saturday, and 11:00am to 5:00pm on Sunday.

5. Parking shall be parked at 1/150 square feet of gross floor area:

Applicant will provide a Parking Study once completed demonstrating compliance with the parking requirement.

6. Drive-through facilities associate with the use are prohibited:

Applicant is not proposing a drive-through facility as part of the medical cannabis dispensary operation.

7. Marijuana plants, products, and paraphernalia (and depictions thereof) shall not be visible from apublic sidewalk or public right-of-way:

Marijuana plants, products, and paraphernalia (and depictions thereof) will not be visible from a public sidewalk orpublic right-of-way.

8. Odor and air quality. The applicant shall ensure that therc are adequate air filtration systems in placeto ensure that dust, smoke, or odors will not go beyond the confines of the occupied space:

9. Nothing in fiis section shall prohibit a state.approved dispensing organization, or another entitylicensed under state law to dispense cannabis, from making deliveriee of cannabis or derivatiyeproduets to l*te tesidence or business of an authorized individual, or to a health care facility, aspermitted by other relevant ordinances and state law:

Applicant acknowledges that nothing in Sec,47-18.46 prohibits a state-approved dispensing organization, oranother entity licensed under state law to dispense cannabis, from making deliveries of cannabis or derivative products

to the residence or business of an authorized individual, or to a health care facility, as permitted by other relevantordinances and state law.

10. All other uses related to eannabis not listed as permitted in this section, including but not limited tocannabis cultivation uses, shall be considered prohibited within the city:

Applicant acknowledges that all other uses related to cannabis not listed as permitted in Sec. 47-18.46, includingbut not limited to cannabis cultivation uses, are considered prohibited within the city.

As discussed above, the proposed project saffsfi'es the Medical Cannabis Dispensing Facilities requirementsof the ULDR.

C. Gonditional Use (Sec. 47-24.31

Pursuant to the City's interpretation of the Use Variance attached hereto, any permitted and conditional usesallowed in the B-1 and General Business B-2 Districls are pennitted on the PEDD zoned Harbor Shops shopping center.Medical cannabis dispensing facilities are permifted as a conditional use in the B-1, B-2, and B-3 Districts. Therefore,the development is subject to ULDR, Sec.47-24.3. Applicant hereby provides the following information demonstratingcompliance with the Conditional Use criteria.

a. A description of the inherent nature of the proposed use.

As a licensed MMTC, One Plant will provide medical cannabis medical marijuana products to patients sufferingfrom at least one of the following conditions:

. Amyotrophic lateral sclerosis (ALS)

. Cancer

. Crohn's disease

. Chronic Pain

. Epilepsy

. HIV/AIDS, tt/ultiple sclerosis. Parkinson's disease. Posltraumatic stress disorder (PTSD). A terminal condition diagnosed by a physician other than the qualified physician lssuing the physician

certification. Chronic nonmalignant pain.

Applicant seeks to maintain a safe and secure environment for dispensing of medical cannabis by adhering to allstate and local regulations and best practices related to medical marijuana dispensary facilities.

b. The methods and materials utilized in the operation of the use.

Florida Statute regulalions require onsite security both in design and continuing operations, ensuring that themedical cannabis dispensary use will not be hazardous to the community. The medical cannabis dispensing facility willcontain a state-of-the-art operational security system to ensure the safety of patients, caregivers, employees, and thecommunity. Sufficient lighting will be maintained from dusk until dawn. The medical cannabis dispensing facility willensure that local law enforcement is notified as quickly as possible in the event of a theft or emergency.

c. The scope of the proposed operation.

The operation will be limited to sales within the confines of the Property. The facility will service existing and futurepatients with ailments treated with medical cannabis. Applicant inlends to limit the scope of the operation to the fullestextent possible in order to minimize any effect on the surrounding uses. Applicant will adopt all measures to ensurethat the sales are conducted in a safe environment by installing state-of-the-art equipment.

d. A description of the economic and environmental impact on the surrounding area by permitting theconditional use.

The proposed medical cannabis dispensary facility will positively impact the surrounding area. One Plant has thepotential to benefit the local economy through tax revenue, job creation, increased property values, and other directand indirect impacts. Other municipalities that have permitted medical marijuana dispensing businesses have

experienced significant local economic activity. Additionally, the proposed change in use will have minimal environmentimpact.

e. Impact on abutting properties ae evaluated underthe Neighborhood Compatibility Requirements, Sec.47-25.3.

The proposed medical cannabis dispensing facility must comply with the regulations, inspections, and operatingrequirements for medical marijuana treatment centers established by Florida Statutes and the Florida Department ofHealth. Service, retail and other commercial uses similar to the proposed development have existed in harmony withthe surrounding neighborhood for many years, and the proposed use will continue this pattern and not introduce anyunforeseen impacts. Please refer to the Neighborhood Compatibility section for a thorough analysis.

Access, traffic generation and road capacities. Consideration will be given to the design capacity ofthe adjacent roadways, the particular traffic generation characteristics of the proposed conditionaluse, including the type of vehicular traffic associated with such uses, and traffic generationcharacteristics of other uses permitted in particular zoning districts.

There will be no changes to the existing traffic patterns. All vehicular traffic patterns must enter and exist throughthe ingress/egress along Cordova Road and Southeast 20th Street. A Traffic Statement will be provided uponcompletion.

S. The location of the use or structure is not in conflict with the city's comprehensive plan

The medical cannabis dispensing use is not specifically addressed in the Comprehensive Plan. The Future LandUse Element section of the Comprehensive Plan addresses permitted uses in the Transportation designation andpermits uses which may be permitted by the City of Fort Lauderdale City Commission and the PEDD. Pursuant to theCity's interpretation of the Use Variance attached hereto, any permitted and conditional uses allowed in the B-1 andGeneralBusiness B-2 Districts are permitted on the PEDD zoned Harbor Shops shopping center. The addition of themedical cannabis dispensary use to the City's business zoning districts, while controlling the use through the conditionaluse criteria, supports the following Goals, Objectives, and Policies:

Goal 1: Promote the distribution of land uses that will preserve and enhance the character of Fort Lauderdaleby establishing land development guides designed to promote environmental protection, meet social andeconomic needs, provide for adequate services and facilities, conserve natural resources, and ensurecompatibility of land uses.

Off-site and on-site conditions exist which reduce the impact of permitting the medical cannabis dispensing facility.The Property is located in the Harbor Shops shopping center south of Southeast 17th Street Causeway. The proposeduse is a small retail use, which is consistent with the existing commercial character of the Harbor Shops shoppingcenter and Southeast 17th Street Causeway. The Property was previously used as a restaurant. The proposed usemay have less impact on the surrounding area than the prior use of the Property. Retail, service, and other commercialuses similar to the proposed use have existed in harmony with the surrounding neighborhood for many years, and theproposed use will continue this pattern.

i. On-site improvements have been incorporated into the site plan which minimize any adverce impactsas a result of permitting the use or structure

. The Harbor Shops existing approved site plan will remain. The only 'on-site' improvements that are proposed areincorporated into the interior building prqect plans which aim to minimize adverse impacts as a result of the uie. FloridaStatute regulations require onsite security and safety both in design and continuing operations, ensuring that themedical cannabis dispensary facility use will not be hazardous to the community.

j. The location of the use in proximity to a similar use does not impact the character of the zoning districtin which the use is located

egress points of the dispensary. Security cameras are also located within the line-of-sight of the points-of-sale and waiting and receiving areas"

h. Potable Water and Potable Water Facilities

The proposed use does not affect potable water. Applicant anticipates that the existing water mains andtreatment facilities have sufficient capacity and an ability to handle the added demand of this prgect.

i. Sanitary Sewer

The proposed use does not affect sanitary sewer. The existing sewer treatment facilities and systemshave sufficient capacity to provide for the needs of the project.

j. Schools

The proposed use is situated the appropriate distance away from any school or childcare facility.

k. Solid Waste

Applicant's existing trash collection/service area will continue to serve the facility's needs.

l. Storm Water

Public drainage facilities are minimally affected by the proposal.

m. Transportation Facilities

1. The Applicant does not anticipate the project will have a significant impact on transportation facilities.The existing transportation facilities in the area have sufficient capacity for this project.

2. The Applicant expects the project to create a marginally increased impact on the regionaltransportation network. A Traffic Statement will be provided upon request.

3. The proposed project will not measurably affect local streets.

4. A Traffic Statement will be provided upon completion.

5. No dedication of right-of-way is necessary for this project.

6. Existing walkways and pedestrian components will remain.

7. Access to the Property is provided by the existing driveway approaches on Cordova Road andSoutheast 20th Street.

8. The Applicant does not anticipate needing to make any additional roadway improvements.

n. Wastewater

The proposed use does not affect wastewater.

o. Trash Management

Adequate accommodation of garbage and recycling will remain on-site.

p. Historic and Archaeological Resources

q. Hurricane Evacuation

The Property is close in proximity to Federal Highway and will utilize the standard evacuation route forthe area.

G. Neighborhood Compatibility (Sec. 47-25.31

The proposed medical cannabis dispensing facility is primarily surrounded by B-1, B-2, B-3, and PEDD zoningdistricts. The building is located on the northeast portion of the Harbors Shops shopping center and is surrounded byactive commercial and office uses and ample on-site surface parking. The proposed use is a small retail use, which isconsistent with the existing commercial uses in the Harbor Shops plaza which have existed in harmony with thesurrounding neighborhoods for several years.

Applicant will operate the medical marijuana dispensary as a licensed MMTC pursuant to Florida Statute Section381.986. Florida Statute regulations require onsite security both in design and continuing operations, ensuring that theMMTC dispensary use will not be hazardous to the community. Studies show that medical cannabis dispensing facilitiesreduce crlme in their immediate surrounding due to increase surveillance, well-lit properties, on-site security, andtrained staff.

One Plant will operate from 9:00am to 7:00pm from Monday to Friday, 10:00am to 6:00pm on Saturday, and11:00am to 5:00pm on Sunday. One Plant is required to ensure the safety and security of the premises with a fullyoperational security alarm system and video surveillance system. The MMTC's outdoor premises will include 360-degree security surveillance and maintain sufficient lighting from dusk until dawn. The indoor premises wheredispensing occurs will also be monitored. The receiving area and private consultation area will have sufficient spaceand seating to accommodate qualified patients and caregivers. Medical marijuana and authorized delivery devices willbe stored in a secured, locked vault and will not be displayed nor dispensed in the waiting area. The video surveillancerecordings will be kept for sixty (60) days. An unarmed security guard will be on site during all business hours.

The proposed use will not exceed maximum levels of smoke, odor, emissions of a particular matter and noise.Lighting will remain in compliance with City codes preventing glare or spillover from negatively impacting adjacentproperties. Applicant will maintain the same structural appearance and dimensions. The interior will consist of acontemporary and professional design ensuring a positive patient experience. The application does not propose newdevelopment; therefore public facilities and services are already in place for the Property. The change in use willmitigate adverse impacts such as traffic, noise, odors, shadow, scale, visual nuisances, or other similar adverse effectsto adjacent properties.

lV. Conclusion

Applicant respectfully requests a determination that the proposed development meets the standards andrequirements of the ULDR, the criteria for a Site Plan Level lll development, the criteria for medical cannabis dispensingfacilities, and the criteria for a conditional use permit to establish a medical cannabis dispensing facility.

The One Plant tenant will occupy 2,550 square feet within a small 3-tenant building located on the northeast corner of the shopping center. According to City of Fort Lauderdale parking requirements, the subject cannabis dispensing facility requires 17 parking spaces. As indicated in the attached parking study conducted by Traf Tech Engineering, Inc. (report dated March 30, 2012), the Harbor Shops commercial center is underutilized (over 300 unused parking stalls during the peak parking periods). Moreover, the proposed 1830 Cordova Road tenant is located within Zone E of the parking study. Zone E located within the northeast area of the shopping center has over 100 unused parking spaces, as presented in Table 2 of the parking study (222 available parking spaces and only 113 used during the peak day/peak hour for Zone E). In summary, the Harbor Shops commercial center has sufficient on-site parking spaces to accommodate the peak parking demands of the future One Plant tenant, in addition to the peak parking demands of the mixed of uses within the entire shopping center. Dear Jim:

Traf Tech Engineering, Inc. conducted a parking utilization study at the existing HarborShops commercial center located at the south terminus of Cordova Road in the City ofFort Lauderdale, Florida. Attachment A shows the site plan with tenant locations. Theparking utilization study was conducted in order to determine the actual parking needs ofthe commercial uses located within the shopping center. This study documents if there isan existing parking surplus or a parking deficit.

Project Overview

The Harbor Shops consists of three distinct areas. A Publix supermarket is located on thesouth side of the site with commercial uses on both sides of the subject food store. Atwo-story commercial building is located on the west side of the center and five separateoutparcel buildings are found on the northeast and northwest areas of the site. The entireshopping center consists of 209,946 square feet. A total of 1,083 parking spaces areprovided on site for an existing parking ratio of approximately 5.16 parking spaces per1,000 square feet of commercial space.

Comprehensive Parking Demand Study

Parking occupancy counts (number of vehicles parked on site) were conducted at theHarbor Shops on Thursday, Friday, and Saturday, March 15, 16, and 17, 2012. Theparking counts were recorded in one-hour increments between the hours of 10:00 AMand 8:00 PM. During the time of the parking occupancy counts, the shopping center hadapproximately 22,186 square feet (approximately 10.57%) of vacant/un-leasedcommercial space.

For purposes of this parking study, the parking lot of the shopping center was subdividedinto seven (7) areas labeled “A” through “G”. The seven areas are described below andare depicted in Exhibit A.

Parking Area “A” – Northwest area of the shopping centerParking Area “B” – West area of the shopping centerParking Area “C” – Parking area primarily serving PubixParking Area “D” – Northeast area of the shopping centerParking Area “E” – East area of the shopping center

Parking Area “F” – East rear parkingParking Area “G” – West rear parking

Additionally, the two easternmost parking bays of the main Publix parking area(identified as areas C1 and C2) and a small parking section of Parking Area “E”(identified as area E1) were selected for further analysis. A future commercial tenantwith additional square footage is anticipated between Publix and Total Wine andtherefore, the parking usage of the above-mentioned parking areas were furtherevaluated.

Tables 1, 2, and 3 present the results of the parking occupancy counts recorded during thethree-day study period. The results of the parking counts indicate that:

o The maximum number of parking spaces occupied on Thursday, March 15, 2012was 703 out of 1,083 available parking spaces, for a parking surplus ofapproximately 380 parking spaces (35% vacant parking stalls). The peak parkingperiod occurred at 7:00 PM. During the 7:00 PM peak parking hour, parkingareas C1, C2, and E1 had 129 empty parking spaces. The 129 vacant parkingspaces can support approximately 32,000 square feet of commercial space (parkedat 4 parking spaces per 1,000 square feet).

o The maximum number of parking spaces occupied on Friday, March 16, 2012was 674 out of 1,083 available parking spaces, for a parking surplus ofapproximately 409 parking spaces (38% vacant parking stalls). The peak parkingperiod occurred at 1:00 PM. During the 1:00 PM peak parking hour, parkingareas C1, C2, and E1 had 85 empty parking spaces. The 85 vacant parking spacescan support approximately 21,000 square feet of commercial space (parked at 4parking spaces per 1,000 square feet).

o The maximum number of parking spaces occupied on Saturday, March 17, 2012was 569 out of 1,083 available parking spaces, for a parking surplus ofapproximately 514 parking spaces (47% vacant parking stalls). The peak parkingperiod occurred at 2:00 PM. During the 2:00 PM peak parking hour, parkingareas C1, C2, and E1 had 67 empty parking spaces. The 67 vacant parking spacescan support approximately 16,750 square feet of commercial space (parked at 4parking spaces per 1,000 square feet).

Based on the above information, Thursday was the peak parking day for the HarborShops. Moreover, the three small parking bays located between Publix and Total Winecan support approximately 16,750 square feet of additional commercial space.

Adjustments to Account for Vacancy/Un-Leased Commercial Space

As indicated previously, during the three days of parking data collection, the HarborShops was approximately 89.43% occupied/leased (approximately 10.57% unleased) atthe time of this parking utilization study. In order to determine the actual parkingdemand at 100% occupancy/leased, the maximum number of parking spaces recordedduring the peak period on Thursday was adjusted as follows:

703 maximum Thursday peak time parked cars x 1.1182 (required adjustment for 100%occupancy) = 786 parked cars. With a maximum parking need of 786 parking spaces, thesubject shopping center is over-parked by approximately 300 parking spaces.

Adjustments to Account for Peak Season

According to seasonal variation in traffic conditions published by the Florida Departmentof Transportation, traffic data recorded in east Broward County in mid March correspondto peak season conditions. Therefore, no adjustments are required in order to reflect peakseason conditions.

Summary

The results of our comprehensive parking occupancy count conducted at the site indicatethat during the peak 60-minute period of the peak month, at 100% occupancy/leasedcommercial space, the shopping center will require approximately 786 parking spaces.Since the shopping center has 1,083 existing parking spaces, the Harbor Shops is over-parked by approximately 300 parking spaces. Moreover, the three small parking bayslocated between Publix and Total Wine can support approximately 16,750 square feet ofadditional commercial space.
